Raja, Kanimozhi acquitted in 2G case
NPRAAF’s 7-day ultimatum to Rural Development dept.
NEW DELHI, DEC 21 (AGENCIES): A special court on Thursday, acquitted all 33 of the accused in the alleged 2G scam, which Time magazine had ranked it as the world’s secondbiggest abuse of executive power after the Watergate scandal in the US. According to IANS, this came as a major relief to former Telecom Minister A. Raja and DMK MP Kanimozhi who were charged and jailed on allegations of kickbacks for issuing the telecom spectrum and licences at throwaway prices in 2008. The 2G scam hit the headlines after the then Comptroller and Auditor General, Vinod Rai in an audit report alleged that Raja sold spectrum and telecom licences to private firms at throwaway prices. Questions have been raised on Rai’s calculations putting the notional loss to the exchequer due to the spectrum allocation, in 2008, on a ‘first-come-first-served’ basis, at Rs 1.76 lakh crore. A. Raja eventually became the face of the scam among others accused of complicity -- DMK Rajya Sabha member Kanimozhi
and DMK supremo M. Karunanidhi’s wife Dayalu Ammal. Others acquitted in the case are former telecom secretary Siddharth Behura, Raja ‘s erstwhile private secretary R K Chandolia, Swan Telecom promoters Shahid Usman Balwa and Vinod Goenka, Unitech Ltd MD Sanjay Chandra and three top executives of Reliance Anil Dhirubhai Ambani Group (RADAG) -- Gautam Doshi, Surendra Pipara and Hari Nair. In his first reaction after the verdict, a beaming Raja said he was “happy with the judgment”. DMK MP Kanimozhi today said justice has been delivered with the special court acquitting her and others in the 2G spectrum allocation scam cases, and described her last six years as “harrowing and “excruciating”. Case was based on rumour: Special Judge OP Saini, who oversaw the trial of all 2G spectrum cases since early 2011, on Thursday said his seven-year anticipation for evidence ended “all in vain” because the case was mainly based on “rumour, gossip and

speculation”. The judge pulled up the prosecution that started the case with “great enthusiasm” but became “highly cautious and guarded as to what (it) wanted to prove”. He said the “quality of prosecution totally deteriorated and became directionless and diffident”. He said even several applications and replies were filed but no senior officer or prosecutor signed these applications and left a “junior-most officer, Inspector Manoj Kumar,” to do that. The judge said when the final arguments started, the prosecutor had promised to file written submissions but argued the matter orally for several months.
The prosecutor, he said, filed unsigned written submissions even after “great efforts had to be made to persuade” him. “What is the use of a document in a court of law which is not signed by anyone?” “Many more things can be said but that would only add to the length of the order.” The judge also pulled up the DoT saying the policy decisions of the department were found to be scattered in different official files and that had made it difficult even to its officials to trace and understand them. “I have absolutely no hesitation in holding that prosecution has miserably failed to prove any charge against any of the accused, made in its all well choreo-

A press release from ZPO (N) president, Kezin Zeliang and secretary, Kerang Dumtta placed this request before the government “taking the advantage of the good gestures and benevolent attitude of the government towards Peren district” – which is referring to the upgradation of the administrative headquarters of Jalukie from SDO(C) to that of ADC, and EAC Athibung to that of SDO(C). While the area is abundant with greenery, vegetables and other perishable items, they are left to rot because they cannot be marketed as transportation costs are too high,
they said. They added that due to road conditions, essentials commodities and building materials are made more difficult to acquire with the high rates of transportation. In view of this, they asked the government consider the plight of the people and immediately take remedial measures to address the problem of transport and communication for the people of Tening area. On behalf of the Zeliang and Kuki community of Peren District (N) they also expressed their sincere gratitude and profound appreciation to the government, all well wishers and officials involved in fulfilling the long cherished wishes of the people of the district by upgrading the two administrative headquarters. CBI to appeal: The CBI on Thursday said it would file an appeal against the 2G scam case verdict by a special court, which acquitted all the 16 accused rejecting the case presented by the agency. The agency, which normally takes months to “study” court orders before proceeding to file an appeal in higher court, declared within hours of the verdict that “it has been prima facie examined”. “The judgment relating to the 2G scam case of today has been prima facie examined and it appears that the evidence adduced to substantiate the charges by the prosecution has not been appreciated in its proper perspective by the learned court. The CBI will be taking necessary legal remedies in the matter,” CBI spokesperson Abhishek Dayal said. Asked whether an appeal would be filed in the Delhi High Court challenging the verdict, the spokesperson replied in the affirmative.

D i m a p u r , D ec 2 1 (NPN): Nagaland Public Rights Awareness and Action Forum (NPRAAF) on Thursday once again threatened to approach the Centre for initiating a probe into utilisation of Rs 1,000 crore meant for implementation of MGNREGA in Nagaland in 2016-17 and 2017-18, if Rural Development (RD) department continued to refuse to give details in public domain about utilisation in the next seven days. NPRAAF through its Information & Publicity pointed out that it had disclosed through local dailies on October 8, 2017 that more than Rs 1,000 crore was released to Nagaland for implementation of MGNREGA in the two fiscals. In this regard, NPRAAF said it had urged upon the RD department to reveal details of release of funds for material and labour components district-wise, block-wise and village-wise through local newspapers as there were widespread allegations of misuse of the fund. NPRAAF had also
follow up action from the NSCN (I-M). In a statement through media cell, the federation said it was totally against bursting of crackers within Dimapur urban area, especially during festive seasons. It reminded the citizens that Christmas was not about bursting crackers, but was about receiving the Saviour in our hearts. “We
cautioned the department then that refusal to provide the details in public domain might compel it to approach appropriate authorities for initiating a CBI inquiry into the entire matter. However, the Forum said the department had ignored its appeal so far in disclosing the fund distribution details in public domain and did not exhibit transparency in the matter of its utilisation. “Given the humongous amount involved and the RD department shying away from exhibiting transparency in the management of funds, NPRAAF is contemplating taking up the issue of MGNREGA fund separately and will approach the Centre for an inquiry,” the Forum cautioned. NPRAAF also warned that it should not be held responsible in the event of any freezing of MGNREGA funds to Nagaland by the Government of India. The Forum reminded the RD department for one last time to disclose the complete details of utilisation and distribution of MGNREGA funds in public domain within the next seven days.

According to DUCCF, bursting of crackers was harmful to health and environment as hazardous chemicals were used in manufacturing crackers.

However, in view of the urgency of the issue, ten members demanded a short duration discussion demanding that the resolution should be adopted to protect the territorial boundary of Manipur and furnish the same to the government of India. Opposition leader and former chief minister (CM) O. Ibobi Singh and former deputy chief minister, Gaikhangam also joined the chorus that the issue be discussed in the House.
