With stay-at-home orders currently in place across NSW, this initiative is a great way to support local businesses who are struggling.

Since the launch of the ‘Buy Regional’ website in 2019, there have been over 500,000 online shoppers purchasing a range of regional products, from farm-fresh meat, handdistilled spirits and unique fashion and homeware design pieces.

Changes proposed for rural and environmental lands PROPOSED changes to the way the region’s waterways, rural and environmental lands are managed are currently open for community feedback as part of the draft MidCoast Rural Strategy.

The draft Rural Strategy sets out a proposed framework for clear and consistent land use planning principles to sustainably manage the use of land and water resources outside of the region’s towns and villages, and is the final body of work to inform a single MidCoast Local Environmental Plan (LEP) and Development Control Plan (DCP).

Prepared by MidCoast Council’s Land Use Planning team, the draft strategy addresses ways to identify and protect productive land

and water resources, provide accommodation and services for rural communities, and manage development in rural environments into the future.

“Rural land makes up more than 95% of the region’s total area, and given the importance of the environment and our rural landscapes to the local community, we’re keen to check in to make sure we are on track before we move to the next step – preparing the LEP and DCP,” Council’s Director of Liveable Communities Paul De Szell explained.

“This strategy is about establishing a consistent platform and a program of actions that facilitate the sustainable use of the region’s assets.”

The draft Rural Strategy

sets out to achieve four key goals: sustaining primary production opportunities; enhancing rural lifestyles and livelihoods; protecting natural landscapes; and improving planning and plan-making in practice.

Among other proposed changes, it looks at bringing rural land into a single zone with consistent rules about what landowners can do on their properties, and proposes a standard minimum lot size across the region.

It also provides rezoning recommendations in some areas, and includes a review of land within paper subdivisions.

In a recent case Tapping v Empress Diamonds Pty Ltd ATF Empress Discretionary Trust [2021] FCCA 1335, an employer was found to have breached the general protections provisions of the Fair Work Act 2009 (“FWA”) after terminating an employee who requested a period of leave to recover from surgery following a breast cancer diagnosis.

The general protections provisions of the FWA prohibit an employer from taking adverse action against an employee because the employee has, or proposes to exercise a workplace right.

Ms Tapping was employed

by Empress Diamonds Pty Ltd (“Empress Diamonds”).

After receiving a diagnosis of an aggressive breast cancer, Ms Tapping requested a period of annual leave and personal leave for a period of approximately 5 weeks to recover from surgery. The request was made to Gabi Yitshaki, the sole director of Empress Diamonds. Mr Yitshaki replied to Ms Tapping’s request by saying “I can’t

keep your job”. Mr Yitshaki then wrote on a separation certificate under the heading “reason for separation”: “cannot keep position because of breast cancer treatment and cannot hold job after”.

The Court found that Empress Diamonds breached the general protections provisions under the FWA. It was found that the dismissal occurred because Ms Tapping proposed to exercise her workplace rights by accessing her annual leave and personal leave to recover from surgery.

Mr Yitshaki was also found to be an accessory to Empress Diamonds’ breach of the general protections provisions on the basis that he was knowingly concerned in her dismissal.

A further hearing is to take place in relation to the penalty to be imposed on Empress Diamonds and Mr Yitshaki and compensation to be paid to Ms Tapping.

The Bush Fire Danger Period commenced in the MidCoast LGA as of Wednesday 1, September.

It is imperative that members of the community get the relevant permits and check the fire danger rating before lighting any fire.

To obtain a permit contact Mid Coast Fire Control Centre on 1300 643 262.

Fires in NSW have contributed to significant loss of habitat and caused injury to people and property in recent years.

As spring and summer warm up the dangers we face as a community increase.

It is recommended that we all have a bush fire survival plan.

The RFS website has a guide that you can download to create a four step fire plan.

MidCoast LGA and 26 other LGA's in NSW now require permits for fires.

MidCoast Council advised residents, “A Fire Permit must be obtained from your local RFS Brigade prior to any Burning Activity.”

Pindimar/Tea Gardens NSW RFS Brigade Captain David Bright told News Of The Area, “This Fire Season, we have already had one incident locally with a pile burn left unattended and subsequently burning out of control, fortunately our local brigades managed to contain it, otherwise it could have become a major incident.

“The landowner didn't have a fire permit, and further action will be forthcoming.

“Due to weather constraints we haven't been able to conduct as many Hazard Reductions in our area as we had planned, hopefully we will be able to conduct several more in coming months.

“We were very fortunate to avoid any major incidents locally during the catastrophic fire season of 2019-20.

“We have enormous fuel loads in many areas including Pindimar, Bundabah, Hawks Nest and parts of Shearwater, an out of control wildfire could be devastating.

Call For National Plan to Address Suicide

By Marian SAMPSON MINDFULNESS and meditation are tools that many of us have accessed during the long road to living a COVID-normal life.

However for many the toll of the pandemic has hit hard and more help is needed simply to save lives.

Now one in four Australians report knowing someone who died by suicide during the past 12 months of the pandemic – the equivalent of 5 million people – with social isolation, the economy and jobs driving concerns, particularly amongst women.

This comes as two-thirds of Australians (66%) back the Federal Government introducing a standalone national suicide prevention act requiring all government decisions to consider and mitigate suicide risks two years in a row.

The findings are from Suicide Prevention Australia’s second State of the Nation report, which will be officially released on World Suicide Prevention Day 2021 (Friday, 10 September).

Suicide Prevention Australia CEO Nieves Murray said history showed major increases in suicide were linked to major social and economic events and there was none more concerning facing Australia than right now.

Ms Murray said legislation was the best prevention against suicide rates increasing, particularly given the major government decisions about economic, employee and welfare to support Australia’s COVID-repair and recovery.

“There have never been more lives lost to suicide in this country,” said Ms Murray.

“Australia needs a national Suicide Prevention Act and we need to act now.

“We all have a role to play in preventing suicide.

“An Act will legislate a whole-ofgovernment priority to prevent suicide and focus the attention of every agency to address the risk of suicide across our community.

“Suicide prevention isn’t limited to health portfolios.

“Housing is suicide prevention, employment is suicide prevention, finance is suicide prevention, and education is suicide prevention.

“We know social and economic isolation are the biggest drivers of suicide rates and COVID-19 has seen Australians subject to 18 months of rolling lockdowns and disruption to their personal lives, employment and businesses.

“We’ve seen how quickly COVID-19 cases can get out of hand and we need to have the

Sadly, in the past year, one in four (25%) Australians say they know someone in their personal life or networks, who has died by or attempted suicide either directly (15%) or indirectly (11%) and more than one in four (27%) Australians say they have ever directly (16%) or indirectly (16%) sought help or searched for advice from a suicide prevention service in the past 12 months.

Australians believe that the people most at risk of suicide over the next 12 months are young people 12-25 years (42%), middleaged Australians 25-55 years (29%) and men (29%).

THREE members of the Karuah and Great Lakes Landcare Group have been recognised by their peers and National Resource Management Professionals for significant contributions to the environment, sustainable agricultural practices and natural resource management via the Mid Coast Regional Landcare Awards.

Andrew Yeo from the Bulahdelah Sustainable Farming Group was awarded the Landcare Farming Award, Robyn Lamond from the Wang Wauk-Wallambah Sustainable Farming Group was awarded the Individual Landcarer Award, and Rod Zemanek from the Karuah Catchment Landcare Group led the team, known locally as the G8, that

was awarded the Landcare Community Group Award.

Andrew's award is recognition for how he has created a successful, sustainable, small acreage farming enterprise using permaculture and regenerative farming principles that hydrate the landscape and enhance the soil's capacity to sustain life.

Robyn's award recognises her dedication, commitment and leadership in the Landcare movement at local, regional and state levels for more than 25 years.

Karuah Catchment Landcare received the Community Group Award based on their success delivering the Branch Wetlands Regeneration

Project which has had a major impact on improving water quality and nutrients in the Karuah Estuary.

The project was a true partnership of grassroots Landcare, Mid Coast Council, Local Land Services, Landcare Australia and the University of Newcastle.

These award winners have also been nominated through to the State awards, which will be decided at the 2022 Landcare NSW and Local Land Services State Conference in Tweed Heads.

Swan Bay researcher identifies new Australian Crayfish species

SWAN Bay resident Robert McCormack has been a part of a team which has identified a new Australian Crayfish species.

It only took 15 years of rigorous research but finally the team have formally described a new species of freshwater crayfish.

Robert believes identifying the yabby is a

win-win for the species.

Port Stephens local Robert commenced research on the species in 2006 as part of the Australian Crayfish Project.

In 2012, Tarmo Raadik from the Arthur Rylah Institute for Environmental Research, Victoria came onboard and together over the next nine years they worked together researching this new crayfish species.

Robert told News Of The Area, “Unless we formally recognise these species we cannot put protections in place for them.”

The elusive yabbie is a freshwater crayfish found along the Murray River from Lake Moira upstream to near Wodonga in New South Wales and Victoria, including along the Edwards River and Gulpa Creek, Barmah Forest, and the Murray River tributary catchments, an area of approximately 17,700 km2.

The common yabby Cherax destructor lives in

this area and is well known, inhabiting just about every creek, river, swamp and farm dam.

This new yabby can be found living within a metre of the common yabby but it lives in terrestrial environments, it's restricted to deep burrows in wet areas beside the creeks and rivers.

The newly identified yabbie spends the majority of its life within its burrow system only venturing out when floods occur inundating its surface burrows.

Burrows are typically in paddocks and roadside drains with terrestrial vegetation above the burrow.

This new species has been known to occur in the area for some time, unfortunately, lack of specimens and the difficulty in capturing specimens has seen the species go undescribed till now.

Ellen Clark, a distinguished crayfish taxonomist, talking about common yabbies wrote in 1936, “At Whitegate, a few miles from Benalla (Victoria), some areas

riddled by yabbies are practically useless and are known as “crab hole country”.

These may not be common yabby holes but C. latimanus burrows.

This is the first new species in the Murray Darling Basin since the description of Cherax rotundus in 1941.

It's extremely important to formally describe a species and give it a name.

The description provides the biological and distributional information the scientific community and management agencies need, to manage the future of this species.

G o v e r n m e n t s , landholders, and conservation groups from both States now have all the information they need to protect and conserve this new species' future.

Both Robert, Research Director, Australian Aquatic Biological, NSW and Tarmo, Senior Scientist, Arthur Rylah Institute for Environmental Research, Victoria, continue to work together researching freshwater crayfish with many more new species currently under investigation.

TO SCENT OR NOT TO SCENT? “I’m wondering what you think about candles, scents or incense as part of property presentation?”

YOU raise a relevant point. To scent or not to scent is a highly personal choice and one that has a very big impact on a buyer’s first impression. It’s important to have your home smelling sweet and fresh and as a starting point I always suggest a vendor give their home a thorough clean of all surfaces, carpets and upholstery too if that’s possible, as odour is a fact of daily life – especially if pets are part of your family. It may be that this is all you do and if you select a cleaning product with a fresh, discreet and not too sweet aroma, such as lemon myrtle, the aroma will linger gently at inspection time. If you prefer to ‘scent’, whether you choose fresh flowers, candles or plug-ins, it’s vital the aroma is consistent throughout. Avoid mixing aromas or choosing a single scent that is over-powering. You don’t want buyers curling their nostrils or holding their breath through the inspection!!! And definitely avoid incense, it’s very personal, way too strong and can repel. Select something fresh, light and discreet and you’ll create the right first impression.

WHEN Ash Barty delighted us by winning the women’s Singles at Wimbledon recently, we remembered it had been 41 years since Evonne Goolagong had led the way.

Ash said Evonne had been her inspiration.

This led us back to our own brush with fame.

When the Tennis Club at Hawks Nest was formed in 1976, Hazel Gimbert was the first President and her daughter-in-law, Jenny Gimbert, was the first coach!

The amazing thing was that Jenny’s father was Evonne Goolagong’s coach!

Victor Allen Edwards lived in Sydney and had the largest tennis complex in the Southern hemisphere at that time.

Jenny was 12 when Evonne, who was 11 years of age, came to live with her family, Jenny’s younger sister, Patricia Edwards, and Evonne won the Junior Girls Doubles competition at Wimbledon.

On two occasions Evonne and Jenny attended a garden party at Buckingham Palace and met the Queen.

One of these occasions was in 1972, when Evonne was appointed a Member of the British Empire for ‘Services to Tennis’ and was presented to the Queen.

Jenny travelled with Evonne as her companion when she went on tour and remembers visiting America, Europe and Britain in 1972: a big circuit.

Margaret Court was Evonne’s inspiration as Evonne was to Ash, and Jenny remembers minding Margaret Court’s children at times.

The first tournament held at the Yamba Tennis Club at Hawks Nest was 14 August, 1977 and it was noted in our local paper that Jenny’s Mother, Mrs Victor Edwards, was there to give her support.

You will find Hazel and Jenny at ‘Black Possum Fabrics’ in Tea Gardens.

Their shop has been keeping the crafty people of the area supplied for many years.

records as well as players keeping all points achieved during the online bridge game.

Update on Council services MIDCOAST Council’s waste management facilities remain closed to the public, with some exceptions, while other services continue both online and over the phone as long as the NSW Government’s stayat-home orders are in place.

General Manager Adrian Panuccio said he was pleased with how the organisation had adapted its services but acknowledged that there had been some confusion about the disposal of waste.

“Our waste management facilities have continued to accept commercial waste from businesses as well as waste from residents who don’t receive a kerbside

collection,” he explained.

“Other than that, waste that poses a public health risk can be disposed of, but all other waste is not essential and will have to wait until the current public health order is lifted.”

Mr Panuccio asked the community to observe signage that had been placed around waste management centres and contact Council’s Customer Service Team if any further clarification is required.

“This isn’t the first time we’ve been through this so we have a detailed plan to ensure we continue to deliver, while protecting Council’s

workforce, in line with any requirements of the State Government.”

Council’s customer service phone line continues to operate and a range of services are available online, to ensure the community can continue to do their business.

Grants for disaster recovery and resilience

Boosting housing in the Hunter ASPIRING homeowners and local planning experts from the Hunter were among those who participated in the Regional Housing Taskforce virtual roadshow to share ideas on how the NSW Government can unlock much-needed housing in the region.

Parliamentary Secretary for the Hunter Taylor Martin said the influx of people moving from cities to regional areas was good news, but was putting more pressure on local housing supply.

To be eligible, organisations must meet specific entity criteria and have an Australian Business Number.

The project or activity must also be delivered within the MidCoast local government area.

“We encourage any eligible organisation that wants to deliver a project or activity to improve the recovery and resilience of their community following our bushfire events to take a look at these grants and apply.”

ELIGIBLE community groups are being invited to apply for new funding to support ongoing recovery and build resilience and preparedness for future disaster events.

Funding of between $2,000 and $15,000 will be available for community development and capacity building projects and activities, which must be completed by 20 March 2022.

“The projects and activities can either support ongoing recovery needs in a community, or they may improve the capacity and capability of community members to respond to future disasters,” said MidCoast Council’s Manager Libraries and Community Services, Chris Jones.

NSW Sports Infrastructure Fund THE State’s sports infrastructure boom is set for a further boost, with the opening of the latest round of a $100 million funding program by the NSW Government.

Minister for Sport Natalie Ward said the funding would be available for new and upgraded sports facilities in Round 2 of the Greater Cities and Regional Sport Facility Fund.

“This fund is not just an important boost for local economies and jobs, but also promotes health and wellbeing for residents across NSW,” Mrs Ward said.

“By investing in new and existing sports infrastructure, we are helping more people experience the benefits of participating in sport and active recreation.

“The Fund is creating a sports infrastructure construction boom across the State as part of the NSW Government’s multi-billion dollar infrastructure pipeline.”

Eligible projects include lighting, amenity buildings, clubrooms, change rooms and grandstands.

Round 1 of the program resulted in $54 million being awarded to 91 projects.

They included $1 million to Snow Australia for community snow sport facilities at the National Snowsports Training Centre (NSTC) at Jindabyne, $1 million for a new skate park at Wyatt Action Sports Campus in Lidcombe and $937,500 for a new grandstand and amenities at Darling Street Oval, Newcastle.

Round 2 is the final round of the program and sporting organisations and councils are urged to apply.

The grant application and assessment process will be overseen by an independent probity advisor.

Applications are now open and will close on 8 October 2021.
