Death for rape of children below 12 yrs

NEW DELHI, APR 21 (AGENCIES): Union Cabinet on Saturday approved an ordinance that provides for death penalty to those convicted of raping a child below the age of 12 and life term for raping a girl below age of 16. The Criminal Law (Amendment) Ordinance, 2018, approved at cabinet meeting presided over by Prime Minister Narendra Modi, seeks to provide effective deterrence against rape and instill a sense of security among women, particularly young girls in the country. Centre also decided to put in place a number of measures for speedy investigation and trial of rape cases including a two month time limit for investigation, two months for completion of trial and six months for disposal of appeals. There will be no provision for anticipatory bail for a person accused of rape or gang rape of a girl under 16 years. The Cabinet also decided to strengthen investigation and prosecution including setting up fast track courts, and special forensic labs in each state besides maintaining a national database of sexual offenders.

States asked to expedite Lokayukta appointment NEW DELHI, APR 21 (IANS): Supreme Court has asked 11 states and a union territory to expedite the process of appointing Lokayukta or Uplokayukta. A bench of Justice Ranjan Gogoi and Justice R. Banumathi said appointment “need not wait and the process (must) be expedited”. Earlier, the court asked the chief secretaries of the states to explain reasons for non-appointment of Lokayukta in their respective states or UT even after the law was enacted in 2013. These include Jammu & Kashmir, Odisha, Manipur, Meghalaya, Mizoram, Nagaland, Tamil Nadu, Telangana, Tripura, West Bengal, Arunachal Pradesh and the union territory of Puducherry. On Thursday, many states filed affidavit saying they have been taking steps to appoint Lokayukta and some have recommended the name to a selection committee. Manipur, Arunachal Pradesh, and Telangana sought time. The court order came on a petition by BJP leader and advocate Ashwini Kumar Upadhyay, seeking appointment of Lokpal at the Centre and Lokayukta in the states.

The ordinance came in the wake of a nationwide outrage over rape and murder of an eight-year-old girl in Kathua in Jammu and Kashmir, and other instances in different parts of the country including rape of a nine-year-old girl in Surat.

Amendment in POCSO Act: Punishment for the child rapists: Death penalty and life imprisonment.  In case of gang-rape of a girl below the age of

12, the punishment will be- death penalty or life imprisonment.  In case of rape of a girl below the age of 12, the punishment will be- death penalty, life imprisonment or a minimum imprisonment of 20 years.  In case of gang-rape of a girl below the age of 16, the punishment will beimprisonment for the rest of life. In case of rape of a girl below the age of 16, the punishment will be- impris-

onment for 20 years (earlier 10 years) which is extendable for rest of life.  In case of rape of a woman, the minimum punishment has been provided to be 10 years (earlier 7 years) which is extendable to life imprisonment. Time limit for investigation and trials under the amendment: Investigation of all cases of rape should be completed within 2 months  The trial of all rape cases should be completed in 2 months.  A time limit of 6 months has also been provided for disposal of appeals in rape cases. Restrictions on bail: There will be no provision for anticipatory bail for a person accused of rape or gang rape of a girl under 16 years.  Before deciding bail applications in case of rape of a girl under 16 years of age, the court has to give notice of 15 days to the public prosecutor and the representative of the victim. Other provisions of the amendment: To help the victim of rape better, the present scheme of One Stop Centres for assistance to the victim will be extended to all

districts in the country.  Dedicated manpower will be provided for investigation of rape cases to speed up the investigation.  Special forensic labs will be set up in States/UT exclusively for rape cases.  Special forensic kits will be provided to all Police Stations and hospitals for rape cases.  New Fast Track Courts will be set up in consultation with States/ UTs and High Courts.  New posts of public prosecutors in consultation with States/UTs.  National Crime Records Bureau will maintain a national database and profile of sex offenders which will be shared with states/ UTs to better track, monitor, investigate and verification of antecedents by police. What is POSCO Act? Protection of Children from Sexual Offences Act (POCSO Act) 2012 was formed to protect children from offences of sexual abuse, sexual harassment and pornography and to provide a child-friendly system for the trial of these offences. The act received the President’s assent on June 19, 2012.

Acharya, has appealed to the people of Nagaland, especially retired teachers, who could teach two or more local dialects, to come forward to be a part of the NE department/chair of different universities in the country. According to a Raj Bhavan statement, those selected persons would have to go to Mumbai, Mangaluru or Delhi. The Universities would provide accommodation and honorarium for their service. Governor said it was a positive and noble mission for strengthening emotional and national integration. Interested persons could submit applications along with details addressed to Ms. Pooja Kamath, Secretary, INFC, Mumbai and mail to Raj Bhavan, Kohima within 30 days. Governor has initiated opening of NAMASTE (Nagaland, Arunachal Pradesh, Manipur, Meghalaya, Mizoram, Assam, Sikkim, Tripura) NE Department/Chair in different Universities of the country to teach local dialects of the NE states. Gover-

nor observed that nearly 800 Universities in India have a department for foreign languages including German, Korean, French, etc while only a few Universities have a department/chair for tribal dialects. Acharya has so far motivated Mumbai University, SNDT Women University, Mumbai, Dr Babasahib Ambedkar Technical University, Maharashtra, NITTE Medical & Science University, Mangaluru, Alva’s Education Foundation, Mangaluru, Manipal University, Mangaluru and JNU, New Delhi to start a Department/Chair for tribal dialects. All the above Universities have requested the governor to identify and nominate one guest teacher who could teach at least two dialects of North East for their NE Department. The honorary teacher would be teaching once or twice in a week for an hour. Earlier, in 2016, NITTE University, Mangaluru had invited Governor Acharya to inaugurate the NAMASTE NE Department, in the name of Dr.T.Ao, an Olympian from Nagaland.

MOKOKCHUNG, 21 APR (NPN): In a tragic accident, one person died while three others sustained injuries when they were buried under a retaining wall which collapsed at Tongdensuyong Ward Saturday at around 3 p.m. All four were masons working on the particular wall of which one died on arrival at the hospital. Of the three, one of them was rushed to the hospital for treatment of injuries. On receiving news of the tragedy, police and civil officials along with disaster management personnel rushed to the spot to supervise rescue and provide assistance. It may be pointed out that the public nearby immediately responded when they dug out the persons buried underneath the earth and also rushed the injured to hospital. M e a n w h i l e, D C Mokokchung visited the injured at the hospital. He also handed over immediate relief amount of Rs. 10,000 to the deceased’s father and Rs. 3000 each to the injured.

Today I am severing my ties with the BJP,” the 80year-old announced at a meeting here attended by opposition leaders from the Congress and the RJD besides dissident BJP leader and Patna Sahib MP Shatrughan Sinha. Sinha, who held finance and external affairs portfolios in the Atal Bihari Vajpayee government but was sidelined after Narendra Modi and Amit Shah came at the helm,

made it clear that he would not join any other political party, saying he was taking ‘sanyas’ (retirement) from party politics and will now work for “saving democracy in the country”. The BJP said it was not surprised by his decision as it was clear from his opinions and actions that he had been acting at the “behest of the Congress”. Sinha has been publicly opposing the Modi government’s economic policies and style

of functioning. The Congress, meanwhile, took a swipe at the BJP, saying all honest senior leaders are being forced to take ‘sanyas’ in the saffron party. Shatrughan Sinha dares BJP: Hours after Yashwant Sinha announced quitting the BJP, actor-politician Shatrughan Sinha dared the ruling party to take action against him if it wants to but made it clear he won’t resign from its membership on his own. Shatrughan Sinha has been at loggerheads with the current BJP leadership since the 2015 Bihar elections. He has often taken a stance at variance with the official party line, including on demonetisation, implementation of GST, and on BJP government’s policy on Kashmir.

KOHIMA, APR 21 (NPN): Four students of Kohima Bible College were injured when the bus in which they were travelling, met with an accident, five kilometres away from Wokha on Saturday. The students were reportedly travelling to Zunheboto to attend a programme. Wokha police informed Nagaland Post that the bus carrying 22 students went off road and rolled down when the driver was giving side to a speeding convoy of a VIP heading towards Kohima. According to the bus driver, citizens from the nearby village- Wokha village youth, new Wokha village VDB secretary and others rescued the victims and rushed the injured to Civil hospital Wokha. Meanwhile, local MLA, Dr. Chumben Murry visited the accident site and the injured students in the hospital besides extending them with financial aid.

DIMAPUR, APR 21 (NPN): State Higher & Technical Education minister, Temjen Imna Along on Saturday lamented that the higher education sector in Nagaland had been neglected for too long and the only way to address the issue was through reformation. Speaking at the inaugural programme of Dimapur Government College (DGC) administrative building, floriculture nursery and museum at the newly inaugurated DGC conference hall, Along said the first step in achieving this goal would be by discouraging students from studying outside the state. For this, he called upon parents to be the catalyst in bringing in the change. In her brief speech, Higher education, director, Kuholi Chishi, former principal of DGC, acknowledged the contributions and assistance of department officials and all responsible for the completion of the project under RUSA phase-I. DIMAPUR, APR 21 (NPN): Heeding to the clarion call of chief minister, Neiphiu Rio, for mass social work across the state as preventive measures before the onset of monsoon, a massive state-wide mass social work was undertaken across all the district headquarters on Saturday with active participation from citizens, government employees and students. In Kohima, the district ad-

ministration along with Kohima Municipal Council (KMC) successfully carried out mass social work in all the wards, colonies, town and villages under Kohima district. According to an official bulletin, district administration officials led by deputy commissioner (DC) Kohima, Rajesh Soundararajan visited the wards and colonies in and around Kohima town. DC and his team took note of the issues raised by the concerned ward and assured

to take up necessary measures. Besides, DC office Kohima, all government offices and all the 19 wards including business community took part in the mass social work. As part of the drive, jungle clearance and clearing of culverts, drains, streets and office compounds were carried out. KMC along with the line departments including 15 BRTF and some individuals and contractors contributed the tipper trucks and backhoe loader

(JCB) to facilitate removal of garbage during the social work. Naga Hospital colony Kohima residents cleared the main drainage adjacent to the NH29 and also filled up potholes on the national highway and the connecting roads. In this regard, the colony Panchayats and the Naga Hospital Colony youth organization thanked Keneizhakho Nakhro, MLA for providing a excavator (JCB) and a tipper truck to the colony during the mass social work.

In Dimapur, the mass social work was conducted in all the 23 wards under the supervision of GBs and ward chairmen. Government employees also cleaned their respective office premises under the supervision of the heads of offices as directed by DC Dimapur, Sushil Kumar Patel. DMC also pressed into service all its available machineries (dumper, backhoe loader) and manpower for smooth conduct of the social work.

DIMAPUR, APR 21 (NPN): PWD Executive Engineer Longleng has informed that the temporary bridge between Montikang– Chuchuyimlang road had been washed away due to incessant rain during the past few days, a DIPR report stated. In this regard, all travelers have been advised to take the normal route-Longleng–Changtongya, which leads to Chuchuyimlang via Mongtikang and also serves as an alternate route not only for Longleng district, but for Tobu and Moka (Cont’d on p-5, more on p-2) areas of Mon district as well.
