for the historical use of the river to be the inspiration for the names, rather than early settlers' names.

The Progress Association, along with other prominent groups in the area have put forward three name options for the three wharfs, all located on Marine Drive, two of which are public wharves and the third being the ferry wharf.

Two of the names – ‘The Salamander’ and ‘The Ability’ pay tribute to the paddlewheel droghers that were introduced in the early 1900's to replace the punts.

Both these droghers used mooring sites where the current public wharfs are now located.

The third name, the Yalinbah, is suggested for the current ferry wharf in memory of the vessel which plied the Port, River and Lakes with groceries, mail and passengers and locally known as the Yally from 1927.

A pop-up session was held on 26 November at the ferry wharf on Marine Drive, on the grassed area opposite the waterfront.

This session gave locals the chance to meet with Council staff and members of the Progress Association to discuss the current

Better Access through whole MidCoast Region THE Community has collectively voiced its desire for greater pedestrian and mobility access and improved footpath and cycleway connections across the region and MidCoast Council is listening.

In their community conversations this year, towns and villages from across the MidCoast were united in their desire for greater pedestrian and mobility access, and improved footpath and cycleway connections, leading Council to work towards the development of a Pedestrian Access and Mobility Plan (PAMP) and a Bike Plan.

As a result, MidCoast Council has engaged specialist consultants, Stantec, to undertake an independent review of the region’s pedestrian and cycle routes.

Stantec has considerable experience in the delivery of traffic and transportation projects across all stages of the project life cycle including planning, development and implementation.

Once they review the existing pedestrian, cycleway and access plans, they will determine the future pedestrian and cycle key routes as well as identify opportunities for developing and enhancing pedestrian and cycle related activities and attractions for community members and visitors.

The first part of this project involves meeting with locals to identify each community’s priorities for pathways and this will be done at a range of community meetings.

This input will then be used to develop a Pedestrian Access and Mobility Plan (PAMP) and a Bike Plan.

“We’ve heard loud and clear that pedestrian and mobility access, improved footpaths and cycleways are a priority across the region,” said MidCoast Council’s Director of Infrastructure and Engineering Services, Rob Scott.

“The development of our Pedestrian Access and Mobility Plan (PAMP) and Bike Plan will enhance the sustainability and liveability of the MidCoast local communities and enable pedestrians, cyclists and motorists to interact with consideration and safety.”

Together with MidCoast Council, the Stantec team invites all MidCoast locals to be part of this important conversation and share ideas for Pedestrian Access and Mobility in their area.

The recent case of Dee Vine Group Pty Ltd v Palais Reception Centre Pty Ltd [2019] NSWSC 1462 has provided useful judicial guidance as to the requirements of a valid Notice of Breach of Covenants under Section 129 of the Conveyancing Act 1919.

Kunc J reinforced the position found in International Health Clinic Pty Limited v South Sydney West Area Health Services [2010] NSWCA 268 where it was found that a valid Notice of Breach of Covenants under Section 129 must not only allege breach, but must also: • describe the particular acts or omissions constituting the allege breach, and • indicate the acts of the tenant which the landlord would consider sufficient for the Lease to continue and on completion of which the landlord would abandon its claim to forfeit.

The standard of particulars or degree of specificity depends on the circumstances, including the nature of the covenant alleged to be breached, the tenant’s actual constructive knowledge and whether the landlord claims reasonable compensation.

Kunc J found that a Notice of Breach of Covenants must generally provide for a high degree of specificity in relation to the requirements of the Lessee to remedy the alleged breaches. For example, the required remedy to ‘cease playing of loud and excessive music from the premises’ was held to be too imprecise as it provided no guidance as to the precise kind of noise the tenant was to cease creating and provided no maximum noise levels measured in decibels and frequencies.

Further, the requested remedy to ‘regularly remove all trade waste, garbage or refuse from the premises’ was also found wanting for specificity as the concept of ‘regularly’ was too imprecise and should have been set out in respect of particular time periods or after certain events.

Accordingly, the contents of a Notice of Breach of Contents must be carefully considered and the Lessor’s specific requirements in relation to the remedy of those breaches set out with maximum specificity in order for the Notice to be upheld.

FEMALE koalas can live up to 12 or 14 years of age and can continue breeding until their final days.

Male koalas typically live a couple of years less due to their constant hunt for female partners and fights with other males in the process.

Females tend not to roam far from their “home range”, whereas males wander much greater distances searching for females.

We have one female koala in Hawks Nest that we have been following since 2009.

She was a mother then, so at least two years old.

She is therefore now 12 or more.

In 2009 we were called out to a sick juvenile koala in Karthena Crescent, Swan Bay and took her to Koalas in Care, Taree, who are

currently in the news because they are caring for so many koalas burnt in the bushfires.

Sadly, the juvenile died of unknown causes and the carers asked us to catch the mother so she could be checked out.

She was OK and returned to us with a green tag in her right ear. The residents from the house where we returned her named her “Princess”.

Since then, she has frequently been seen and recognised because of the green ear tag.

Sightings have mostly been in Swan Bay but for a while she ventured across Kingfisher Avenue as far as Mermaid Avenue.

GRID C Since 2009 she has born at least three more babies including “Louise” who became famous on national TV because she was so tiny when rescued.

Princess is still very active and has frequently been seen in Swan Bay this spring, including some mating activity in Koonawarra Drive and Monterra Avenue.

Jimmys Beach Ocean Race 2019

SWIMMERS from Germany added an International flavour to the 2019 Jimmys Beach Open Water Swim held Sunday 17 November.

Competitors chose either the 600m course, the 1500m Chris “Mobbsy” Mobbs Memorial Swim or both.

Publicity Officer from the Local branch of Masters Swimming NSW, Myall Masters Val Mobbs told News Of The Area, “This year we had 88 registrations in the 600m and 92 for the 1500m, all co-ordinated by Brad Jensen who did a great job from start to finish.”

With water temperature at 20 degrees and the tide rising with a slight westerly wind, the first squad of swimmers set off at 9.30am in

the 600m “warm up” race.

The wind picked up late morning and swung south westerly creating the real sense of an ocean race for the 1500m course swimmers.

Myall Masters has been part of the community for more than 14 years.

Most members swim two to three times per week for fitness and health.

Val said, “The beauty is you can make of it what you want set yourself a goal and go for it.”

There are plenty of interclub meets each

year plus there are pop-up events.

Some swimmers sign up to a Masters Swim Club to get ready for an ocean swim and then stay on because it’s social and good for their health.

This year’s First Men’s place in the major 1500m event went to Andrew Leese in a time of 21.47 with the First Women’s award going to Brinlei Baxter in 22.55.

Final of the Novice Consistency Tea Gardens Women’s Bowling

By Lynda RICHARDS TUESDAY, 19th November: The final of the Novice Consistency Competition, Bette Saillard v Judi Polak plus social bowls. Due to the extreme weather conditions play commenced earlier for the finalists. Great bowling by both competitors, unfortunately as always "there can be only one winner". Some stats on the contest neither of them scored a 10, out of the 24 ends bowled 18 were won by Bette, 4 to Judi and 2 were drawn. Judi conceded on the 24th end 140 v 100. Congratulations to Bette on her win. Thanks to Kathie Rimmer for Umpiring and Lynne Green for Marking. Social bowls played 3 games of Fours (Irene Roberts playing "swinger lead), these games were to be 18 ends but finished at 14 ends due to the hot weather/smoky conditions. A win for GOL100 Jan Coomer, Jean Glover, Jill McBride and Dale Winter 15 v Christine Fossey, Pam Gilchrist, Maureen Campbell and Loretta Baker 5. Leona Clissold, Bev Rhodes, Robyn Webster and Karen McPhie went from 4 all on the 7th end against Sheril Johnson, Dorothy Thompson,

Bev Stephens and Pat Baker to winning by 9 shots, 14 v 5. Irene Roberts, Ingrid Luck, Dawn Jones and Karen Green took the lead on the 6th end and never looked back, defeating Irene, Lyn Nightingale, Jeanette Emmett and Maynie Roberts 18 v 7. Winners on the day with the highest score were Karen Green's team. Everyone enjoyed lunch which was catered for by the Myall Bistro and Café.

Thursday 21st November: Our usual "12 end day", 2 games of two bowls Triples and a game of Pairs. On Rink 2 Trish Ward, Bette Saillard and Maynie Roberts 16 v Lynda Richards, Maureen Campbell and Karen McPhie. The score 16 v 8 hardly depicts how close this game was. On the 9th end 8 all then Karen's team scored a 4, a 3 then 1, 8 shots on 3 ends game them victory.
