A MAN has died after a two-vehicle collision at Tea Gardesn this week.

At about 4.50pm Monday 6 July, emergency services were called to the Pacific Highway, at the Myall Way intersection in Tea Gardens, after a white Suzuki Jimmy and white Hino rigid tabletop collided.

The driver of the Suzuki, a 90-year-old man, died at the scene.

The driver of the Hino, a 24-year-old man, was not injured and participated in a roadside breath test that returned a negative result. He was taken to the Mater Hospital for mandatory blood and urine testing.

Officers from Port Stephens-Hunter Police District attended and commenced investigations.

One southbound lane of the Pacific Highway, and the right-turning lane, northbound into Myall way, were closed for a short time.

The Hino was transporting two steers at the time. The animals were not injured in the collision.

Ms Smith explained the motivation behind the idea of having Wellington come to visit, “The residents have former connections with draft horses.”

“They grew up with them doing farm work.”

“Noel, one of our residents was a baker who used a draft horse cart as a bakery cart.”

Jayden Beesley the owner of Wellington and W and C events said, “The Clydesdales are particularly important for the older generation because they used them on their farms and they drove them to school for example.”

Ms Markham explained why she believed Wellington was such a hit, “The horses really pick up on the feelings of the elderly.”

“The connection with the horse and the elderly people is amazing to watch.”

The Clydesdale visit was not only fun but had obvious benefits for the elderly residents of the home. Ms Markham observed, “A lot of the residents usually aren’t as animated as they are today, usually they are very quiet.”

“They are just beside themselves.”

“Jan McDonald our one-hundred and two-year-old just couldn’t keep the smile off her face.”

Colin Mitchell, an eighty-four-year-old resident of the Home told News Of The Area, “It couldn’t have been any better.”

“It makes me remember how my Wife and I used to holiday at a ranch with horses.”

Dune rescuers work around COVID crisis

Having not been able to work since the onset of the COVID-19 crisis, the 15 volunteers were faced with a mammoth task when they gathered at The Boulevarde in Winda Woppa, Hawks Nest.

Invasive bitou bush had grown wide and high, smothering the dunes while the red-topped mother-ofmillions weeds were in full bloom and out of control along the roadside of The Boulevarde.

The volunteers found it was hard and difficult work cutting and poisoning the bitou bush at ground level, to leave the roots to help

Myall river sand dredging win for community

By Sandra MURRAY FOLLOWING a boat side inspection of the lower Myall river sand dredging site, Local MP Kate Washington declared, “The sand dredging is a win win for the community, restoring the health of the Myall River and building a stockpile of sand to replenish Jimmy’s Beach.”

The active local MP was accompanied by Rick Wraight, from the local Chamber of Commerce, Andrew Stanilands, the MidCoast Project Manager, and local advocate Gordon Grainger.

Kate Washington added, “I thank the community for its sensible and strong advocacy, without it this would not

be happening. I also thank MidCoast Council for gaining the necessary approvals and funding, then making it all happen. It was terrific to see the progress that’s already been made and I’m sure the entire community is looking forward to seeing it completed.”

The MidCoast Council’s dredging operation in the lower Myall River is now over one month into the 27 week project and progressing well with 27,000 cubic metres of sand removed from the eastern channel to date.

A total of 120,000 cubic metres of sand will be removed from the channel over the 27 weeks of the project.

The build-up of sand over time has resulted in several shallow zones throughout the channel which impede the

ability of boats to move safely along the eastern channel.

Dredging will improve navigation through the channel for all boat users The excess sand will also benefit the Jimmy’s Beach community by supplementing the Winda Woppa stockpile, combating erosion via the sand transfer system.

Andrew Staniland, the Coastal Management Coordinator for MidCoast Council added, “As of 26 June 2020, I can confirm that the dredge has moved 27,000 cubic metres to the Winda Woppa stockpile. The dredge contractors have experienced some blockages, however, are managing to average 1,000 cubic metres daily. The dewatering and stockpile management is working perfectly, with clean clear water being returned

the project is $1.7million, Council successfully received $850,000 in funding through the NSW Government’s ‘Rescuing Our Waterways’ program, to cover half of the costs.”

Boat users are advised to be aware of changed conditions in the area during the works period, including underwater, anchored

pipelines and limited thoroughfare in the channel.

A second closure of the boat ramp will be required at the end of the dredging, which is expected to be in October.

The Court requires proof of death before allowing a person to manage their assets. In a recent case, of Estate of Lyn Burtonwood [2020] NSWSC 715 tragically a man went swimming in the ocean and was not seen again. The Coroner after an inquest determined that the man had died by drowning.

A death certificate was issued. A question arose whether due to the lack of finding a body, death was to be “inferred” or “presumed” This makes a difference legally because if death is only presumed restrictions apply in relation to distribution of the estate. In this case, the Judge was prepared to find that the evidence was “clearly supportive” of the conclusion, notwithstanding no body having been

located, that the deceased had died on a particular day.

The findings of the coroner and the evidence in support pointed convincingly to the deceased having died within a short period of having gone swimming.

There was also no evidence of a motive to disappear as would justify the inference that he might have set the stage, elaborately, to give the impression that he had come to his death by drowning. Whilst thankfully these types of situations are rare, we usually include a provision about presumed and inferred deaths in the Wills which we draft just in case. This is because if a married couple go missing together in similar circumstances, issues arise as to who died first even if the fact of death is accepted.

Drive through COVID-19 testing clinic

TRIPLE C Health Family Practice Karuah has opened a COVID-19 drive through testing option.

The Practice requires patients with concerning respiratory symptoms to first call ahead and book a phone consultation with the GP to determine their eligibility for testing.

“All low risk patients will be offered testing locally and those who are high risk or needing urgent care will be referred appropriately to other facilities or hospitals for review,” said Dr Sita Dewamitta, Principal GP at Family Practice Karuah.

“It’s part of our commitment to providing COVID-19 diagnostic services to the community to help prevent a second wave.”

Patients who are offered a drive through COVID-19 testing will be asked to drive into the car park immediately outside the side door of the Practice and inform reception of their arrival over the phone while remaining in the car.

“I’ll attend patients with PPE cover through the side door of the Practice and perform the test to avoid exposure of any patients with possible symptoms to myself, other patients,

and Practice staff,” said Dr Dewamitta.

All patients will also be first counselled over the phone prior to any testing with information on what to expect and an action plan for either positive or negative testing.

Dr Dewamitta continued, “We are all committed to delivering COVID-19 results as a priority and to ensure continuity of care to patients with appropriate further management.”

The Mid North Coast has had 52 cases of COVID-19 since the start of the pandemic, with one life lost.

Dear News Of the Area, THE facts of the cause of justified community concern regarding the additions to the Tea Gardens Police Station should be considered.

A development application was submitted to MidCoast Council by the NSW Government for consideration, which was approved by delegated authority, where Council staff did not put the matter on public display for public comment and input, denying the voice of our community.

There is no doubt that changes would have been made to make the structure blend with the current buildings and amenity of these locally heritage listed public structures, and such amendments would have filtered through to the NSW government for amendment prior to approval.

The responsibility for this fiasco lies squarely on our elected Councillors who have permitted this system to evolve. An example of another recent DA approval by delegated authority is to demolish the heritage listed Tea Gardens Slipway winch shed by the Tea Gardens Slipway

“When it went to air that July it was the same time that the supermarkets had introduced a ban on lightweight bags yet one chain kept giving away the thicker plastic bags for free. “NewSouth publisher Elspeth Menzies was so disappointed with the decision she emailed me the next day to discuss it and the rest is history,” she said.

Joanna Atherfold Finn told News Of The Area, “I missed the Fremantle book launch due to COVID-19 border restrictions, but thanks to technology I was able to watch it and it was a wonderful celebration of not only the book, but the 10 year anniversary of Plastic Free July."

Finn’s previous book Watermark is a work of fiction, one which creates characters and takes the reader through short stories with a coastal theme.

This book is very different, taking the reader to a place where we can be better than we were.

“Plastic Free July is an accessible challenge, which is part of its appeal.”

Finn expounds the benefits of being single-use plastic free and admits that it takes time to make these changes and to make them a way of life.

She hopes others will be inspired to use less single-use plastic after reading the book and also hopes they will get involved in local plastic-free initiatives like Plastic Free Port Stephens.

One story that really hit home for Finn was the destructive nature of plastic on Lord Howe Island’s flesh-footed shearwaters.

Mmm. Look I feel your pain. There's nothing worse than a mum that takes on something new, because mums tend to go into these ventures full tilt. My kids are still unrolling their t-shirts and trying to unknot their underwear that I'd turned into origami swans during my Marie Kondo phase. The casual Buddhist attempt didn't end well either.

But let's look at this from your mum's point of view. It's Plastic Free July and though it may be a bit challenging for you, she's trying to do her bit for the environment. Since you live in Anna Bay, a fantastic part of the world, I bet you really enjoy swimming and surfing and riding your bike on all the amazing bush tracks. What your mum is doing, along with lots of other people, is trying to help keep the bush and the ocean and all the amazing creatures that rely on the environment, including us, happy and healthy.

It may be a bit of a challenge for you, but maybe you could come up with just one way to reduce plastic that will keep your mum happy and let her know you support her. You mentioned there are no snacks in the house and that's because your mum would have tried to buy snacks but realised most of them are packaged in layers of plastic, so you could maybe have a bit of a baking session with her.

You won't be starving and your mum will be so thrilled that maybe she'll splash out on a shampoo bar from the health food shop or supermarket instead of the vinegar option (tell her it's a plastic-free option and she'll be super impressed).

Another thing you could do is bribe her.

Say, 'Mum, I'll support you and Dad with this plastic free thing, but I want the money from the bottles you take to the recycling centre or I'll call you out on social media by letting everyone know that 95 per cent of them are from alcoholic beverages.'

I reckon your mum will be totally up for that sweet little deal, SF, and I won't say it was my idea, or make any mention of the fact it's also Dry July, as long as you don't buy anything that's single-use plastic with the proceeds.

Respiratory masks for local Fire Brigades

By Ashley CHRYSLER SYDNEY Mother and cancer survivor, Ophelia Haragli, has raised more than $600,000 to purchase special respiratory masks for local fire services across Australia, including the Myall Coast’s Medowie and Bulahdelah Rural Fire Brigades.

“So far I’ve been able to distribute more than 5,000 respiratory masks to those in need in NSW alone,” Ms Haragli said.

“I put a post up on Facebook for people to get in contact with their local Brigade to see if they were interested in receiving respiratory masks and the response was huge, with Captains and even family members of

MIDCOAST Council has welcomed the news that the NSW Government is introducing annual permits for non-desexed cats and restricted dangerous dogs, as a way of encouraging responsible pet ownership.

From, Wednesday 1 July, owners of cats that are not desexed by four months of age will be required to pay an $80 annual permit, in addition to their one-off lifetime pet registration fee.

Annual permits for non-desexed cats will create a stronger incentive to desex cats, which will in turn improve their health and wellbeing, including reducing the risk of some cancers.

Improving desexing rates will also lower demand on pounds and shelters, reduce euthanasia rates and help to address concerns about feral, stray and roaming cats and their impact on local wildlife.

“This is great news from our perspective because anything that promotes responsible pet ownership means less animals in the pound and more information is available to us about the pets in our area,” said Bruce Moore, MidCoast Council’s Manager of Development Assessment.

Similarly from 1 July, owners of dogs of a restricted breed or formally declared to be dangerous will also be required to pay a $195 annual permit in addition to their one-off lifetime pet registration fee.

“We hope this will serve as a further disincentive to owning high-risk dogs and encourage owners to better manage the behaviour of their animal,” added Bruce.

“We see too many dog attacks in our region, with a serious attack happening only last week so this is more positive news to help us try and bring this number down.”

From today, local pet owners will be able to pay for annual permits using the NSW Pet Registry website or through MidCoast Council.

Anyone registering a cat on the NSW Pet Registry will be informed that they must pay for an $80 annual permit if their animal is not desexed by four months of age.

Annual permit fees will go directly to the Companion Animals Fund which pays for companion animal management by local Councils including pounds/shelters, ranger services, dog recreation areas, and education and awareness programs.

The fund is also used to operate the NSW Pet Registry and carry out responsible pet ownership initiatives.

As a breast cancer survivor, Ms Haragli was shocked to learn how difficult it was to actually use the traditional P2 masks, and how ineffectively it protected firefighters.

“I started doing my own research on the impacts of bushfire smoke and saw that it can cause cancer so that was right up my alley,” she said.

“Fighting fires has mostly been done using P2 masks, so many of the firefighters I’ve spoken with didn’t even know about these types of respiratory masks.”

The Bulahdelah Rural Fire Brigade were chuffed to receive a batch of masks, hand delivered by Ms Haragli herself, and posted on Facebook, “This afternoon the Brigade was privileged to receive a gift of 23 respiratory masks worth in excess of $2,000 from a wonderful lady named Ophelia from My Sisters Keeper.”

“We truly appreciate this gift.”

Ms Haragli has delivered nearly 75 masks to Medowie and Bulahdelah Rural Fire Brigades, and hopes that the RFS, who is now conducting their own review of P2 respiratory masks, will be able to continue the work that she has been doing.

Jean Ryan, volunteer delivery driver for Meals on Wheels

By Brooke LYNCH ON Wednesday 1 July the Tea Gardens and Hawks Nest Meals on Wheels hosted its annual morning tea at the Hawks Nest community hall as a thank you to its thirty-five volunteer delivery drivers.

Manager at Meals on Wheels told News Of the Area, “Today we are having a morning tea specifically for the deliverers of meals because each day in the kitchen the staff and the volunteers get to sit around having morning tea and enjoy each other’s company, but the deliverers don’t get that

“Because of this, once a year in the middle of the year we like to give them morning tea so that they can get together and chat and laugh as well.”

Ms Rae explained how important the role of the volunteers is to the operation of Meals on Wheels, “Basically we couldn’t be a service without the volunteer deliverers and kitchen staff.”

Ms Rae told News of the Area, “We want to thank our volunteers very much because they do a fantastic job and we can’t do it without them.”

Judy Poole has been a delivery driver with Meals on Wheels for over three years and said what appeals to her about the organisation is the social interaction she receives, and the satisfaction of providing a valuable service to the community; “It’s a great group of people.”

“I have never seen so many people care about what they are doing.”

“From a delivery standpoint it's about making contact with the people who need it.”

“It is about having a five- or tenminute chat with the clients.”

“It’s really nice touching base with our clients, it’s just a joy.”

“Many of them really depend on Meals on Wheels for their food.”

Meals on Wheels has been active in the Hawks Nest / Tea Gardens community since the mid nineteen eighties and Jean Ryan is the longest serving delivery driver.

Jean has been volunteering for the organisation for approximately thirty years.

Fishers and marine life are already reaping the benefits of that pile of rocks and recycled oyster shells that were moved from the old Tea Gardens ramp to the entrance of the Myall River earlier this year, according to the NSW Department of Primary Industries (DPI).

The rocks and shells form part of the Oyster project currently being piloted in the lower Myall River.

It uses one of the area’s historical industries, oysters, to boost the river habitat.

The recycled oyster shells were collected from oyster farmers located within Port Stephens, to ensure diseases are not introduced from other estuaries.

Oyster reefs once covered large areas of the local marine environment, providing habitat and food for fish, invertebrates, and other marine life.

Many were lost over time due to over harvesting, habitat removal, dredging, water pollution and disease.

DPI Senior Fisheries Manager, Kylie Russell, stated, “The project placed 3,300 tonnes of rock and 180 cubic metres of recycled oyster shell on two restoration sites, creating more than 10,000 square metres of reef base for oyster colonisation. Researchers have already documented fish and invertebrates utilising the new

reefs and settlement of oysters began within days of the rocks being placed,” The restoration of oyster reefs is part of the NSW Marine Estate Management Strategy (MEMS).

A True Gentleman VALE JOHN FITZGERALD A SCHOLAR AND A GENTLEMAN 1928-2020

By Lyn CHAIKIN THE family and friends of the late John Fitzgerald recently gathered at lunch to reminisce and celebrate his interesting and well lived life.

John was an active member of the U3A till his death. He was a true renaissance man. His knowledge on many subjects was deep and till the day he died, his curiosity, love of life and belief in people did not diminish.

John was born in England and like many young children from London he was sent to the country during the war. His education was cut short and although he managed to resume his studies in later years, he continued learning all his life and never lost his thirst for knowledge.

He joined the navy and travelled to many countries. His shipboard stories are legendary. John and many other young sailors decided

that they would possibly move to Australia which they saw as the land of great opportunity.

After a few years back in England, John returned to Australia with his beloved wife, Kay. His second love of life was the world of film and he made many films for the Australian Coal board. Later, he branched out independently and made other films. He won awards for his films about Sri Lanka and the official documentary on the building of the Opera House. John was a a leading member of the Myall U3A and delighted his audiences with his presentations on film making in all its genres.

Sadly, Kay became an invalid and John nursed her for several years before she died. Even when John's health was failing, he travelled with his son and grandchildren to Europe. He never lost his thirst for knowledge and his love of life He will be lovingly remembered by all his friends, especially those at the U3A. He is survived by his children, Helen, Mark and Kevin and his eight grandchildren. John was a true gentleman and a man of the people.

He will be remembered lovingly by his U3A family and all his friends who crossed his path.

TEA Gardens Transfer Station, known by locals as the ‘Tip’, has received a new weighbridge system, traffic light and set of rules to follow when visiting.

Amy Hill, MidCoast Council’s Waste Program Coordinator, said that the Tea Gardens Transfer Station is an Environment Protection Authority licensed facility, and one of the conditions of holding this license was to install a weighbridge by 30 June 2020.

“Council is required to ensure all visitors are weighed in and out of the facility from 1 July, and this new system is a ‘user pays’ system where residents are charged per kilogram/tonne of waste rather than a set

“Generally, people will find that their tipping fees will go down as the per load fee is based on all trailer loads having 300kgs of waste/green waste on it, and most residents drop off substantially less than that in weight per trailer.”

David Lyne, owner of Home and Property Maintenance in Hawks Nest, said that while it may benefit residents, that’s not the case for business owners such as himself.

"It's probably good for Council revenue, but not for ratepayers and small businesses like tradies."

"Up until now, it used to cost us between $37 and $70 to drop a trailer load of building debris at the local Tip.”

“Now, with a box trailer weighing 750kg it will cost around $170 to $300 per tonne - so an astronomical increase in waste disposal costs.”

“I’ll be driving the 45 minutes now to the Stroud landfill.”

Unfortunately for those simply wanting to visit the tip shop, visitors can only access the car park onsite by going over the weighbridge which means waiting in line with those being weighed.

Ms Hill continued, “We are investigating a range of alternative options to try to alleviate this issue, including opening the site for longer hours on Sundays, opening the tip shop in the mornings, or opening the site on Saturdays.”

Much needed practice Tea Gardens Men’s Bowling Club

By The JAFFA 1 July: Bowlers were allowed access to the Country Club building today after what seems like an eternity.

What a pleasant surprise indeed. The Club has had a makeover and it certainly looks a treat.

Although restrictions were in place the staff at the Club went out of their way to ensure players followed instructions and from all appearances everything went smoothly.

It was nice to have a draught beer for a change!

Around 30 bowlers participated in a game of three-bowl Pairs over 21 ends in near perfect conditions.

As there were no prizes, the winners have bragging rights only.

There will be a similar format next week.

3 July: The good winter weather held for players to enjoy some much-needed

practice on the grass with the anticipated resumption of the Club Major Pars competition scheduled for Saturday 11 July.

For those who may not remember, it was so far away, the resumed draw will see the following matches: Ross Barry and Danny Johnson vs Jeff Baker and Ron Green Greg Smith and Noel Jackson vs Leigh Hunt and Neil Kibble Dave Garcia and Bob Weir vs Keith Smith and Bill Thrift Gary Wynne and Dave Benson vs Luke Gliwa and Stew Sturrock Col Saillard and Dave Perry vs Bob Peady and Doug Naylor.
