Notice to all Visitors and Traders
Please read and observe the following:
• Excessive dirty vehicles will not be allowed entry, therefore ensure vehicle is clean before arrival.
• All vehicles transporting livestock will be subject to a documentation check before entry to market site.
• All visitors and traders must ensure they wear clean clothing and footwear before entering market site.
• All visitors and traders using car park areas please use main entrance.
• All persons delivering livestock to mart must park on the hardcore area at the back of the site and then proceed along the designated route to the biosecurity control next to the supervisors office.
• Hauliers and farmers delivering livestock must disinfect their boots before and after loading or unloading.
• Livestock purchased or unsold will not be allowed to move unless an authorised “pass slip” has been issued by the main office.
• No livestock will be allowed to remain on the premises after a sale.
• Only staff, livestock hauliers, owners or their agents are permitted to load or unload livestock.
• Wash hands thoroughly when leaving livestock pennage areas.
• Please observe our staff’s instructions at all times.
Our on site Biosecurity Officer will only be too pleased to give you assistance.
CONDITIONS OF SALE
1. All stock is sold subject to the Conditions of Sale, dated 1984, recommended for use at Markets by the Scottish Institute of Auctioneers’ Pay Office. Every vendor, bidder and purchaser shall be deemed to have full knowledge of these conditions and agree to be bound by them. These conditions shall apply to the sale of any pedigree stock save in so far as they conflict with any Special Conditions expressly applicable to the sale of such stock, when the latter Conditions shall prevail.
2. All lots are accepted for sale on the terms that the vendor warrants his right to sell the same and undertakes to indemnify the auctioneers against all actions, proceedings, claims, demands, costs, charges and expenses to which they may be exposed or which they may incur by reason of any deflect in the vendor’s title.
3. The auctioneers act in all respects only as agents for the vendor and it shall be deemed than no condition or warranty expressed or implied has in any circumstances been given by the auctioneers or any servant of the auctioneers, whether as to title, description, the quality of any lot sold or otherwise. The auctioneers and their servants shall not incur any liability to the purchaser in respect of any defect of title, error of description or imperfection or in respect of any announcement or statement relating to or affecting any lot offered for sake whether made orally or in writing and whether given before, during or after the auction, nor shall they incur any liability in relation to any dispute between any purchaser and vendor.
4. All animals are at the risk of the vendor before sale and at the risk of the purchaser after the sale.
5. Neither the Vendor(s) nor the Auctioneers will be responsible for any accidents or injury to persons or property, through fire or any other cause whatsoever.
6. The auctioneers reserve the right to refuse to accept bids from a vendor and they reserve on behalf of themselves and of the vendor(s) the following rights: (a) to fix a reserve price (b) to bid on behalf of a vendor (c) to re-arrange, consolidate or withdraw any lots or vary the order of sale (d) without giving any reason therefore, to refuse to accept the bids of any person
7. The person making the highest accepted bid shall be the purchaser.
8. No bid shall be retracted.
9. If a dispute arises as to any bidding, then at the discretion of the auctioneers, either: (a) the lot to which the disputed bid relates shall immediately be put up again, or (b) the auctioneers shall determine the dispute and their decision shall be final and binding on all parties.
10. The purchaser shall, if and when required, give his name and address to the auctioneers, and shall if required, pay to the auctioneers the purchase money for each lot on the fall of the hammer, or so soon thereafter as the auctioneers may require.
11. Purchasers paying by cheque must be prepared, if required, to produce a banker’s reference
12. No lot shall be removed from the sale premises until a written delivery order has been given by or on behalf of the auctioneers.
13. Each lot shall, at the purchaser’s expense, be removed from the sale premises within a reasonable time after the close of the day’s sale.
14. (a) If a purchaser fails to comply with any of the preceding Conditions, the auctioneers may cause the lot in respect of which the failure is made to be re-sold by public or private sale without warranty or reserve and without notice to the purchaser.
(b) If upon re-sale as aforesaid a lower price is obtained for any lot than was obtained on the first sale, the difference in price together with all cost and charges attending the re-sale, shall be a debt due from the purchaser in default at the first sale.
15. All other rules as stipulated in the “Conditions of Entry”.
16. All registered sheep entered and forward at any Sale must be inspected to ensure their ear tag numbers tally with the catalogue and that they comply with the Society’s breed standard. Shearlings showing more than two broad teeth can be sold but cannot go forward for the show. All four-horned sheep must have wool, hair and/or skin between the top and side horns, even if only a very small amount, to pass the inspection.
Rejected sheep will not be sold in the Official Sale. Should there be any slight faults with older sheep that the Inspectors wish to pass, the vendor will be informed and the Auctioneer will announce the fault before the sheep is sold and will be marked with blue tape around the horn. Should the vendor refuse permission for this announcement, the sheep will fail its inspection. The Inspectors’ decision will be final. Any sheep that fails the inspection referred to in 16 above shall be excluded from the Official Sale and will be identified with RED TAPE around its right-hand horn. Rejected sheep will not be sold in the official sale.
REGISTRATION FORMS MUST BE AVAILABLE FOR INSPECTION WITH THE ANIMAL PRIOR TO BEING HANDED TO MARKET. SHEEP WILL NOT BE ACCEPTED UNLESS ACCOMPANIED BY THEIR CERTIFICATE TSC ANOTES THAT AN ANIMAL HAS BEEN TESTED CLEAR OF TAY-SACHS.
TAY-SACHS - The Jacob Sheep Society runs a scheme whereby sheep are voluntarily tested for a Tay-Sachs marker gene by LGC Laboratories. Animals which have been DNA tested as Tay Sachs clear, have (TSC) added to their registration numbers. Animals with two (TSC) parents have the annotation (~) added to their registration numbers, indicating that they are ‘bred Tay Sachs Clear.

SETTLEMENT AND CLEARANCE OF STOCK: Settlement in full is due immediately at the close of the sale. No animal may leave the sale premises without an official ‘pass slip’ obtainable only from the auctioneers upon settlement.
