NC Reduces Data Available from AOC Provided by Karen Caruso, Mind Your Business, Inc.

Next month the North Carolina Administrative Office of the Courts (AOC) policy changes regarding the type of information it will provide to licensed data research companies who request background information about individuals such as candidates and employees. The purpose of the change is to resolve challenges with expunged cases and inaccurate case information being reported to end users through data providers.

Starting Jan. 1, when companies send batch or other automated requests for information, the AOC will respond with only the individual’s name and his or her court case numbers. The AOC will no longer include details about each of those court cases.

These changes will result in licensed data researchers having to access the Remote Public System (RPS) to obtain the case details, including charges and disposition.

This may result in a slower background checking process.

These changes will not affect information service providers such as Mind Your Business (MYB), who already go directly to the sources to find candidate and employee background information. MYB has recognized the RPS as the most reliable source of record information since 1996 when it incorporated use of RPS and advanced technology into its standard operating procedure.

Looking Back and Moving Ahead As I pass the NCASP Presidency baton on, I reflect on the progress this association has achieved, the relationships that have been developed, the vendor partners with whom we have aligned, and, quite frankly, the national buzz and excitement about the NC Association of Staffing Professionals.

It has been a privilege and joy to serve as your President the last 2 years.

From the camaraderie on the Board of Directors, to the conferences and more, the time seems to have flown by. I am really proud of my fellow Board members, not only for having the will and passion to serve and keep the glue strong for this group, but also for their loyal commitment for the greater good.

Every leader has a right hand person, for me, I had a right and a left - Mary Mallett and Kara Bertoncino. I want to personally acknowledge their contributions. Through thick and thin, they have advised me, been my “coconsigliores,” kept this ship moving, and, most important, they have been wonderful friends.

It would have been very easy for the Board to have taken the easy road, complained about the economy, not fully participated. But this very talented and loyal group stepped it up and supported me and its members without reservation.

On a final note, I want you to know that the NCASP ship has not docked.

Things are moving full steam ahead.

We just finished our 2011 NCASP Board planning retreat, led by Mark Griffin, and you’ll be seeing a whole set of new initiatives. I will continue to

be a part of this effort. I look forward to seeing you at the 2011 Conference in late April, where I’ll probably be behind the video camera.

I cherish the past 2 years with NCASP and look forward to a bright future for our members and our industry.

Creating Outstanding Candidate Experiences

Prepared by Mary Storms, CPC, STORMS Associates , from NCASP webinar presented by Pamela Laksana, Careerbuilder There’s little difference between candidates and clients when it comes to providing them a good customer service experience, said Careerbuilder’s Pamela Laksana, during her Dec. 1 NCASP webinar.

The CareerBuilder information was based on a 2010 survey by Inavero. One of the survey’s key findings was that 46% of a staffing/ recruiting company’s clients were previously their candidates. Why’s that important? Because it’s impossible to separate reputation and messages to clients and candidates.

Clients decide to work with specific firms because of:

1. Past experience 2. Candidate quality 3. Company reputation Candidates’ major complaint in the survey was that applying to recruiters is like a black hole, lots of information going in but little feedback coming out. In the future, would they choose firms that gave them no feedback and treated them shoddily?

Pamela’s webinar was packed with useful information. Her key point? While candidates are plentiful, you should make them fans so they remain available to you once job demand exceeds candidate supply. Here are her 5 key take-aways: 1. Because clients and candidates are virtually the same, every time you

touch a candidate, you’re dealing with a prospective client.

2. Talk with your candidates about their perceptions and needs.

3. Simplify your application process.

4. Implement a simple candidate communication process.

5. Leverage social media and technology to improve candidate relations.

NCASP Gift Nourishes 2nd Harvest Food Bank

In September, NCASP donated $1,500 to Second Harvest Food Bank of Metrolina. We were able to make this generous donation due to the generosity of our vendor partners, members, and others at the 2010 Annual State Conference Silent and Live Auctions.

NCASP President Jonathan Weiner and Conference CoChair Quintin Williams presented the check during a surprise visit to Kate Carter, Second Harvest’s Executive Director.

Kate said the $1,500 will be used to purchase and distribute food to those in need and to charitable partners of Second Harvest. NCASP is proud to support Second Harvest in its efforts to “Provide a regional distribution warehouse and branches that supply food and grocery items to charitable agencies that assist people in need.”

NCASP Leadership Plans for 2011 Ethics. Government. Membership. Training.

By Mary Storms, CPC, STORMS Associates The NCASP Board of Directors met in Asheville, Oct. 22, for its annual planning meeting. Mark Griffin, our 2011-2012 President, led the meeting, which was attended by 18 members of the 2011 Board.

As NCASP President, Mark’s focus in 2011 will be: 1. Ethics and professionalism: Highlighting industry best practices and differentiating our member businesses as ethical and valuable drivers of the economy.

2. Government and the economy: Increase our voice in state government and increase NCASP communications with members about government regulations and economic trends in our industry.

3. Membership: Grow membership so that NCASP can provide more high quality training for its members and vendor partners.

As of Oct. 22, NCASP had 63 members (23 in Charlotte area, 21 in eastern NC, 12 in Raleigh area, 4 in western NC, and 3 in Winston-Salem area), about half of which were staffing and half recruiting firms.

4. Training: Develop another high-level annual training conference and continue to increase the training value of webinars, regional meetings, and certification events. The 2011 annual training conference will be April 28-30 at Wrightsville Beach Holiday Inn Resort.

On the topic of rejection, I want to share a true story with you: Seventy-Seven publishers rejected Jack Canfield and Mark Victor Hansen’s idea for their book “Chicken Soup for the Soul.” They chose not to quit and, when the 78th publisher said yes, they went on to sell over 100 million books!

No one is immune to rejection or failures. In fact, successful people fail more than unsuccessful people because they try to do more things. They view failures as learning experiences, overcome them and move on!

You are only one choice away from changing your life.

Take time to determine what precisely that choice would be for you. What one choice would be life-altering? What one choice would have the greatest impact on your life?

Now for the most difficult question you have to answer…

Nah, I don’t need that. I know that . . .

The longer I recruit, the less tolerant I become of mediocre attitudes. And one of those attitudes that is a sure sign of weakness is overconfidence.

I couldn’t believe my ears when I heard an owner of a 10-recruiter shop say, “Our people don’t need any more training. They’ve been in the business a long time and know everything already.”

Um, okay. I could tell by the tone in her voice that she really believed this. I tried to overcome her concerns but was unsuccessful in helping her see that her people could learn more and that they could bill more by adopting some new ideas, tactics and beliefs. We quickly ended our call because I knew any attempt to show her otherwise would be futile.

Learn or Stagnate At the end of our call, I sat there and came to a realization about people who can’t see that they live in a state of mediocrity. They need to understand that there’s a difference between a recruiter who has been in the business for 20 years and another who has one year of experience twenty times.

If you don’t grow and don’t learn, you atrophy. You stagnate. You get soft and mentally fat and lose your edge and won’t be ready for the unpredictably volatile contemporary economic landscape in which you live.

Stay sharp. Get disciplined. Stay on the cutting edge. Force yourself to explore the depths of ideas that seem to be obvious and normal and everyday to you and get better at those things. The concept of learning how to make phone calls is something on which I’ve written and spoken and trained prolifically to dozens of industry groups and tens of thousands of recruiters and sales people. And I can learn more.

Become a Smart Caller A few months ago I found myself purchasing a book from a bookstore that at first glance I believed was below my level of expertise. It was Art Sobcazk’s book Smart Calling: Eliminating the Fear, Failure, and Rejection from Cold Calling. When I saw the book on the shelf, my first instinct was this: “Nah, I don’t need that. I know that already. I even teach the stuff. How could I learn anything more about this subject?”

But then I picked it up, flipped through the pages and learned one little idea. And then another. And then I was sold.

I think I’ve made somewhere between 25,000 and 30,000 sales and recruiting calls since I first entered the business in 1995. And if I’ve been teaching sales training for seven years and if I learn something from a book, then I’m going to purchase it. It doesn’t matter how long you have been in the business or how much success you have achieved. You can still learn more.

As Vice President of Catawba Valley Staffing, what are your primary job responsibilities?

I am primarily responsible for leading and motivating our staff, managing the day-to-day operations, and planning for our future.

In which industries and functions do you specialize?

At CVSI, our specialty is providing for our clients to meet their needs in any arena. If we are not able to, we help them find someone who can.

Which aspects of your job get you revved up?

The little and big successes of my staff! It is so rewarding to see their excitement.

What’s one of your favorite staffing stories?

I became hooked on staffing when I was still in high school. We had a client that manufactured parts for the first Gulf War, Desert Storm. We had a little over 100 employees at the plant on 3 shifts, 7 days a week, and they were working as hard and fast as they could to meet the US Military needs. We delivered pizzas each weekend for their breaks, and I volunteered for third shift on Saturday nights. I got to stay out past curfew! By being patriotic and from the rewarding reaction I got from the company and the employees when I would show up, I learned to love the way it feels when you are a part of something bigger. Still today, I love to feel like I am, or our company is, an integral part of something important that our clients are doing.

Which aspects of your job would you outsource if you could?

The time I lose traveling from one place to the next.

Tell me about your professional life before joining your current company. Before opening Catawba Valley Staffing, Inc. with my mom, we both worked for a staffing company in South Carolina. As a teenager, I worked for her as a temp, and then went on to do summer internships with the company, then finally accepted a position with them as Finance Manager when I graduated from UNC. I was fortunate to learn the business from the front desk to the back office.

The exposure was tremendously helpful when we started our own staffing “adventure.”

Understanding the diverse challenges people face in different positions has helped me be an effective manager.

Has your NCASP membership benefited you thus far?

NCASP has been awesome for me in several ways: The training is top notch. It is a huge motivator for me and my staff. And it is such a great opportunity to meet and build partnerships with vendors and interesting people in our field.

Why did you join the NCASP BOD? I joined the board because Mary Storms insisted to me and my mom that we become more involved…and she kept insisting until we agreed! One of my personal challenges was overcoming discomfort speaking in front of a group of people. Interacting with the Board has helped but I am still video shy. Over the past few years, being on the Board has become an important part of who I am. You know you are in good company when you can get a lot of great stuff accomplished and have a lot of fun at the same time!

Benefits of Being an Honest Broker

Our industry is renowned for misleading both sides of the hiring equations that we broker. We rationalize that it’s for their own good - especially when it for our own good. I’ve concluded that it’s not good for anyone.

Here are a few points to consider next time you have a moral dilemma about what to tell clients or candidates:

• When top level clients and candidates realize you’re an honest broker, you’ll have set yourself above the other recruiters who’re after their business. Result: More clients and referrals.

• Clients and candidates are more likely to tell you

the truth if they believe you’re telling them the truth. They will give you critical insights only if they consider you a trustworthy advisor. Result: More placements.

• Clients are more likely to work with you if they’re

convinced you’re honest. You seal future deals when you give advice that is in their best interests and they realize it’s not in your short-term income interests. Result: Greater client retention.

• Your day is less stressed and sleep more restful

when you’re doing what’s best for the people you represent. Result: More energy and eagerness to make sales and recruiting calls.

In the long run, being honest with clients and candidates isn’t always easy but is usually in everyone’s best interest.

Doing Less May Get More Results

Because the new year is just a few short weeks away, now is a good time to take inventory of your individual business processes. If you feel like you’re the proverbial hamster on the wheel, read on!

The business world seems to be full of overwhelmed people who are looking for “magic bullet” solutions to organize their space, manage their email overwhelm, or find a more efficient way to use their work time.

Frankly, there are no magic bullets.

Sure there are ways to do things moderately or significantly better, and for a certain group of people, those ways will really, really help.

IT’S JUST TOO MUCH! But there’s this whole group of other people are just trying TO DO TOO much. They are unfocused, scattered, stressed out and worn out. They have no discernment or boundaries around the information they are allowing to come at them.

Think of a dog in the yard…he’s out sniffing around, checking things out. Suddenly, SQUIRREL! And he’s off running in a whole different direction, and whatever he’d been sniffing before suddenly is completely forgotten.

This group of folks is just like that! They are trying to read everything, reply to every email, and learn everything there is to know about everything (especially in business). Think about what you’re doing and why you’re doing it. Rather than trying to squish it all in, figure out what you can get rid of through delegation or just stop doing it.

People simply can’t keep up this pace. You can see it on the faces of people you interact with every day. Everybody is overwhelmed. It’s just unmanageable. The only answer really is: Stop doing so much. Slow down. Think about about what you’re doing and why you’re doing it. And rather than trying to squish it all in figure out what you can get rid of through delegation or just freaking stopping doing it.

BUT...

Unfortunately, many of today’s “get organized” tips are really just temporary fixes that help relieve some of the pressure, but don’t actually delve into and solve the real problem. People inevitably fall back into go, go, go mode. They stop using the tips and tricks. Once they stop doing those things, once they let their guard down, the creep of paper and email and information starts coming back and everything falls apart again. They are in this cycle of, “Oh it’s better now. Oh, it sucks again. Oh, it’s better right now. Oh, it sucks again.”

STOP There is no solution to that until people STOP and pay attention to what they are doing and how they are spending their precious time.

Until people stop thriving on the chaos. Until they stop thriving on the overwhelm. Until they stop thriving on the stress. Until they get out of the habit of reacting and learn to simply respond. Until they say enough is enough and “I’m not living like this anymore. I’m not working like this anymore. My company is not working like this anymore.”

It’s a little bit like Chik-fil-A taking a stand and saying, “And on Sunday, we rest.” And sure we lose however many millions each year, but who cares? Because our people need to rest.

This “hamster on a wheel” method of coping is insanity and it is getting worse each year.

It is about priorities. But it’s also about your values. It’s about stopping long enough to see how you’re REALLY using your time versus how you actually WANT to be using your time.

That’s the long and short of it. That’s the big deal. When people are REALLY ready to create change, they are in it to solve the problem once and for all. They crave accountability. Why? Because they want OFF the hamster wheel.

There aren’t too many new ideas or thoughts, but it is frustrating to see people spend hours “getting organized” or finally cleaning out their inboxes only to see them backslide six months from now.

Controlling Your Company’s Legal Costs

“The most significant way to save legal dollars is to spend -investing in policies, training, and internal audits.”

Every company should establish a budget for legal costs, and staffing firms are no exception. However, what many employers do not know is how to spend their legal dollars to get the most bang for their buck.

Employers’ average defense costs are:

• EEOC charge = $3,000 – $10,000 • Frivolous lawsuit = $30,000 • Lawsuit “with legs” = $80,000 You can control legal costs by identifying where you should spend your money to best prevent and defend against expensive litigation. The most significant way to save legal dollars is to spend -- investing in policies, training, and internal audits.

Employee Handbook The employee handbook is the best communication tool for employees and is the original source of defense for employers. Make sure that the policies and procedures set forth in the handbook are current, enforced, and compliant with federal and state law.

For example, your current employee handbook should incorporate language from the recent amendments to the ADA, FMLA, and FLSA. An annual review and update of your handbook is necessary to best maintain compliance.

Consistent Training and Enforcement In addition, your managers and supervisors must be trained to enforce the policies in a consistent and uniform manner.

Supervisors should be trained on how to receive an employee complaint, how to conduct an investigation, and how to finally resolve the matter.

Internal Audits Finally, every staffing firm must conduct internal audits on a routine basis. Audits ensure that your company is operating in compliance with the law and also serve as a defense to EEOC charges and lawsuits. A good audit will include a thorough review of the company’s policies, payroll department, personnel files, I-9 Forms, and employee benefits.

With respect to payroll, the audit should focus on compliance with wage and hour laws governing exempt employee status, recordkeeping compliance, and wage deductions. Many “good” terminations go awry when wage and hour liability is discovered.

In the context of I-9 Forms, the audit confirms that the forms are properly completed, retained for the requisite time period, and cured of any paper violations. Additionally, an audit of healthcare coverage plans is of particular importance given the recent passage of the Patient Protection and Affordable Care Act. These are just a few examples of the internal audits we recommend.

By taking preventative measures, you minimize the chance of being sued. Even if you were to be sued, you’d be in the best position to defend and win the lawsuit. By investing your dollars in good policies, consistent training, and periodic audits, you can partner with your attorney to avoid spending many more dollars on litigation.

New Rules: CPC/CTS Recertify Annually

Happy Holidays! I’m excited to provide updates about certification as we start looking toward the New Year and new professional priorities.

Annual Recertification Requirements If you’re already certified, you know that maintaining your certification is as important as getting certified. NAPS (National Association of Personnel Services) certification is yours for life as long as you complete the continued education and training and submit this to NAPS.

April 28, 2011, Certification Training and Exam NCASP is pleased to host NAPS at our April 2011 annual spring Conference. NAPS will present the immersion course April 28, prior to the conference kick off.

Bob Style, NAPS corporate counsel and author of the training materials, and Dr. Frank Burtnett, educator and author of the certification exam, will facilitate the immersion training and administer the exam. The immersion training will cover both the CTS (Certified Temporary Staffing Specialist) and CPC (Certified Personnel Consultant) material. Below are links that will allow you to view additional information about each exam.

NAPS recertification guidelines have recently changed.

You must now turn in your CEU training log to NAPS every year rather than every 3 years. Now NAPS requires you to acquire 17 CEU hours annually. It has simplified this process to make it easy for you to get and stay certified!
