By Ann SCULLY OVER one hundred and fifty generous, community minded people attended a fundraising evening which was held in the Masonic Hall last Saturday to gather funds to be placed into a Trust Fund for ten year old Jack Nolan whose Dad, Pete Nolan, sadly passed away a couple of months ago.

BUSH fire season is fast approaching and it is time to make sure that all households have a bush fire plan.

Port Stephens has many areas of bushland and properties adjacent to high risk areas for bushfires.

The environment and climate create a risk to lives and property.

Our actions in the lead up to bush fire season can make all the difference.

A recent decision of the Supreme Court of New South Wales, has found that media companies could be liable for defamatory comments made by readers, concerning news stories posted on corporate Facebook pages.

The plaintiff, Dylan Voller, is a former youth detainee whose treatment in custody triggered a Royal Commission into the Protection and Detention of Children in the Northern Territory.

Mr Voller commenced proceedings for defamation against a number of media companies, based on comments made by members of the public on 10 Facebook posts made on the companies’ public Facebook pages in 2016 and 2017. Mr Voller alleged the comments contained false and defamatory imputations. Mr Voller argued that the media companies were responsible for the comments made by members of the public on the Facebook posts.

To be liable for defamation, you must publish something that is defamatory. It is well recognised that the publisher is not necessarily the author of the defamatory content. The question considered by the Court in this case was whether Mr Voller had established that the media companies had ‘published’ the comments.

Justice Rothman held that the

media companies were primary publishers of the comments by members of the public on the news stories posted on their Facebook pages. He found that media companies have a commercial imperative for posting on Facebook, that being to increase reader engagement thereby allowing them to charge more for advertising; and as such they assumed the risk of potentially defamatory comments.

He found that as media companies have the ability to review comments that might be defamatory before they are made visible to the public, they have control over the comments that are posted, and cannot escape the consequences of their actions by turning a blind eye to it.

Justice Rothman considered that as the articles posted by the media companies in this case related to an emotive issue that could trigger strong positions on both sides, including unreasonable positions, the media companies were aware that comments were likely to include defamatory material.

This decision highlights that businesses that operate public social media pages, should ensure they have adequate measures in place to moderate and review comments on their posts by third parties, particularly if posts are on emotive or controversial issues.

Traversing a Koala Friendly Wooden Fence

KOALA Survey, Part Two In November, Koala ecologist George Madani will be back in our towns to do further koala surveying to add to the wealth of information he gathered last year.

As well as that, George will present to the entire community the results of his surveys in a public meeting on the afternoon of 7 November.

Details of exact time and place will be announced a bit closer to the date.

30th Anniversary Coming Up

Now in its thirtieth year, the Myall Koala and Environment Group has decided it is a good time to re-evaluate the work it has done in the past and develop a “Strategy for the Future”.

One of our members, David Ingram, who is a skilled business strategy facilitator, recently lead our members in a Strengths, Weaknesses, Opportunities and Threats (SWOT) analysis of the Group’s activities.

Many of our members were surprised at how many activities the Koala Group is involved in but also were concerned about

some of the challenges we face in the future.

The result of the session was a list of many activities we do well, some not so well but, more importantly, new ideas we can embark on. The next stage will be to prioritise the tasks needing action and then establish small working groups to address immediate concerns.

Winter Koala Sightings

As is usually the case, koala activity has been very quiet over winter. In fact, only 5 koalas were reported to us in the last three months, including the one in the photo who was using the top of a timber fence to traverse from Yamba to Binda Streets.

Larger University presence for MidCoast LGA MIDCOAST Council has welcomed news a steering committee is to be formed to support the development of a larger University presence in the MidCoast LGA region.

The announcement by Federal Member for Lyne Dr David Gillespie MP last week, showed that he will be working with key stakeholders to secure funding for greater educational

opportunities in the MidCoast is good news, according to Mayor David West.

“The opportunity to advocate for a strong university presence in our Council area is something I believe strongly in,” Cr West said.

MidCoast Council has indicated they will support the push to provide greater opportunities for both high school leavers and mature age students.

“We look forward to being part of this exciting process to work with Dr Gillespie to deliver both educational opportunities and regional economic benefits to our community.”

Cr West said the possibility of a University presence in Taree was also an opportunity to use Council’s Pulteney Street office, once administration functions centralise to Biripi Way, Taree.

“To use this central location for the benefit of the community would be a great outcome.”

Council will be represented on the Taree Universities Campus steering committee established by Dr Gillespie to progress the initiative.

Centralisation Efficiencies are gained not only in costs but also productivity if the main back office services are centralised.

Council saw the opportunity to purchase the Masters building at Taree for $7m some $20m under construction cost. The fitout and relocation costs will be $20m. The funding will come from merger savings, loans paid by commercial rent returns and sale of existing land/buildings. Rates will not be used towards the building or fitout. In addition the once the centralisation occurs it is estimated to save$3m a year which will be used for services to the ratepayer.

The efficiencies will be a dividend to the ratepayer.

There are many inaccuracies being promulgated by those opposed to the project. Such as, staff will have to ravel further to work, which is true for some but not the majority but most workers travel for work. The true cost is $40m for a tin shed. Neither is true. The building is a concrete wall slab construction and built to a high standard. It has concrete polished floors and a standalone power supply and air-conditioning. The ratepayers will be disadvantaged. Probably 90% of ratepayers never attended the main offices in Taree or Forster. For those who do need to travel from the North, South or West will have much easier access. For us it is quicker and easier to go to Taree but when was the last time you went to the Forster Office? All town and village areas especially Forster will have an administrative hub whereby one can attend.

The whole project has undergone rigorous scrutiny .The Office of Local Government has announced that council has undertaken appropriate processes.

The icing on the cake however, is that, Dr Gillespie has announced the creation of a tertiary education precinct for the MCC area.

The possibility of a university presence in Taree is also an opportunity to use Council’s Taree office, once administration functions centralise to Biripi Way, Taree (Masters).

By Ann SCULLY SPRING into Summer 3, Lions Charity Fashion Show, will be held on Sunday, 22 September 2019 in the Auditorium at RSL LifeCare (The Grange), Tea Gardens with this year’s focus on raising much needed funds for their chosen charity, The Isabella and Marcus Foundation.

This Foundation is a charity which was established by two families whose children, Isabella and Marcus, had passed away after suffering with Diffuse Intrinsic Pontine Glioma which is the most aggressive and deadly of all childhood cancers, randomly striking normal healthy children at an average age of five to ten years.

In Australia, brain cancer receives less than 5% of Federal Government cancer research funding with numerous charities allocating around 1.4% to paediatric cancer and largely the majority of the funding for paediatric research is raised privately by bereaved parents, families and friends.

Westmead Children’s Hospital announced in July 2018 that it was conducting Australia’s first clinical trial for paediatric brain cancer funded by a joint commitment of $400,000 from privately funded charities, Cure Brain

Cancer Foundation and the Isabella and Marcus Foundation.

This year, the Lions Charity Fashion Show will be supported by BTS For Fashion, Ellas Boutique, Little Faith, Vitamin Bead, Circle of Friends, Mungo Road, Salty Lane and Alanas, all of whom will be showing their individual style on the stage along with accessories, with all models having their makeup done by Annette from Basic Beauty and music supplied

by Jomeca.

Woodwards Nursery and Garden Centre will be supplying plants and foliage for decoration and these plants will be on sale at the end of the show.

Co-ordinator of the Fashion Show, Carole Richards, told News Of The Area, “I staged my first show in 2016 mainly to create a general awareness of all the wonderful retail outlets that are operating in our small community and the main thrust was to bring those businesses together to work cohesively in an effort to raise funds for our given charity at the time.

“Our local Lions Club supported my enthusiasm and efforts in organizing the Fashion Show and I must say that I really enjoy working with the many volunteers, both on and off the stage, who are keen to be involved in the

Burn N Carrot

BURN N Carrot is made up of two musicians based in the Hunter Valley town of Muswellbrook. Craig “Burnout” Daniel is a drummer who has been playing in Rock Bands for the past 25 years, and Darryl “Carrot” Bowen is an acoustic guitarist and vocalist who has been doing solo gigs around the Hunter Valley since 2010.

They came together to join a dynamic duo in 2014 after recording a couple of successful originals with their band Carrot Bowen & The Collective.

With Burnout on his electronic drum kit and backing vocals and Carrot playing his acoustic guitar along with his vocals, the

duo has built up quite a following with their covers of songs that range from old classics, country rock to modern day pop songs, giving all the songs their own little spin.

They have a number of songs in their repertoire that can cater for all types of crowds. From easy listening to upbeat song to have you dance the night away.

They do pubs, clubs and private functions. You will not leave disappointed from a Burn N Carrot show.

TUESDAY 20th August: Social bowls plus Round 1 of the Club Championship Triples Competition. On Rink 1 Lorraine Murphy, Maynie Roberts and Kayelene Pearson v Jeanette Emmett, Dot Dallas and Maureen Campbell. This game was fairly even just a 2 shot difference in the score on the 9th end, Kayelene's team leading. By the 15th end they had increased they lead by 8 shots. Maureen's team reduced the difference to 4 shots on the 18th end. Just 3 ends to bowl the game could have gone either way, victory to Lorraine, Maynie and Kayelene 22 v 16. Judi Polak, Lynda Richards and Elizabeth Kelly led all the way against Pam Gilchrist, Jill McBride and Kathie Rimmer winning 21 v 12. An interesting contest on Rink 5 Sheril Johnson, Jean Glover and Karen Green starting strongly against Ingrid Luck, Robyn Webster and Karen McPhie. They had a 6 shot lead on the 6th end, but by the 10th end the score was "even Steven", all on 9. By the 16th end Karen McPhie's team were ahead by 6, the next 3 ends belonged to Karen Green's side amassing 7 points. The score on the 19th end the Green team 18 v the McPhie team 17. The result on the 21st end a win for the Green team 21 v 20, a very exciting game of bowls. Thanks to Ron Green for umpiring. Social bowls, a game

of Pairs Lyn Nightingale and Bev Rhodes 16 v Jan Coomer and Sandra Leisemann 13. The winner of the voucher to the Myall Bistro & Café was Ingrid Luck.

Thursday 22nd August: Round 2 of the Triples Championship bowled in very difficult weather conditions, wind gusts of up to 60km/h. Sheril Johnson, Jean Glover and Karen Green were" holding their own" v Lorraine Murphy, Maynie Roberts and Kayelene Pearson till the 9th end but Kayelene's team proved too strong winning 23 v 11. Bev Rhodes, Sandra Leisemann and Lynne Green led all the way and claimed a win on the 20th end in their match against Lynda Richards, Judi Polak and Elizabeth Kelly 27 v 13. The winners from today will compete in the final of this event on Tuesday 27th August, this will be a thrilling game of bowls. Thanks to Kathie Rimmer for umpiring. Results for social bowls, Margaret Wigman (swinger lead), Judy McGavock and Maureen Campbell 12 v Margaret, Ann Remment and Jill McBride 9.

Weekend Pennants resumes next Saturday 31st August, at Soldiers Point this is the final game, prior to the Post Sectional Play-Offs. TGWBC are currently winning in their Section so hopefully will be in the PlayOffs scheduled for 14th and 15th September, venue to be advised.

Leon Bobako winning Gold in all disciplines of Breastroke,

To keep up the training regime during these months Leon and Peter regularly travel to Raymond Terrace or Maitland pool for training.
