MIDCOAST Council’s ordinary meeting will consider the annual operational plan, which will guide Council’s works program and allocate works for the 2020 – 2021 financial year period. The meeting will be (has been) livestreamed via Council’s website, from 2pm on Wednesday 27 May. General Manager Adrian Panuccio said the operational plan details the projects and services Council will deliver to the community for 202021, and includes the budget for the same period.

“Importantly, the plan also indicates how we will

measure our performance to show we are delivering on our commitments to our community,” Mr Panuccio said.

“We report on our progress against this program every six months to ensure we are on track, and this information is publicly available for our community so they can be informed on our performance.

The plan outlines the progress Council will make on a number of important projects during the coming year, including: · developing a climate change action plan

· revising and updating the emergency plan after the tragic bushfire events of 2019 · starting to deliver more than $2 million in Federal and State funding for bushfire recovery · developing the MidCoast environmental plan and development control plan, and · developing MidCoast Cultural and Aboriginal action plans.

“These projects, and a vast number of others, will be our focus as we continue to strive to deliver our mission of delivering benefits to our

community in ways that add value and build trust,” explained Mr Panuccio.

The annual budget is included in the draft plan and indicates that Council’s borrowing costs are trending downwards. The $100 million road program, funded jointly by the NSW Government and the final year of the 5% special rate variation (SRV), is included in the 2020-21 budget.

Council has kept other rates and charges to a minimum during the period of the SRV. The charges which will be pegged for this year include the water availability charge, sewerage charges and the domestic waste management charge.

“There has been no increase in the Waste Management charge since 2017 and sewer charges have not increased since 2018,” added Mr Panuccio.

Following the meeting the operational plan and budget will be placed on public exhibition for community comment.

Among other items on the meeting’s agenda will be the appointment of members to the Bushfire Recovery Reference Group, the adoption of the draft community donations and draft surveillance camera policies.

When an individual becomes bankrupt, subject to any contrary provision of the Bankruptcy Act, 1966, the assets of the bankrupt vest in the trustee in bankruptcy.

Those assets are then used to pay the debts of the bankrupt It follows that if a beneficiary of a Will is bankrupt when the testator dies, then the executor us bound to pay the entitlement of the beneficiary to the trustee in bankruptcy.

The inheritance is an asset of the bankrupt. If the executor fails to do so and pays the entitlement to the beneficiary (being the bankrupt) and if the trustee in bankruptcy becomes aware of the entitlement, then the trustee in bankruptcy will request the executor to pay the entitlement to the trustee.

If the bankrupt refuses to repay the entitlement to the executor then the executor is personally liable to make the payment to the trustee. It is therefore very important that an executor ensures that a

beneficiary is not bankrupt (or likely to become bankrupt in the foreseeable future) before distributing the estate.

If a person when making his or her Will suspects that one of the beneficiaries is bankrupt (or may become bankrupt), the Will maker should inform the solicitor making the Will, and receive advice as to the options available if the Will maker does not want part of the estate to be paid to the trustee in bankruptcy in the event that the beneficiary is bankrupt at the time of death. Further, if after a person makes his or her Will, he or she becomes aware that one of the beneficiaries is bankrupt and if the Will maker does not want part of his or her estate to go to the trustee in bankruptcy, then the Will should be changed to remove the bankrupt as a beneficiary.

It is important to act promptly.

MidCoast region Welcoming Visitors from Monday 1 June WITH the NSW Government announcing the easing of restrictions allowing travel and holidays within NSW, the MidCoast region will be welcoming visitors from Monday 1 June, although physical distancing rules will still apply.

“Our businesses and especially the tourism sector are very happy to be able to begin welcoming visitors back to the MidCoast,” said MidCoast Council’s Manager of Growth, Economic Development and Tourism, Deb Tuckerman.

“At the same time, local businesses are working hard to adapt their operations to ensure they comply with the public health orders and protect our community and visitors from COVID-19. Slowing the spread of the virus as restrictions ease is a key priority for everyone.”

As a result, many local businesses will look a little different as they reopen.

MidCoast residents and visitors alike will need to adapt to new measures, including physical distancing, increased cleaning and restrictions on numbers allowed at any one time in venues.

“Our businesses are asking us to all be tolerant and expect things to be a little

different as they open and welcome visitors for the first time in two months,’ added Ms Tuckerman.

While businesses will be following guidelines for operating within existing public health orders, customers also have a responsibility to practice physical distancing and comply with the requests of business operators for everyone’s health.

“These measures will ensure we can reopen our businesses, and give some much needed relief to our economy.”

The Australian Bureau of Statistics released figures this week indicating the NSW Mid North Coast was one of Australia’s hardest hit regions economically by the COVID-19 restrictions, with the highest national unemployment rate of 11.8%. The MidCoast Council area is part of this region.

“The MidCoast community is resilient and people here really step up and pull together in hard times. The business chambers and local businesses have worked hard during the lockdown to keep business flowing, and our community has responded, supporting their local businesses wherever possible,” said Mayor David West.

I have a lot of confusion about the correct way to sign off on email correspondence. There are so many variations. What is the standard these days for business correspondence?

BACK in the day when I was a wide-eyed student, Mrs Loehorn made it very clear that the two acceptable ways of signing off on business correspondence were 'Yours sincerely' or 'Yours faithfully'. How things have changed. I just had a quick scan through the last 20 emails I received and the variety is overwhelming, each of them providing very distinct undertones. Interestingly there wasn't one Yours sincerely or Yours faithfully in the mix, which would have Mrs Loehorn rolling in her grave.

Here we go: Best: This is the sign-off favoured by those in the publishing/arty/creatives world. It's short and punchy but it takes a certain je ne sais quoi to pull it off successfully.

Thanks in advance: This one is a desperate plea for the receiver to do something. The email will involve a lot of work on your part and the 'thanks in advance' doesn't allow any room for wiggling your way out of it. Thanks in advance is from a savvy sender. They probably work for a company called Honey and Fox. Cheers: To me this is a Friday afternoon email, and yet for many this is their standard sign off. There's something overly friendly and celebratory about it. I don't sign off with Cheers unless I have three vodka shots lined up next to my laptop. Each to their own.

Aho: Ok, this one is usually attached to an email about mana yoga, chakra alignments, luna medicine circles, sitar strumming and pretty much any other offering that sounds new-agey and visionary, but will actually cost you your week's wage and maybe even your soul. Lately this sign off is also attached to conspiracy emails about 5G, Bill Gates, Lady GaGa, satan worshipping, child trafficking and Adrenochrome scare-mongering, which seems a little at odds with such an earth mother complimentary close.

Speak soon: This is a good one to use when something is about three weeks overdue. It sort of lets the receiver hang in there on the promise that the work is on its way. It can have a calming effect and also let you off the hook for another 48 hours.

S x: The single initial and kiss is a contemporary sign-off that has a laid-back, affectionate feel to it. It causes a lot of angst to over thinkers who don't normally respond with a kiss, but feel almost obligated to return in kind or even add an extra x. Before long you end up going down a very weird rabbit hole where you profess your love to each other and shack up in Mullumbimby. Use sporadically and only when you are certain of the outcome.

Yours in sincere gratitude: This sign off is definitely attached to an email requesting a direct debit from your already dwindling bank account to save homeless dogs/rainforests/ war veterans and so on. If you read right down to the sign-off on the email, you are no doubt whipping out your credit card details at regular intervals as everyone needs a handout at the moment - except the Libs who just located an extra 60 billion dollars from their JobKeeper stuff up.

The Branch works MIDCOAST Council crews are currently in the process of sealing a section of The Branch Lane at The Branch, with works continuing through to the end of July.

What was originally started as a 1km project has recently grown to a 2.4km extension of the bitumen seal, from the Warraba Road intersection to the Branch River Crossing. The scope of works includes

establishing roadside table drains adjacent to waterway crossings, stabilising and supplementing the existing gravel base, and finishing with a two-coat bitumen seal. Signage and guideposts will also be upgraded as part of the seal extension project.

Council to prepare for Inaugural Cultural Plan Midcoast Council is urging the community to help shape the inaugural Cultural Plan for the region.

MIDCOAST Council is urging the community to help shape the inaugural Cultural Plan for the region.

Feedback provided by the community, via an online survey, will help Council to prepare the plan which will support and celebrate arts, culture and creativity in our everyday lives.

“The MidCoast Cultural aims to deliver benefits to the community through arts and cultural programs as well as diversifying the economy to support and enable arts and creative enterprises to flourish,” explained Paul De Szell, Council’s Director of Liveable Communities.

Council is also hoping

to gain insight into the way locals engage in cultural activities and is asking community members to share information on their favourite experiences, stories and community facilities on an interactive map on the website.

“This plan will help Council identify where improvements can be made, what kind of things the community want to see and do more of to enhance the local cultural experience and reflect the diversity of the region.

“Essentially the Plan is a road map to identify what we currently have, where there are gaps, what we want to be in the future

and how we’re going to get there.”

The formation of the Cultural Plan is a process that involves the wider community as well as targeted groups and stakeholders for ideas and feedback. A draft plan will be created and will go on public exhibition later in the year, and the community will be able to provide feedback on the document before it is adopted.

Government to assist Councils NSW Councils have applauded the Federal Government for a fantastic first step on the road to a locally led recovery, following the announcement of $0.5 billion additional funding to be shared by Councils across the country.

Local Government NSW (LGNSW) President Linda Scott said the new funding would help stimulate local economies through the construction and maintenance of infrastructure including pools, parks and libraries and roads.

“Councils are truly grateful for this recognition of need, and committed to seeing the funding is used to help their communities survive and recover from the economic impacts of not only COVID-19, but the bushfires, floods and droughts that preceded the pandemic,” Cr Scott said.

“This funding will help keep local economies from

collapse by keeping the tens of thousands of people who make up our invaluable local government workforce in jobs.

“It helps communities now, and it delivers public good for tomorrow.

“Communities know there’s a shortage of good quality public infrastructure in NSW, and without assistance such as this, councils could struggle to deliver our parks, libraries, sporting fields and footpaths into the future.”

Cr Scott also welcomed the second component of the stimulus package, which will see the Federal Government make an advance payment of Financial Assistance Grants to councils.

“It’s also great that the Federal Government is bringing forward the second instalment of Financial Assistance grants this year, as they have for the past eight or nine years,” she said.

“We do need to be mindful that the actual funding under the Financial Assistance Grant

Is there life out there in the Universe?

I KEEP getting asked this question; Do you think there is life out there in the universe?

The correct answer is that ‘we don’t know’.

As an observational astronomer, I have tried to avoid this question however this quest has always fascinated me.

For me to put this perplexing question into perspective, there is a two pronged attack to ponder; Part 1: The quest for the search for extraterrestrial life: Part 2: If we look up into

the sky, the stars, like our Sun, are born, they live and they die. Is this not the cycle of life?

Firstly, Part One: Are we alone in the Universe? The answer is ; as I said above, we don’t know?

Philosophically it comes down to whether “intelligence” as we know it, is a probable outcome of natural selection, or an improbable fluke?

By definition, “probable events” occur frequently, “improbable events” occur rarely — or once only. Our evolutionary history shows that many key adaptations — not just intelligence, but complex animals, complex

cells, photosynthesis, and life itself — are simply unique, one-off events, and therefore highly improbable.

Our evolution may have been like winning the lottery … only far less likely?

The Universe is astonishingly vast.

Our galaxy,”The Milky Way”, has more than 100 billion stars, and there are over a trillion galaxies in the visible universe, the tiny fraction of the universe we can see.

Even if habitable worlds are rare, their sheer number (there are as many planets as stars), maybe the concept of extraterrestrial life, and particularly extraterrestrial

intelligence, has had a major cultural impact, chiefly in works of Science Fiction.

Over the years, Science Fiction has introduced a number of these theoretical ideas, each having a wide range of possibilities. Many have piqued public interest in the possibilities of extraterrestrial life.

One particular concern is the wisdom of attempting communication with extraterrestrial intelligence.

Some encourage aggressive methods to make contact with intelligent extraterrestrial life.

Others also argue that to do so may give away the location of Earth, making an invasion

possible in the future. — does this suggest lots of life is out there? If so, where is everyone?

We may also be utterly alone in the Universe!

Such are the disparities between movies such as “ET” and “Independence Day” that polarise our feelings?

The hunt for extraterrestrial life will spark scientific whilst mankind exists.

Since the mid-20th century, active ongoing research has taken place to look for signs of extraterrestrial life. This encompasses a search for current and historic

extraterrestrial life, and a narrower search for extraterrestrial intelligent life.

Depending on the category of search, methods range from the analysis of telescope and specimen data to radios used to detect and send communication signals.

The New Normal

By Marian SAMPSON NSW is blazing a trail towards a future with strong business and COVID-19 safe measures.

While Queensland is operating somewhat like a Banana Republic, NSW has cleared the decks, reopening accommodation, tourist attractions, schools and allowing restaurants, pubs and clubs 50 patrons per venue.

With the Queensland border firmly sealed at the time of writing and NSW

Premier Gladys Berejiklian opening the State for intastate travel from June 1, areas like Port Stephens and the Myall Coast are set to be hot options for those looking to get out of the house.

One new case of COVID-19 has been recorded in the Hunter New England District, breaking a two week trend of no new cases in the region.

While many locals are apprehensive, the Premier says it is safe as long as we maintain social distancing.

Local restaurants, clubs

and cafes are busily gearing up to welcome visitors which are set to put locals back to work in the hospitality industry.

Restaurants, Pubs and Clubs need to abide not only by the 1.5 metre social distancing rule but also the 4 square metre rule.

Restaurateurs who have been struggling with only 10 patrons are keen to see the numbers increase, and they have also expressed their disappointment over people who have booked tables and failed to turn up.

news is that MoonshadowTQC will be operating daily whale watching cruises from May 27.

These socially distanced experiences will offer those who partake a very private and exclusive experience.

Throughout the shutdown, Moonshadow-TQC Cruises used the time to reevaluate their business model and to make modifications to vessels to ensure they are compliant with new social distancing restrictions.

Mel Turner of Moonshadow-TQC told News Of The Area, “We have the benefit of large vessels that can comfortably comply with the social distancing rules, our crew and team have been inducted with special training to ensure all areas of the vessels are cleaned and we have made some rather large

modifications to the vessels removing seating to ensure safe distance for those in the main cabin,” she said.

The company has also implemented new boarding procedures on the docks to the vessels.

With the current COVID-19 restrictions cruises will be limited to 10 passengers on board; this will change as restrictions are further eased.

The company is confident that they can safely get people back on the water for the highly anticipated Whale Season.

While some will whale watch from the boats, there are plenty of shore based vantage points around Port Stephens and the Myall Coast where you can enjoy the migration of these majestic creatures.

The Wild About Whales App lists vantage points and recent sightings as well as allowing avid whale watchers to record their sightings.

Some of the top whale watching spots include: The hole in the wall picnic area; Sugarloaf Point Lighthouse; the Tomaree gun emplacements; Elizabeth Beach picnic area and the foreshore areas at Boat Harbour and Fishermans Bay.

A Whale’s Tale

THERE’s no question about it the people of Port Stephens, and the Myall are passionate about our migratory whales and despite everything that is going on in the world, the whales migration is a constant.

It’s that time of year when locals get their “Whale On”.

Each year from May the humpback whales and other species make the trek north to the warmer waters of Queensland.

Experts estimate that around 30,000 whales will make the annual migration and they will return south from August with their calves.

milestones as Prime Minister Scott Morrison and the health advisors have ruled against Grandparents as spectators at sporting fixtures.

Kids participating in community sport will also need to shower at home, and there will be no high fives and no huddles.

Banning Grandparents from community sport is about protecting the vulnerable.

Greatest fears across the community are of a second wave of infection and the demographics of the Myall Coast and Port Stephens sees many of our residents are particularly vulnerable.

LOCAL Year 12 students completing a hospitality course at School are also undertaking Barista training.

Liz Smith, Hospitality Teacher at Bulahdelah Central School told News Of The Area, “As part of this training, students are required to develop skills in preparation and customer service.”

Hospitality students are learning how to prepare and use the espresso coffee machine to create a variety of coffees such as espresso, latte, cappuccino and macchiato.

Students are learning about industry standards for strength, taste, temperature and appearance as well as the characteristics of the different styles of coffee.

Ms Smith said, “The skills these students are developing will assist in preparing them for future employment in the hospitality industry. It is a great way to break into the industry if you don't have any prior experience.”

receive coffee orders from staff. This provided feedback on the strength, taste, temperature and appearance of the coffee and the service provided.”

The class is very grateful to the staff for their willingness to be the tastetesters of all the coffees made.

This offers the community a great opportunity to engage with each other safely, get exercise and enjoy life despite the threat of COVID-9 in our community Sue Dodds from the Myall Park Croquet Club told News Of The Area, “Following approval from Mid Coast Council, Myall Park Croquet Club reopened its lawns on Wednesday 20th May.” The club is doing everything possible to ensure the safety of its members.

“We have restricted member limits to each session available and we practice the health and safety rules regarding social distancing, along with hand washing and sanitising.”

Club members can book a session by phoning Pat Rowe, prior to the day they wish to play.

“We are all just happy to be back on the lawns!” she exclaimed.

The good news is that membership isn’t restricted and anyone interested in the game of croquet, should not hesitate to call Tony Jones on 49970816 to find out how you can get out and enjoy croquet on the Myall Coast.

Committee member Charlie Shuetrim, building on the initial efforts by Sally Aldrich and Sam Kebby to organize online Bridge games between Club members, has enabled the Club to hold regular competitive sessions using Bridge Base Online.
