Welcome to the June edition of Concrete Connections.

If you are running any business one of the most important aspects is to get prompt and regular payment from our customers and clients. This is for a variety of reasons but one of the key ones is to ensure we have enough cash flow to reinvest in the business, pay staff, suppliers and other stakeholders in a timely manner. It is because of this important issue we have run an article on the securities of payments act (NSW) in this newsletter which has some great advice on this subject for builders and sub-contractors. In addition, we are holding a seminar next month in Sydney which will go into this subject in more detail also include a presentation on durability matters in remedial design.

Last month it was my pleasure to chair the inaugural meeting of the Western Australia branch of ACRA. The new branch members showed great interest in organising local events that are of specific interest to the WA construction industry and I am sure the branch will grow into a thriving one with lots of activities that benefit members and the wider industry in WA. With a sub branch established in Western Australia our focus now turns to New Zealand and I encourage anyone that has any contacts or companies located in New Zealand to express their interest in becoming a member.

I would like extend a big welcome to several new members that have come on board in the last couple of months and are listed in this newsletter. It is great to see that there is growing interest in ACRA and organisations see value in being part of ACRA. Lastly, we have recently launched our new website and the feedback so far has been very positive! We would still like to hear from you though to see how we can improve if further.

Hopefully the more modern look and easier to navigate website makes it a more user friendly site to use for everyone in the industry. ~ Andrew Dickinson, President.

Welcome to a new era in ACRA…….

Recently ACRA held a “Special Meeting” for members in regards to an Association name change. As of the 19th of February 2013 the Association will now be known as the Australasian Concrete Repair Association (ACRA) and will be soon heading over to New Zealand to hold one of many Technical Courses but the first will be in Auckland and details will be posted soon. As New Zealand doesn’t have their own Concrete Repair Association and we had received a lot of interest from our neighbours we thought it was time to head over there with a view at some stage of starting an ACRA Sub Branch in New Zealand also. Adding to this we do have our first NZ member which is Water Infrastructure Group-NZ. So if you have any New Zealand contacts you would like to share with ACRA please send the details to info@acrassoc.com.au or if you have an office in the Australasian region and would like to see these details on our NEW website, send them through.

Recently Andrew Dickinson, ACRA President flew over to Perth to meet with our first Branch Committee which is in WA. New Website……..

It’s finally happened, with the new Association name we have developed a new and improved website which will showcase all our events, publications and of course our members. The ACRA office receives many calls from the public as well as companies asking for consultants, contractors or supplier advice and with this new website it will be easier for everyone to navigate around. The Association has grown from strength to strength over the years and with member support we are able to give back via more technical events which have now doubled in the amount held per year as well as more seminars with topics that members have requested. Our next seminar is two great topics within the one seminar.

ACRA SEMINAR Topic one will cover the Security of Payments Act and the speaker is Marty Perry from BCP and the other topic is on the Durability In Remedial Design. Different concretes require different degrees of durability and protection depending on the exposure environment and the properties desired. In this part of the night our speakers will share insights in regards to performance testing and protection of reinforced concrete from a remedial design perspective as supposed to durability design and planning at the construction phase.

The two presenters are Greg Zambesi of GHD and James Aldred of AECOM Australia.

Presentation title: Residual Life Assessment and Repair Design of Wastewater Structures Greg Zambesi is a Senior Materials Scientist at GHD with extensive experience in infra-structure inspection and assessment, diagnostic investigation and asset management of concrete, steel and timber.

He has over 20 years in the construction and mining industry, including experience with maritime, port and water infrastructure projects.

Greg has worked on a variety of key marine asset related projects and has a significant understanding of maritime related infrastructure.

Greg obtained his Bachelor of Applied Science, Materials Science from UTS Sydney and his Geologist degree from the University of Canberra.

Presentation title: Applications of Repair and Protection Methods for Reinforced Concrete Dr James Aldred has over 30 years’ experience in the concrete industry in Australia, Asia, the Middle East and the United Kingdom. His background includes Technical Director of an international admixtures company, Manager of the High Performance Concrete Research Group at the National University of Singapore, Technical Manager of Taywood Engineering and Honorary Research Fellow at Imperial College. He was the Independent Verifier for the Burj Khalifa in Dubai which is the world’s tallest tower. James is currently Technical Director with AECOM and an Adjunct Associate Professor with the School of Civil and Environmental Engineering at the University of New South Wales.

James obtained his PhD from Curtin University. He is a Chartered Professional Engineer and a Fellow of the Institute of Engineers Australia. He is a Fellow of the American Concrete Institute and the Institute of Concrete Technology as well as being a LEED Accredited Professional. Dr Aldred has received the Award of Excellence from Concrete Institute of Australia and Award for outstanding and sustained contributions to concrete technology by ACI International Conferences and the prestigious George Stephenson Medal from Institute of Civil Engineers.

Confusion exists about the steps that need to be taken to ensure that you are paid fully and on time. The Security of Payment Act is your safeguard – NSW Master Builders Head Solicitor, Robert Collings, walks you through what you need to know There continues to be a basic lack of understanding among builders and subcontractors about the statutory procedures involved in the Building and Construction Industry Security of Payment Act 1999. This is no reflection on the individual builders and subcontractors, as the Act can become confusing in that there are a number of choices to be made at each step. Accordingly, this article seeks to set out the basic principles.

OBJECTIVES

BASIC PROCEDURE

The basic objects of the Act are to:

• A claim is made for payment (payment claim).

• entitle certain persons who carry out construction work to timely payment for the work they carry out, and

• The claim is accepted or disputed (payment schedule).

• provide a procedure for securing payments to which those persons become entitled under the Act.

• A disputed claim can be referred to an adjudicator for determination (adjudication).

• Payment.

The Act is intending to work in tandem with the contract procedure. The procedure under the Act has no effect on any civil proceedings that either party may wish to bring before a court or a tribunal involving the same issues.

PAYMENT CLAIMS

ACCEPTING OR REJECTING THE PAYMENT SCHEDULE

A payment claim must: • identify the construction work and payment period to which the claim relates • identify the amount claimed, and • state that the claims are made under the Act. The usual phrase used to state that the claim is made under Act is: “This is a payment claim made under the (ROM) Building and Construction Industry Security of Payment Act 1999.”

If the claimant accepts the payment schedule then they need only wait until the time for payment for the amount indicated in the payment schedule.

If the claimant wishes to reject the payment schedule then they can make an application for adjudication within 10 business days of receiving the payment schedule.

NO PAYMENT SCEHDULE AND NO PAYMENT If there is no payment schedule and no payment then the claimant will have two choices:

The payment claim must comply with the contract or if the contract is silent then the Act.

• Issue court proceedings – the respondent is theoretically not entitled to defend or cross claim.

PAYMENT SCHEDULES (THE REPLY TO THE CLAIM)

• Issue a section 17(2) notice – this notice gives a further 5 business days for the respondent to serve a payment schedule, after which the claimant can make an adjudication application whether a payment schedule is served or not. The application for adjudication must be made within 10 business days of receiving the payment schedule after the expiry of the 5 business day period provided in the notice.

A payment schedule is anything in writing that makes a rejection, completely or in part, of the payment claim.

A payment schedule must: • identify the payment claim to which it relates, and • indicate the amount of the payment (if any) that the respondent proposes to make.

The schedule must advise why the respondent proposes to pay nothing or less than what is claimed in the payment claim.

If the respondent does not dispute the claim or want to challenge it then they need do nothing and then will be liable when the claim payment becomes due for payment.

The Building and Construction Industry Security of Payment Act 1999 can be difficult to understand especially when used for the first time. While the procedure is relatively basic the detail can be quite tricky and the time periods are strict.

If you are unfamiliar with the Act then you should contact MBA Lawyers for advice as soon as you receive a payment claim or wish to make a payment claim. MBA Lawyers can provide guidance throughout the procedure.

One of our Technical Training Course speaker’s Peter Johnsson recently attended the Department of Housing and held a ½ day tailored course for 25 inspectors all of which gave very positive feedback on the course and were quoted “we found the course to be invaluable and Peter was able to answer every technical question that was thrown at him. We recommend this course to anyone who does concrete repair work”.

This course is the best independent information available to date for engineers starting out in the specialist area of concrete repair, contractors’ supervisors and foremen, as well as those who just want some basic but detailed knowledge.

Asset managers, port and road authorities, councils and ACRA members should consider training their key staff by sending them to a session run around the country.

A practical understanding of how repairs should be undertaken is discussed in the last two topics of the day – “Repair Specification”, which covers materials and workmanship; and “How to Do a Repair Properly” which presents a step-by-step guide to undertaking a repair and some common problems with workmanship.

The registration fee is $495 (GST inclusive) for members of ACRA and $595 (GST inclusive) for non-members.

National Concrete Solutions (NCS) were approached for a solution to the deteriorating floor joint edges in a very large store in regional NSW. Stacking and movement of the large reels of product, is undertaken by AGV (automatic guided vehicles) with point loading on the hard wheels of around 5MT. This concentrated loading combined with rotation and turning loads was breaking the joint edges and ultimately causing stoppages, risk to the equipment and potential safety hazards to personnel.

Due to the plant operating continuously the designed solution needed to provide a fast turn around and rapid return to service.

“NCS were engaged to carry out trial joint repairs using high strength epoxy grout and to map the joint condition throughout the reel store” Commented David Neveling “Site Project Engineer”.

The custom solution developed by NCS incorporated the excavation of concrete either side of the joint to a specific profile, followed by reinstatement with high strength epoxy.

The smooth finished concrete floor had post cut joints at approx. 6 meter spacing.

Specialist machinery and operators were engaged to excavate the specific repair profile prior to reinstatement with high strength epoxy grout.

Finally the joint was recut and sealed with a semi ridged epoxy sealant to provide added support to the joint edges.

The result was a smooth surface for transition by the AGV’s with superior resistance to edge spalling due to the high strength epoxy grout and high edge support characteristics of the semi rigid joint sealant.

David commented “The repairs are performing well and showing no signs of distress under constant AGV traffic” The high early strength of the products used also assisted in fast turn around and return to service.
