Planning your future care Many older people and people with disabilities choose to live at home, but sometimes they need help and support to do this. There are voluntary organisations and community services that can provide you with information to help you choose the best options for you. The aim is to enable you to live safely and independently at home for as long as possible. Connect to Support is a new free website to help people seeking social

care or support in the Bradford District. You can find everything you need from this website to help you with your support; from local to national products and services, plus information, advice and much more. This and other information can be found at www.connecttosupport.org/bradford. If you do not have access to the internet information can be obtained from advice and support centres within your local community (refer to customer service centres listed on page 12).

What support is available from Bradford Adult Services? The time may come when you need more support than you or your family feel able to arrange independently. Bradford Adult Services can provide you with telephone advice and if appropriate we can discuss with you the option of carrying out an assessment of your needs. The aim is to explore the options available to you to help you make a decision about your future. Social care is not free to everyone however we will always provide advice and support. You may be eligible for financial help depending on your income, savings and capital assets. To work out how much you might need to pay we would carry out a financial assessment which would be completed by our specialist financial team. If you choose not to have a financial assessment then you would have to pay for all your support. Within the assessment of your needs we will initially consider options such as telecare, basic equipment, minor adaptations and enablement. These services are designed to help you regain daily living skills and/or improve your confidence, for example following a sudden illness, which may have included a stay in hospital, or trying to reverse a

steady decline in skills due to the progression of a long term illness. Once these options have been explored the assessment will consider if longer term support is required and assess your eligibility for financial support from the council using the Fair Access to Care (FACS) criteria and a financial assessment. We will also assess the needs of your carer and take this information into consideration. However, if you need a lot of care and feel that you are unable to continue to live at home, even with support, you may need to think about alternative housing arrangements such as extra care housing or supported housing. An alternative option is residential care or a nursing home. This is a big step and you will need to carefully consider everything involved, including the cost. The financial implications vary depending upon individual circumstances however we would advise everyone to obtain advice before making any long term decisions. You can contact Adult Services Access Point on 01274 435400 where advice can be given regarding the support you can expect from the council. As a rough guide you should expect to pay the full cost of the care homes fees unless your assets, savings and income are very low (less than a total value of £23,250 in 2013-2014). If your savings and income are below this level you may be eligible for financial support from the council. If you approach the council for support a financial assessment and care assessment will need to be carried out. This will consider if you could be supported to live in the community or need continued residential home or nursing home care. If you’re assessed

as requiring residential care and the council has assessed that they will pay towards the cost we will only do this up to an agreed limit. This may restrict your choice of residential home and if you are in an existing home which does not accept our rate this could result in you moving to another home. Introduction Personalisation ‘Personalisation’ is the term used to describe the ability to tailor a range of support services to meet an individual’s specific care needs and it is at the heart of the Government’s drive to transform social care. It means that everyone who receives support, whether from the Council or funded by themselves, will be empowered to shape their own lives and the

services they receive in all care settings, including their own homes. Independent living is one of the goals of personalisation. It does not mean living on your own or doing things alone, but rather it means having choice and control over the assistance and/or equipment needed to go about your daily life.

Self Directed Support Part of the personalisation agenda, SelfDirected Support is a totally different way of providing adult social care. As the name suggests, Self-Directed Support

Individual Budgets An important part of personalisation, an Individual Budget is an amount of money the council allocates to help people who due to disability, frailty or vulnerability, receive the support they need. Councils are now working in a different way, in order to give people who use services more choice and control over how money they are entitled to is spent.

Direct Payments All or part of an Individual Budget could in most cases consist of a Direct Payment should you be assessed as being eligible for services from Adult and Community Services (ACS). A Direct Payment is money paid to you by ACS to enable you to organise your own care to meet specific needs. Examples of which could be: • Employing a personal assistant for home support and social inclusion

• Employing an Independent Domiciliary Care company www.

allows you to design and tailor your own support package to meet your specific needs. This is a major change in the way adult social care services are delivered in Bradford District.


• Employing a live-in carer subject to certain criteria • Day care

Any money paid to service users under Direct Payments scheme remains public money until it is used for the service user’s assessed need and any unused money can be reclaimed by the Council.

• Short stays in a care home for no more than 4 weeks • Equipment to meet your care needs that would traditionally be provided by the Council. Direct Payments are intended to support adults in independent living, so you cannot use them to pay for permanent accommodation in a care home or care home with nursing. If you are applying for services for the first time, your social care worker should discuss the Direct Payments option with you when they assess your care needs. Direct Payments can be paid by the following methods: • To an accounting bureau who will hold the money on the service users behalf • On to a debit card with ‘chip and pin’ technology that is best suited to online or telephone banking methods for making payments A Direct Payment forms no part of a service user’s personal income, is not taxable and has no impact on benefits.

Assessing your needs If you are facing a major change in your life because of an illness or disability, Adult and Community Services (ACS) will talk to you and the people who matter to you so that they can help you decide what you want to do and how they can help. This process is called an assessment and is something everyone is entitled to and is free. An assessment starts with a discussion to understand all your needs and what you want to achieve. Your social worker will ask you about:

• What difficulties you have now • What you can do for yourself and what you think you need help with • What you can’t manage at all • Who helps you now • How best to achieve your goals With your permission, your social care worker will also talk to people closely involved with you, for example, your carer, family and friends. Other professionals, such as an occupational therapist, physiotherapist or district nurse may also be included as part of your assessment. www.

This will make sure you are given the right information to make choices about your future. If you have health problems as well as other difficulties, you may get help from both the NHS (National Health Service) and from ACS.

All information given during an assessment and afterwards, will be kept securely. ACS will share relevant information with professionals like a doctor or nurse unless you ask them not to. The assessment will take account of your religious beliefs and cultural practices.

If you are a carer (you provide regular and substantial care to a relative or friend, and are not paid for it), you are entitled to an assessment even if the person you look after doesn’t have help or funding from ACS.

If you are eligible for services you will also be asked to complete a financial assessment that will calculate what you can afford to pay towards the cost of services arranged to meet your social care needs (see Paying for Care - Page 34).

How to get an assessment You or a friend, relative or a health professional like your GP can ask for an assessment by phoning Adult Services Access Point on 01274 435400. A social

care worker will arrange to see you. If you are in hospital, the nursing staff can arrange for a social worker to contact you, either during your stay in hospital, or on your return home.

Helping you stay independent in your own home Bradford Enablement Support Team (B.E.S.T) In Bradford, as part of the assessment process when you meet the Fair Access to Care (FACS) criteria, Bradford Enablement Support Team (B.E.S.T) service will work with you to set goals with short term support designed to help you become as independent as possible. Perhaps you require support with personal care or to prepare a meal - the Enablement Service will work with you to make it as easy as possible to manage these tasks on your own. The Enablement Service also has staff who have been trained in therapy competencies and where a therapist has set a therapy programme the B.E.S.T. service can work with you to achieve these therapy goals. This enhanced service is referred to as the B.E.S.T. Plus service in Bradford.

In traditional home care someone would visit and do these tasks. Using the Enablement Service, a home care worker will work with you so that you can learn (or re-learn) important tasks needed for everyday life. In Bradford, at least 29% of people who participate in an enablement programme find that afterwards they can cope very well on their own, without the need for ongoing statutory social care support. The enablement programme will normally last up to six weeks and will be free of charge throughout this period as long as the person participating in the programme is making progress. Where people require ongoing long term home care support, this will be arranged by the Assessment and Support Service after a post enablement assessment of your needs has been completed.

Telecare – ‘Safe and Sound’ Safe and Sound is Bradford Council’s Community Alarm System. Using the latest technology your home can be connected to Safe & Sound, where calls are monitored 24 hours a day including weekends and all bank holidays. The alarm unit operates over the telephone network. Equipment supplied by Bradford Council plugs into an electric socket and a telephone point. These need to be close together without obstructions. We can check if your existing sockets are suitable and advise if any alterations are necessary (we regret we cannot pay for any changes that may be required.)

At the Safe and Sound Control Centre, confidential information which you provide about yourself is held on computer and is instantly available so that effective action can be taken in any emergency. The moment a call is received the operator will know your www.

name, address, GP, next of kin and key holder information. Safe and Sound has mobile Response Teams operating in the Bradford Metropolitan area. They are trained in first aid, lifting you safely after a non-injury fall and and provide a back up to your named contacts and can help in a simple emergency, but are not able to perform ‘care tasks’. Where there is an assessed need we can also provide you with additional equipment such as a medication dispenser, property exit sensor and epilepsy sensor. Some of this equipment will connect via the alarm unit to keep you safe in your own home. Safe and Sound equipment is simple to use: A press of a button, and you are in touch with us. • We will know who you are at once • Information supplied by you and stored on our system will be highlighted automatically

Adapting your home A Disabled Facilities Grant can help towards the cost of adapting your home to help you to be more independent or assist your carer to manage more easily. This may be getting about your home, doing everyday tasks such as bathing, going up and down stairs, or getting in and out of the house. Adaptations can only be considered after your situation has been assessed - they are usually a last resort after such options as rehabilitation have been considered. Adaptations costing less than £1000 are usually arranged by Adult and Community Services (ACS) through an occupational therapist. Anyone living in (or caring for someone in) the Bradford Metropolitan District, who has a ‘permanent and substantial’ disability, and who has significant difficulties managing everyday tasks within their home can apply. The grant is provided for essential adaptations to give you better freedom of movement into and around your house so that you can use the essential facilities in it, for example: • Taking a bath out and installing a shower • Installing a stairlift or providing a downstairs bathroom

• Widening doorways and putting in ramps • Improved access to enable the disabled person to care for a child or spouse etc. • Ensuring the safety of the disabled person by, for example, fitting gates to stairs or safety glass in doors and windows • Changing the heating system, or adding more heaters where this is necessary for your disability The Occupational Therapist will discuss options with you if it is decided that your property cannot be adapted. We will be able to help you make enquiries to local Housing Associations. If you want to buy a property we will look at it first before you decide to go ahead to see if it can be adapted. Your first step must be getting an assessment from the occupational therapy service. They accept referrals by telephone from service users directly. Please telephone 01274 435400 between 8.30 am and 5.00 pm Monday to Thursday and 8:30 am and 4:30pm on Friday for this service. An occupational therapist will then arrange to see you to discuss your needs. If it is decided that an adaptation will be suitable for you, a Housing Technical Officer from the Housing Service will also visit to make sure the adaptations can reasonably and practically be made to your home. This may mean that you have to consider adaptations that are not what you expected. If everyone agrees that the adaptations will meet your needs and can practically be done you will be able to apply for a Disabled Facilities Grant to see if you can get help to pay for them. The maximum grant allowed is up to £30,000 and is means tested to establish if you will have to make any contribution yourself. www.

Will I have to pay for the adaptation? The Council will carry out a ‘means test’ to see if you have to make a contribution towards any grant. This means you will have to provide us with details of your income, benefits, savings etc. With this information we will then be able to tell you if you have anything to pay and if so how much it will be.

If you are disabled, some benefits mean that there is no contribution. Disabled children are not means tested. Work must not start until the grant is approved. Community Meals A hot meal service can deliver a hot main meal and dessert. No assessment is required for this service. You can choose from an extensive range of meals which meet a wide range of special dietary requirements.

Independent home care providers In order to enable people to live in their own home for as long as possible a range of home care services are available. A range of help is on offer from day-today tasks such as cleaning, shopping and food preparation/cooking through to personal care that helps with tasks like dressing, bathing, toileting and prompting the taking of medication. Carers should be trained in moving and handling including the use of hoists for some tasks. Daily care / domestic support Carers can call in on a daily basis to assist with any of the tasks described above. Depending on the level of help required their visits can be just half an hour or up to several hours. Generally,

visits are available from 7am until 10pm. Some people will need multiple visits per day. The hourly rate for these types of services typically range from £9 to £15 per hour depending on the services required, the time of day and the location. Night services can also be provided. Rural areas may present particular difficulties and a travel charge will probably be made in addition to the normal hourly rate. All home care providers are regulated and inspected by the Care Quality Commission which publishes inspection reports on their website www.cqc.org.uk. When considering a service it’s always a good idea to check their report. Before you make any decisions regarding the provision of care, be sure to contact several providers and ask for a ‘Service User’s Guide’ and their charges and a draft contract between you and the care provider.

Home care agency checklist These questions may be useful when considering using the services of a home care (domiciliary) provider to help you build up a picture of how your care needs will be met in your own home. For care packages which have been arranged by Adult and Community Services, contracts and care plans will have been completed by your care

manager and the agencies used will have been accredited to work for Adult and Community Services. People arranging and funding their own care either privately or through a Direct Payment or a Personal Budget are able to choose their own worker or care agency.

Agencies • What experience does the agency have in your particular field of need? Can they supply references for you to check? • Home care agencies providing personal care must be registered and inspected by the Care Quality Commission. Ask to see a copy of their registration certificate. • How long has the agency been operating? • How many carers would the agency assign to care for you and would you see the same one every day? If not, how does the staff rota operate and what happens if your carer goes on holiday or is sick, will you be notified in advance that a different carer will be attending? • How can you contact the agency in an emergency or outside office hours? • How hard or easy would it be to make a complaint and how are things then put right? • If this is a private contract ask for a copy of the agency’s contract terms and read these carefully with someone you trust. Get as much help as you can going over it and ask any questions you may have before signing anything. The Citizens Advice Bureau or Age UK could help with this.

Carers • You should expect your personal preferences, dignity and privacy to be respected. Discuss this with the agency and ask how the most suitable carers for your particular care are chosen. Can you talk to them before deciding? • Carers should be fully trained or be in ongoing training. Ask the agency about their policies on this. • You will have a care plan drawn up by the agency which the carers will work to. Ask how often this plan will be reviewed by the agency. • Carers must be checked with the Disclosure Barring Service (DBS) and have a criminal records disclosure – make sure this is the case.

Paying • If your care needs do not meet Adult and Community Services’ eligibility criteria and have been arranged privately you should carefully check the fee rates charged and exactly what the payment you make covers.

Housing with support Accommodation based services and floating support The purpose of Housing Related Support is to provide support services which develop a person’s capacity to live in the community independently in accommodation, or sustain their capacity to do so. It aims to increase independence and empower people to be able to integrate successfully into the wider community. Housing Related Support provides an effective way of delivering services to a wide range of vulnerable people and every person who receives Housing Related Support is helped to create a support plan which addresses how they will achieve a range of positive outcomes in line with people’s personal circumstances. Housing Related Support can be delivered through

accommodation based services, or through floating support services. Accommodation based services are linked to a property or scheme, such as self-contained accommodation, and floating support is provided in a persons own home. If the individual moves house, the floating support can move with them. Both types of service are offered for up to two years and can include help to: • Access health services such as doctors, community nurses • Access leisure activities, educational courses or you may wish to volunteer to help out a local group • Gain confidence and emotional support


• Maintain or regain life skills such as managing your money, cooking, shopping and managing your own home The Council buys in services from a range of organisations and these are monitored to ensure that they provide a good service. We also ask people who use

housing related support services to get involved in how services are developed and delivered and how the programme is managed. Sheltered housing Sheltered or retirement housing is suitable for people who like living independently but want the reassurance of knowing that assistance is on hand if there is an emergency, or where they expect to be away from home for long periods and need to know their home is safe. Often called retirement housing, there are many different types of sheltered schemes available both to rent and to buy. The size of the schemes can vary but typically consist of between 15 and 40 dwellings. These may be bedsit rooms, self-

contained flats, bungalows or luxury apartments. Some schemes are simply housing designed to meet the needs of older people and linked to a community alarm. Many of these schemes have a scheme manager/warden, who provides housing management and support to residents. Schemes are linked into the Council provided community alarm service – Safe & Sound or to the landlord providers equivalent system. There are often communal facilities such as a lounge, laundry, guest flat and garden. Meals are not normally provided but a few schemes include a restaurant and some can arrange hot meals.

Extra care housing Extra care housing developments are sometimes known as ‘very sheltered housing’ or ‘assisted living apartments’. This is a growing and popular part of the housing with care market for older people. It can offer an environment that is accessible for people who are finding it difficult to get around the house, and which promotes well-being for people with health conditions. Typically, there is support to access social activities and recreation and some schemes have their own shop, restaurant and other facilities. Individuals living in the schemes ordinarily have a requirement for care services and receive this from a range of agencies offering care and support, some of which can assist with high levels of need. Care providers must be registered with the Care Quality Commission (CQC) as Domiciliary Care agents.

People find it attractive because it offers independent living in a home of one’s own and you might choose to move to extra-care when still relatively independent, or as a positive alternative to residential care. The potential advantages include the opportunity for couples to stay together rather than being separated by one partner moving into a care home and some schemes offer the choice to buy as well as rent.


Care homes All care providers in the country must be registered with the Care Quality Commission (CQC). All services are inspected by the CQC, who report on their findings. These inspection reports are available from the care service or the CQC (visit www.cqc.org.uk). Further information about the CQC can be found on page 40.

Care homes with nursing If you think you need a nurse to oversee your care, you will need to be assessed for this and it will be carried out by an NHS nurse. The assessment can be carried out in your own home, in hospital or in a care home. You will be fully involved in the assessment and the planning of your care needs. If you feel you need this assessment, you can contact the Continuing Healthcare Team via:

There are two types of care home: Care homes offering personal care only If you are reasonably active, but would like greater security and care, subject to a needs assessment, a care home offering only personal care may be your best option. Personal care includes bathing, feeding, dressing and help with your mobility and must be paid for in full if your capital/savings exceed £23,250 (current nationally set figure). If you need advice, even if you are paying in full you can contact Bradford Council’s Adult Services Access Point.

This means, the NHS will pay for part or all of your care home fees depending on your assessed care needs. Your social worker will give you information to help you find a home which can meet your care needs and any costs the NHS are responsible for will be paid directly to the care home of your choice. See page 34 for more information on paying for your care.

Learning disability If you are considering moving out of your family home, there are a number of options that could be explored before considering a care home. You may be able to have your own flat with support.

An important change affecting people with learning disabilities is the introduction of Personal Budgets (explained on page 10), putting people at the centre of how they choose to pay for their support.

There is also the option of supported living, where you can share a property with other people with support provided for all. Support can include learning independent living skills like cooking, cleaning and money management as well as help with health needs. Either of these options can often give you greater independence and choice than

Services, who specialise in learning disability, will be able to give you information to enable you to make the right choices. Physical disability Following an assessment of your needs, you may be eligible for help from Adult and Community Services, including a Personal Budget, occupational therapy, adaptations to your home and supported housing. We can also offer support for your carer. We can help with daily living tasks at home and assist you to take part in activities in the wider community. Shared Lives schemes and short breaks in care homes are among the ways in which we can ensure your needs are met while your carer has a break. Dementia As it can be best for the person with dementia to stay in their own home for as long as possible, a range of community care services are available to facilitate this. Adult and Community Services can provide access to: home care; meals in the home; sitting services (which provide a break for carers); advice on equipment and adaptations; day care centres and respite care. If you are responsible for looking after someone with dementia in their own home you may be entitled to support in your own right to help you manage. These services can be provided directly by registered providers including those who do not require financial help from Adult and Community Services, however Adult and Community Services will still be willing to offer an assessment of need. You may have a choice of which agency you receive your care from whether or not Adult and Community Services assist with the funding of your service.

If you are considering a specialist care home, remember it should be able to maintain and improve your quality of life. Depending on the degree of the dementia, you should be able to live in a care home that offers quality personal www.

care and person-centred care. It’s important to consider homes that provide nursing care in case your condition deteriorates and you require a higher level of care. Many care homes offer specialist units with experienced nursing staff and facilities adapted to the needs of residents with dementia. People with dementia can benefit from a range of group or individual therapies involving social interaction and mental stimulation, including reminiscence. Activity co-ordinators and occupational therapists can provide people with dementia with reality orientation, reminiscence and validation therapy. Music therapy, art therapy approaches and other creative therapies can also be helpful. Behaviour management approaches that promote understanding of the behaviour of the person with dementia can also be beneficial and trained staff can offer this service within many care establishments. Mental Health Your local Community Mental Health Team (CMHT) should be your first point of contact if you have mental health issues. You can ask your GP to refer you or ask someone who knows you to contact the CMHT on your behalf. Contact CMHT on 01274 251800. The local authority is investing in supported accommodation and home support for people with mental health issues. A move to residential or nursing care will only be necessary for people who cannot live in their own home with support. Like other specialist care services, home support can be paid for (if you have been assessed as eligible) with a Personal Budget or Direct Payment. Alternatively, a good care home can help improve the quality of your life - the structured environment and activities provided can build up your confidence. Your Social Care Worker and the care providers should assess you carefully to make sure the placement is right for you and all care providers should operate to a recovery model, helping people to learn the skills they need to become more independent. A member of staff may visit you at home, talk to you and look at your assessments of health and social care need.

Paying for care Care funded by the Council Do I qualify for local authority financial assistance? If you have been assessed as needing a care home place and your capital is below £23,250 you should be entitled to financial support from your local authority. If you have capital below £14,250 you will be entitled to maximum support contributing your income less £23.90 retained for your personal expenses. If you have capital between £14,250 and £23,250 you will also pay a capital tariff of £1 per week for each £250 between these two figures.

The home you choose must be suitable for your assessed needs, comply with any terms and conditions set by your local authority and not cost any more than they would usually pay for someone with your needs. What if a home costs more than the local authority is prepared to pay? The local authority will allow a third party such as a family member to top up the weekly care fees to the rate agreed with the care home (see page 35 for details).

Capital includes the value of your former home unless it’s occupied by your partner, a relative who is aged over 60 years or incapacitated, a child under 16 years who you maintain or a separated partner who is a lone parent.

My partner needs care, how does this financially affect me? Your local authority will take into account 50% of any joint savings therefore, to accelerate financial help, it is better to have separate single accounts meeting care costs paid from the account of the person in the care home.

Do I have a choice of care home if the Council is paying? Yes and it can even be in a different county.

Paying for your own care Self-funding If you are self-funding your care because you are not eligible for local authority funding there are other forms of financial assistance you may be entitled to: Will the local authority pay my fees whilst I am selling my former home? If, apart from your property, your other capital is below £23,250 the local authority will help as above with the costs during the first twelve weeks of permanent care. Beyond that period any financial help will be charged against the value of your former home and recovered from the eventual sale proceeds. Do I have to sell my property? No, your local authority can lend you the money to pay for your care charged against your property value. However, they may limit how much they will pay and it could adversely effect your welfare benefit entitlements.

Do I have to pay Council Tax on an empty property? If you move into a care home and your property is left empty then you should receive full exemption from Council Tax until it’s sold. Is there any financial help that is not means tested? Attendance Allowance is a non-means tested, non-taxable allowance paid at the lower rate of £53.00 for those needing care by day or night and, at a higher rate of £79.15 for those needing care by day and night. Whether your stay is temporary or permanent if you receive nursing care in a care home you may be entitled to an NHS Registered Nursing Care Contribution (RNCC) towards the cost of your nursing care, paid directly to the home at £109.83 per week. If your needs are primarily health care needs, you may be entitled to full funding from your local CCG following an assessment under their continuing care eligibility criteria. This figure applies to England only. Wales, Northern Ireland and Scotland pay different amounts.

What happens if I move into a care home independently and run out of money? Once your capital reduces to £23,250 you should seek local authority assistance. However, if the home costs more than the local authority usually pays and won’t reduce its fees you could be in the difficult situation of either finding a source of top-up or seeking less expensive accommodation. If there is a likelihood of running out of money it’s important that you arrange an assessment of your care needs with the Council’s Department of Adult and Community Services to ensure they will step into help. Also check if the care home owner can continue to accommodate you at social services funding rates or whether they will require a third party top-up.

Third party payments If the home you choose costs more than the rate the Council usually pays for someone with your needs, you will have the choice to ask someone else to make an additional payment. If there is no-one available to supply the extra payment, you can ask the Council to find you another placement at their normal rate. If, however, you do decide to live in the more expensive home and you have someone who is able to make an additional payment for you, they will have to pay the difference between the Council’s rate and the amount the home charges. This additional payment is often referred to as a ‘top-up’ or ‘third party top-up’. You should ask what additional services or facilities you or your relative are receiving for the extra money you are paying. The law says that you are not allowed to

make this additional payment yourself, except in limited circumstances. Therefore, the additional payment has to be made by someone else, for example, a family member or charity. Before anyone agrees to make additional payments on your behalf they should be aware that the amount could change, usually increase, once a year and they need to be confident that they can sustain the payments for as long as they are required. If the additional payments stop being paid for any reason, then you should seek help and advice via Adult Services Access Point on 01274 435400. Once it has been established that someone is willing and able to make these payments they will be asked to sign an agreement to formalise the arrangement. Because the financing of care is a complex area it is advisable to contact the social worker who is arranging your placement with you or Adult Services Access Point on 01274 435400 to ask for advice and individual guidance.

Important Information Care home contracts for self-funding residents If you are self-funding your care and have a contract with your care provider, it is important to speak to solicitors with experience in this field. Any contract should explain: the cost of care, what services are included in the price and how often

this is reviewed; what complaints procedure is in place; what your rights are and the obligations of the care provider under the contract; the procedure for cancelling a contract and the administering of medication.

How solicitors can help A solicitor can give you impartial advice about wills, making gifts, estate planning and Powers of Attorney. Some can also offer guidance on immediate and long-term care plans, ensuring (if applicable) the NHS has made the correct contribution to your fees. Lasting Powers of Attorney (LPA) allow you to appoint someone you trust to make decisions about your personal welfare, including healthcare and consent to medical treatment, and/or your property and financial affairs. An LPA is only valid once registered with the Office of the Public Guardian. It allows for a person of your choice to make decisions on your behalf at a time when you may be unable. The Court of Protection can issue Orders directing the management of a person’s property and financial affairs if they are incapable of managing their own affairs should they not have a LPA. The Court procedure is presently very slow and the fees are quite expensive so preparing a LPA is always advisable, providing you have somebody sufficiently trustworthy to appoint as your attorney. An ‘advance directive’ allows you to communicate your wishes in respect of future medical treatment but it is not legally binding. You may instead wish to make a living will, properly known as an

‘advance decision’ setting out treatment that you do not want to receive in specified circumstances, which would legally have to be followed, even if you die as a result. Any proposed Gift out of your estate needs careful consideration of the benefits, risks and implications, particularly on any future liability for care costs or tax liability. Long-term care: whether you remain in your own home or move into sheltered accommodation or a care home, you may qualify for financial assistance in the form of social care and NHS-funded care and welfare benefits. If you don’t have your own solicitor, ask family or friends for their recommendations. Contact several firms, explain your situation and ask for an estimate of cost and an idea of time scales involved. Many firms will make home visits if necessary and will adapt their communications to meet your needs. It’s important to find a solicitor who specialises in this area of the law. The Citizen’s Advice Bureau offers an advice service and will be able to recommend solicitors in your area.


Comments, compliments and complaints All organisations need to know how they are performing. They are happy to receive your feedback on their service whether they are compliments or complaints. Feel free to tell them what you think and your comments can be used constructively to improve the service. If you do need to make a complaint you should feel able to complain about any aspect of your care, health or well being. This could be about the way you are treated by a staff member or the quality of the food you are served. You can also make comments and suggestions about possible improvements to your surroundings and the services provided. Providers are required under essential standards of quality and safety to have

a simple and easy to use complaints procedure which they will be happy to give you. If you are concerned about the care that you, a friend or a relative is receiving, it makes sense to speak to the manager before you take any further action. The problem may be resolved quite easily once they are made aware of it. However, if you need to make a formal complaint, you should initially contact the registered owners of the service. They have a duty to respond to any complaints made. Safeguarding vulnerable adults Safeguarding is about protecting people from abuse, preventing abuse from happening and making people aware of their rights.

Sexual abuse – making sexual remarks, showing sexual materials, touching, rape or any other sexual act to which a person has not consented, or could not give consent.

Safeguarding encompasses six key concepts: empowerment, protection, prevention, proportionate responses, partnership and accountability.

Psychological or emotional abuse – bullying, humiliating, controlling, threatening, intimidating or showing a lack of respect or dignity.

Adult abuse can happen to anyone aged over 18. Some adults find it harder to get help and may be more at risk of harm, such as those with: • A disability • A mental health condition • A temporary or long term illness or • Frail older people.

Financial or material abuse – stealing or fraud, misuse of property or possessions, putting pressure on people to include them in their will or on how they spend their money or benefits. Neglect – when a person doesn’t get the help that they need such as medical or physical care, food, drink, heating. It can involve being left alone for long periods and having no activities.

Abuse is the violation of an individual’s human or civil rights by another person or people and it can take many different forms, such as:

Institutional abuse – when organisations such as residential, nursing or care homes, hospitals, day centres or sheltered or housing schemes are run in a way where people are abused, harmed or mistreated.

Physical abuse – hitting, pinching, pushing, shaking, and pulling hair, misuse of medication or restraint.

Domestic violence and forced marriage – are forms of abuse which can include some of the actions mentioned above.

Discriminatory abuse – when a person is treated unfairly, harassed, ridiculed or targeted because of their race, religion, nationality, sexuality, age, gender or disability. Hate crime – is also abuse, it is when a person is targeted for abuse because of their race, religion, nationality, sexuality, age, gender or disability.
