By Margie TIERNEY IT’S a bitter, sweet time for members of the Tea Gardens / Hawks Nest Family Research Group.

After 17 years, the Group has been forced to close the doors of their office and meeting area at the Masonic Centre, on Myall Street.

A rent increase and the Centre under new management by the Grand Lodge in Sydney, sealed their fate.

For the past few weeks, members of the Group have been packing up and moving their research books, computers and memorabilia into storage.

On a positive note, the Research Group has been given temporary accommodation.

“The Tea Gardens Country Club has offered the Jack Bramble Room, so we’ll be able to open the doors again in May, or maybe earlier,” Anne Shannon said.

The move will enable the Group to continue with its mammoth ‘Trove Project’, involving the digitising of the early copies of the NOTA dating back to 1970.

The Group will be able to use the room at the Country Club on Mondays, Saturdays and Sundays unless a function is booked.

“The Country Club’s management has been terrific. Warren Gooley didn’t hesitate when we asked to use the room,” Terry Munright said.

After a farewell morning tea, it was time to take the Family Research 'Welcome' sign off the wall and bid farewell to their old home and look forward to the next chapter.

30 Years of erosion and a number of huge storms have taken their toll on Jimmy’s.

The system, jointly funded by MidCoast Council, the Office of Environment and Heritage and Crown Lands has taken 8 months to construct and is the first of its kind to be built along the NSW coast.

“There are 10 discharge stations, seven along The Boulevard and three on the other side of Barnes Rock, which are there as a protection for the pump station,” MidCoast Council Coastal Management Coordinator Andrew Staniland told News Of The Area.

The series of big black pipes and pumping station, do little to enhance the environment, but MidCoast Council is confident the system will provide a buffer.

“In the case of a super storm there’s not much we can do. This system is not designed to stop erosion; it’s aim is to make a buffer, give the ocean something to chew at, instead of chewing out the road,” Mr Staniland said. q

Sand for the stockpile has come from Council’s dredging program across Port Stephens and the Great Lakes, but the next scheduled dredging of the navigational channel is at least two years away.

The Myall River Action Group has been lobbying all levels of Government for ongoing dredging of the natural entrance of the Myall River, also known as the Short Cut. "One of the problems we have is that the Short Cut is not a designated navigational channel,” MRAG’S Gordon Grainer said.

“I don’t think we can last another two years before we go back to the days where we had very low salinity and diseased fish."

The Jimmy’s Beach Preservation Association has welcomed the sand transfer system, “We have worked closely with MidCoast Council and strongly support the project,” Richard Streamer said.

“The system is the most suitable and economical solution to the erosion on Jimmy’s Beach,” Mr Streamer added.

It’s estimated the sand transfer system will cost $200,000 a year to run, a third of the cost of trucking sand onto Jimmy’s.

The twice yearly campaigns are expected to take place around April and before September, timed to miss the migration of the ‘Little Terns’ to the area.

Part 2 – The Decision Last week’s article outlined the facts of a Supreme Court case that looked at whether, or not, a particular will had been made “in contemplation” of marriage. Without rehashing the facts, the answer to that question determined which of Mr Grant’s children, or his second wife, received (much of) his estate.

Ultimately, the Court concluded Mr Grant’s will had not been made in contemplation of marriage. The reasoning is quite subtle but suggests there is an important distinction between “making a Will having contemplated marriage and making a Will in contemplation of a marriage”. That is, there must be more than a consciousness on the part of a Will maker, of the possibility of a particular marriage. The Will maker must have the particular marriage in mind when the Will is made.

On the particular facts, the Court concluded that at the time the Will was made, both Mr Grant and his (future) second wife had thought about the possibility of marrying, but were fundamentally

‘free agents’ who had not made any commitment to marriage at a future point in time.

A particular focus of the Will was the exclusion of the first wife (and an estranged step-son) from receiving any benefit. The Court considered those factors had precedence in Mr Grant’s mind; not the contemplation of a future marriage to his second wife.

The Will was declared void, and the second wife did obtain a substantial share of the deceased estate (which was valued at around $5M).

As a side note, because the rules of intestacy applied, the natural children of Mr Grant received a share in the estate, but the step-child mentioned in the Will did not. The Court ordered a substantial amount be paid to that stepson on the basis that he had not been adequately provided for by Mr Grant.

If nothing else, the case shows why it is important to take advice about Wills or intended Wills when significant life events occur, or are about to occur – and in particular, where a potential marriage is ‘on the horizon’: Re Estate Grant, Deceased [2018] NSWSC 1031.

MIDCOAST Council is holding another community workshop in Tea Gardens, early next month.

The meeting is designed to give locals a voice to raise their concerns or ask questions in regards to projects, planned and ongoing.

Campaigners for the upgrade of the Tea Gardens public swimming pool are calling on supporters to attend.

“There was a proposal to have the existing pool upgraded so it could be used 12 months of the year,” Wendy Earnshaw said.

“This has been rejected, but with enough community support we’re hoping we can have a new hydrotherapy pool which is much needed,” she said.

The community workshop is being held at the Baptist Church in Myall Street, beginning at 6 pm on Thursday 9 May.

BULAHDELAH Historical Society will 4 5 6 7 soon be celebrating the completion of the "Self Guided Walk" located in the grounds 8 of the iconic Bulahdelah Courthouse Museum.

Dementia Walk on Horizon

DEMENTIA is a cruel disease that changes loved ones and steals their memories.

There are people from all walks of life suffering the effects of this insidious disease.

There are some 436.366 Australians currently diagnosed with dementia and there is no cure.

It is the second leading cause of death for Australians.

The Myall Park Tennis Club in conjunction with Dementia Australia is organising a Memory Walk and Jog fundraiser for Sunday 25 August.

The Club is undertaking the event to raise money for Dementia Australia.

Club President Chris Armour told News Of The Area, “At this stage we are looking for sponsors, donations and volunteers for the day of the event.”

Dementia Australia conducts Memory Walks around the Nation and Chris is hopeful that the Myall Park Tennis Club’s Do It Yourself event will become a successful flagship event for the organisation.

Some believe that Dementia is the

disease that will have the greatest social and economic impact of our time.

Participants at the event can undertake a range of distances with the longest being 6km.

“Walkers can really turn around at any stage and head back to the Tennis Club for the sausage sizzle at the finish line,” she said.

MidCoast Council has already granted approval for the event to proceed, and Chris is keen to see sponsors come on board to help raise funds for this cause.

Next Saturday, 27 April, round 7 kicks off with the First National Grade 4 side playing Beresfield at Beresfield.

20 April Three of the quarter-final matches have now been completed in the rain-interrupted Club Major Pairs Championship.

The Ross Barry Danny Johnson combination led all the way in their game against Tony Coomer and Leigh Hunt, just managing to hold the lead at the end with a 23-20 win.

Bowls was rounded off with a barbeque lunch and with the blue skies and superb facilities thrown in, a good time was had by all.

“Club Member of the Year was awarded to John Estens,” Valerie Mobbs told News Of The Area.

“John is a very hands on member of the club, always available to help with anything and everything which requires attention as well as holding the position of Treasurer.”

Valerie said, “The Encouragement Award went to Doug Gillespie, a new member this year and a very enthusiastic swimmer.”

Other awards included the Coaches Certificate of Encouragement, which went to Doug Gillespie, Max Harder, David Brailey and Leigh Smith.

High Achievement Awards went to Chris Lock, Col Bertram, John Coles, Laurie Vickery, Leon Bobako, Brad Jensen

The Myall Masters Club continues to go from strength to strength.

“This year’s annual swim carnival attracted 177 swimmers, a record for our club,” Valerie said.

She added, “This is a spectacular achievement for our club of 57 members considering our outdoor training pool closes from April through to October and many other clubs have indoor facilities.”

At the recent AGM, Leon Bobako was elected new President of the Club.

A very close game in the beginning both contestants sharing the lead and generally only by one or two shots. By the 13th end Karen managed to have edged ahead by 5 shots but Maynie put down some great bowls and gained a lead of 1 by the 17th end. Then she won the next 3 ends adding 5 to her tally in all. The score on the 21st end Maynie 20 v Karen 15, it looked as if this contest was nearly over but no, it wasn't. Karen won the next end by 2 shots, then Maynie won the next by 1, then Karen won the next 4 ends gaining 9 shots, winning 26 v 21. the spectators were not disappointed with the standard of the bowling, a great game to watch.

They have added 0.5 point to their tally, remaining in first position in their section but the margins are narrowing and all the teams in their section bowl on the 23rd April so they are not yet "home and hosed".
