Dear Counsel: This matter came before the Court on October 20, 2008 on Defendants’ plea of res judicata and collateral estoppel and their demurrer. After considering the pleadings, the record, the oral and written arguments of counsel, and the relevant legal authority, the Court has decided to sustain the Defendants’ plea of res judicata.
