Free skateboarding workshops WANT to learn to ollie, grind and flip like a pro?

MidCoast Council is partnering with the Totem Collective to deliver skateboard workshops for beginner and intermediate skaters at Stroud, Tea Gardens and Nabiac thanks to funding from the NSW Government’s Regional Youth Summer Holiday Break program.

The workshops will now take place during the first week of February outside of school hours.

Originally scheduled for the school holiday period, they were postponed due to weather concerns – it is not safe to skate when the conditions are wet.

“They’re also a direct incentive for businesses to reduce emissions.

manufacturers, this program will benefit some of the more energy-intensive small and medium businesses in our region.”

Assistant Minister to the Minister for Industry, Energy and Emissions Reduction Tim Wilson said the Coalition Government was committed to backing business, as part of the journey to becoming carbon neutral.

“Reducing needless energy consumption is at the heart of the Coalition Government’s focus on technology, not taxes,” Assistant Minister Wilson said.

“This program will help our small business sector boost competitiveness, create new jobs and reduce Australia’s environmental footprint.”

The marine park extends from Cape Hawke near Forster South to Birubi Beach at the northern end of Stockton Beach and is approximately 980km2.

James Tremain, Senior Media Advisor at Nature Conservation Council NSW says that the review will have big impacts across the state.

“This review has huge implications for conservation of the state’s marine estate, a massive area that includes the ocean, estuaries, beaches, dunes, headlands, islands and coastal wetlands, seaward to three nautical miles (5.5km).

“Marine Parks in NSW extend along 500km of coastline, which is about 30% of the

state’s coastal edge,” Mr Tremain said.

After the review, the government plans to both recreate and create zones for the parks and a suite of policies and programs to protect biodiversity and water quality, enhance fishing and recreational opportunities.

“Marine conservation has gone backwards in NSW over the past decade.

“The Coalition Government has wound back marine protections, allowing illegal fishing in sanctuary zones that were established to give marine life maximum protection.

“The conservation movement, including the Australian Marine Conservation Society and the NSW National Parks

continue that trend and further entrench the influence of some sectors – particularly the recreational fishing lobby and other commercial interests - ahead of the wider community interest in conserving our astonishing coastal and marine life for current and future generations,” Mr Tremain said.

The plan aims to seek information on areas including Aboriginal culture, commercial fishing, aquaculture, local government, marine conservation, marine science, maritime industry, recreational boating, recreational fishing, recreational water use and tourism.

In response to community feedback, the consultation period for the draft strategy was extended until 28 January 2022.

During that time, Council’s Land Use Planning team has reached out across the community to

provide information under COVID-safe conditions.

Individuals and community groups have interacted throughout the consultation phase through phone appointments, video conferencing, email correspondence, and faceto-face appointments when restrictions allowed.

In early December 2021, the High Court in Arsalan v Rixon; Nguyen v Cassim [2021] HCA40 considered the issue of hiring a replacement vehicle of broadly equivalent value to the damaged luxury vehicle.

The case concerned luxury vehicles that were damaged in motor vehicle accidents driven by Mr Rixon and Mr Cassim. The insurers admitted liability in negligence.

Both vehicles were used for social and domestic purposes, and not incoming earning purposes.

Mr Rixon and Mr Cassim hired replacement vehicles of similar value to their damaged luxury vehicles, while the vehicles were being repaired.

The Court proceedings started in the Local Court of New South Wales. A Magistrate held that Mr Rixon had not demonstrated the need for a prestige replacement vehicle and awarded damages representing the market rate of a Toyota Corolla. The Magistrate determined that a Toyota Corolla would have met Mr Rixon’s needs.

He did not agree. So much so, that he lodged an appeal to the Supreme Court of New South Wales.

The Supreme Court agreed with the Local Court. Mr Rixon was even more displeased with that outcome

and appealed to the Court of Appeal.

The Court of Appeal had a different view. They held that Mr Rixon and Mr Cassim were entitled to a replacement vehicle that is equivalent to or is close to equivalent as possible as the damaged vehicle.

The Insurers appealed that decision. The High Court dismissed the appeals, holding that Mr Rixon and Mr Cassim were entitled to damages representing the costs of hiring replacement prestige vehicles.

The Court determined that loss from the negligence includes both the physical inconvenience from the inability to use the vehicle but also the loss of enjoyment of the use of that vehicle. The Court confirmed the loss of amenity of a use of a chattel should be recognised as a recoverable head of damage for negligent damage to a chattel, consistent with the compensatory principle. Once a plaintiff mitigates their loss by hiring a replacement vehicle of broadly equivalent value to the damaged vehicle, the onus lies upon a defendant to prove that the costs incurred in mitigation was unreasonable. In this case, the costs of a replacement luxury vehicle were reasonable.

Red Spot re-detected

EPIZOOTIC Ulcerative Syndrome (EUS) or ‘red spot disease’ has been re-detected in the Myall River.

In a sample tested by the Elizabeth Macarthur Agricultural Institute in early January, the disease was confirmed in an ulcerated Bream that had been caught in the river.

Red spot disease is known to be an epidemic in several waterways in NSW, with the first confirmation of the disease in Myall Lakes in September 2008.

EUS is caused by a fungus (Aphanomyces invadans) and shows as red lesions (sores) or deep ulcers.

Secondary bacterial infections are often also associated with red spot disease.

It can affect numerous fish species including bony bream, silver scat, sole, bream, mullet, whiting, dusky flathead, silver trevally, eels and catfish.

“Previous outbreaks of EUS have been associated with acid water run-off, particularly after heavy rain following a prolonged dry spell, as well as other factors such as prolonged cold temperatures, crowding, and conditions associated with drought.

“Healthy fish with no sign of EUS can still be caught and consumed by recreational fishers and caught and sold by licensed commercial fishers,” a spokesperson from the NSW Department of Primary Industries said.

Member for Myall Lakes Stephen Bromhead said work on site is expected to start once project planning is complete and statutory planning approvals have been achieved.

“It is vital that Myall Lakes residents have access to the best healthcare facilities and Stage 2 of the redevelopment will continue to ensure that,” Mr Bromhead said.

“This follows the completion of the $40 million Stage 1 redevelopment, which improved renal and cancer services and provided a new medical imaging unit.

“A further $100 million for Stage 2 will deliver a first-class hospital to meet the growing needs of patients right across our community.”

The NSW Government has invested $140 million as part of Stages 1 and 2 of the Manning Base Hospital redevelopment.

This next stage is part of the NSW Government’s record $10.7 billion investment in health infrastructure to 2024, with nearly a third of the capital allocation in this financial year going towards regional and rural health facilities.

The Manning Hospital Redevelopment is being delivered in partnership with Health Infrastructure and Hunter New England Local Health District. Along with the redevelopment of the Manning Hospital, other projects underway in this health district include: • $835 million John Hunter Health and Innovation Precinct • $500 million new Maitland Hospital • $20 million for Glen Innes Hospital Redevelopment • $45 million for Stage 3 of the Muswellbrook Hospital Redevelopment • $80 million for Moree Hospital Redevelopment • $53 million for Gunnedah Hospital Redevelopment.

Covid-smart plan to start 2022 school year STUDENTS will return to school under COVID-smart settings that will minimise the risk of the virus and allow teachers and pupils to return safely to the classroom.

As part of the new measures, every student and teacher in NSW government and non-government schools will be able to receive rapid antigen test (RAT) kits before school returns on February 1.

The COVID-Smart Plan to keep schools open and students safe includes: • Twice a week surveillance testing for primary and high school students, school staff and early childhood staff. Surveillance testing will be undertaken for the first four weeks of term, with two weeks of supply distributed before term starts • Mandatory mask wearing for all staff and high school students, with masks encouraged for children in primary schools • Limiting interaction between year groups • Limiting visitors to those providing essential curriculum and wellbeing support • COVID-safe settings in place for music, sport and excursions • Maximising natural and mechanical ventilation, with air purifiers dispatched to where they are needed • Contingency plans in place to manage any disruptions to the workforce

Premier Dominic Perrottet said supporting students to return safely to the classroom is vital after two years of disruption to their education.

“Students learn best at school, some students have spent a quarter of their schooling at home.

“We’re committed to bringing students back safely,” Mr Perrottet said.

“New COVID-smart measures will help make this happen, including surveillance testing both students and staff twice weekly with RATs. “What is most important about this approach is that it allows students to enjoy all aspects of their schooling in a safe and sensible way.

“The government is distributing more than 12 million RATs to over 3150 government, non-government schools and early childhood centres to assist with surveillance testing of staff and students.”

Minister for Education and Early Learning Sarah Mitchell said testing complements other COVID smart measures in schools, including mandatory vaccination for staff, increased vaccination coverage for students , mask-wearing, cleaning, cohorting and limited visitors on-site.

achieve the same important goals of seeing our students learning in their classrooms safely and with minimal disruption,” Ms Mitchell said.

“Activities students love, such as music, school sport and assemblies, will continue with settings in place similar to late last year.”

A number of staffing contingencies are in place including utilising retired and studying teachers.

The Association of Independent Schools of New South Wales Dr Geoff Newcombe AM said all three school sectors worked closely together to develop the back to school arrangements.

“School communities should feel confident about returning for Term 1 under these arrangements, which allow a wide range of activities to proceed with appropriate risk-assessment and planning,” Dr Newcombe said.

Catholic Schools NSW Chief Executive Officer Dallas McInerney said it is imperative

that we have schools that are safe and that remain open.

“We need to keep our students, teachers and families safe and also provide stability.

We know that our kids learn best when they’re in the classroom with their teacher and peers,” Mr McInerney said.

Families will be notified by their schools on how and when to collect the RAT kits for their children.

In the 12 to 15-year-old age group, more than 80 per cent of children have had their first dose of a COVID-19 vaccine, and 78 per cent are double-dosed. In the 5 to 11-year-old age group, more than 24 per cent of children have had their first dose.

Blue Collar and CALD Communities Hit Hardest By COVID

RESEARCH has shown that local government areas with higher blue collar and culturally and linguistically diverse (CALD) communities were vastly more susceptible to COVID infections in 2021 and remain at risk, according to a new report commissioned

by Catholic Health Australia, the largest non-government provider grouping of health, community and aged care services in Australia.

The report, titled ‘Unlucky in the Lucky Country: how COVID has exposed social inequity’ analysed a range of variable factors and found two stood out as key predictors of

which LGAs recorded the most COVID infections: the number of blue-collar workers and the number of culturally and linguistically diverse (CALD) residents.

According to the research, every one percent increase in blue-collar workers per LGA was associated with an increase of an additional 848 COVID

NSW Police Blood Drive The NSW Police Blood Drive for 2021 donation results are here.

Over the past twelve months, Police across all districts made 4,660 donations of blood, bringing the tally of lives saved up to 13,980.

165 officers donated for

the first time, with 53% of all officers donating plasma, 46% donating blood and 1% donating platelets.

In 2022, the state’s police hope to be on track to save up to 14,500 lives through the donation of blood.

While double demerits won’t apply during the operation, additional police

will be deployed across both metropolitan and regional areas in NSW, to keep the community safe over the busy period.

Parliament seeks views on access to regional news A NEW online survey is seeking views on how Australians living in regional, rural or remote areas access news, as part of a federal parliamentary inquiry into Australia’s regional newspapers.

The House of Representatives Standing Committee on Communications and the Arts Chair Dr Anne Webster MP said, “Over the past ten years news outlets in rural, regional and remote communities have closed

their doors which has resulted in a substantial reduction of articles covering local issues.

“It is important that we listen to our communities about what's important to them.

“This survey provides an opportunity for these communities to express their views on whether the loss of their regional voice has directly affected them.

“I encourage anyone who lives in Australia’s regional, rural or remote

areas to participate in the online survey.”

The survey is open until 11 February 2022 and takes less than 10 minutes to complete.

MILLIONS more people in NSW are now eligible for a COVID-19 booster vaccination after NSW Health brought forward the interval between doses by a month.

State-run vaccination clinics will begin offering COVID-19 booster vaccinations three months after people have received their second dose from Friday January 21.

The change from a fourmonth interval to three months means there are now an additional 3.55 million people in NSW who

can book in for their third dose of vaccine.

Premier Dominic Perrottet said being triple vaccinated offers extra protection against the effects of the Omicron variant.

“The advice is clear – getting boosted means there’s less chance you’ll get the virus and, if you do, the effects are generally much milder,” Mr Perrottet said.

“That’s why we are offering more people the opportunity to get the booster sooner.

“I urge everyone who is eligible to get boosted to do

so as soon as possible.

“This will help to protect our older population, as well as vulnerable members of the community.”

Health Minister Brad Hazzard said there are more than 40 state-run vaccination clinics spread throughout NSW as well as mobile outreach locations that these clinics visit.

booster doses of COVID-19 vaccines in support of the Federal Government’s vaccine program.

NSW Health is contacting people who are registered in the NSW Health vaccination booking system with a reminder text message.

NSW Health clinics offer Pfizer or Moderna vaccines to people aged 18 years and over.

Eligible people can also receive a booster dose of a COVID-19 vaccine from their GP and participating community pharmacies.

A booster vaccination can be booked through the COVID-19 Vaccine Clinic Finder.

$250 prepaid Visa card that can be used for fuel, taxis, pre-booked NSW TrainLink Regional trains and coaches, and select community transport services.

“By putting an extra $250 in the pockets of our regional seniors, we are boosting access to safe and convenient travel, as well as reducing the burden on people who often have fewer transport options than those living in the city,” Mr Farraway said.

Applications for the 2022 NSW Regional Seniors Travel Card are open now, and will close on 30 November.

Eligible participants will

also be able to apply for a 2023 Regional Seniors Travel Card in early 2023, meaning more ongoing financial support for essential travel costs.

The 2022 cards are contactless, making payments safer and easier for card holders, and are made from 85.5% recycled plastic.

With the latest COVID-19 health advice, seniors are strongly advised to apply online or call 13 77 88 rather than visit a service centre.

Draft Water Sharing Plan Available for Feedback NEWS

These loaner arms have allowed both new and experienced bowlers to give arms a try.

President Jim Healey, himself an ‘arm bowler’ said, “Although they do require an experienced bowler to change their delivery a bit, the benefits of keeping bowlers in the game and allowing new bowlers to play is a real

bonus.”

Experienced bowlers traditionally tend to be just a tad conservative and tend to resist change just on principle. Interestingly it seems, at least at Karuah, those games that are good enough to try using an arm have now become some of the strongest advocates of using them.

If you’d like to try bowling, even if you have resisted before because of

concerns about backs and knees, give the Karuah Club a ring.

Bowls are on every Tuesday and Thursday weather permitting, names by 9:30AM and on the green at 10:00AM. Loaner gear is available and they are even having a come and have a try (with a free BBQ) at 3PM on Sunday 6 February.

Tea Gardens Men’s Bowling Club

TEA Gardens Men’s Bowling Club News 22 January.

A belated happy New Year to all our bowlers.

The 2022 year began on 12 January but up until now there has been little to report, with bowls washedout last Wednesday, but happily the first and second rounds of the Club Championship Singles made a start today with five matches being determined.

Hilton Newman received a tough draw taking on Club Champion, Jeff Baker in the first round.

Hilton did well to take 14 shots out of the game with Jeff winning 31-14.

It was hard to predict the winner of the Dave Perry, Graeme Reynolds game and so it turned out to be with Dave managing a 31-24 win.

Doug Andrews found himself in a close tussle with Henry Dallas when he tweaked his back and had to concede the game with Henry leading 26-22.

The closest game of all was the Col Amos, Rob Young tussle with the match going down to the wire with Col prevailing in the end, 31-29.

Probably the upset of the day was a great win to Tony Butler over the more fancied Greg Smith.

I know Tony has been putting many hours into practice and it paid off for him today beating Greg 3121.

23 January A bright sunny summer’s day greeted players for the second round of the Club Championship Singles competition today with six matches to be decided.

Club Champion Jeff Baker continued his

winning way with a sound 31-20 win over a very valiant David Garcia.

The more experienced Dave Perry accounted for Andy Docherty 31-6.

Geoffrey Muggleton had a comfortable win against Col Amos, 31-12.

Peter Gurney was well in control in his match against rookie.

Rick Islaub ran out the winner, 31-11.

New to Tea Gardens Bowling Club, Ron Berczelly proved a bit of a dark horse, defeating Ross Barry in a tough game, 31-26.

A dark horse no longer.

The match of the day must be the game between octogenarians, Barry Goode and Henry Dallas, Barry has been in good form since taking to the ‘longbow’, but Henry was always in the match.

It was a memorable game with Barry securing the win, 31-26.

Myall Matters – Progress Associate Update

HAPPY Australia Day! I hope you can take time today to ‘reflect, respect and celebrate’ this day and relax at the beach or riverside.

Although it is late in the season, you might see the beautiful flannel flower which is an iconic Australian wildflower that grows along the Myall Coast and represents healing.

You can see the careful restoration of the wooden Flannel Flower poem stand on the corner of Yamba Street and Tuloa Avenue, Hawks Nest recently renovated with the support of the Progress Association.

On behalf of the Association, thank you to Kath Verdon, Jeanette Hart, The Men’s Shed, and Jock Fraser for their work.

I would also like to acknowledge the local MidCoast Council (MCC) staff who recently replaced the badly vandalised toilets in the Tea Gardens Skate Park.

Brand new toilets were installed by staff within 24 hours of the damage being reported which is a credit to

the MCC and great for park users, mostly families and young people.

The park is now ready for the MCC - Totem Skate Clinic rescheduled to Sunday 6 February.

The PA has contributed to the Clinic to enable more local young people to participate in what should be a great day.

Registration is required, with bookings filling up quickly online at www.midcoast.nsw. gov.au/skateworkshops.

MCC is also running a Free Grant Writing Workshop from Tea Gardens on Thursday 10 February, 2022 which some of our members will be attending.

Meetings Last week we held our first Committee meeting safely by ZOOM. At that meeting we agreed that our General Meetings will be held every second month at 7pm at the Hawks Nest Community Hall starting Monday 14 February.

New members are very welcome with membership forms available on the night.

Dear News Of The Area, IT is a sad day when the Australian flag flying for a community is in a tattered state, especially before Australia Day. Fortunately the Hawks Nest community has been able to raise a new Australian Flag just in time to commemorate our national day.

The community has noted however that the Australian Flag is flying solo without an Indigenous Flag or a Torres Strait Island Flag anywhere to be seen.

Port Stephens and the Myall region are the traditional home to the Worimi Nation and the region has an active Aboriginal Land Council.

The Worimi (Warrimay) have always been and remain today the traditional custodians of a large area of land, The Worimi Nation.

Oral history passed down by the Elders record that the Worimi Nation was originally bounded by four rivers, Hunter River to the south, Manning River to the north, the Allyn and Patterson Rivers to the west.

The Worimi Nation was home to 18 clan groups or ‘ngurras’, with the Worimi Conservation Lands falling within the area of the Maiangal ngurra.

Much of Worimi Country has changed dramatically since 1788, and dispossession has had significant impacts on Worimi people and their culture.

As a result, the granting of the freehold title over the WCL means it is of particular significance to the Worimi.

It is an area where the protection of Worimi cultural values has priority in Australian law, where decisions affecting Worimi Country and culture are made by Worimi people through their majority representation on the Board of Management, and where Worimi traditional owners are employed to implement these decisions.

Today we should see the Indigenous Flag flying alongside the Australian Flag, it is visible at some Police Stations and even on the Sydney Harbour Bridge.

Surely the Indigenous flag should be flying proudly alongside a pristine Australian Flag at Hawks Nest, the community deserves no less.

THERE are so many different rites of passage we must navigate when it comes to children.

The first night they manage to sleep in their own bed.

The day they discover that Bluey on ABC is far more entertaining than their parents.

The first day of school, where some children cling to the gate, and others say they don't need a lift, they'll get on the bus, further diminishing your role, but nevertheless giving you something to gloat about on your socials: "Lucy is so independent that she caught the bus to her first day of kindergarten #proudparents #teachingthemyoung #bringingupanindependentdaughter #madeherownlunchtoo, which other parents will read, scoffing and sniggering so much they spill their morning coffee down their shirt.

Some kids are natural self-starters and others are tied to the hip.

There is no easy way to handle the transition when they first move out of home, but you can make it easier by organising a family dinner at least once a week, or meeting up near her new home for coffee, organising a few takehome meals so you're not obsolete, and relishing in the significant reduction in washing and cleaning, as well as the food bill.

If she is leaving for a good purpose, such as starting university or moving for work, then take some solace in the fact that you have done a good job to this point.

If she's leaving to hook up with someone who looks like Hando from Romper Stomper, then know that even if you have done a good job, most children go through a rebellious stage and generally come out the other end at some point, when it is your role not to gloat in an I-told-you-so way, but to help pick up the pieces.

Make sure you keep in regular contact and try not to be melodramatic when she leaves by throwing yourself around her ankles and begging her to take you with her.

The smiles on their faces when they won their first race was lovely to see and reflects the comradery and enjoyment in the teams at TGHN. Also, not to be outdone by the clubs more experienced open crews, they also are leading the series point score, after taking out first place in the second round.

Congratulations to all the rowers and sweep and coach ‘Rossy’ for such a tremendous start to the series.

It is certainly a great result for the boat crews of our local surf life saving club to be leading the series in all divisions they competed in, with special mention to the U19 Newbees in their first season.

BRIDGE Club members look with much hope and optimism that later this year we may all see a return to normal which allows all members to participate in the game they love and to be able to use their clubhouse once again for social functions.

The club has several new members who are looking forward to meeting all members during playing bridge and likewise members getting to welcome them to the club.

We have been able to welcome back some visitors who have complied with all our best practice safety protocols.

MidCoast Council will be carrying out herbicide control in various open drains at Bulahdelah and on the Myall River from the Battles Bridge at Markwell Road to the broadwater and Nerong inlet, during the months February, March and April 2022 to target pest aquatic weed Parrots feather.

As a precaution, residents are advised to refrain from using, drinking or swimming in the water for 96 hours following treatments. Residents who pump from the river to fill water tanks for human consumption are advised to do so prior to commencement of works, and not resume pumping for 96 hours following treatments adjacent to their property.

Herbicides Metsun 600, Lynx WG, metmac 600, and other registered products containing 600g/ Kg metsulfuron methyl as their only active constituent will be used, at the rate of 10g/100L as per APVMA off label permit 11607. Only qualified, experienced operators will be undertaking the works. This program is subject to weather conditions.

YOU could not have asked for a better start to the Surfboat Competition season for the Tea Gardens Hawks Nest Surf Life Saving Club (TGHN).

In December, the first two rounds of the Hunter Central Coast Surf Boat Series were held at our own Bennett’s Beach.

Tea Gardens Hawks Nest had three crews competing, all coached and swept by Greg Ross.

Over 80 crews turned up to compete with clubs entering from as far North as Woolgoolga and Coffs Harbour to as far south as Ocean Beach and Umina.
