SC to examine poll panel’s powers NEW DELHI, APR 15 (AGENCIES): Supreme Court on Monday gave the Election Commission of India (ECI) exactly 24 hours to explain its lawyer’s submissions in court that the poll body is largely “powerless” and “toothless” to act against religious and hate speeches by candidates during the 2019 Lok Sabha election campaigning. During the hearing, Chief Justice of India Ranjan Gogoi even threatened to have the Chief Election Commissioner (CEC) in the courtroom within the next half hour if the court did not get clear answers to its questions on the poll body’s powers under the law against candidates who spew vitriol. It then said that besides sending a notice, an advisory and a criminal case can be filed only against such a leader. The top court then decided to summon a representative of the EC at
Weather alert for Nagaland DIMAPUR, APR 15 (NPN): Moderate spell of rain and thundershowers accompanied with strong winds would occur over Dimapur, Kiphire, Kohima, Longleng, Mokokchung, Mon, Peren, Phek, Tuensang, Wokha and Zunheboto between April 14 to 16, 2019. According to Skymet Weather report, on and off light to moderate rain and thundershowers with one or two heavy spells were expected to over Nagaland and other North East states till April 17, 2019. During this period, chances of lightning strike, wind storms and violent thundershowers cannot be ruled out over most parts of the region. Thereafter, the intensity of these weather activities would reduce over most parts of the region. But still few isolated pockets may witness spell of light rain and thundershowers. Recently, wind storm has damaged many houses in southern parts of Nagaland. In fact, during next 24 to 48 hours, similar weather activities are expected in some more parts of the region. Thereafter, gradually as rains will start decreasing such weather activities will also reduce.

10.30 a.m. on Tuesday to examine the contention that the poll panel has limited legal powers to deal with hate speeches of politicians during electioneering. The court found that the ECI had issued notices for hate speeches and campaigning for votes on the basis of religion in only three cases so far in the 2019 Lok Sabha elections. The three include Uttar Pradesh chief minister Yogi Adityanath and BSP supremo Mayawati. The ECI, represented by advocate Amit Sharma, said Adityanath had been issued an advisory. Mayawati, the ECI said, had asked for votes in the name of religion. “So what about Mayawati? She was supposed to reply to you [the ECI] by April 12... Today is April 15. She has not replied. What does the law permit you to do in such cases? Answer us... What will you do now? What are you empowered to do?” Chief Justice Gogoi asked the ECI. “We will issue an advisory... We may file a complaint,” Sharma replied. Sharma tried to reason, saying, “There is a procedure... We have to give them time
to reply.” “So you are basically saying you [the ECI] are toothless and powerless against hate speeches. The most you can do is send a notice to the offending candidate. If the candidate replies, send him or her an advisory. Despite this, if there is violation of Model Code of Conduct, you may then file a criminal complaint... That is all? Those are your powers under the law?” CJI asked Sharma. Sharma concurred that was “no other power” with the ECI. “We [the ECI] cannot de-recognise or disqualify the person. This is the only power,” he submitted. Hearing this, the court decided to examine in detail the issue of the ECI’s powers to deal with hate and defamatory election speeches, and violations of the Model Code of Conduct. It ordered an ECI official to be personally present in the court on April 16. Sharma tried to explain that the ECI had “standing instructions” to act against hate speeches and the violation of the Model Code. “What do you mean by ‘standing instructions’? You are duty-bound... In
certain matters like this, time is limited. You have to act promptly. Whether the outcome is good or bad, you have to get into it immediately,” Chief Justice Gogoi addressed the counsel. The court was hearing a petition filed by a Non Resident Indian (NRI) Harpreet Mansukhani, highlighting the increase in hate and divisive speeches in the name of religion in the Lok Sabha elections of 2019. The petition had called for strict action against political leaders and party representatives spreading hatred on religious and caste lines through the media, especially social media platforms. EC swung into action after the court’s observations and “strongly condemned” the four leaders for their remarks and barred them from campaigning. EC barred SP leader Azam Khan and Union minister Maneka Gandhi for 72 hours and 48 hours respectively for their controversial remarks. EC also barred UP chief minister Adityanath for 72 hours and BSP leader Mayawati for 48 hours for their religious comments.
3 killed as massive storm sweeps Manipur

IMPHAL, APR 15: Powerful storm that swept across Manipur on Monday morning has claimed the lives of at least three women and injuring several others including students, official said. The powerful storm that lashed most part of the state, both hills and valley areas, also destroyed houses, school buildings and uprooted trees and electric poles. In Churachandpur district, two women died after the house they were taking shelter was destroyed by powerful storm. The deceased women were identified Nemdom (74) and Chenkholhai (50), both from the K Salemjang village.
Another woman, running a tea stall, died after a big banyan tree fell down on her tea stall in Kakching district. The deceased identified as Yengkhom Nungsitombi aka Memcha (56) was alone in her stall at the time of ill-fated incident. The deadly thunderstorm swept at a speed of 40km per hour, according a source in the state meteorological department. Over 50 people mostly students were hospitalised at various hospitals after they suffered injuries. Around 20 students of two schools in Bishnupur district were rushed to hospitals in the district. Some of the critically injured students were shifted to hospitals in Imphal.
The entire state was without power for some hours after electric poles were uprooted at several places. The power supply resumed only in the afternoon at several places, particularly in Imphal. As per reports from various districts, the most affected area being Bishnupur and Churachandpur district and parts of adjoining Kakching district. Even though, the powerful storm swept across the twin capital districts, there was no report of human casualty and causing major damages to property. State chief minister N Biren Singh, who paid a visit to widely affected Kwakta area of Bishnupur district
bordering Churachandpur district, expressed his shock and pain at the death of three women and assured relief as per government norms. Talking to reporters at the spot, Singh, who is bound by Model Code of Conduct, said that he would direct the state chief secretary and other concerns to take up all possible relief measures as per government norms. Meanwhile, Manipur CEO PK Singh has advised all the DEOs to take up all the relief works, if undertaken, through the official machinery. “No candidate or political functionary or political party should in any way be involved in relief works/ measures,” he advised.

DIMAPUR, APR 15 (NPN): Officials from the Asian Development Bank (ADB) are in Nagaland to assist and guide the state in preparation of project proposals for external assistance for Nagaland. ADB team led by Country Director, Kenichi Yokoyama, held a meeting with the state government officials led by chief secretary of Nagaland, Temjen Toy, at Chief Secretary Conference Hall Monday. According to an official bulletin, this visit
was part of the ADB’s programme for India’s North East paradise unexplored supporting infrastructure planning and implementation for North Eastern Region Project Readiness Financing (PRF) and Technical Assistance (TA). In a power point presentation, senior project officer (urban) Ashok Srivastava stated that the infrastructure development in North East Region (NER) was critical to promote rapid, inclusive and sustainable growth. He said that poor in-
frastructure and limited connectivity have acted as roadblocks hindering the socio-economic development of North East region. On Project Readiness Financing (PRF) for the Region, Srivastava said the bank would assist the states to prepare quality DPRs and build readiness of the infrastructure projects mainly on infrastructure sectors such as roads, urban and power. One PRF may support multiple sectors within one state or multiple states covering single/multiple sectors, he said, adding that all North East states could access to this except Arunachal Pradesh. Key activities under PRF (1) include preparation of DPRs, feasibility studies for prioritized projects, detailed economic and financial analysis including financial and operational sustainability preparation of social & environmental safeguard plans, advisory
support for advancing land acquisition and resettlement, environment-related clearance and shifting of utilities. Incorporation of innovate mechanisms and elements in the projects, advance procurement action, including preparation of bid documents, tendering and bid evaluations. Key activities under PRF (2) include assist project authorities to set up institutional processes, guidelines and decision making system for project management and implementation pilot testing of a project design to test its validity and to make necessary design adjustments ahead of implementation under any ensuing project, development of specific public-private partnerships (PPP) project under transaction advisory services, support for project start up activities where EAs have capacity constraints.

NEW DELHI, APR 15 (NPN): Government of India on Monday extended the Cease-Fire (CF), which has been in operation, with GPRN/NSCN and the NSCN (Reformation) for another year, while a fresh pact for suspension of operations was signed with NSCN/GPRN (K) headed by Khango Konyak, the Home Ministry said. According to the Home ministry officials, Centre had decided to extend the Suspension of Operation with GPRN/NSCN headed by M.B. Neaokpao Konyak and N. Kitovi Zhimomi and NSCN (R) for a further period of one year with effect from April 28, 2019 till April 27, 2020. cease-fire ground rules were signed by Centre’s representative- MHA joint secretary Satyendra Garg and NSCN/GPRN (K) representatives-supervisor Newell Naga and member Michael Yeptho. It may be recalled that after the split of NSCN (K) in 2018, NSCN/GPRN (K) led by Khango Konyak expressed desire to restore the cease-fire. On December 17, 2018, the group held an “informal meeting” with government of India in Delhi to chalk out the differences that had cropped up after abrogation of the cease-fire in March 2015. The meeting was held following NSCN/GPRN (K) led by Khango on December 6, 2018 declared to revoke its decision of unilaterally abrogating the ceasefire agreement with the GoI.
Implement ILP panel recommendations: NTC FY19 oil import could peak under Modi DIMAPUR, APR 15 (NPN): Nagaland Tribes Council (NTC) Monday urged the state government to implement the recommendations submitted by the committee constituted to study extending Inner Line Permit (ILP) regime throughout the state of Nagaland NTC through its media cell reiterated its earlier submissions for effective mechanism and strong system to enforce BEFR and Foreigner’s Acts. In a statement, NTC urged the state government to take up immediate steps for administrative enumeration of indigenous population in Nagaland within the ambit of Nagaland Indigenous inhabitants, vide notification dated April 28, 1977. It stressed that enumeration of indigenous
population was required to maintain real-time data and issue one-time indigenous certificates that could also create a basis for all succeeding generations of the indigenous people for registration. This will enable proper identification of aboriginal communities and individual domiciles in the State, it pointed out. Calling for adoption of standard operating procedures for identification of migrants and strict enforcement of Bengal Eastern Frontier Regulation (BEFR) Act, 1873 and other related Acts for effective operation, the council also suggested that electronic devices be used to monitor and track movement of permit holders with strict regulations to prevent its misuse and exploitation. As Dimapur serves as
a depot from where the illegal immigrants are supplied to other districts and as it has not been brought under the purview of BEFR Act, the council called for adopting a strong mechanism to enforce and curb illegal influx in Dimapur area with immediate effect. It further suggested setting up necessary check points with proper infrastructure in all entry points with tourist and transitfriendly mechanism to regulate movement of migrants without causing “undue inconveniences”. Further, in order to maintain consistency, the council urged the state government to set up a permanent cell under the home department to supervise and monitor the whole system and provide necessary trainings to personnel of enforcement agencies.
NEW DELHI, APR 15 (IANS): A late surge in oil prices is expected to increase India’s oil import bill to its five-year high. As per estimates, India could close 2018-19 with crude import bill shooting to $115 billion, a growth of 30 per cent over 2017-18’s $88 billion. The latest estimates are based on increase in global crude oil prices from the second half of March, when prices reached a new high in 2019. Crude is hovering around $70 a barrel on the back of extended production cuts from the Organization of the Petroleum Exporting Countries (OPEC) and Russia, and expectation of demand pick-up. “The latest estimates suggest we could touch or cross $115 billion in oil imports in FY19. However, contradicting apprehensions, the Oil Ministry’s Petroleum Planning and Analysis Cell (PPAC) in its latest assessment has made a conservative estimate of import bill growing by 27 per cent from $88 billion in 2017-18 to $112 billion in 2018-19. Interestingly, PPAC’s estimates are based on the Indian basket of crude oil price at $57.77 a barrel and exchange rate at Rs 70.73 against the dollar. This estimate has long been breached with price of Indian basket of crude hovering at $70 a barrel. On the rupee front, however, there is some relief as the currency gained a bit
in March after running over Rs 70-71 to a dollar for most of January and February. The oil import bill at over $115 billion will take it closer to FY13 and FY14 levels, when international oil prices had skyrocketed and hovered around $100 a barrel for most of the year. This will push the FY19 crude import bill to the highest in five years of the Modi government, and very close to the UPA II level when the prices had breached all records to touch $140 a barrel. If crude price rises $1 per barrel, the net import bill will increase by Rs 3,029 crore. And if exchange rate rises by Re 1 to a dollar, the net import bill will increase by Rs 2,473 crore.
