Included is a call for volunteers for our next fiscal year which begins on April 1, 2022. We are looking for members interested in serving on the Board of Directors, the various Education Committees and more. We are always looking for new participants with fresh ideas, but the best path to the Board is by participating first on a committee. Our committees weren’t particularly active in 2021 due to all the reasons you are too aware of, but we are hoping to change that in 2022. You will also find applications for our Elite Member program, Credit Executive of the Year both in Chicago and Gateway, and Scholarships for NACM Connect educational events. 2022 Elite Membership Nomination Form NACM Connect has a long-term interest in engaging more young people in the Association. To that end, our Elite Membership honors outstanding and exceptional young Credit Professionals. For the fiscal years from April 1, 2022– March 31, 2024 candidates must be 35-years-old or younger, and be employed by NACM Connect member companies in good standing. This program will recognize these young Credit Professionals for their service, talent and outstanding commitment. Illinois Construction Stuff and Stuff What was cool about the email is it was the same group that wrote, promoted and succeeded in getting SB 1636 passed and put into law so that retention would be reduced from 10% to 5% when a project is 50% done, and introduced legislation that there be no retention on public jobs, since everything is already covered by bonds.

“ Illinois Construction Stuff and Stuff Norm Cowie, CCE Recently I received an email from an attorney … (pause as you gasp in fear and trepidation) … addressed to me, and two other attorneys (no, attorneys like him, not me, since I’m not an attorney) that started like this: “Fellow mechanics lien nerds” Definitely not a threat to me. Then it went on to suggest we look at strengthening the penalties of Section 60/21.01 of the Illinois Mechanics Lien Statutes so that there are more repercussions against jerks who demand lien waivers up front and then don’t pay. If you’ve been reading my articles, you know this is a hot button for me and a couple articles ago I wrote I’d prefer either that requiring lien waivers up front be made illegal, or alternatively, GC’s and owners would be required to accept conditional waivers. But if we can’t have either of those, then, yeah, let’s make the punishment greater. And by punishment, I mean something like holding down the offender and CREDITCONNECTIONS

pouring hot sauce up their nostrils. Or maybe force them to eat cherry Popsicles until they get brain freeze. Or both at the same time. Yeah, that’s it. They need to suffer. This is what I wrote about it in my book, Illinois Mechanics Lien Statutes ... and other construction stuff: Yeah, I’m sure a rough ole contractor is going to be pretty gosh darned scared of a Class A misdemeanor. I’m sure they’re just shaking in their boots, right? Ha, ha, ha!! Of course not. I can’t even scare my teenaged daughters with threats of Class A misdemeanors. Probably the worst that would happen if I tried this on one of them is they’d get dizzy from rolling their eyes. Or maybe they’d go into spasms trying not to bust a gut laughing. I’m sure you read my book, right? No? what are you waiting for? It’s available from NACM. Okay, commercial over.

In other words, a very knowledgeable and influential group that I’m happy to hang around, even though I’m the only one without a law license. But I am very much a lien nerd, so he wasn’t wrong in addressing me that way. He also told me once in the past that he was sure that my favorite thing about myself was that I wasn’t an attorney. He might not have been wrong. Anyway, I got all excited about the email and weighed in that we need punishment to be far greater than just a Class A misdemeanor and it has to be something nondischargeable in bankruptcy. One of the other attorneys chimed in that any parties that JANUARY / FEBRUARY 2022

NACM Connect benefitted might be personally liable as well and the other noted another state had similar penalties already, so maybe we could borrow some of their language. We’re really early in discussing it, so I don’t have much to add yet. But it is a crucial change I’ve been pushing for years now, so I’m thrilled we’re looking closely at it now. I’d like to see similar, strong enforced penalties enacted for those who falsify sworn statements, depriving their subcontractors or suppliers of the protection afforded by being properly listed on lien waivers. In the article I referred to above, it was sparked by a very slow paying customer who routinely falsely claimed that the hundreds of thousand dollars in material they purchased from us came from their fully paid stock. Uh, no, nothing could have been further from the truth. Unfortunately, the rules and punishments aren’t enough to scare this guy or others like him. NACM’s CMI Helps Predict Health of Economy NACM National, Editorial NACM’s Credit Managers’ Index (CMI) is a one-of-a-kind study published monthly since February 2003, which measures credit quality today in effort to forecast future risk. CMI data and analysis provide forward-looking specialized insight. Since its inception, the CMI has been a startlingly accurate economic predictor, proving its worth most notably during the 2008-09 recession. The CMI survey asks U.S.-based credit professionals in manufacturing or service sectors to rate whether a variety of factors in their monthly business cycle have improved, worsened or stayed the same compared with the prior month. Favorable factors rate sales, new credit applications, dollar collections, and amount of credit extended, while unfavorable factors weigh rejections of credit applications, accounts placed for collections, dollar amounts of receivables beyond terms, and filings for bankruptcies. Participants also can comment about the issues they are facing during that month’s commercial business transactions cycle. For example, one credit professional wrote in November’s CMI: “Inflation continues to cause havoc in the credit world. I’ve spent more time in the last month considering credit line increases than I may ever have in my 25-plus year career.” Another respondent shared how supply-chain issues have impacted risk management: “Supply chain problems (along with labor inefficiencies) continue to be the primary factors hindering performance. Customers seem to be a bit more tenuous in making payments. There appears to a level of uncertainty about the economy and we are getting the response more often ‘we will pay you when we get paid.’” Consider participating in the next CMI survey. Why Should You Join CFDD? Credit Financial Development Division (CFDD) is the educational branch of NACM.

A CFDD Chapter is a group of credit professionals organized with a focus on education, networking, and professional support for employees of member firms of the National Association of Credit Management. Local chapters meet monthly on topics of interest to the credit professional as well as seminars and workshops. Scholarships for local, regional, and national conferences are available, as well as mentor/mentee networking for problem solving and sharing of experiences. In each class, NACM Connect provides a textbook for each student to take back to the office and use as a reference guide. The intention of these courses is to teach students about credit and prepare them for the workplace. These classes also set the stage for continuing education in future seminars and Institute of Credit classes, in which students prepare to earn their professional designations.

Credit 101 is a basic-level orientation program that introduces newcomers to the multifaceted field of credit management. This session examines the credit function, the procedures and tasks performed in a typical credit department and how those procedures impact an entire organization.

Credit 102 is an intermediate-level program designed for inquisitive credit personnel who wish to exceed the basics of credit management. This professional educational program examines the underlying knowledge required to successfully function and advance in today’s ever-changing credit department.

Credit 103 is designed for mid-level credit professionals who would like to learn where they fit into the corporate structure and give them tools, which are not widely talked about and creating a positive impact on the mission of their credit department.
