Message from our Executive Director and Board President

DEAR FRIENDS AND MEMBERS, The Land Council is so grateful to all of you for your continued support of our work and our mission. The health of Nantucket’s environment is critical to the health of our community. Your recognition of this and your ongoing passion for the natural beauty and resources of Nantucket are an integral part of our success.

2021 began with continued uncertainty around the safety of public programs and events.

We adapted to changing circumstances with a variety of virtual or hybrid educational opportunities and truly enjoyed seeing many of you in person as well. We welcomed Anna Day to our team, and the NLC staff executed a suite of successful programs.

We presented year two of our virtual Clean Water Series: Topics on Tap, highlighting a number of water related topics through local and regional speakers. We hosted our 5th annual State of the Harbor Forum using a hybrid format at the Nantucket Yacht Club, with special guest Nantucket Harbormaster Sheila Lucey, to discuss environmentally friendly boating practices. We also held a very successful Friends Fête with the Almanack Arts Colony and our End of Season Dinner in person.

The NLC continued extensive community education programs within the local schools, through our Karen K Borchert Educational Grant Program, and in conjunction with the Nantucket Boys and Girls Club and Nantucket Senior Center. Our popular Oyster Farm Harbor Tours resumed, and we partnered with the Sconset Trust on a new series of tree tours in Sconset.

The health of Nantucket’s waters remained at the forefront of our research with extensive sampling in several Nantucket ponds, monitoring of our groundwater and precipitation, and investigation of the impacts that proposed synthetic turf fields could have on our public water supply. The Nantucket Waterkeeper spent the summer on the water in our new boat sampling the invasive green crab and working with a variety of partners on the eelgrass restoration project in Monomoy.

The Land Council carried on as a voice for Nantucket’s environment through our advocacy efforts. We prevailed in Superior Court and received a groundbreaking decision by the judge, gaining standing in the Surfside Crossing 40B appeal. We also testified before the state legislature in support of a bill focused on upholding local wetland bylaws and regulations during the permitting of 40B developments.

Our small, dedicated staff works diligently year-round to be Nantucket’s environmental advocate and to use our research to keep the community informed of the island’s pressing environmental issues. NLC is YOUR environmental ADVOCATE…

Thanks to YOU

— We advocated for more environmentally friendly boating practices in our harbors to help eliminate pollutants and better protect our estuarine resources for all to enjoy.

— We prevailed in Superior Court on appeal of the Housing Appeals Committee denial of our motion to intervene in the Surfside Crossing 40B development hearing. The Judge not only determined that the NLC had standing as an intervening party, but that the HAC needed to re-do its hearing and take open space and other local interests into consideration along with community housing needs.

— We testified before the MA Joint Committee on Municipalities and Regional Government to advocate for An Act Relative to the Protection of Wetlands and Water Resources in Chapter 40B Applications. This legislative amendment would not directly affect the Chapter 40B program but would preserve the wetland and water resource protection regulations that local officials have adopted.

— We attended meetings of the Coastal Resilience Advisory Committee and participated in the review of the Coastal Resilience Plan, providing comments and recommendations as well as helping to engage the public to do the same.

— We participated in the ongoing deliberations and hearings surrounding the Sconset Beach Preservation Fund’s existing geotube installation with assistance from our coastal engineering consultants. We advocated for the Commission and the Town to properly address the significant deficit in mitigation sand, and ultimately supported the Commission’s Enforcement Order to remove the geotubes in light of their serious permit violations.

— We continued to attend regular local Select Board, Planning Board, Conservation Commission, Zoning Board of Appeals, and Board of Health meetings to advocate for policies and decisions that protect and preserve our island’s natural resources and be a VOICE for our island environment!

— We reviewed each Annual Town Meeting warrant article and prepared recommendations for Nantucket voters for all articles that related to our NLC mission, including recommendations against increased density and development in environmentally sensitive areas.

We supported a citizen article to increase protection of sensitive eelgrass and shellfish habitat from impacts of residential piers.

— We evaluated the proposal for synthetic turf fields at the Nantucket Public Schools through the expertise of consultants in order to provide the community with a scientific assessment of potential impacts to our island groundwater.

— We participated in advocacy efforts with the Waterkeeper Alliance to address the growing concerns around forever chemicals like PFAS in the waters and surrounding environment of our region.

The NLC is committed to PROTECTING open space — The Nantucket Land Council continued its Conservation Restriction (CR) Program to work with landowners to protect open space. These legal agreements between an owner of land with conservation values and a nonprofit group, such as the Land Council, or certain governmental entity, protects the values of that land in perpetuity.

Each CR reflects a unique parcel of land and its landowner’s wishes for the future use of that land.

— The NLC accepted the donation of a new Conservation Restriction on 6.29 acres of mid-island property by Wynndhill LLC. This beautiful rolling meadow and shrubland habitat supports groundwater protection, scenic views and the preservation of dark skies around the Maria Mitchell Loines Observatory. The NLC thanks the property owner and her family for this generous gift and their support of conservation on Nantucket. Every bit helps—contact the NLC today about protecting your land from overdevelopment permanently!

— The NLC now holds a total of 92 Conservation Restrictions with over 1500 acres on Nantucket, Tuckernuck and Muskeget islands.

— The NLC supported the permanent protection of a beautiful 26-acre parcel, the “Jackson Property”, on Tuckernuck Island with a challenge grant awarded to the Tuckernuck Land Trust. We look forward to continuing to support the TLT and the conservation of unique and fragile resources on Tuckernuck Island.

— The NLC provided a grant to the Nantucket Conservation Foundation to support their permanent protection of the Rosenzweig Property in Shawkemo. This collaborative effort by NCF involving the NLC and Nantucket Land Bank was a great success protecting 8+ acres of open space in our harbor watershed.

— The NLC continues to collaborate with other island organizations including the Nantucket Conservation Foundation, the Nantucket Land Bank and the Sconset Trust to coordinate land protection efforts across the island for maximum open space!

NLC is a leader in island-wide environmental RESEARCH! — NLC, with the help of our community partners, transplanted 4,000+ eelgrass shoots to our restoration site in Monomoy. Volunteers and our collaborators from the Natural Resources Department and Boston University collected eelgrass shoots to be transplanted. Also, for the first time ever, we tried a new seeding method in Nantucket Harbor, which we will be expanding on in 2022!

We also supported an important new monitoring effort of Sandbar Sharks, one of the island’s top coastal predators. This research conducted by Caroline Collatos involved catching, tagging and releasing sharks in order to track their location and gather exciting new data on their local movements and population dynamics.

NLC is helping EDUCATE future generations of environmentalists!

— As part of the Nantucket Biodiversity Initiative’s Science Showcase, we co-hosted a water quality primer and kayak tour of Sesachacha Pond with Town Water Quality Specialist Thaïs Fournier.

— During Nantucket’s 2nd annual Green Crab Week, the NLC held a green crab fertilizer “how-to” workshop with Sustainable Nantucket, a cooking demonstration with Greencrab.org Director and co-author of the Green Crab Cookbook Mary Parks, and a green crab derby with Maria Mitchell Association.

— NLC held walking tours and trips with a variety of Nantucket organizations including the Nantucket Boys and Girls Club, Salt Marsh Senior Center, Nantucket Junior Yacht Club, and the general public for vernal pool exploration, tidepooling, and downtown tree tours. Be sure to sign up for a tour in 2022!

— The Karen K. Borchert Educational Grant Program supplied local educators and their students with funds supporting a children’s book, water quality sampling equipment, programable beach-cleaning robots, and DNA testing equipment. These supplies enriched the experiences of over 200 students in our public and private schools.

— The NLC continued our monthly seasonal webinar series, Clean Water: Topics on Tap. Each month we hosted a special expert guest speaker to educate and inform our community on a variety of water-focused issues including Septic Systems 101, Coastal Plastics, the invasive green crab species, and more. NLC is CREATING AWARENESS of the critical mission the NLC works to uphold year-round, island-wide-protecting and preserving our natural and water resources. JOIN US! — Over 117 unique community members identified — Our 2021 Trashtag litter clean-up event was an over 850 species on Nantucket this year as a amazing success and so much fun! With over part of our NLC Associates “Bioblitz” citizen 50 participants working along Surfside Road and science project in July alone! — Host extraordinaire, Susan Baer, and her generous and kind family, graciously invited the NLC and members to their gorgeous home in Tom Nevers for our NLC Annual Labor Day Dinner. This event is a huge component of our annual fundraising and our ONLY fundraising event each year, and what a magical night it was! Treasurer’s Report Dear Nantucket Land Council Supporters, I am pleased to present the Nantucket Land Council’s statement of financial position for the fiscal year 2021. Amidst the continued global pandemic and resulting uncertainty, our balance sheet has remained strong. The strength is primarily attributable to the generosity of our membership, continuing to provide both donations and support that enable the NLC to further its mission to protect and preserve Nantucket’s environment.

Our general membership support—via both unrestricted and restricted gifts—was robust in 2021. Those gifts have allowed us to continue focusing resources on land protection, education, research and advocacy year-round on the island. Specifically, the donations have gone directly towards funding our programs and projects including eelgrass transplanting in the harbor, studying PFAS and coastal plastics, informing voters via our Annual Town Meeting recommendations, classroom and community education trips and tours, our Conservation Restriction program, reviewing Conservation Commission, Select and Planning Board proposals to ensure that our island environment has a voice, and so much more.

We are also grateful to members who contributed their time to the NLC. We appreciate those who participated in the NLC’s mission through advocacy at the Annual Town Meeting and regulatory meetings, through volunteering, and by attending the Young Associates Friends Fête and our flagship annual fundraising event—the Labor Day Dinner. Your participation has been critical.

By including the nonprofit Nantucket Land Council in your estate plans, you are leaving a legacy and making a statement about what has been important in your life. Your gift will provide a source of continuing support for environmental action on Nantucket.

The NLC can provide sample language for various forms of bequests, however, these are just suggestions. We encourage you to consult your attorney and financial advisors to make certain that your gift fits well into your overall circumstances and planning.

Conservation Restrictions The NLC Conservation Restriction (CR) program is an excellent opportunity for Nantucket land owners who have ecologically significant parcels of property to take advantage of a tax incentive program while simultaneously protecting their land from further development in perpetuity. The Nantucket Land Council holds a total of 92 total restrictions on 1,510 acres of land throughout Nantucket, Tuckernuck and Muskeget islands. A CR is a recorded legal agreement between an owner of land with conservation values and a nonprofit group, such as the Land Council, or governmental entity that will always protect that land. Each CR reflects a unique parcel of land and its landowner’s wishes for the future use of the land.

Tax Incentives for Conservation Restrictions In 2015, the United States Congress made permanent certain enhanced tax benefits. The core elements of the change include: — Raising the deduction a donor can take for donating a Conservation Restriction to 50% of his or her annual income; — Extending the carry-forward period for a donor to take a tax deduction for a Conservation Restriction to 15 years; and — Allowing qualifying farmers to deduct up to 100% of their income.

Before this conversation, I had not really thought about pollinator gardens. I put in 20 plants and have also planted milkweed seeds. Next summer I intend to plant more. It is super exciting to learn how planting the right native plants can really help the environment and the pollinators and how this also greatly helps the birds. In 2020, Nantucket Land Council was proud and excited to join The Waterkeeper Alliance. The Waterkeeper Alliance is a nonprofit comprised of over 300 environmental groups around the world, all with the same goal; fishable, swimmable, and drinkable water for every community. NLC will administer the island’s very first Waterkeeper program, and take the lead among island nonprofits in protecting Nantucket’s aquatic resources. As the “eyes and ears” of all water resources ranging from Nantucket’s sole source aquifer to the sweeping expanses of Nantucket Sound, the Nantucket Waterkeeper conducts critical research, is the primary community contact for environmental issues, and holds accountable those who harm Nantucket’s beautiful waters. The Waterkeeper works with local, state, and federal government regulators to enforce existing environmental regulations, and draft new ones.

Water Fund Founders Circle Members The Board of the Nantucket Land Council is proud to continue “The Water Fund”; a donor-restricted fund to help support marine and freshwater projects on Nantucket. Over the past decade, the Nantucket Land Council has steadily transitioned into being the leading voice for the protection, investigation, and education of our water resources.

We have been increasing our water projects by expanding our eelgrass health research into Madaket harbor, supplementing the Town of Nantucket’s water quality sampling with our small pond water quality research and investigating coastal plastics on our beaches and ocean waters.

The Nantucket Land Council remembers Eileen McGrath who served on the NLC Board of Directors for decades. Eileen’s passion for the natural sciences and for the protection of the island environment drove her to become a long time supporter and active participant in the Land Council’s research, education, advocacy, and land protection programs. Eileen permanently protected her own beloved property by donating a Conservation Restriction on 6+ acres which she affectionately called “the meadow.” Eileen served as an incredible role model to many island girls and women, and was always a strong advocate for participating in the community.

Her wisdom, scientific knowledge, historical perspective and great wit will be dearly missed.
