R-S Residential District - Single-Family (§ 295-51 — § 295-58)

§ 295-51

Applicability.

In the R-S Residential District, the following regulations shall apply.

§ 295-52

Uses permitted.

[Amended 4-1-1974 by Ord. No. 1974-8; 5-9-1979 by Ord. No. 1979-4; 5-14-1986 by Ord. No. 1986-3] Permitted uses are as follows: A. Single-family detached dwellings. B. Churches or similar places of worship; parish houses. C. Schools, when not operated for gain or profit, including accessory residential uses. D. Private or semiprivate recreation areas as a special exception (see Article III, General Regulations). E. Hospitals, sanitariums, and nursing homes as a special exception (see Article III, General Regulations). F. Electric and telephone, public utility, transmission and distribution facilities, including substations, water pumping stations and reservoirs. G. Home occupations. H. Tilling of the soil, the raising of crops, fruits, and vegetables. I. Signs when erected and maintained in accordance with the provisions of Article XIX, Signs. J. Accessory buildings and uses customarily incidental to the above uses. K. Retirement housing as a special exception (see Article III, General Regulations).

§ 295-53

Height regulations.

[Amended 5-14-1986 by Ord. No. 1986-3] The height of a building shall not be greater than 35 feet. Height of retirement housing may exceed 35 feet, but shall not exceed five stories.

§ 295-54

Area regulations.

[Amended 5-14-1986 by Ord. No. 1986-3] The lot area per dwelling unit shall be not less than 7,500 square feet. The lot area per dwelling unit of retirement housing shall be not less than 4,000 square feet for a one-story unit, 3,000 square feet for a two-story unit, and 2,000 square feet for a three-story unit or above.

§ 295-55

Width regulations.

For a dwelling the lot width at the building line shall be not less than 75 feet on an interior lot.

§ 295-56

Yard regulations.

[Amended 5-9-1979 by Ord. No. 1979-4] Each lot shall have front, side and rear yard of not less than the depth or width indicated below:

A. Front yard depth shall be established by a building line at least 25 feet from the right-of-way line of the road or street which it abuts, except as follows: (1) Derry Street: front yard depth shall be not less than 80 feet from the center line. (2) Paxton Street: front yard depth shall be not less than 80 feet from the center line. (3) Traffic Route 441: front yard depth shall be not less than 80 feet from the center line. B. On a corner lot, the side yard abutting a street shall have the same width as required for front yard depth except for corner lots fronting on Derry Street, Paxton Street and Traffic Route 441, which shall have a minimum side yard width of 60 feet. C. Side yards. There shall be two side yards, one on each side of the main building, neither of which shall be less than five feet wide; the total width of the combined side yards shall equal at least 25% of the lot width at the building line. D. Rear yard: depth of 25 feet.

Coverage regulations.

The coverage shall be no more than 30%.

Off-street parking.

Hospitals, sanitariums, nursing or convalescent homes (see Article III, General Regulations). J. Lodging and boarding houses. K. Neighborhood shops as a special exception (see Article III, General Regulations). L. Private and semiprivate recreation areas as a special exception (see Article III, General Regulations). M. Schools when not operated for gain or profit, including accessory residential uses. N. Tilling of the soil, the raising of crops, fruits, and vegetables. O. Signs when erected and maintained in accordance with the provisions of Article XIX, Signs. P. Accessory buildings and uses customarily incidental to the above uses. Q. Conversion apartments. R. Professional offices conducted entirely within a dwelling by the occupant(s) of the dwelling and by no more than two employees in addition to the occupant(s).

Apartment dwellings: (1) Apartment dwellings of one or two stories: There shall be two side yards and a rear yard of not less than 15 feet each, provided that for each story over two, five feet of width or depth shall be added to the front, side and rear yards. The total width of the combined side yards shall equal at least 25% of the lot width at the building line. (2) In no case shall the length of front and rear walls exceed 40 feet without an offset of not less than four feet, or one foot times 1/2 the number of dwelling units contained within each "section," whichever produces the greater offset.

In the C-G Commercial District, the following regulations shall apply.

§ 295-108

Uses permitted; performance standards.

[Amended 5-9-1979 by Ord. No. 1979-4; 1-16-2002 by Ord. No. 2002-1] A. Permitted uses are as follows: (1) All uses permitted in any residential district, provided that residential uses shall be subject to the floor area ratio, area and lot width requirements of the R-M District regulations, in addition to the requirements of this article. (2) Indoor and outdoor recreation facilities whether or not conducted for gain or profit and amusement enterprises, including theaters, billiard or pool parlors, bowling alleys, skating rinks or similar uses or places of assembly. (3) Assembly and packaging of previously prepared electronic components such as controls communication and alarm systems, metering or measuring devices or similar uses. (4) Automobile sales and service garages, automobile service stations, auto body shops, auto sales lots, and house trailer sales. (5) Banks, business and professional offices. (6) Contractors, equipment and sales service. (7) Carpenter, cabinet making, furniture repair and upholstery, electricians, metal working, tinsmith, welding shops, plumbing, gas, steam, or hot water fitting shops, when these shops are in a completely enclosed building and are primarily assembly plants, or sales and service shops and not manufacturing plants. (8) Cleaning, dyeing and laundries. (9) Clubs and lodges. (10) Department stores. (11) Electric and telephone public utility transmission and distribution facilities, including substations, water pumping stations, and reservoirs. (12) Florists or nurseries, provided that all incidental equipment and supplies, including fertilizers and empty cans, are kept within the building. (13) Hotels, residential hotels, extended stay hotels, motels and tourist homes. (14) Hospitals, medical care centers and nursing homes, including convalescent homes. (15) Laboratories, and research labs for medical, dental, biological or similar uses provided the use is in an enclosed building and does not involve the keeping of livestock. (16) Building supplies, provided all material is stored within a building and enclosed or screened by walls or plant materials. See "screening," § 295-11C of this chapter.

(17) Medical and dental clinics and laboratories. (18) Pharmaceuticals. The compounding and packaging of previously prepared drug or pharmaceuticals or similar uses. (19) Publishing and printing. (20) Schools conducted for gain or profit. (21) Planned commercial developments. (22) Railway or bus passenger stations, telegraph offices and express offices. (23) Restaurants, tea rooms, cafes, and other places serving food or beverages. (24) Stores for the retailing of goods and services. (25) Warehouses, not including truck terminals and cold storage plants. (26) Business identification signs when erected and maintained in accordance with the provisions of Article XIX, Signs. (27) Other uses similar to those enumerated above. (28) Accessory buildings and uses customarily incidental to the above uses. (29) Indoor health club and/or physical fitness facility. [Added 11-8-2006 by Ord. No. 2006-5 ] B. The above specified stores, shops and businesses shall be permitted only under the following conditions: (1) Such uses, operations, or products shall not be objectionable due to odor, dust, smoke, noise, vibration, or other similar causes.

Height regulations.

The height of a building shall be not greater than 35 feet except as provided for in the "height" section of the general regulations, ยง 295-9.

ยง 295-110

Yard regulations.

[Amended 5-9-1979 by Ord. No. 1979-4] Each lot shall have a front, side and rear yard of not less than the depth or width indicated below: A. Front yard depth shall be established by a building line at least 40 feet from the right-of-way line of the road or street on which it abuts, except as follows: (1) Paxton Street: Front yard depth shall be not less than 100 feet from the center line. (2) Traffic Route 441: Front yard depth shall be not less than 100 feet from the center line. (3) Eisenhower Boulevard: Front yard depth shall be not less than 100 feet from the center line.

B. Two side yards shall be provided, one on each side of the principal building, and each shall have a minimum width of five feet. On a corner lot, the side yard abutting a street shall have the same width as required for the front yard depth except for corner lots fronting on Paxton Street, Traffic Route 441 and Eisenhower Boulevard, which shall have a minimum side yard width of 80 feet. C. Rear yard depth: five feet. D. Buffer yards shall be provided in accordance with the provisions of Article III, General Regulations, ยง 295-11, Yard regulations.

Coverage regulations.

The coverage shall be no more than 60%. At least 10% of the lot area shall be covered with vegetative material.
