“As well as the change.org petition, we also need to send a message to the NSW Parliament and Government,” Ms Poldmaa said.

“The e-petition to the NSW Parliament asks the Planning Minister to use his powers to change the zoning back to Public recreation.

“The Planning Department does not have the power to alter the rezoning but the Minister has the power to direct a Council to alter a zoning,” she said.

If more than 20,000 signatures are obtained on the petition, it must be debated in Parliament but Kathy welcomes even more.

“If we get a whole lot more, the better

it is,” Kathy said.

Any resident of NSW can sign this petition to the Parliament.

The Hawks Nest Development Group was formed by Kathy Poldmaa to keep locals informed on what is happening in the area.

“I started the Facebook group to make people aware of what is going on locally in terms of developments and to make people’s lives easier to lodge their submissions and what not, because the Council submissions website is a nightmare,” Kathy said.

“We are fighting the good fight here, I am not about having oversized developments in our beautiful town.

“I am here to help the community with that sort of stuff,” said Kathy.

Apply now for Building Better Regions funding COUNCILS and community groups are encouraged to apply for Building Better Regions Fund Round 6, which is open from last week through to Thursday 10 February, 2022.

Local governments and eligible, incorporated not-forprofit organisations can again apply for grants of $5,000 up to $10-million, to cover 50 percent or more of project costs.

Round 6 projects will be funded under two streams: ● The Infrastructure Projects Stream supports construction of new infrastructure, or the upgrade or extension of existing infrastructure.

● The Community Investments Stream funds community development activities including, but not limited to, new or expanded local events, strategic regional plans, leadership and capability building activities.

A MANDATORY Child Safe Scheme, a residential care workers register and development of a child protection audit tool are all among new measures helping to keep NSW children safe, according to a report released on December 17.

Attorney General Mark Speakman said the NSW Government’s annual progress report provides an update on actions in 2021 to implement recommendations of the Royal Commission into Institutional Responses to Child Sexual Abuse.

“Keeping children safe is our absolute priority.

“We have continued to make real progress while

navigating a global pandemic, but there is still more to be done,” Mr Speakman said.

“We will continue to work hard throughout 2022 to protect children and young people, support victims and survivors and hold perpetrators to account for their horrific crimes.”

Key points mentioned in the annual report include: • Introduction of new laws establishing the Child Safe Scheme, a regulatory framework requiring certain NSW child-related organisations to implement Child Safe Standards; • Boosted protection for young people in detention, including expanding support

services, trauma-informed counselling, and embedding a youth-centric and child safe approach in every Youth Justice centre; • A new child protection audit tool to drive continuous improvement in the quality of child protection casework; • Development of a new framework for preventing and responding to problematic and harmful sexual behaviour in children and young people; • Completion of the residential care workers register build.

By Tara CAMPBELL COMMUNITY consultation has ended on a development worth over sixteen million dollars that has been lodged in Tea Gardens.

DA2021/2128 is a proposed three to five storey shop top housing development situated from 91-95 Marine Drive, Tea Gardens that will include nineteen apartments and 47 are spaces in a single level of basement car parking.

The development was put forward by Sydney company, Sandro Developments on 14 October 2021 and is designed by Drew Dickson Architects.

Kathy Poldmaa, administrator for the Hawks Nest Development Facebook group, which keeps locals updated and aware of development applications and rezoning proposals, is concerned that this development will obstruct natural views of Tea Gardens.

Alongside many others, she now anxiously awaits the result of community consultation that recently took place.

“I am concerned that the height of this DA proposal it is excessive and does not meet the current B1 and R2 zonings, if this was to go ahead as is it would set a precedent to future developments and cause the town to lose what is attractive, predominantly the open space feeling of a coastal town, something which is disappearing at an alarming rate along the coast currently.

“This proposal will spoil the appearance and feel of the Tea Gardens waterfront,” she said.

“Visitors come to Tea Gardens/Hawks Nest to get away from the city and high-rise developments.

“Any building development needs to be designed for the area and the community, the council and the community need to protect this otherwise we will lose the very features of what people reside or visit here for,” Ms Poldmaa said.

The site currently features two large heritage-listed (local Heritage Item I57) storage sheds which feature a number of items from the Universal Store which used to occupy the site.

The Great Lakes Council (Now amalgamated to MidCoast Council) had the site submitted to the State Heritage Inventory in 2004.

“The first corner store was established on the site of the existing corner store in 1926 as the local office for the Port Stephens Pilot.

“Austin Cook took over the premises and the adjacent residence as a general store in 1930.

“The store was operated by Jack Blackstone from about 1938 and then relocated around the corner in Maxwell Street to make way for the new (present) general store in the late 1940s.

“The store, former store and residence were sold to Frank and Gwen Pye 1n 1972 and then to Evan and Liz Cunningham,” a representative for the Council wrote on the listing.

Since then, the store has been demolished, with the remnants stored in two storage sheds held on the site.

Sandro Developments wishes to rebuild the Universal Store on the site of the development, reusing as many materials as possible.

“The original bricks are to be reused (if of a suitable quality), original wall timbers to be reused where possible alongside decorative borders and ceramic tiles to be reused.

“Any highlight windows glass panels will be replaced with new glass to meet current safety standards.

“The reuse of any stockpiled heritage materials is subject to the condition that they are once removed from storage,” the development plan stated.

Heritage21 prepared a report regarding the development, believing that the development will not negatively affect the heritage listing.

“The re-construction of the significant Universal Store would facilitate the conservation of the heritage item and additionally, the proposed reconstruction would continue to tell the story of the ‘place’ including the association of the Universal Store with the George Adolph Engel family.

“In our review, there are no aspects of the proposal which could be detrimental to the significance of the subject site of the Tea Gardens heritage conservation area,” Heritage21 said.

MidCoast Election Results

THE results from the 2021 Local Government elections are here.

For weeks, results have been too close to call with a total of 80 candidates across thirteen groups, but the

new MidCoast Council has officially been elected.

The eleven representatives for MidCoast are as follows: Alan Tickle, Peter Epov, Claire Pontin (Labor), Troy Fowler (Liberal), Peter Howard, Jeremy Miller, Paul Sandilands, Dheera Smith

(The Greens), Katheryth Smith, Kathryn Bell and David West (Liberal).

Councillors Claire Pontin, Katheryn Smith, Kathryn Bell, Peter Epov and Troy Fowler will be returning to their positions for another term in the Council.

Candidates Michael Bergin, Jessica Corkill and Luke Cubis have not been elected.

Len Roberts and Karen Hutchinson have not been reelected.

76,170 were enrolled to vote in the election with only

85.86% of these submitting their votes.

Only two of the thirteen groups running received two candidates elected, Group C (Epov and Howard) and Group K (Fowler and West).

There were a total of 3,706 total informal ballot papers, creating a total of 5.67% informality, an improved rate compared to the 7.75%

informality of the 2017 Local Government Elections.

Based on first-preference results, Epov’s Group C led the polls with 11,227 votes.

Closely following were Fowler’s Group K with 8,094 votes, Tickle’s Group A with 7,450 votes and Pontin’s Group H with 6,165 votes.

Congratulations to all those elected.

A celebration of nature around the Myall

GALLERIES in the Gardens (GIG) artists have been busy creating new work for their upcoming exhibition.

With a theme of ‘Celebrating Nature around the Myall’, GIG artists are excited to bring this new exhibition to The Gallery.

“This is an expansive theme and we have only to open our eyes to find inspiration,” Cathriona Kelly, Visual Communications for Galleries In The Gardens told News Of The Area.

The exhibition will run from 5 January 2022 – 31 January 2022 from Wednesdays to Sundays with free entry and wheelchair access available.

GIG are also extremely pleased to announce that the local Myall Koala and Environment Group (MKEG) has sponsored this year’s Cool Summer exhibition.

As a result of this generous sponsorship, there

will be one 1st prize for 2D work and another for ceramic/sculpture exhibits with the judge being an independent artist from outside the area.

“MKEG fosters preservation of the locally endangered koala population, is actively involved in protecting the Hawks Nest and Tea Gardens environment, as well as monitoring both appropriate and inappropriate development proposals on the Myall Coast and GIG is pleased to be associated with them,” Ms Kelly said.

The group will be raffling

a large painting donated and produced by Galleries In The Gardens artist with all proceeds being donated to MKEG. Alongside this, there will be a large basket of gourmet goods raffled to raise funds for Wildlife In Need of Care.

THE NSW Crime Commission (NCC) inquiry into money laundering at licensed premises in NSW has been welcomed by the State Government.

NSW Premier Dominic Perrottet said he was pleased Commissioner Michael Barnes had determined

to use the NCC’s extensive powers to perform a thorough investigation.

“Money laundering and organised crime are completely unacceptable in any form.

“The NSW Crime Commission has the full backing of the NSW

Government as they launch this inquiry,” Mr Perrottet said.

“Pubs and clubs play key roles in the fabric of their communities and so recent reports highlighting how organised criminals are laundering money through poker machines are deeply concerning.

Crime Commision Inquiry into money laundering at licensed premises “The Commissioner will work in collaboration with the Independent Liquor and Gaming Authority and the Australian Criminal Intelligence Commission.”

Minister for Police and Emergency Services David Elliott welcomed the joint inquiry which will investigate

potential vulnerabilities within the legal framework governing the relationship between poker machines and money laundering.

“Organised crime costs our community more than $36 billion each year, and criminal networks are dependent on money laundering channels to legitimise the proceeds of their activities. I expect the NSW Police Force to make a submission to the inquiry,” Mr Elliott said.

Minister for Digital and

Customer Service Victor Dominello, as the Minister responsible for liquor and gaming in NSW, also welcomed the inquiry.

"For the first time we will get an understanding of the link between organised crime and how they use pokies to launder dirty cash,” Mr Dominello said.

The Commissioner has released terms of reference for the inquiry and called for public submissions to be made by 28 January 2022.

“Coercive control is also a red flag for intimate partner homicide.

“The Domestic Violence Death Review Team led by the Coroner found that intimate partner homicide in NSW is typically preceded by coercive control often without any recorded physical violence.

“I commend especially the extraordinary bravery of the victim-survivors who contributed to the Inquiry,” Mr Speakman said.

Taylor said domestic abuse can take many forms other than physical violence, which together can comprise coercive control.

“Coercive control is simply unacceptable.

“It involves patterns of abuse that have the cumulative effect of denying victim-survivors their autonomy and independence, including physical, sexual, psychological, or financial abuse,” Mrs Taylor said.

In addition, the Department of Education will review school programs about respectful relationships to ensure

these include content about coercive and controlling behaviour.

Comprehensive training on coercive control will also be introduced across Government systems and communities.

A public awareness campaign about coercive control will be developed and delivered in consultation with stakeholders, including with culturally and linguistically diverse and First Nations communities and organisations. accommodation, social housing and specialist wrap-around services.

THE NSW Government has committed to outlawing coercive control in current and former intimate partner relationships as part of the response to recommendations from the Joint Select Committee on Coercive Control.

Attorney General and Minister for Prevention of Domestic and Sexual Violence Mark Speakman said NSW Parliament moved to establish the Committee just over a year

ago to explore whether to criminalise this conduct in NSW. At the same time, the NSW Government published a discussion paper to help guide the work of the Committee and inform submissions to the Inquiry.

The Government is now taking the next step building on the Inquiry’s work by developing and consulting extensively on the drafting of this new law.

THE BENEFITS OF A PRE-SETTLEMENT INSPECTION “Is it necessary to do a pre-settlement inspection?”

IT’S natural to want to protect our possessions. When we make a purchase as significant as property, probably the most important single purchase we’ll make in our lives, we should really want to protect it. A pre-settlement inspection is the final step before paying the balance and taking full possession. Its purpose is to check the home and surroundings within the designated boundary so that you are confident the property and inclusions are just as when you purchased it: no post-purchase damage has occurred, all inclusions listed in the Contract of Sale such as window furnishings, floor coverings, air conditioners and dishwasher are present etc. You then confirm acceptance with your legal representative and the property settles. Property insurance should already be in place, having been taken out at Exchange of Contract, and you should now be ready to align your Contents Insurance with your move-in date. The risk in not doing a pre-settlement inspection is that, once you take possession, only to find damage has been done, or items missing, you have little recourse to claim compensation. That’s a risk I suggest is simply not worth taking.

A Year In Review from News Of The Area Reporter Alice Hennen

SO, this is Christmas.

And what have we done?

Another year over, a new one just begun.

AS we wrap up another year, it’s worthwhile to look back on where we’ve been and set goals for the new year ahead.

The year just seems to have flown by, especially with the chaos and uncertainty of the ever-present COVID-19 pandemic, lockdown 2.0 and the emergence of the Omicron strain.

Nevertheless, the recurrence of Christmas is often a joyful experience people look forward to, and this year, we need it now more than ever.

In the words of Charles Dickens, the man who more or less invented the Victorian Christmas, “But I am sure that I have always thought of Christmas time, when it has come round...as a good time; a kind, forgiving, charitable, pleasant time; the only time I know of, in the long calendar of the year, when men and women seem by one consent to open their shut-up hearts freely.”

My name is Alice Hennen and I am a contributor reporter for both Port Stephens and Myall Coast News Of The Area.

I started writing for this publication in March of this year, after seeing an advertisement for contributors in the paper.

My career in journalism has been a sporadic yet enjoyable one, having written previously for

Newcastle Weekly and The Star.

My favourite stories to write are those about community events that just need that extra signal boost.

The little wins, the community jumble sales, the little things we sometimes don’t notice but make up the fabric and the good vibes of the neighbourhood.

The community issues that need attention brought to them.

Those whose voices often go unheard.

I recently covered the proposed deer cull in Raymond Terrace, where fierce debate is underway over whether the deer are icons of the local area or whether they are pests that need to be eradicated.

There were many good points made by both sides of the argument, and certainly a situation to keep an eye on.

It was an intensely interesting piece to write, and hopefully an interesting piece to read.

While Christmas can be a time of joy and excitement, even more so this year, it can also be a time of struggle and loneliness, particularly for those who don’t have family or who cannot see their family.

Stay Safe on the Water Over Busy Summer Season BOATERS are being urged to look out for each other, monitor weather conditions and wear a lifejacket to ensure a day on the water doesn’t end in tragedy over the busy summer holidays.

NSW Maritime Acting Executive Director Darren Wood said we’ve seen an increase in the number of people applying for new boating licences over the past year, and more people on paddle craft on our waterways, so boaters need to know the rules and plan ahead.

“We’re reminding all boaters, a skipper is responsible for the safety on board their vessel - that includes ensuring everyone is wearing a properly maintained lifejacket that

is fit for use, and the vessel is not overloaded,” Mr Wood said.

“A skipper must also keep a safe distance from other vessels, structures and the shore, especially when our waterways will be congested over the busy Christmas and New Year period.

“It’s also crucial to monitor weather conditions closely.

“Weather conditions were a likely factor in more than 1 in 5 (22%) fatal boating incidents in the 10 years to June 2020.

“Unfortunately, of the six fatalities across the state since July, only one was wearing a lifejacket.

“Lifejackets are the most important safety equipment on any recreational vessel.

“In NSW you must service inflatable lifejackets once a year or in accordance with the manufacturer’s instructions. Remember to check them every time before you get on the water.”

Marine Rescue NSW Commissioner Stacey Tannos said around two thirds of all calls to Marine Rescue relate to problems with engines, batteries and fuel and boaters are reminded to ensure their vessel is seaworthy.

“Simple things such as changing the fuel, oil and oil filter, checking the engine, gearbox and propeller; charging the battery, testing the electronics and making sure you have the required safety equipment can mean the difference between a safe and enjoyable day

Our neighbours have gone away for three weeks, and they've asked me to water their plants. I thought I would also use the opportunity to take daily swims in their pool, but they have padlocked the gate (I guess as a safety measure).

They've given me their keys in case of an emergency, so I could easily unlock it.

With these high temperatures, it seems like a reasonable thing to have a quick dip after I build up a sweat watering their garden.

Corrine L. Dear Corrine, A PADLOCK seems to give a pretty clear message as to the status of your role in the neighbour's backyard.

I would assume that they are expecting you to maintain the hedge, water any potted plants, prune stray or dying branches, perhaps give the lawn a quick mow, and top up the bird bath.

The padlock sends a strong signal that they are not expecting you to be languishing in the pool on their inflatable flamingo (pina colada in hand), dragging your toes through the crystal-clear water while the portable speaker blares out the best of 2021's Deep House and Chill Music, and a pool boy named Julio gives you the occasional neck massage and feeds you grapes.

I think they have given you the keys as a form of temptation, and you have been drawn to that temptation like a middleaged woman wearing gardening gloves and nursing some RSI from pulling out one too many weeds in 35-degree heat while the dappled turquoise hue of their inground pool seduces you through the seamless glass pool fence.

What you could do is to accidentally throw a native animal (nothing too major, not a koala, maybe a lizard?) over the pool fence and then you would have an excuse to rescue it from drowning.

You could then legitimately unlock the fence and wade in the cool, calm water until you reach the poor, helpless wretch.

You could then contact your neighbours to let them know you had to use the pool key to save a drowning creature and it would be no trouble to add this duty to your gardening jobs as a lizard (or worse) finding its way into the filter box could be a real issue if left for too long.

Just make sure they don't have any CCTV cameras pointed at the pool, or you're just going to look like a sweaty psycho throwing native fauna into a chlorinated environment.

Heading off from the Oodnadatta Track in South Australia, Ewart shares some of her favourite drives to explore this country’s love affair with the road.

It’s episode two of season eight of the local version of I’m A Celeb, the show that incites schadenfreude (the feeling of satisfaction from another’s misery). A fresh bunch of homegrown celebrities have been taken into the “so-called jungle”. On their first morning in camp, reality is starting to settle in – after a night among snoring campmates, the celebrities have to contend with cold showers, rice and beans, and the long and short drop. It’s not long before the show’s gleeful hosts Chris Brown and Julia Morris turn up with a challenge – the insectinfested Hell Hotel trial.

It’s gloriously gruesome.

Grants for local volunteer groups MORE than 50 local volunteer groups have been successful in receiving funding under the Volunteer Grants 2021 program.

Federal Member for Lyne Dr David Gillespie paid tribute to the recipients before Christmas, many of whom were volunteering their time over the holidays.

“We’re indebted to our volunteers, whose generosity and dedication keep our communities together and encapsulate the spirit of Christmas,” Dr Gillespie said.

“These grants are to recognise and thank our

Rural Fire Service brigades and Surf Life Saving Clubs, community sporting bodies, P&C associations, rotary and lions clubs, community arts and festival committees and local show societies.

“It’s a special Christmas for many of us who have been separated from family and friends in recent months.

“I hope we all have a chance to relax with those we love and enjoy the blessings of the festive season.”

$33 million boost for not-for-profits MORE than 400 not-for-profit organisations delivering services and support to the community’s most vulnerable people will share in $33 million to help them enhance their services and meet the needs of clients.

Minister for Families, Communities and Disability Services Alister Henskens said the NSW Government’s Social Sector Support Fund would provide a financial

boost for organisations who have worked around the clock throughout the pandemic.

“These organisations are delivering critical frontline services and support to vulnerable people and this program will ease financial pressure and help them recover after what’s been an incredibly challenging 18 months,” Mr Henskens said.

“This funding will provide 417 not-for-profits

with between $10,000 and $200,000, so they can continue to deliver critical services to the people who need it most.”

The grants support organisations which did not receive JobSaver or JobSaver Not-For-Profit and are working across child and family services, domestic violence, homelessness, health, disability and animal welfare sectors.

Attorney General and Minister for Prevention of Domestic and Sexual Violence Mark Speakman said critical frontline services experienced greater demand and increased complexity of cases throughout lockdown and this funding will give them a hand-up.

“These funds will help ensure our dedicated frontline organisations are able to recover and continue

their crucial work, including responding to the scourge of domestic abuse and ensuring women and children receive appropriate supports,” Mr Speakman said.

NSW Council of Social Service (NCOSS) CEO Joanna Quilty welcomed the NSW Government’s financial support for not-for-profits through the Social Sector Support Fund.

“The social services

($2500) and Tea Gardens Hawks Nest Meals on Wheels ($2500). sector has worked so hard to ensure continuity of services in partnership with Government and this funding is recognition of the outstanding work they have done to support people doing it tough,” Ms Quilty said.

Fee Relief For Small Business

BUSINESSES have been hard hit by COVID and some will not be back.

Town streets around Port Stephens show the signs with empty stores and windows blacked out.

In response, the Small Business Fees and Charges Rebate has been lifted to $2,000 for small businesses and sole traders in the hope of keeping doors open and businesses trading.

Eligible sole traders, not-for-profit organisations and small businesses in NSW will be able to access up to $2,000 in relief to help them bounce back and get the economy firing again.

Treasurer Matt Kean said the increased

and expanded grant would provide businesses with additional relief as part of the NSW COVID-19 Economic Recovery Strategy.

“From today, the Small Business Fees and Charges Rebate will increase from $1,500 to $2,000 and will now include road user tolls for business usage,” Mr Kean said.

“The rebate can be claimed against eligible NSW and local Government fees and charges that are required to run a business such as food authority licences, liquor licences, event fees and council rates.

“It’s been a tough year for sole traders and small operators and this is one more way the NSW Government is helping to keep businesses in business.”

Damien Tudehope said 70,000 businesses had already lodged a claim under the initial scheme, saving more than $82 million since it was launched on 1 April 2021.

“The expanded Small Business Fees and Charges Rebate will be available to small businesses across the State, from your local electrician paying for their trade licence to the café on the corner setting up outdoor seating,” Mr Tudehope said.

“The expansion to cover road tolls paid since 1 March 2021 will be especially helpful to those businesses who spend a lot of time in the car, truck or van.

“Toll relief of up to $2,000 will have a significant impact on the bottom line for a small business.”

THE Tea Gardens Pool was taken over in management

by The Y NSW recently, in partnership with MidCoast Council.

News Of The Area had a chat with Cal Eastwood, Y NSW General Manager of Recreation to set the record straight about what residents in Hawks Nest and Tea Gardens can look forward to with the pool.

In January, the Learn to Swim program will commence at the pool, alongside much needed upgrades to the pool, in partnership with the MidCoast Council, including hot showers in the changerooms for guests to wash off in comfort after they’ve had a swim.

In the past few weeks, the community has been anxious to see whether opening hours will remain consistent, with fingers crossed that the

“It is important that we point out there are other reasons hours can be disrupted: people get sick, maintenance will be required from time to time (it’s essential to running a clean and safe swimming environment).

“Of course, we have to contend with the possibility that COVID infections can happen anywhere at any time,” Mr Eastwood told News Of The Area.

The Y NSW confirms that

irregular hours are simply teething problems in relation to staffing regulations.

Mr Eastwood confirms that it’s just a matter of time before residents can look forward to consistency.

“We will definitely have consistent hours in place soon, but we’re really appreciative of the community’s patience.

“We also have some great news: we have just communicated to our Tea Gardens members that we have a new Centre Coordinator Manager, Sam Newman, who joined the team on 13 December.

“Sam is joining the team alongside two additional team members commencing over the holiday period,” he said.
