The Progress Association has no part and can only advise the community,” he said.

Darby Neville, resident of Yamba Street spoke for the group stating that the group, was not against development but about size, levels (3 plus carpark & loft making it a 5 storey build), with height and setbacks of concern, as were the effects on the area in relation to fauna, flora and traffic.

The group also determined the need to seek extensions on the DA response period to

allow for adequate community consultation.

MidCoast Council has confirmed the application is currently under assessment.

A number of submissions from the community have been received.

Meanwhile Council staff will be in attendance at a Community Conversation meeting in Tea Gardens on 26 November to provide the community with an opportunity to ask questions on any issues relating to Council, and to hear feedback about a number of projects identified as important to the Tea Gardens and Hawks Nest communities during a Community Conversation meeting earlier this year.

Colourful Repertoire for this year's Concert ON Saturday, 30 November, the Myall U3A Choir is performing its annual Concert in the Hawks Nest Community Hall. A donation of $10 payable at the door will secure a seat and supper after the concert.

Barbara Lyle, the Myall U3A Musical Director has chosen a colourful repertoire for this year's performance.

“The Concert will include a variety of musical genres, from songs of reflection to

popular musicals,” she said.

The Concert is a celebration of community singing; playful folk songs, haunting laments, a touch of Opera, your favourite Christmas Carols, plus a few surprises.

Margaret Rowden will be accompanying the choir as usual.

Lyn Chaikin from U3A said, “Please come along for a wonderful night of singing and community. Supper will be served after the

performance.”

“If there are people who are interested in joining the choir, come along and listen and join the choir in 2020.”

“We meet for practice each Wednesday afternoon at 2pm during term time,” Ms Chaikin said.

The choir also sings at the ANZAC and Remembrance Day Services and occasionally for the Dolphins' Friday group. If you wish to experience the joy of singing in harmony and learning basic vocal technique, you are welcome to join.

When a relationship ends there are many expected outcomes but an issue not often discussed is the tax implications of property division.

Today I am looking at just one: capital gains tax (CGT).

If there has been an increase in value CGT is payable on the disposal of the asset. For example, transferring a house to a new purchaser – the seller pays CGT. However, the Income Tax Assessment Act provides some “relief” to separating couples when, say, one spouse transfers their interest in an investment property to the other spouse.

This ‘relationship breakdown roll-over relief’ means that where a transfer occurs under a Court Order or an Agreement in accordance with the Family Law Act the tax liability is also transferred.

It is not that no tax is payable – just that the CGT

liability is “rolled over” to the person receiving the asset.

If they later dispose of it they deal with CGT then.

This sounds like a relatively simple concept but a number of issues can arise: • Is the asset being transferred subject to CGT? • Who legally owns the asset – is it the couple or is it through an interest they have in a company or Trust?

• Does another tax exemption apply?

• Does the Court Order and Agreement properly set out the Transfer?

Especially relevant if there are third parties involved.

• What is the potential CGT actually payable?

These are not always simple questions and proper legal and tax advice is vital to ensure unenvisaged consequences do not flow.

Snake Season is Here

By Julie McKimm SUMMER is fast approaching and with it comes the increased incidence of snakes in our backyards.

Some of the most common in our area being the eastern brown snake, red bellied black snake, rough scale snake, yellow faced whip snake and diamond python.

There are many misconceptions about snakes and their behaviour so News Of The Area contacted one of the area’s snake enthusiasts, Dylan Stuart, for advice on what to do if you come across a snake.

VERY High water restrictions are in force across the MidCoast region, with Council asking everyone across the MidCoast to ensure they are complying with mandatory restrictions. The weather forecasts and predictions of water usage indicate that Council will need to tighten restrictions very soon.

Very High restrictions restricts any outside water use for 10 minutes every second day, before 9am or after 4pm. Sprinklers and

irrigation systems are banned. If your house number is an even number, water on even days of the month; for houses with odd numbers, water on the odd days of the month, and there's no watering at all on the 31st day of any month. For more information visit Council’s website.

THE Hawks Nest / Tea Gardens Progress Association met on Monday 11 November and was well attended.

The meeting was addressed by local resident Alex Bull, a former Traffic Engineer, who provided modelling on emergency evacuation by residents who rely on the single outlet of Spinifex Avenue.

The modelling shows total traffic congestion, with potential disastrous outcome, should such an event occur.

The meeting asked what evacuation plans are in place and the Progress Association has undertaken to invite representatives from Police, SES, Ambulance and the NSW Fire Service to meet with the community in the New Year.

The meeting was also addressed by Fred Sparksman, who introduced the concept of “Pelican Parade”.

The pelican being the unofficial totem of our twin towns and the police and fire stations, together with the Hawks Nest Newsagency, already displaying the totem. The aim is to have local businesses highlight pelican signage depicting what product or service that location provides.

In turn that will increase visitation and revenue for the business houses and develop an identity for our twin towns In general business and a follow up to last months’ meeting, a resident’s group has submitted 38 objections to Council regarding the Yamba / Booner Streets building proposal. Versatility Day for Men’s Bowling Tea Gardens Men’s Bowling Club

By The JAFFA 13 NOVEMBER: It was to be an early start today for the 12 teams of four that made up the field for the RSL LifeCare Versatility Day. Some endurance was also required as bowlers would play nearly 50 ends over the day in all the bowling disciplines.

It was a tough day also for the lesser teams as they tried to dent the might of the teams featuring “Marquee” players.

The results were not unexpected as the strong teams prevailed and took the first two places.

The team of; John Bilby, Mark Nightingale, Graham Reynolds and Brian Emmett finished first whilst the fancied team of; Lance Atkins, Tom Short, Greg Pearson and Dennis Ashbridge finished second.

Hats off to the team of; Kevin Barbie, Bob Weir, Barry Goode and Col Saillard who finished third!

There were other prizes for Best 4’s team,

Best triples team, Best pairs and Best singles player along with 5 random draw prizes.

The organisers would like to thank the markers, cooks and others who assisted on the day.

In other news: The grass green will be unavailable for 6 – 8 weeks due to yearly maintenance.

The Committee advised that as from Wednesday 20 November, and for the duration of the maintenance period, the first 12 triples teams will be guaranteed a start and names after those on the nomination form may get a start.

Teams of 4 may need to be made to accommodate those other players.

The last day of organised bowls for this year will be the 18th December.

A lunch will be provided with details to be advised by the 1th December.

More Pennant players are required for the 2020 season so as to allow the Club to field three teams. We need more pennant players for 2020 to be able to field 3 teams.

MONDAY 11th and Tuesday 12th November Karen Green, Lynne Green and Kayelene Pearson bowled in the Jacaranda Triples Carnival at Raymond Terrace. Twenty eight teams competed in this event and I am pleased to announce that our ladies came third. A great effort against some very stiff opposition.

Thursday 14th November: Round 2 of the Novice Consistency Competition, remember this event is only open to those who have bowled less than 5 years. The next end Bette gained 9 points equalising the score. The next 8 ends saw Bev holding a narrow lead then once again "even Steven". The turning point in this competition came on the 21st end, Bette gained 10 points and never looked back, claiming victory on the 27th end 152 v 118. NOT one Cucumber sandwich, nor one raised “pinky” was visible at the Myall Park Croquet lawns recently when the local Probus Club visited the venue for a day full of laughter, good humour and remarkably competitive play.

Only a few “croquet novices” were in attendance as most of the Probus players had visited previously and had developed skills and strategies to handle
