In spite of Friday's rain, Saturday morning was beautiful. The Easter bunny was available for pictures and handed out candy, the kids loved the bounce house. TO LIVE and to raise a family. Let's work hard to keep the high standard of living we enjoy in Northdale. If you are interested in volunteering, the Northdale Civic Association (NCA) has numerous committees that need assistance,including:countyrelations, events, deed restrictions, computers, finance, advertising and publishing this newsletter.

DEED RESTRICTION VIOLATIONS

Residents can request an investigation of deed restriction violations. Complaints need to be in writing or submitted online. The NCA conducts periodic neighborhood inspections and will act on their findings when necessary.

Residents can request an investigation of a possible deed restriction. Follow the instructions at http://www.northdale.org/ or, if you prefer, mail us a complaint. Print out a form on line or pick one up at the UPS store or the Sheriff's station in the BOCC building. Mail it to NCA Deed Restrictions at 3853 Northdale Blvd. #374, Tampa FL 33624.

When a violation occurs a letter will be sent to the violating homeowner with a request to correct the problem. After a reasonable amount of time passes, and the problem persists, the coordinator may contact you with the available options. Some of these options could include legal action against the homeowner.

The NCA will not become involved in conflicts between neighbors, animal problems or landscape issues due to drought.

The Northdale Civic Association is a volunteer organization of concerned citizens whose mission is to make Northdale a better place to live and increase property values by providing assistance in enforcing the deed restrictions to which each homeowner is legally subject.

The NCA is also the organized voice of Northdale, and represents residents when issues affecting Northdale are raised by Hillsborough County, the State of Florida and other governing bodies.

The NCA issues this Newsletter and organizes the following events and programs:WelcomeWagonProgram; Easter Egg Hunt; Community Garage Sales; Family Fun Festival; Northdale Pumpkin Run; Holiday Decorating Contest; Meet the Candidates; and the Northdale OWLS (Older, Wiser, Lively, Seniors). President’s Letter

The Northdale Civic Association will hold its Annual Meeting on Monday, May 16th at 7 P.M. at the Northdale Park RecreationCenter,15550SpringPineDrive.ElectionfortheNCABoardofDirectorswilltakeplacethat night.Themeeting is open to the public and I encourage residents to attend.

The 2016-2017 NCA Membership Campaign will begin on June 1st. The annual membership dues will remain $35.00 per household. This small investment (less than $3/month) gives us the ability to provide deed restriction enforcement in Northdale and, when necessary, pay for legal advice and services to resolve issues. In addition, it pays for maintenanceoftheNorthdalewebsite,NeighborhoodWatchprogram,theNorthdaleNewsletterpublicationandcommunity events like the Spring Egg Hunt, Concerts in the Park and the upcoming Candidates Night on August 16th. We could do so much more if more homeowners decided to support the community by joining the NCA. Please note that NCA membership dollarsarenot usedtopresenttheNorthdaleFamilyFunFestival and5K Pumpkin Runeventswhichareself-fundedthrough the sale of sponsorships or runner fees.

I want to extend my best wishes and thanks to Jim Plautz who has moved out of Northdale and has now turned over his duties as Editor of the Northdale Newsletter to Jessica Kingsborough, our newest NCA Board Member. As editor, Jim brought afresh perspective,creative ideas andfound cost savings forthe publication. The qualityofthe newsletter increased tremendouslyover the years that Jimwas incharge andhishard workisverymuch appreciated. Iknow Jessicawill continue to give us a newsletter that we will be proud of.

I want to thank NCA Board Member Martha Hughes who was chairperson of this year’s Spring Egg Hunt at Northdale Park on March 26th. Hundreds of happy kids enjoyed the morning at Northdale Park.

The Northdale Family Fun Festival & Parade on April 9th was blessed with picture-perfect weather which brought out alargecrowdof>3,500toenjoythefreefood,games,andentertainment.Thisevent bringspositiverecognition toNorthdale from many places outside the community. People from all over Hillsborough County and beyond came to Northdale Park and were impressed with our community. I want to thank all that helped make it a success.

It has been reported that the type of mosquito that carries the Zika Virus is present in Florida. We can all do something to help Florida fight the problem and it doesn’t cost anything. Mosquitoes can breed in standing water, so look around your yards and get rid of it empty flower pot saucers, pails, clogged gutters, or wherever water pools. Make sure bird baths have fresh water or put them away. Get rid of tires and other items that can collect water. Information about the Zika Virus can be found at the Florida Health Department’s website www.floridahealth.gov

Deed Restriction Committee Report

Since our last issue of the newsletter the Northdale Civic Association has received numerous phone calls and e mails requesting information about the planned construction on the southwest corner of Northdale Blvd. and North Dale Mabry Hwy. The calls are mostly homeowners that are concerned with traffic issues and some have expressed unhappiness with the removal of many trees and the openness of that area, with concern that it will affect property values in the community. This is not an NCA issue. The Northdale Special Tax District maintains the walls on both sides of the entrance to Northdale. The Tax District believes it has an easement agreement on that sideofthe street similarto theonetheyhave withWalgreens onthe otherside. Theyare currentlynegotiating with the developers of the proposed Wawa store to allow the monument to stay put. Refer to the Tax District article for more information.

Misinformation. 1) We get many requests to investigate an alleged violation in ways that we do not prefer. Phone call and email complaints limit us because we need legal documentation to proceed. If you think you see a violation then PLEASE file the proper form found on line at our web site. Folks tell us they do not like to file a form because they want it to be private. For the record, we do not divulge any complainant to anyone. Now, if a situation finds its way to mediation, then the mediator may insist on knowing the name of the person(s) filing the complaint, but we will let you know beforehand and let you make the call to go forward with the complaint. When we do an inspection I assure you it is near impossible to see everything, all the time, for 2600 homes. So if you think there is a violation that you feel needs to be addressed then file a complaint. The complaint form allows us to maintain proper records and helps with a reasonably accurate follow up system.

2) Another thing that seems to be out there is the NCA’s ability to enforce deed restrictions. Back in 2007 we started a process to first revise and then renew the deed restrictions. At that time we believed that our 30 year old restrictions would automatically renew for another 10 years. Much to our surprise our attorneys informed us of a Florida law, the Marketable Recording Title Act (MRTA) that made it impossible to renew. So without going into much detail about MRTA, we basically started over by revising and then renewing as each neighborhood section became due. The MRTA situation made a slight change to deed restriction enforcement, but did not eliminate it. When we send out a violation letter to owners (even if the property is a rental) we usually have success. Most homeowners comply. When a situation continues and we exhaust all avenues then the Executive Committee will make a decision on how to proceed. The severity of the case and financial obligation comes into the call. This is where your dues are so important. As I have said before, over 65% of Northdale homeowners approved the revised/renewed restrictions but less than 35% pay $35 a year dues. It is up to you.

Northdale Special Tax District

NORTHDALE SPECIAL TAX DISTRICT REPORT

Both the Tax District and the Northdale Civic Association have received many inquiries recently with regard to the proposed WaWa construction at the entry to our community. Below we will bring you up to date on what has and will be taking place.

On or about January 24, 2005, Sun Trust Real Estate Corporation created a Perpetual and Exclusive Easement for Entry sign and Landscaping (“Easement”) which was recorded on May 2, 2005 in OP Book 14848, Page 1856 of the public records of Hillsborough County, Florida. However, at the time of recording, the legal description of the propertyidentified in the Easementwas not attached. WhileNorthdale Special Dependent Tax District (the “district”) still believes it has a valid easement, UP Development WaWa Dale Mabry, LLC (the “Developer”) has yet to fully recognize the Easement.

The District has attempted to reach an amicable resolution with the Developer. However, to date, such efforts have proven unsuccessful. After heavy equipment appeared on the site, the District filed a lawsuit styled “Northdale Special Dependent Tax District v UP Development WaWa Dale Mabry, LLC”, in the Circuit Court of the Thirteenth Judicial Circuit, in and for Hillsborough County, Florida, Case No.2016-CA-2027, to quiet title with respect to the Easement as well as seek a temporary injunction to prevent any disturbance of the District’s sign and vegetation in the Easement area.

The District is still attempting to resolve this matter with the Developer. There is an injunction hearing scheduled for April 27, 2016, upon the District’s Motion for Temporary Injunction. In the meantime, the District is hopeful that an ultimate resolution can be reach. We will keep you informed as to the progress.

Meanwhile, repairs to our community walls continue and to date we have had no further updates from Hillsborough County with regard to the waste water construction that continues along Dawnview and Northdale Blvd. The County is currently taking bids for the landscape and irrigation repairs.

Please know that both the NCA and the Tax District are aware of your ongoing concerns and will attempt to keep you informed of any and all progress. As always we appreciate being alerted to any new conditions that may warrant our attention and actions. Thank you all for keeping Northdale a first rate community in which to live and raise our families.

Northdale Special Tax District

What is the NSTD?

The Northdale Special Taxing District is a Hillsborough County dependent tax district. The District was originally set-up under a State ordinance, but in 1992 was adopted under County ordinance #92-35. The County collects the taxes for the District and provides the ordinance or regulations that give authority to the District. Funds are derived from the County non-ad valorem tax of $130 per residential unit. Residents in single family homes, along with apartments and condominiums are assessed $130. Also, all properties within Northdale boundaries including businesses and other non-profit groups are taxed based on an equitable per residential unit basis.

The District is responsible for maintaining the common areas throughout Northdale. These areas include the main entrances coming into Northdale, landscaping in common areas alongside roadways and medians, neighborhood entrances, the outer surface of the block walls and along the roadside. The District also maintains selected lakes and wetland areas along the main roadways in Northdale.

TheDistrict is governed by a Board of nine trustees who are elected by the public or appointed by the Board. Board members must be registered voters and reside in Northdale. The trustees receive no compensation for their work. The Board has hired an administrator to complete many of the day-to-day details of the district. The administrator is a subcontracted (paid) position.

Although the District does maintain the common areas in Northdale, there are many areas that the District does not control. The District does not maintain roads, street lighting, street signs, or utility lines. Also, the District does not maintain private property or enforce deed restrictions. Deed restrictions are enforced by the Northdale Civic Association (NCA). The District and the Civic Association are two different and separate bodies. The District is a public governmental body and the Civic Association is a private association of Northdale residents. Only the Civic Associationhasauthoritytoissuedeedrestrictionwarnings.

Although separate, the District and the Civic Association work to achieve the same goal of making Northdale a great place to live.

Summer Reading

A summer reading brochures will go home with Claywell students. Kids are encouraged to go to their local public library, such as Jimmie B. Keel, to check out and read those titles over the summer. Also, check out all the wonderful programs offered by the public library system this summer. Another option is to visit local bookstores, such as Barnes & Nobles which offers a reading program. MyOn will be available online all summer too! Go to www.readonmyOn.com for contests. Scholastic also has a challenge for students. We’re hoping our students read at least 1500 minutes over the summer. Mrs. Kline hopes every child at Claywell enjoys reading for pleasure and information. Have a happy summer in June & July! We will celebrate our summer readers when they return in August.

Congratulations to all our third through fifth grade students who read all 15 of the 2015 Sunshine State Readers as well as some second graders who met the Non-Fiction Challenge. These students will celebrate with a pizza party in the library on June 1, 2016.

Thank You Northdale! for 32 good years!

Rosann and I moved to Northdale in 1984, with our three children; Bill, Mike and Kelly. They all graduated from Gaither with honors, went on to college and relocated out of state. Rosann passed away three years ago, leaving me with an empty space and a large home on East Course Drive. I sold my home in January and moved from Northdale.

I’ll miss Northdale. You’ll still see me sweating at the YMCA, playing pickleball at Northdale Park and trying to hit that little white ball on Northdale Golf Course. My son, Bill, and I played a lot of tennis at Northdale. I miss that too.

I have been Editor of the Northdale Newsletter the past two years. It’s been a good experience and that I will look back on with fond memories. My wish is that more Northdale residents would pay the $35 annual dues and support the Civic Association. They help keep property values high.
