NEW DELHI, AUG 17 (AGENCIES): Retired military officers and bureaucrats on Saturday filed a petition in the Supreme Court, challenging the Presidential order by which Article 370 was abrogated, saying that the order was constitutionally invalid. The petitioners have also challenged the Jammu & Kashmir Reorganisation Bill. The petitioners include former Air Vice Marshal Kapil Kak, Retired Major General Ashok Mehta, former IAS officers Hindal Haidar Tyabji, Amitabha Pande and Gopal Pillai, and former member of the Home Ministry’s Group of Interlocutors for J&K Radha Kumar. The petition has been drawn by advocates Arjun Krishnan, Kaustubh Singh and Rajalakshmi Singh and settled by Senior Advocate Prashanto Sen. Terming the presidential order on abrogation of Article 370 as constitutionally invalid, the petition states that a presidential order under “Article 370(3) of the Constitution requires the Constituent Assembly of Jammu and Kashmir to recommend a presidential notification under Article

August 23: NH calls for meeting of tribe hohos D I M A P U R , AU G 1 7 (NPN): Naga Hoho has convened a meeting of all tribe hohos at Hotel Metsuben, Mokokchung on August 23, 2019 at 5pm to deliberate over the report of search committee and finalise its way forward. NH through its communication cell stated that on the expiry of Naga Hoho tenure for 2013-18, a search committee was set up to nominate/elect the new team of office bearers and to reach out to the dissociated tribe hohos for strengthening of NH. Accordingly, it said the search committee worked tirelessly for the last eight months in the interest of Naga people and had submitted its report to the office of the Naga Hoho. Stating that every Naga citizen was well aware that the time has come to be united, the NH said Nagas’ aspiration to hammer out political settlement and live in peace lay in cohesive efforts of all rank and file. “This is the defining moment to forgive each other and prepare for our future by crucifying narrow tribalism, regionalism, groupism and egoism,” it stated. NH therefore, requested all the tribe hoho presidents/representatives/ interested individuals to attend the scheduled meeting.

Article 370 370(3) declaring that Article 370 shall cease to be operative”. “ T h e Ja m m u a n d Kashmir Constituent Assembly no longer exists and thus could not have made a recommendation to that effect,” the petition states. The petition describes the amendments “as striking at the heart of the principles on which the State of J&K integrated into India, especially as they had no affirmation/sanction from the people of J&K which, according to the petition, is a constitutional imperative as far as the State of J&K is concerned.” Speaking of the amendments, the petition states that the alteration which says that the “legislative assembly of J&K doesn’t have the power to alter state’s

relationship with India on account of Article 147”, it said, “has the effect of undermining the very basis on which the state of J&K had integrated into India”. The petitioners have said that the decision to abrogate the provisions under Article 370 which has been effectuated “without ascertaining the will of the people either through its elected government or legislature or public means such as referenda, violates the basic principles of democracy, federalism, and fundamental rights”. “The unconstitutionality of the act is further exacerbated by the fact that this declaration had been made with the concurrence of the Governor [Satya Pal Malik] at a time when the state of Jammu and Kashmir was

under the President’s rule,” the petition read. The petitioners also said that the brazen unconstitutionality of the act is unprecedented. Challenging the division of the state into two union territories, the petition states that downgrading the status of J&K and creating two union territories could not have been exercised without the consent of the state of J&K. The petition stated that, “The principle of pluralistic federalism would be set at naught if one of the two parties to the federal relationship (i.e., the Union) can unilaterally amend the terms of their relationship, without even passing through the rigours of the amending process under Article 368”. “The distribution of power between the Union and the (erstwhile) State of Jammu & Kashmir reflected that matters of national importance in which a uniform policy is desirable is retained with the Union of India and matters of local concern remain with the State of Jammu & Kashmir. Thus, with the State of Jammu & Kashmir, the quasi federal structure of the Constitution of India continues, but with

certain differences. These have been on account of historical developments already explained hereinabove and in fact many states enjoy a special relationship in view of the peculiar facts and circumstances relating to that State. This is reflected in Article 371-A to 371-J which provide a special status, in different respects, to the states of Nagaland, Mizoram, Manipur, Maharashtra, Karnataka, Sikkim, and others.” “By the impugned acts, the respondent has sought to completely destroy the very basis on which the (erstwhile) State of Jammu & Kashmir had been integrated into India and, in the process, has also jeopardized the quasi federal balance envisaged by the Indian Constitution,” it said. PMEGP a mental harassment NSCN (I-M) ‘lieut’ held for most applicants, says BAN in Aboh murder case DIMAPUR, AUG 17 (NPN): Following several complaints by successful Prime Minister’s Employment Generation Programme (PMEGP) applicants, the Business Association of Nagas (BAN) said it was surprised to learn how the individuals had to undergo mental, physical and financial harassment by various banks even after clearing the selection process conducted by the government. A meeting in this regard was held with the 24 aggrieved applicants on Saturday, organized by BAN here at Hotel Saramati. Citing a case, BAN said a female applicant was asked by a private bank to deposit Rs 10 lakh as collateral for a Rs 15 lakh project. In another case, a government undertaking bank made a pregnant lady run from pillar to post and in the end refused her the financial assistance, it added. It also pointed out that a youth, with a brilliant idea, after receiving a notice that he was selected for the loan, made a trip to Delhi to get industry experience. However, after he came back, the bank declared

that his project was ‘not feasible’, BAN stated. BAN said it failed to understand why applicants were made to go through a lengthy process of project making, interview, entrepreneurship development programme etc. only to be shown the door by the banks. “Our youths may not be technically sound but today’s generation have shown positive entrepreneurial spirit and dedication,” said BAN, adding that they should be given a chance. Though past beneficiaries may have defaulted and created NPAs, BAN said the present generation should not pay for the sins of the past. Since this was a Prime Minister’s scheme, that holds great promise and can empower many upcoming entrepreneurs, BAN advised the authorities not let it be downgraded as just another lowly government scheme. Assuring that it would take the matter with authorities concerned, BAN said it was committed to help genuine applicants of the scheme, so that they get what they deserve.

IMPHAL, AUG 17: In one of the biggest seizure in the North Eastern region, Manipur police on Saturday busted an illegal drug factory in Thoubal district and seized huge quantity of brown sugar worth over Rs. 150 crore in the international market. A special police team assisted by a local body raided a house in Moijing Awang Leikai area of Thoubal district and seized equipments and chemicals used to manufacture heroin and brown sugar, Superintendent of Police, Thoubal, S Ibomcha Singh stated. The team police team assisted volunteers of ANJUMAN-- a civil society body against drug menace and trafficking, busted the

GUWAHATI, AUG 17 (AGENCIES): The National Investigation Agency (NIA) arrested a ‘lieutenant’ of NSCN (I-M) on Friday in connection with the killings of 11 persons, including an NPP MLA, Tirong Aboh of Arunachal Pradesh on May 20, a Deccan Herald report stated. A joint team of NIA and army arrested Yangte Josaham from Dimapur, following an investigation revealing his involvement in the killings. Josaham, hails from Longding district in Arunachal Pradesh, a statement issued by NIA said. Two other members of the outfit- Sethok Kangnong and Napong Jenpi - were also arrested earlier in connection with the case. According to reports, Josaham was arrested after the two, during interrogation, revealed about his involvement including others. Josaham will be taken to Guwahati for interrogation, sources informed. Tirong Aboh and others were killed just before the Arunachal Pradesh Assembly elections were declared. Aboh, who contested as a NPP candidate, also won the elections, results of which was declared on May 23. The BJP government had handed over the case to NIA soon after it took charge.

KOHIMA, AUG 17 (NPN): Kohima police on Saturday morning recovered a body of an unidentified non-Naga male who was found shot dead in a waiting shed in Zubza area. According to PRO Kohima police, the deceased, around 25 years of age, was found with his hands tied and bullet wound on the left side of the temple. PRO said a post-mortem was conducted and the body kept at the morgue for identification. A case has been registered at Sechu Zubza police station and investigation underway. It may be recalled that unidentified masked gunmen shot dead a senior NSCN (I-M) functionary, ‘major’ Toishe Yeptho at point-blank range inside his residence at Purana Bazaar-B, unit colony, Dimapur on Friday around 7.30 p.m.

DIMAPUR, AUG 17 (NPN): Kohima Smart City Development Limited (KCDL) in collaboration with the Green Team Kohima invited the Kohima Chamber of Commerce and Industries (KCCI) for a consultative meeting under the “100 days Smart City Special Initiative Campaign on Sanitation” and also in pursuance to the government order on ban of plastic on August 16, 2019 in the chamber of the KMC administrator and CEO, KSCDL to discuss and draw out strategies for implementation and enforcement of the plastic ban. At the meeting, KMC administrator & CEO Kovi Meyase reminded that only a month was left for the ban to come into force i.e. September 17, 2019. He said that the whole issue of plastic ban would not be possible without the inputs

and efforts of the KCCI. Meyase pointed out the need to rope in all stakeholders for the implementation to be successful. While NGOs like the Green Team Kohima were taking all efforts to create awareness, it was felt that KCCI has a very important role in generating awareness and helping enforce the ban. Deliberating on how best to go about in implementing and enforcing the ban on plastic, the members decided that since the District Task Force headed by DC Kohima has been entrusted with the responsibility of monitoring and vigilance purpose, the task force may first be consulted. The members then decided to put forward some suggestions and practical action plan for the perusal and incorporation by the task force.

NH and NMA react to NDPP’s clarification Organizations flay killing of NSCN (I-M) member DIMAPUR, AUG 17 (NPN): Reacting to the clarification issue by the National Democratic Progressive Party (NDPP) to its objection on the chief minister’s statement at the JLF meeting, the Naga Hoho (NH) and Naga Mothers Association (NMA) said NDPP tried to clarify that NH and NMA had made the allegations against the chief minister based on hearsay. In a joint statement, NH and NMA said it appreciated the initiative of NDPP in admitting the unpalatable statement made by the leader of the state in the Joint Legislators Forum meeting. They said that there has been no breach of trust since the JLF meeting was not a confidential one, with many others including a non-Naga present. F u r t h e r, N H a n d

NMA said that the nonNaga junior advocate was given the responsibility to speak on Article 370 and Art 371 A for a long time. This has raised questions on the lack of trust by the state, on the professional knowledge of eminent Naga advocates and Judges, who would have been equally competent to speak on the same Constitutional provisions before the elected Naga legislators, they stated. NH and NMA asserted that their objection was not only on the allegation of being unmandated, but also on the chief minister’s claim that the NPGs had lost confidence on these organisations, which was defamatory and false. Therefore, the claim that the chief minister had expressed his concern to strengthen these organisations in larger interest was

based on wrong hearsay, they said, adding that was not what was conveyed to the audience at the meeting. NH and NMA reminded that the Naga Hoho was constituted as the apex body consisting of all Naga tribes, that has been working for unity and fraternity among the Nagas. Despite efforts to destroy it, they said NH maintains its responsibilities and will continue to do so, till the next team takes over. They also reminded that the Naga Mothers’ Association which was formed in 1984, was not based on tribe constituents but on voluntary membership of adult Naga women from different tribes and background. They said NMA continues to work with tribe women organisations affili-

ated to it and other women from different tribes, in protection of women’s rights, peace work and running the NMA Cradle Ridge Centre, Seithogei which is the only Centre in the state, looking after HIV positive orphaned children of both sexes, for decades. T h e r e f o r e, N a g a Hoho and Naga Mothers’ Association asserted that they remain committed to building peace and working for the larger interest of the Nagas. “The years of commitment and contributions of the Naga Hoho and the NMA is on record, and cannot be wiped away by vested interests or the State on vague reasons or defamatory allegations. The days ahead will reveal the true intentions of a State that professes peace and unity, but seeks its own glory,” they stated.

D I M A P U R , AU G 1 7 (NPN): Several organisations have condemned the killing of a senior NSCN (I-M) functionary, ‘major’ Toishe Yeptho, by unidentified masked gunmen in Dimapur on Friday. NSCN (I-M) through its MIP said Nagas in general and the organisation in particular were shocked at the dastardly act of killing ‘maj.’ Toishe Yeptho when Nagas were “still in upbeat mood having just celebrated the ‘73rd Naga Independence Day across Nagalim.” “Such a manner of cowardice by the killers is condemned in the strongest term by NSCN,” MIP stated, adding that “wicked are the enemies when they choose to strike at the time when the Nagas were at the threshold of making a deal with the Government of India to end the seven decades of Naga political struggle.”

According to MIP, late ‘maj.’ Toishe left behind a record of having given his best in the service of the Naga nation and his name shall be recorded in the pages of the Naga history. MIP conveyed condolences to the bereaved family, and prayed that Almighty God give them strength and courage to face these hours of heavy burden. CNTC: Central Nagaland Tribes Council (CNTC) has highly condemned the killing and said that whoever was responsible for “such kind of abominable act” should be condemned by all and severely punished. CNTC through its media cell stated that such type of “horrendous act” upon one’s own brothers brings only doom and curse to the society. At a time when every Naga was craving for peace, CNTC said “such

inhumane killing of a person who is son, a husband and father sows only seeds of hatred and bitterness amongst ourselves.” CNTC maintained that it was time the Nagas “shed the practice of killing and annihilating in our midst and stand united for peace, progress and prosperity in our land.” Further, CNTC has demanded that the authorities properly investigate the matter and bring those responsible to justice. It also appealed to for every group and faction to maintain peace and harmony CNTC has condoled the death and conveyed heartfelt sadness and condolences to wife, children and relatives.
