ORDER OF POSTING The object of this suit is to obtain a divorce A Vinculo Matrimonii from the Defendant on the grounds of a separation of greater than one year without cohabitation and without interruption. It appearing from an affidavit that the Defendant is not a resident of this Commonwealth or that diligence has been used by or on behalf of the Plaintiff to ascertain in what county or city the Defendant is in, it is ordered that the Defendant appear to protect his interests before this Court. It further appearing that the Plaintiff has been determined unable to pay the fees and costs of this proceeding pursuant to §17.1-606 of the Virginia Code by this Court, it is ORDERED pursuant to §20-104 of the Virginia Code that the actual publication of this Order in a newspaper shall be and is properly dispensed with. The Clerk shall however, post a copy of this Order on the main entrance to the Circuit Courthouse until such time as the Defendant’s time to appear in this matter has expired, and the Clerk shall mail a copy of this Order, postage pre-paid to the Defendant at his last known address provided in the Affidavit of the Plaintiff filed herein. No Order of Publication shall be required and no depositions in the suit shall be commenced until at least 10 days shall have elapsed after the Order has been mailed and posted as required by law.
