Drug & Alcohol Clearinghouse Training by Amy Bricken, DriverIQ What is the FMCSA Commercial Driver’s License Drug and Alcohol Clearinghouse? The Clearinghouse is a secure online database that gives employers, the FMCSA, State Driver Licensing Agencies (SDLAs), and State law enforcement personnel real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations. An act of Congress directed the Secretary of Transportation to establish the Clearinghouse. The Clearinghouse enables employers to identify drivers who commit a drug and alcohol program violation while working for one employer, but who fail to subsequently inform another employer (as required by current regulations). Improving Highway Safety The Clearinghouse provides FMCSA and employers the necessary tools to identify drivers who are prohibited from operating a CMV based on U.S. Department of Transportation (DOT) drug and alcohol program violations, and ensure that such drivers receive the required evaluation and treatment before operating a CMV on public roads. The Clearinghouse Rule The Clearinghouse rule requires FMCSA-regulated employers, medical review officers (MROs), substance abuse professionals (SAPs), consortia/third-party administrators (C/TPAs), and other service agents to report to the Clearinghouse information related to violations of the drug and alcohol regulations in 49 Code of Federal Regulations, Parts 40 and 382 by current and prospective employees. The Clearinghouse also requires the following: • Employers are required to query the Clearinghouse for current and prospective employees' drug and alcohol violations before permitting those employees to operate a CMV on public roads. • Employers are required to annually query the Clearinghouse for each driver they currently employ. President’s Message John Rojas, President, NAPFTDS Hello NAPFTDS Members 2022 has been filled with many challenges and I hope you and your families are doing well. Entry Level Driver Training (ELDT) is here and in full effect. February 7th was on most of our calendars but no one knew it was going to be so crazy. I have had several conversations with schools across the country and everyone seems to be at capacity and having a 30 to 60 day waitlist for attending classes. The Training Provider Registry (TPR) is starting to take hold, but we have seen some challenges with testing across the country. CDL Testing has also had some challenges because of the confusion at our state DPS offices regarding ELDT. We have heard several delays with students who received their CLP prior to February 7th, and students who actually completed ELDT theory requirements and their school has entered their completion on TPR having to wait several days to test because of delays in FMCSA/States updating system. Our annual conference is approaching very quickly, I hope to see everyone in Scottsdale, Arizona. Please consider participating in the golf outing on Sunday. Can’t wait to see everyone.

By Martin Garsee We are only in the first few days of the month of March and this year has been fast and furious in the training world. Most of us are seeing record inquires for our programs. The well published supply chain issues, the news reporting driver shortage and the ‘popularity” currently of trucking has been good for the training industry. Since February 7th people are waking up to the world of Entry Level Driver Training (ELDT). Every person must receive training in order to be able to skills test for a CDL. This has been a long time coming and we could spend hours debating the years for it to become a reality, but it is now a reality. This alone has caused our schools to become more popular and valuable. I am sure many of you have answered hundreds of questions regarding ELDT, from local governments and agencies that thought they were exempt, only to find out that they are not. Also, from the general public wanting to get a CDL. Our time to shine is now. The other “big” thing is we are meeting on person after two years. You will find out more information about our Annual Conference in Scottsdale. I am so looking forward to meeting face-to-face, Teams/Zoom and all the other platforms are great but nothing replaces in-person networking. See you soon. Committee Happenings …

Carrier-Donnie Tulk, Chair. The Carrier Outreach Committee continues to move forward with getting the NAPFTDS postcard out to potential carrier members via an email blast and through the US postal Service. Please help us in getting the word out by supplying Crissie with information for non-carrier members that recruit your students, please email Crissie with the pertinent information for these potential carrier members. We need a contact name, email address, phone number, and mailing address so we can get the carrier outreach postcard in front of their eyes whether it be by email or regular mail. On another note, the Carrier Outreach Committee members are looking forward to seeing all of our Carrier members at the NAPFTDS annual conference in Scottsdale! Conference/Nomination-Martin Garsee, Chair. This year’s plans for annual conference are in full swing, Together Again – Face-To-Face! After a long 2-year pandemic, I think everyone is looking forward to this conference. We have presentations by FMCSA, AAMVA, Next Gen, Industry updates with a training on Monday morning on drug and alcohol clearinghouse. Also, there are 3 open positions for the Board with the following nominees: Kelly Carey (MD), Richard ‘Rickey’ Monroe (FL), Donnie Tulk (OK) and Dan Zdrojewski (WI). If you are not going to be present at this year’s conference, be sure to do an Absentee Ballot which is located on the Home page ‘Association New’ – Deadline is March 31, 2022 EOB! Education-John Thorpe, Chair. The education Committee has not met since we hosted the super-regional here in Drumright. Since getting back to somewhat normal since Covid-19 and with the implementation of ELDT, I felt like is was important for everyone to be able to focus on their schools instead of worrying about committees and webinars. My plan is to reunite the committee at Scottsdale and start meeting again monthly after the conference. Marketing/Social Media-Rob Behnke, Chair. The Marketing committee is a tool for the Association and its members to use when communicating our specific training or industry information. Since the start of the year, The Membership Committee has received a steady stream of applications and have reviewed 11 applications for membership. We have fielded many emails and phone calls from prospective members. There is a lot of interest in NAPFTDS from all parts of our industry. The value of NAPFTDS is second to none. Many training providers, companies, organizations, and institutions have started to become aware of us. It is truly an exciting time for NAPFTDS. Our Current Membership is comprised of 147 Schools and 31 Associate Members = 178 Strong! Regulatory-Jill Schultz-Chair. The Regulatory Committee informs NAPFTDS members of changes in federal laws, regulations, and policies related to truck driver training. Highlights for January and February include: • School Bus waiver. In January, FMCSA announced an optional three-month waiver of the “under the hood” component of the CDL skills test for school bus driver applicants. The waiver expires March 31, 2022. • Alternate vision standard. Effective March 22, 2022, CMV drivers who cannot meet the current vision standard with the worse eye may be eligible for an alternative vision standard. • Third-Party knowledge testing. FMCSA has issued an interpretation that states that third-party examiners are not prohibited from administering CDL knowledge tests – meaning a state driver licensing agency may allow administration of a CDL knowledge test by a third-party examiner. • FMCSA withdraws CDL-related proposals On March 9, 2022, FMCSA withdrew two proposals related to CDLs.  The first, a proposal that would have allowed a third-party skills test examiner to administer the CDL skills test to a student the examiner provided skills training to. This proposal has been withdrawn by FMCSA. The requirement in §383.75 of the FMCSRs, prohibiting this practice remains in place.  The second, a proposal that would have allowed a student to take the CLP knowledge test in a state that is not his or her state of domicile. While some states currently have agreements in place (and this will continue), this proposal, which has been withdrawn by FMCSA, would have allowed a student to take the knowledge test in any state. 2022 Board Nominees and Biography Kelly Carey is the Director of Transportation at Wor-Wic Community College in Salisbury, Maryland. I have had the position for 3 years after being promoted from the Transportation Coordinator position. My responsibilities include curriculum creation, new course implementation, planning coursework, staying in compliance with state and federal regulations, supervising up to 16 instructors, managing a $300,000 budget, and communicating with President’s staff and the Dean. I earned my CDL at Wor-Wic Community College in December of 2010 and immediately went over the road as a flatbed truck driver with a national company. Earning my CDL and starting my career in transportation was a life-changing experience for me. After four years over the road, I came home to help care for my elderly parents. I got a local delivery job and then a sales job prior to being hired at Wor-Wic Community College in the transportation department. Helping people earn their CDL and experience the success and joy of being in the transportation field brings makes my career rewarding and fulfilling. Seeing lives change in 8 weeks and families supported and giving people a second chance is the driving force behind my motivation. I have a bachelor’s degree in History, a master's degree in Management, Interdisciplinary Studies, and am currently in a Ph.D. program earning a degree in Organizational Leadership. The doctoral program is research oriented and my statistical analysis and ability to research and parse data could be an asset to NAPFTDS. Being able to serve on the Board of Directors for NAPFTDS would be rewarding and being part of the change and development happening currently in the industry would be exciting. NAPFTDS has been an asset to me as a director and I would like to serve other colleges making a difference in people’s lives. Richard ‘Rickey’ Monroe, Marion Technical College, Ocala, Florida. Rickey has been in the trucking industry since 1999. He has been in education as an instructor since 2012 and Lead Instructor/ Examiner with MTC since 2018. In his career, he has been a company driver, owner operator, owned a trucking company, dispatched as well as an instructor. As an instructor, he enjoyed being able to teach new drivers what he had learned over the years as well as his love for the transportation industry which he shared with his students. Donnie Tulk (Board member re-election) has 7 years as an instructor of Entry-level Driver Training, 6 years as a program coordinator, Truck Driver Training, 10 years as an Advisory Council member of Central Tech, Truck Driver Training and 38 years of Industry experience as Driver, Management, Recruiting and Safety. In 2017 Tulsa Tech hosted the Region 4 meeting. Donnie has attended Regional meetings and national conferences. His company was a carrier member in 2011 and his school, Tulsa Tech has been a full member since 2016. He has worked as a past Board member with the Oklahoma Trucking Association; past chairman of Oklahoma Safety Management Council; and was awarded the 2006 Safety Professional of the year award from the Oklahoma Trucking Association. I first became involved as a member of NAPFTDS in 2011 as a Carrier Member. At the time, I was on the advisory council of Central Tech's Trucking Driving Training program, being involved with Central Tech introduced me to several NAPFTDS members, I could see the passion that this great group of professionals had for properly training entry-level truck drivers and I knew that I needed to become a member and get involved with like-minded people that understood the importance of thoroughly and effectively training entry-level truck drivers. To me, serving on the board is an opportunity for me to give back to the industry that has been very good to me, also, I feel that by bringing almost 40 years of experience in the trucking industry coupled with the experience that I have so far in technical education, I believe I can work with all members equally to help make decisions that affect NAPFTDS in a positive way. My vision for NAPFTDS as an organization is to continue to be on the forefront of working with local, state and federal legislators in regards to changes in legislation or regulations when it comes to training entry-level truck drivers. I also feel that there is strength in numbers and the more members we have makes us stronger, I will pledge to put forth a concerted effort to be an NAPFTDS ambassador and will do my part to recruit full, affiliate, and associate members. 2022 Board Nominees and Biography cont’d Dan Zdrojewski (Board member re-election) For the last 8 years I have been a truck driving Instructor and the Lead Faculty at Milwaukee Area Technical College. The last 6 of those years, I have been the Membership Chair for NAPFTDS. Operating, developing, scheduling, designing, recruiting, teaching, coaching, implementing, listening, researching, learning, leading, following, and staying dedicated are constant daily tasks that I embrace in my career and life. I am a lifelong learner, US Army Veteran, 18-year experienced truck driver, with degrees in Computer Network Systems, Management, and Supply Chain Management. I have numerous certifications and awards; however, none of this compares to the intrinsic reward of watching my students reach their goals. These last 6 years, I have been honored and proud to serve the association as the Membership Chair for NAPFTDS. NAPFTDS Membership is increasing every month. The Membership Committee and I proudly strive to meet the demands for anyone seeking membership within our Association. Our continued success and dedicated work contribute to NAPFTDS’s growth and awareness. My vision for NAPFTDS is this continuing growth and sustainability. I want to continue the awareness of NAPFTDS and keep increasing the value of membership within the association. My goal is to make sure processes and procedures will continue to help NAPFTDS grow and evolve with the changing times. The skillset, knowledge, and connections I have acquired in my life and in the last 6 years will help assist NAPFTDS continue to achieve its goals. As individual schools, as an industry partner, and as an association, we are all faced with many challenges. I strongly believe NAPFTDS will help with these challenges and continue to lead the way into the future for its members and our industry.

Speakers - 32nd Annual Conference in Scottsdale, Arizona Brad Bentley, President, FASTPORT is a graduate of the University of Alabama, having earned a BA in broadcast journalism. Since that time, his accomplished career has led him to various leadership positions in trucking media companies like Randall-Reilly and serving as President of the Truckload Carriers Association (TCA). Today, Bentley oversees a variety of key roles as President of FASTPORT, including sales, operations and forming and enhancing trucking industry partnerships. In addition to his experience in driver recruiting, publishing and executive leadership, Bentley focuses on honoring our nation’s military with projects such as Wreaths Across America, and the Vietnam Veterans Memorial Fund’s The Wall That Heals. At FASTPORT, Bentley continues that work by helping the trucking industry adopt and improve military hiring programs, and he is currently pursuing a Masters of Arts In World War II Studies from Arizona State University.

Kevin Burch, Vice President, Governmental Affairs and Sales for Martin Transportation Systems (MTS), has over 48 years of experience in the trucking industry, including LTL, TL, Air Freight and consolidation. MTS purchased Jet Express in 2017, where Kevin had been President since 1990. MTS continues to handle, just in-time and general freight throughout North America.

Kevin is currently past chairman of the American Trucking Associations, the largest national trade association for the trucking industry (2016-2017). Through a federation of 50 affiliated state trucking associations and industry-related conferences and councils, ATA is the voice of the industry America depends on most to move our nation’s freight. Kevin is past-chairman of the Truckload Carriers Association (2009-2010). Kevin has been an active member of the American Trucking Associations since 1990. He serves on the ATA Executive Committee and Board of Directors, as well as numerous ATA committees. He serves as cochairman of the executive committee of the Trucking Moves America Forward image movement. Kevin is known for his I Heart Truck button and the creation of Safety Sammy, the industry’s mascot. Kevin is always promoting the image and career opportunities in the trucking industry. He is a Trustee of the Ohio Trucking Association, a steering committee member of the Dayton Logistics Council, Treasurer of the Miami Valley Transportation Club in Dayton, Ohio, a member of the Board of Directors of the Dayton Area Chamber of Commerce. Kevin believes that drivers drive the company and acquired his commercial driver’s license (CDL) at the age of 56. Kevin in 2014 received the prestigious Mike Russell Trucking Industry Image Award, and in 2015, Jet Express, Inc. received the esteemed Dayton Chamber of Commerce Corporate Partner Award, the John H. Patterson Award. In March, Kevin received the Lee J. Crittenden Memorial Award from the Professional Truck Driver Institute (PTDI) for his support of highly-skilled, safe and professional truck drivers. Kevin and his partners sold Jet Express, Inc. to Martin Transportation Systems (MTS) in November, 2017. Kevin continues to serve on their senior management team.

Richard Clemente, Transportation Specialist, FMCSA, has 35 years experience in transportation safety in the trucking industry. In his present position, Rich is a Transportation Specialist for the U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA), and has now been with the Agency for over 16 years. Rich works in the Driver and Carrier Operations Division and is responsible for assisting in the development of Federal rulemaking initiatives, interpretation and clarification of the Agency’s regulations and policies including the development and implementation of the entry level driver training rule. Prior to coming to FMCSA, Rich was the Director of Safety for the Truckload Carriers Association and began his career in transportation with the American Trucking Association as a Safety Engineer. Patterson High School Supply Chain and Logistics Training Center as well as co -founder of the Next Generation in Trucking Association. He has been actively involved in the trucking industry since 1988 as both a driver, manager, and founder of Faith Logistics; non-profit truck driving school ministry. Dave has been employed by the Patterson Joint Unified School district for 22 years and holds both multiple and single subject teaching credentials. The Next Generation Trucking Association is a non-profit trade association who is engaging and training the next generation of trucking industry professionals by partnering with high schools, community/technical colleges, and private schools to launch training programs around the United States.

Kevin R. Lewis, Director, Driver Programs, American Association of Motor Vehicle Administrators. Kevin was born in Pittsburgh, Pennsylvania on

January 5, 1955. Served in the United States Navy in the military intelligence arena from 1973 to 1979 and graduated from the University of Maryland with a degree in Business Administration in 1985. Kevin has over 40 years of Information Systems, Computer Hardware/Software Integration, and Driver Licensing experience. Kevin has worked for a wide variety of employers, including NASA, where he worked on the first 3 Space Shuttle launches and the Defense Advanced Research Projects Agency (DARPA) where he was responsible for managing the Agency’s Data Processing Center as well as providing computer hardware support for over 1,500 workstations. Kevin joined AAMVAnet in August, 1997 as the Driver Systems Implementation Manager and became Manager of the Operations Department in June, 1998. In March of 2000 he assumed the position of CDL Safety Director in AAMVA’s Programs department. He currently serves as Director of Driver Programs in AAMVA’s Member Services and Public Affairs Division and is the staff liaison to the AAMVA Driver Committee. Kevin has been married for 32 years and resides in Mitchellville, Maryland.
