By Tara CAMPBELL AMONGST the flooding and wet weather of the past week, Stroud SES assisted in ensuring a local wedding could go ahead.

On Saturday 5 March, members from Stroud SES assisted with getting the bride, groom and wedding party over a flooded causeway to their wedding.

After 160mm of rain in four hours overnight, other family members attending the wedding coming from Markwell Back Road to Bulahdelah were unable to assist in getting the wedding party to the venue.

By Marian SAMPSON SAVAGE rains and floods are impacting lives across NSW and Queensland, with seventeen local government areas (LGAs) declared as disaster areas Port Stephens and the Myall Coast have so far not reached disaster levels, however the wild weather conditions have impacted our beaches.

Notably Stockton Beach, along with a range of beaches from Coffs Harbour to Shell Harbour were closed over the weekend due to erosion and hazardous surf, with some SLSCs having no access to the beach to set up patrols or position rescue equipment.

Conditions across the state were deemed too dangerous for all coastal activities including swimming (including ocean pools), rock fishing and boating.

The iconic red and yellow flags were down across many beaches.

While riverine flooding in some locations is easing, the situation on NSW beaches is one of widespread erosion,

damage to seawalls and access ways due to high tides and powerful surf.

Hazardous surf, lack of access for rescue craft, coupled with the strain on volunteer resources due to the flood response, particularly in the north, means many clubs will not be able to patrol this weekend and beaches will be closed.

Lifesavers conducted surveillance patrols from clubs and Support Operations callout teams are on standby for emergency incidents.

A 3-metre long-period swell from the East continued to batter the NSW coastline with conditions considered extremely hazardous for any coastal activity and in particular rock fishing.

High tides will likely continue to cause inundation and further coastal erosion while the continuing rain will see water quality deteriorate with debris from erosion or rivers and possible overflows of sewage and storm water systems.

Meanwhile the volunteers at Surf Life Saving have been rolling up their sleeves to assist with flood relief efforts.

More than 500 lifesavers answered the call.

By Wednesday there were more than 120 lifesavers active in the field with 43 Inflatable Rescue Boats deployed across NSW, most in western Sydney.

Callout teams have been conducting evacuations of people and in some cases animals stranded by floodwaters, assisting with food-drops and supporting other emergency services with logistics.

Along with IRBs, Duty Officers have been positioned in all of the Emergency Operations Centres as Liaison Officers and UAVs have been deployed to provide intel on conditions and will continue to assist in the recovery phase of the disaster.

“The response to the callout for volunteers has been amazing,” said Joel Wiseman.

“I’m so proud to be part of an organisation where so many people are willing to drop everything and lend a hand, including some of our members who themselves have lost their homes in this disaster.”

Emergency services resources were stretched over the weekend with ongoing flood operations and the usual resources to respond to emergencies on the coastline will be significantly reduced.

Disaster Relief Grant Funding

By Tara CAMPBELL AT the recent MidCoast Council meeting on 23 February 2022, Councillors endorsed the financial support of numerous community projects for the second round of Disaster Relief Grant Funding.

Applicants could apply for a maximum of $15,000 for projects that deliver social, cultural, economic and/ or environmental benefits to the community, address identified community priorities, have broad community reach and are

sustainable.

The recipients are as follows: MidCoast 2 Tops Landcare Connection - $3,380 for First Nations Perspective on Cultural Burnings on Worimi and Birpai lands, this is part of the organisations’ free education program on fire management and ecology.

Mission Australia - $8,715 for hearing the voices of children and young people in disaster response and resilience planning.

MidCoast Outreach Inc. – $3,900 for the purchase of a defibrillator to form part of

MidCoast Outreach’s mobile team kit.

Mooral Creek Hall and Progress Association - $10,550 for the Mooral Support program which presents a series of local, artist-led, free, creative workshops.

Manning Valley Neighbourhood Services - $15,000 for ‘Stories: The beginning and the middle' project to engage artists and storytellers to facilitate workshops that allow local women to explore their experiences during and post, black summer fires to develop their individual stories.

The Retail Leases Act NSW (1994) (“the Act”) is filled with potential hazards for landlords.

One of these hazards is the operation of Section 8 of the Act which “can give rise to a situation where a retail shop lease comes into effect to the surprise of all involved.”

In Tarleton & Peters Pty Ltd v EK Nominees Pty Ltd [2010] NSWADT 248 it was found that a retail lease had been entered into and was binding on a landlord despite, seemingly, there being no meeting of the minds as to the commercial terms of the Lease. A Lease was submitted to a tenant and the tenant made amendments to the Lease, signed the Lease and returned it to the landlord’s solicitor.

Three days later the tenant took possession of the premises.

Subsequently, five days after the tenant took possession, the landlord responded to the tenant that the amended terms submitted by the tenant were not agreed.

Despite the Lease being unsigned by the landlord and

the tenant unilaterally amending the terms of the Lease before signing the Lease, the Tribunal found that ‘when there is entry prior to the final documentation; the statute creates what seems to be appropriate to describe as an interim retail shop lease which is eventually “overlaid” by the actual signed document. The terms of that interim statutory creature will depend on the individual circumstances of each matter.”

The Tribunal Member found that “Section 8 overcomes the need for a concluded contract, and that the terms of the statutory occupancy can be found by reference to the extrinsic evidence.”

The lesson learnt from this case is that, as a landlord, you must be very careful that a concluded agreement has been reached before a tenant is granted occupation of a retail premises.

The Australian Labor Party has endorsed Alex Simpson as its candidate for Lyne in the upcoming election.

THE Australian Labor Party has endorsed Alex Simpson as its candidate for Lyne in the upcoming election.

Alex has a Bachelor of Science in chemistry and physics and has worked as a research assistant developing energy storage technology.

While people across the electorate have raised many issues with Alex, four major areas of concern have arisen, with health and aged care services at the top of the list, plus climate change, jobs and education.

“Amongst the campaign’s priorities, health and aged care are the most serious areas of need in the electorate,” Alex said.

“Lyne is home to an older population facing the inequality we see too often in regional Australia.

“I have already met with community groups who have strongly voiced their concerns

about infrastructure, medical equipment and staffing issues in our hospitals, and I’ve listened to aged care workers tell me of horrible experiences reflecting those revealed by the Royal Commission.

“As a candidate for Lyne, I will fight for better outcomes in health and aged care, and I’ll be looking to make commitments for the changes that Lyne needs, and that Labor can deliver,” Alex said.

Alex was drawn to politics by what he perceives as the government’s lack of action on climate change.

As an aspiring scientist, Alex said he believes that real action needs to be taken on these important issues.

“A major poll shows that in every federal electorate, the majority of voters want the government to do more on climate change, yet the government continues to deny its climate

responsibility.

“It’s time to act on the messages from climate change experts,” he said.

Alex told News Of The Area that he has seen job losses in the TAFE and university systems, including in his own workplace.

“I’ve seen staff agonising over whether their job will be kept, and I’ve seen their employers faced with impossible decisions.

“Older academic staff may never be able to get back into the workforce.

“The damage done by the Coalition’s neglect of higher education is severe and we need to do something about it,” Alex said.

Alex believes that it's time for a change in the government, to ensure that today’s problems are being dealt with.

“I’m working to make that happen in my electorate, and I’m asking the people of Lyne to help me do that,” he said.

Draft Hunter Regional Plan

By Tara CAMPBELL THE MidCoast Council has endorsed a submission on the Draft Hunter Regional Plan.

The Council’s submission examines the challenges the five-year review of the Hunter Regional Plan 2036 creates for Council, with regards to density requirements, housing availability and required implementation of density and infill/ greenfield benchmarks and potential delays in the release of land for future housing.

Sue Calvin, MidCoast Council Senior Land Use Planner, said the plan raises particular challenges for the MidCoast area.

“Critically, significant changes to the structure and format of the existing Plan compared to the draft Plan, down-play recognition of Newcastle as a regional city with

clear and distinct development opportunities and requirements; and instead, promote a more consistent, one-size fits all approach to strategic land use and infrastructure planning across the region,” Ms Calvin said.

In simplifying the intended outcomes, the Plan highlights the unique differences, challenges and opportunities faced by coastal, regional and rural local government areas in the Hunter to accommodate the new objectives and processes that have been successful for the Greater Newcastle area.

“The Plan also highlights, but does not clearly articulate, how local Council and community led planning and initiatives can be incorporated into these new processes, or how these can be effectively implemented within the five-year life of the new Plan,” Ms Calvin said.

The areas of concern that the council raises in the submission includes: review vs rewrite (a focus on the review of Greater Newcastle and Hinterland being recognised as high growth areas, realising the vision for the district), density requirements (move from the ‘one size fits all’ approach - a minimum 5075 dwellings per hectare of developable land, to controls in the plan), infill vs greenfield development (amendment of benchmarks to be consistent with the District: Coastal consistent with Central Hunter - 40% infill and 60% greenfield; and Barrington consistent with Upper Hunter - 20% infill and 80% greenfield) and 15-minute neighbourhoods/ 30 minute strategic centres (application of the contexts of the program but acknowledgement of the plan requiring a 20-year-timeframe).

These changes make it easier to understand which category your event belongs to.

The categories include community and local events (up to $2,500), events and festivals (up to $10,000), and regionally significant events ($10,000 and over).

“Supporting the community to hold a diverse selection of events is part of our commitment to helping build a sense of local spirit, attracting visitors to the region, stimulating the economy, and putting MidCoast on the map.

“After some challenging years due to COVID-19 restrictions, it will be uplifting to once again see the community come together to celebrate all that our region has

to offer culturally.”

THE Tea Gardens Hawks Nest Men’s Shed is having a special Garage Sale this Saturday, March 12, with all proceeds going to flood victims in Lismore.

“Not being content with raising $500 from a whip around of members on Monday that was immediately donated to the Salvation Army’s flood victim appeal, the Shed members wanted to do more,” said John Adkins, President, TGHN Men’s Shed.

The idea of a garage sale in support of the flood victims was then raised, and Shed members have been busy donating tools and equipment for the sale.

The Garage Sale will run from 7am to 12 noon this Saturday, 12 March at the TGHN Men’s Shed site at 25 Wanya Rd, Tea Gardens (in the industrial estate).

All proceeds from the garage sale will go to flood victims in Lismore and surrounding areas.

“It’s our way of letting the people up there know that we care,” said John.

The Council also chose to include information in the submission detailing housing affordability and availability in the MidCoast and Hunter regions which are not specifically addressed in the plan.

“With many people buying houses in the regions, property prices have increased, reducing housing affordability and availability for locals, resulting in increased homelessness.

“The new initiatives and processes in this Plan could potentially slow down our new planning controls, rezoning and development applications.

“The Plan needs to streamline the provision of housing on the market, rather than impose requirements that are not easily achieved in regional areas,” Ms Calvin said.

Fame Cove Rescue At 8AM on Sunday 6

March, the Radio Base at Marine Rescue Port Stephens received a request for assistance from a 15m sail mono who was moored at Fame Cove having engine issues.

The crew made their way down to the dock to prepare PS31 for her short trip across the bay to Fame Cove.

The two people on board were happy to see PS31 by her side.

The Unit safely put the mono sail alongside its pen at Nelson Bay Marina.

These sailing vessels are very slick in the water, so it takes care and manoeuvring skills to place them safely.

Once secured the PS31 crew waved goodbye and headed back to their berth just in time for lunch.

NEW South Wales Health is alerting the community to protect themselves against mosquito bites.

Japanese Encephalitis (JE) virus has been detected in samples from commercial pig farms at five locations in both southern and western NSW indicating the virus is likely circulating in the mosquito population.

Japanese Encephalitis is a mosquito-borne disease that may affect animals, including pigs, and humans.

The virus is spread by mosquito bites.

“It is really important to protect yourself from mosquito bites as mosquitoes can spread viruses including Japanese encephalitis,” said Dr Kerry Chant, Chief Health

Less than one percent of people infected with the disease experience symptoms, which typically include fever, joint pain, and rash.

Occasionally, it can cause severe neurological illness with headache, convulsions and reduced consciousness.

It is the NSW Health advice that the best mosquito repellents contain Diethyl Toluamide (DEET), Picaridin, or oil of lemon eucalyptus.

Insecticide sprays, vapour dispensing units (indoors) and mosquito coils (outdoors) should be used to clear rooms or repel mosquitoes from an area.

All windows, doors, vents and other entrances are recommended to be covered by insect screens.

Outside water-holding containers where mosquitoes can breed should be removed.

“NSW Health is cautioning people undertaking outdoor activities such as camping and fishing to carefully consider their plans.

“This is especially important for people planning activities near waterways or where mosquitoes are present,'' Dr. Marianne Gale, NSW Health Acting Chief Health Officer said.

High Tea on The Myall

After a trying couple of years Myall Community Art and Craft Centre is finally able to get back to the new normal.

AFTER a trying couple of years Myall Community Art and Craft Centre is finally able to get back to the new normal.

Along with a lot of other businesses in town the Craft Centre has been following strict health guidelines to keep all it’s members safe and at long last have been able to hold their annual High Tea. “The High Tea is usually held as a way to thank all the volunteers who work in our shop and all the consignees who make all our wonderful items for

sale,” said Susan Burns, Myall Community Art and Craft Centre.

“Without these members our shop would not exist.”

This year, Craft Centre President Kerrie Croaker decided that along with the volunteers and consignees, the High Tea would be a nice way to reconnect with all members.

“Thanks to the organisation and hard work of five of our members including the President, a very successful High Tea was held on Saturday

26 February at the Craft Centre.

“Our five ladies served over 60 members who enjoyed home made sandwiches, cakes, slices, meringues and a gift box of chocolates created by our own Maryanne Durrant.

“The day was an outstanding success appreciated and enjoyed by all members who attended.

“If you are new to the area then we all invite you to come along and enjoy the social side of the Craft Centre and make new friends,” said Susan.

Boosting Regional Housing Supply SHARING the planning load and helping regional councils speed up the delivery of new housing are at the heart of a new program unveiled last week.

Minister for Planning and Minister for Homes Anthony Roberts announced $1 million for the establishment of a program of targeted assistance to

regional councils, at the Local Government NSW Conference.

“We know regional NSW needs more homes, that’s why I’m announcing a Regional Housing Flying Squad to help regional councils clear development applications faster,” Mr Roberts said.

“A panel of planning consultants, funded by

the NSW Government and helped by the Department of Planning and Environment (DPE), will be available to help manage development applications for new homes.”

Mr Roberts said the targeted assistance responded to recommendations made by the Regional Housing Taskforce.

“We know attracting

qualified planners can be a problem, particularly for smaller regional councils,” he said.

“That’s why, in addition to the flying squad, the Department will open up space in its offices for councils to use as remote workplaces for their planners.

“Covid has proven the importance of flexibility in

the workplace.

The CoPlan Spaces initiative builds on that, giving people access to convenient office space along with opportunities to learn and network with other council and DPE planners.”

Collectively, there are more than 16,000 active DAs in regional NSW, worth more than $14 billion to the

Hunter Defence Cooperative THE NSW Government is set to boost the state’s commitment to sovereign defence industry capabilities with the launch of a new $1.23 million Regional Defence Networks Program aimed at making it easier for local businesses to expand and supply to the defence and aerospace

industry.

Minister for Enterprise, Investment and Trade Stuart Ayres said that the three-year program will focus on driving business growth across four key regions: Western Sydney, Shoalhaven/Illawarra, Riverina-Murray and the Hunter.

“We know that procurement requirements and entering the defence market requires a deep understanding of the industry, so we want to do all we can to help existing suppliers grow, and support new players to enter the sector,” Mr Ayres said.

“This program is about helping businesses understand the defence supply chain and identify that their offering has value and need.

“We want to turn local businesses from being ‘Defence Interested/Able’ to ‘Defence Ready’.”

Hawks Nest to host Triathlon STORY STARTS on BACK COVER, Page 20

q Barrington Coast, Powerade and Tea Gardens Hotel, amongst others, to host four different triathlons.

These include Tri-A-Tri (free for first timers with a 200m swim, 10km bike and 2km run), Super Sprint (200m swim, 10km bike, 2km run), Sprint (750m swim, 20km bike and 5km run) and Standard (1.5km swim, 40km bike and 10km run).

Kicking off at 8:00am for registration and a health and lifestyle expo at Providence Bay Park, the triathlons will begin at 10:00am, 11:00am

and 11:30am from Bennetts Beach.

Seb Gallery from Elite Energy told News Of The Area that the team are excited to be bringing the Triathlon event back to Hawks Nest, following 2016’s successful event.

"The entire Elite Energy team is really excited to head back to Hawks Nest, there was no shortage of hands raised when we asked who wanted to work this event.

“The combination of a stunning location and a great local community make this event a staff favourite.”

In 2016, Elite Energy

hosted the event in Hawks Nest with 400 participants, however, this years’ event has already exceeded expectations for the company with an estimated 850 expected to participate and an additional 1500 spectators.

“We are looking forward to what was going to be a great little event now being a great big event,” Seb said.

Will the Black Swans return? *The following story is a reader’s submission from Peter Thomas of Nerong.

THE black swan waited for a signal.

I paddled about 50 metres from the flock of swans.

I took this photo about fifteen years ago while on a day paddle to Tamboi village, about sixteen kilometres on the Myall River north of Tea Gardens.

I used to see black swans out here all the time back in the early 2000’s.

They were a common sight paddling out of Nerong and up to the Broadwater.

On this particular spring afternoon, I paddled over to where the main flock was.

About 50 metres away, the lead swan let out a ‘honk’

Suddenly there was an

explosion of feathers from the front of the flock and like a domino, it spread to

the rest of the flock, as they launched off to the south.

OPINION large water bird and breeds mainly in the southeast and southwest regions of Australia.

It’s a nomadic species with erratic migrating patterns depending on the climate variations.

I researched the Aboriginal Dreamtime stories recently and found one on the Sydney Swans YouTube channel.

It’s a lovely story and I refer to it here.

One Aboriginal word for black swan is ‘Guunyu’.

A long time ago, there was a beautiful white swan.

All the other birds were envious of its beauty.

One day, the birds enticed this white swan to some bushes near a river.

And there they viciously beat up the white swan.

In a nearby tree, a crow watched on and felt very sorry for the swan.

The white swan had lost all its feathers in the beating.

It’s body was covered in blood.

The wounded swan managed to clean off all the blood from its featherless body but couldn’t clean the blood off its beak.

The crow gave the swan all its black feathers and so the swan thanked it and covered its body with the crow’s feathers.

And so it became a black swan.

I will always remember those days when the black swans were abundant here around Nerong and the Broadwater.

Perhaps one day they will all come back.

DEAR News Of The Area, IT is amazing to see that after all the floods along the East Coast, the Hunter Central Coast Joint Regional Planning Panel is still considering a 691 residential lot subdivision of the wetlands in front of Coles and alongside the Skate Park.

Thank You for the support DEAR locals, IT has now been two months since the local election, and I wanted to acknowledge and sincerely thank the many locals (2000+) for your support.

It was a very challenging time but positive change was achieved and open access to all our local government representatives and MidCoast Council services has and will continue to improve.

I remain a local resident strongly committed to progressing our stunning local area and volunteering in several of our wonderful community groups.

The ‘Peter Epov Group’ was only formed for the local democratic election which is now over.

Flood risks at Parry’s Cove 2022 at 4pm.

This subdivision is now known as Parry's Cove but was the original Riverside application which was turned down.

Nothing has changed, just it has been resubmitted with a few less houses.

Before any development starts 0.9 meters of earth is required to fill the area.

What does this tell you?

There is no mention as to where this earth is to be sourced nor how it is to be transported into this area.

I'VE met a wonderful lady, but I seem to have an allergy to something in her home.

Each time I go there I develop red eyes, wheezing and sneezing.

I now have to take an antihistamine before I visit, which is not a long-term solution.

There are so many options of what it could be - plants, her beloved dog, her casual approach to cleaning and the candles and incense she burns.

How do I delicately approach this, and perhaps start to remove some of these items one by one to work out the issue via a process of elimination?

Approximately 50 to 100mm of rain is all that is required to flood this area, add roads and house roofs to this mix and all their little retention dams will overflow.

Rainfall of 200mm locally, 200 mm up river at Bulahdelah and a high tide might one day make the Myall River flood into this area, I wonder what the insurance premium will be for a property here?

There is ample land on the rise behind me on Shearwater Ridge which does not flood. Why risk flooding in the lowland below which is only going to get worse if you believe in climate change?

WELL, this is a bit of a disaster.

You've finally met someone you really like, but there seems to be a few more incompatibilities that we should address.

This woman sounds to me as though she has a rather easy-going approach to life, and your process of elimination comment is a bit troubling.

If you were simply eliminating a grevillea, or perhaps avoiding her home during the height of springtime pollen production, that would be understandable.

But when you start mentioning her beloved dog in the same sentence as having a dig at her housekeeping skills, I fear that once the giddy joy of those early romantic days subsides, your world will start to crumble.

All you will be left with is a woman wearing yoga pants, chanting affirmations through clouds of sandalwood smoke, while her Burmese Mountain Dog, Clarise, licks the breadcrumbs from her plate, while you, Geoff, are in the corner in a Hazmat suit, surrounded by HEPA filters, rolling a lint brush down your pinstripe suit to remove dust mites and dog hairs.

Geoff, if my intuition doesn't fail me - and it rarely does - I feel that the only process of elimination that will be taking place in the very near future is the elimination of you.

Chin up, though.

There are plenty of clean freaks in this world.

Maybe you just need to throw a few more keywords into your dating profile your love of gleaming benchtops, hospital corners and cleaning between tiles with a toothbrush should filter out some of the less suitable candidates.
