PROTESTING CURBED100 FEET FROM HOMES

P

icketing within 100 feet of a residential home is now illegal in Cottonwood Heights.

Through a recently passed ordinance, picketing or targeting residents at their home within 100 feet of their yard line, for political or other purposes, will result in legal action.

“This affects not only elected officials but every resident in our community,” said Cottonwood Heights Police Chief Robby Russo.

Similar ordinances have been considered or passed all over Utah. The momentum for these ordinances stems from an event in October of last year when protesters gathered in front of state epidemiologist Dr. Angela Dunn’s home.

“This does protect any resident, not just elected officials, which might include an activist or member of a nonprofit. There’s equal protection of those homes as well. I think this is a good thing,” said Councilmember Scott Bracken.

“The form of this ordinance is based heavily on ordinances

that have been enacted in sister cities in Utah,” said City Attorney Shane Topham. “The use of this type of ordinance has been affirmed by the U.S. Supreme Court.”

“This ordinance implements what every other city does and we will use what’s in the ordinance,” said City Manager Tim Tingey.

From the Cottonwood Heights City Council, there was only one concern voiced when passing the ordinance. “I don’t want it to be an excuse for a heavy-handed response like we saw in August,” Councilmember Tali Bruce said. “We all want to be safe in our homes.”

Ordinance 353, Enacting Chapter 10.42 of the Cottonwood Heights City Code of Ordinances concerning Targeted Residential Parking was passed unanimously on Jan. 19. The code was updated for prohibiting targeted residential picketing (i.e., picketing or other demonstrations specifically directed or focused toward a residence or one or more occupants of that residence). l

Discussions underway of possible new school boundaries

T

he development of Jordan Bluffs in Midvale is expected to shake things up a bit when it comes to drawing school boundaries.

Jordan Bluffs, bound by 7800 South on the north, Holden Street and Main Street on the east, the Midvale City boundary on the south and the Jordan River on the west, roughly has 40 students attending Canyons School District schools now, but is expected to house 150 to 175 school children by 2025, said Canyons’ Business Administrator Leon Wilcox.

Plus, nearby Bingham Junction is another redevelopment that will revitalize the older neighborhood and provide housing for families, bringing more children into schools, he said.

“This is so hard because we want to get as much community input as we can and it’s just so hard in this environment to have meetings in person,” he said about wanting patrons’ comments about the four Midvale elementary schools’ boundaries. “It certainly impacts some students. We’re trying to do as minimal as we can, but still need to accommodate growth with student enrollment with the current buildings’ capacities and with the necessary programming that we need to support all the students there so trying to balance that out is always the challenge.”

Boundary changes may go into effect in fall 2022 at the earliest, Wilcox said, but depending on COVID-19 impact, it may be pushed back to fall 2023.

Canyons is looking at several options that they will make public, including increasing enrollment at Midvalley, which can house about 800 students, to “take a little bit of pressure off, if we can, Copperview and a little bit of Midvale.”

Elementary so Wilcox said that they’re looking to balance that school’s enrollment.

“We’re just trying to find the best solution for everyone,” he said.

Both Midvale and Midvalley elementaries are about 80% capacity in a nonCOVID-19 year, Wilcox said.

“We want to try to get more students into Midvalley and maybe keep Midvale the same, but we know that more growth is going to come into that area with the Bluffs, too,” he said.

Copperview Elementary, which Wilcox said can serve a little more than 500 students, and East Midvale, which can serve closer to 600 students, are both “pretty full,” Wilcox said, so district officials also are looking into those schools’ boundaries to adjust student populations.

“These are Title I (schools) so one thing

that comes into immediate impact is we want to make sure we can support the kids that are there and that weighs heavily in the calculation,” he said, adding that Midvale Elementary also is a Title I school. “Title I (schools), you have to have smaller class sizes, more supports and so you need more spaces and so even though you may have a 500 (student) building capacity, you don’t want to necessarily put 500 kids there because it may not be the best way to support them.”

Midvalley recently introduced a Spanish dual immersion program and that could also influence the number of students enrolled in its school.

Wilcox said currently they aren’t addressing busing right now, as they would like to keep students in their own neighborhoods, but he also said it wouldn’t be ruled out.

ble,” he said. “You’d like boundaries to go along State Street, it is a natural boundary like I-15 is, but you can’t always do that. So, you try your best to see what we can do, but the main thing is always going to be to focus on how we can best support students. We put together a couple options and we’ve got a couple more that we’re looking at.”

Those potential options Wilcox shared at the Board of Education last fall. One option is that all of Jordan Bluff students will attend Midvale Elementary, then shifting some current Midvale students to Copperview, and some Copperview students to Midvalley, and some East Midvale students to Midvale Elementary to balance enrollments. The second would split Jordan Bluffs between Midvale and Copperview elementaries, with additional shifting of students as in option one.

“We’ve gotten some positive feedback and we’ve gotten some negative feedback, but we’re wanting to hear from more people in the Midvale community,” he said.

Wilcox said that typically by holding open houses and focus groups, more options may emerge from those discussions, but without those in-person events, it’s harder to hear from people in the community. He has reached out to those elementaries’ PTAs and school community councils and schools’ staff and faculty. There are discussions of holding virtual open houses or possibly sending out mailers to the community.

Under state law, once an option or multiple options are made public, 120 days needs to pass before Canyons Board of Education approves it. Canyons currently has not started that process, he said.

“In this environment, it is so hard to get any community feedback,” Wilcox said.

“We’re trying to bring in as many people as we can to make sure we get it right.” l

Local church puts the ‘community’ in community gardening

A

local church has added some SOUL to community gardening. For over 20 years, Cottonwood Presbyterian Church has hosted a space called the SOUL Garden where residents, whether members of the church or not, can take care of a plot in their spacious community garden. The 2.8-acre space has over 50 plots that people can tend as part of a thriving community effort.

The SOUL (Stewardship on Urban Land) Community Garden is located behind Cottonwood Presbyterian Church at 1580 Vine Street. For a one-time nominal fee, residents can sign up for a plot about 12 foot by 24 foot and grow whatever produce they like.

Volunteer gardeners, including Steve Sands and Marshall Smith, are always around to lend a hand and offer expert advice.

“We’ve got in the neighborhood of 54 plots, and only about 13 are used by members of the church,” Sands said. “It’s truly a neighborhood thing.”

The SOUL Garden offers a communal experience for its participants. Its coordinators provide gardening classes, community events like Easter egg hunts, and host monthly work days for tackling garden-wide maintenance projects. With the onset of the COVID-19 pandemic, the church has used the garden area for socially distanced outdoor Sunday services during warmer months.

“The gardens are larger than any other garden I know of,” Smith said. “They’re real gardens.”

Gardeners are asked to donate 20% of the produce they grow, which is sold to raise

money for charity. Produce that does not sell is also donated to charity. The garden regularly donates to the Utah Food Bank and a nearby women’s shelter. Sands’ wife often takes the lead on sales, which have no list prices. Customers pay what they feel the produce is worth.

Demand for garden plots has grown as fast as the vegetables. One of the challenges its organizers face is having enough open plots for new applicants. “It was originally a small garden, and Steve and I expanded the whole thing,” Smith said. That growth has led to another challenge in the form of water pressure. Access to water has limited the garden to its current number of plots.

Gardeners fortunate enough to have a plot in the space can partake of communal portions of the garden, like a fruit orchard and plots of raspberries and asparagus. Gardeners also enjoy seeing others tend their gardens on a regular basis and get to know their neighbors.

They are also likely to see Sands and Smith, who offer help and advice in addition to tending their own plots. Smith is a master gardener who has dedicated countless hours of work on the SOUL Garden over the years.

When surveying the garden, he will point out new features, things that need to be fixed, as well as much-appreciated donations of mulch and supplies. He will often wave to a neighbor or friend passing by on the Murray Canal Trail, which runs behind the garden.

ber used to make wine. They can quickly name the owner of each garden, what they like to grow, and how they have modified the space to make it their own. Both Sands and Smith sound like proud uncles when talking about the gardeners in their community.

Children also play a key role in the SOUL Garden. Students from nearby Woodstock Elementary tend two large plots and enjoy class trips to the garden to plant and maintain it during the school year. Families volunteer to tend the school’s plot during the summer break.

“It’s a great introduction to gardening for a lot these kids,” Sands said.

The garden is open to visitors, even if

they don’t have a garden plot of their own.

The space offers straight wide paths for wandering between plots and two pergolas with outdoor seating. The SOUL Garden also features a meditation space in the form of a prayer labyrinth, one of the relatively few registered labyrinths in Utah.

While garden plots can be hard to get, anyone interested in applying for one can do so through Cottonwood Presbyterian Church. With planting season around the corner, Sands and Smith will be there to lend a helping hand or to offer some pleasant conversation.

Local substitute teachers stepped up with greater demand during COVID-19

chools nationwide have been struggling to recruit substitute teachers, who have been in high demand during the COVID-19 pandemic.

Locally, six substitute teachers speak about their return to the classrooms and the safety precautions in place.

Rebecca Lyon, Canyons School District It was March 12, 2020, and Rebecca Lyon was substituting at Hillcrest High—the day before former Gov. Gary Herbert placed schools on soft closure to stop the COVID-19 spread. It lasted the rest of the school year.

“We could see it coming,” she said, noting teachers were worried and taking some precautions.

As a former teacher and parent volunteer, Lyon became a substitute teacher in fall 2019.

Lyon) “The teachers have gotten so good at Canvas, it’s become easier for a sub because the kids can just go there. Or sometimes, the teacher would actually teach the class remotely and I just had to take roll,” Lyon said. “I was substituting third grade one time and those little kids all knew how to get online and what to do.

The little kids are so diligent and obedient and wear their masks. (At a middle school), a teacher had a chart on the board of which students were supposed to be the ones in charge of wiping the desk down at the end of every period.”

Not only does she substitute for the love of teaching, but also for the pay. She said a bonus working for the district is that she received her COVID-19 vaccinations from the district.

Melissa Sugden, Jordan School District As Welby Elementary’s former PTA president and a math aide at the school, Sugden decided she wanted to be a substitute teacher.

“I love being at school; it’s just my favorite place to be,” she said.

But she decided last March, right before COVID-19 hit.

“I didn’t actually start being a sub until after everything got back going (this past fall),” Sugden said. “I knew the risks of going during COVID. At the beginning of the year, it was really unknown and scary. For me, I was just like if the teachers are going to go in there and my daughter’s there, I may as well go and do what I can.”

Since COVID-19, she said teachers’ lesson plans are in place.

“Mr. (Aaron) Ichimura (Welby’s principal) is really big on making sure teachers have a plan and that has made a huge difference,” she said. “You know exactly what to do and when they need hand sanitizer and when to wash their hands and clean their desks and the kids just do it. “That’s an amazing thing. I’ve never seen any kid have a big problem with masks at all. It was kind of surprising how well they wear them,” she said. “We wipe down between every kid and you know, with all this cleaning, I think the schools are cleaner than my house.”

Natalie Fisihetau, Murray School District Natalie Fisihetau was substituting at Murray High the day the school district closed its doors March 12, a day ahead of the rest of the state.

“The principal got on and said, ‘We need everyone to exit the building,’” she said.

Since school returned in August, she has mostly substituted long term at the high school.

“I love teaching, but I’m on disability right now. I was a full-time teacher, but I have some issues that I couldn’t do it full time. I need to do it for the money. My husband lost his job and I’m on disability right now,” she said.

“COVID doesn’t scare me in the schools. I think the district has done a great job,” she said.

“I’ve just been really careful and be smart about it.”

By being a long-term sub, Fisihetau is able to access district emails about cleaning and sanitation so she has stayed current with those procedures. She sprays the desks between class periods and allows students to dry them with paper towels.

“Sometimes the classes were very, very small. I might only have six kids in class. I think the most I have had is 20—that is not likely as kids can choose to be online or hybrid. I just go with the flow and put a smile on—although people don’t know that I’m smiling with my mask,” she said.

Karla Roberts, Canyons School District After teaching for 10 years, Karla Roberts has substituted in elementary schools for more than a decade, appreciating the flexible schedule it has given her to care for her mother and babysit a grandchild.

“I sub in elementary. For me, it’s easy to follow the outline and pick up where the teacher left off,” she said. “My teaching experience has helped a lot.”

During COVID-19, Roberts has opted not to accept any long-term substitution positions.

“I’m sticking to two or three schools because I learned their COVID routines,” she said, adding that schools have strongly enforced not sending kids to school sick. “If the kids are even having little sniffles, they’re advising them to stay home.”

While kids are wearing masks, washing hands and being socially distanced, Roberts noticed something else about students during COVID-19.

“Students are becoming more responsible for their own learning,” she said. “They’re understanding the importance of learning after last spring and are logging on and learning what the teacher outlines. They’re also being responsible for making sure they’re able to stay in school by following the rules and helping to sanitize.”

Roberts said she has been grateful that teachers have been shown appreciation this year.

“They really do appreciate us so much more this year. They’re more aware and are expressing it,” she said.

Theresa Johnson, Jordan School District Theresa Johnson started substitute teaching as a way “to get out of the house.” Twenty-two years later, she still can’t stay home and is substituting in classrooms.

“Back in August, I was a little afraid and I brought my little bag in case I felt like I needed to clean something more,” she said. “But I didn’t need to. They supplied cleaners so when students switch half the day in dual immersion classes, we cleaned every desk and chair. We even clean every ball they use on the playground.”

Johnson has substituted consistently even though she is around her mother and her son’s mother-in-law, who has stage 4 colon cancer, as well as babysits a grandchild.

and I actually was one of the first in line the first day (Jordan School District) gave out the COVID shot. It surprised me that we were included and are being appreciated,” she said. “The principal comes in every morning and says, ‘Thank you and we appreciate you coming in.’”

Substituting on Fridays is one of her favorite times.

“That’s when certain kids come in, maybe that’s for extra help, or it could be your top students who want to come in because they want to be at school. This week, I had three kids come in and we had a ball there and got those kids caught up,” she said.

Nancy Mann, Canyons School District For a decade, Nancy Mann has been a substitute, often in special education classes where she once taught full time. In addition to substituting, Mann is a competency base measure tester where she typically tests students in their literacy skills.

“After testing, and I saw how things worked, I knew it would be fine. I saw that the teachers, the administration and all the schools have done a great job trying to keep the kids and teachers safe, and trying to keep everything running as smoothly as possible. At every level, preschool to high school, I saw how often they’re cleaning and sanitizing, and they’re wearing masks.”

Mann remembers on March 13 she was substituting at Brighton High when she heard announcements “track got canceled, baseball got canceled, everything got canceled.” Later, she learned schools were canceled.

“I thought about how the students were going to learn. I thought about the teachers. As teachers, you spend all your days teaching and your nights preparing. It’s a hard profession. I love a good teacher—there’s nothing better in the world,” she said.

“Do you know growing up what a lot of people say is the worst thing ever? A sub. I know when I walk in, and I’m qualified, I’ve taught. I’m not going to be a sub who will turn on a movie. I’m going to carry on, keep the kids on task and carry out the day.

I take it very seriously. I respect the kids and they respect me.

They’re wanting to learn and I’m there to help them.”l

Brighton’s new winter guard to host state competition

n late March, Brighton High will host students throwing rifles and sabers and twirling flags while they compete for a winter guard title.

In its first year competing, Brighton will host the Winter Guard International state championships for scholastic regional A on March 27, while following the safety and health guidelines surrounding the COVID-19 pandemic.

“We have six total competitions this year and almost all of them are virtual,” Brighton High Color Guard Director Hunter Field said. “We will travel to Riverton and Tooele, but even there, teams will be performing shows that are recorded to be judged. At state, it will be the same thing; we will only host about five or six schools.”

Even so, Field is thankful his firstyear 14-member squad will “get the competition feel and experience.”

Similar to marching band season, winter guard performs a routine set to music, showcasing their techniques and talents with flags, rifles and sabers.

Brighton’s routine is named after the song they perform to, “If there was a zombie apocalypse, I'd let my dog eat me.”

“There are so many stresses in life right now, I thought we all could use a release, something fun in life,” Field said.

“It’s a story-driven show that is very expressive. It’s a lot more visual, and the flags provide color.”

Field, who has visions of the guard increasing up to 50 members by next fall and competing on four different teams within six years, said he welcomes any student in “any shape, way or form.” Dance experience is preferrable, but not required, and dance company members would be a natural crossover, he said.

The squad not only performs during fall marching band season and winter color guard season, but also will learn up to four routines for summer parade season.

After marching band, some instrumentalists will grab a flag to perform for just the winter, returning in the summer to their instruments for parade season, Field said.

sabers,” he said. “We want to make sure students have the most positive experience, we want to make sure people feel welcome and they want to be there.”

To ensure that experience, Field and assistant director Elliott Ramirez-Rodgers have regular meetings with each guard member.

“We set goals and ask what they want to accomplish and get out of the season.

We ask, ‘What can we do to make sure this is a positive experience for you?’” he said.

Then Field works with students during the three weekday rehearsals as well as the optional rehearsals that are held twice per week, where students learn to master new tricks.

Students are not only learning those tricks and basic dance fundamentals in their guard experience, Field said they’re learning leadership skills and a positive attitude.

“We want to teach our members to have that positive outlook on themselves, not to beat themselves up if they see someone is better than they are at a competition. We help them realize that if someone is better, it doesn’t mean that they aren’t good at something,” he said.

Field knows that approach works from personal experience.

“The best part of color guard is 110%, the people around it. They are some of the most positive people I’ve ever met,” he said.

Field got involved in color guard when he attended Provo High School.

“A cute girl asked me to join,” he admitted. “I’m not a dancer, but I came over and fell in love with the dance aspect and with a rifle, saber and flag, it was so much more fun.”

It wasn’t a romance that ended happily ever after as Field said she got mad as “I got better than her.”

After high school, he continued to perform with the Wasatch Independent Winter Guard for three or four seasons before starting to help with technique on the Spanish Fork High School color guard.

He worked his way up to assistant director last season, even helping to originate the school’s routine as a memorial to Bob Ross.

Now, Field is studying math at Utah Valley University to become a teacher and has hopes of teaching at Brighton as he builds the color guard program.

“Some of our color guard members are the most dedicated, passionate members I’ve seen anywhere,” he said. “This is one of the best experiences of my life.

Statewide regulations for conceal carry, accessory dwelling units, utility permits and housing inspections

ost every Thursday morning throughout the duration of the 2021 General Legislative Session, city lobbyists meet with members of the Cottonwood Heights City Council to discuss updates in legislature proceedings.

One of the most notable events in the legislature as of publication was the passing of H.B. 60 Conceal Carry Firearms Amendment that would allow the conceal carry of firearms without permitting or training.

City Lobbyist Brain Allen reported that the bill designates eligibility to any individual over the age of 21 and in good standing to carry a concealed firearm in public. “We have talked to (the legislators in support) about the concerns from the law enforcement perspective and they aren’t sympathetic. Law enforcement is unitedly against the bill.”

Councilmember Christine Mikell asked Allen if he knew what the argument in support of the bill was, because she didn’t understand the argument against education.

“We can all benefit from education. I hope we are fighting this strongly,” she said.

“It’s always a mistake to assign logic and reason to the legislative process,” Allen

said.

“Their argument primarily is that criminals will carry guns if they have the law or not. There’s no reason we should restrict responsible citizens to conceal carry. In their mind it’s less disruptive to the public order to allow concealed carry because it’s not out in the public view and it doesn’t make people nervous,” Allen said.

Allen reported on the many law enforcement bills as well. “There is law enforcement bill in committee almost every day with a lot of good, thoughtful discussion. Everyone is interested in getting it right. Most have been favorable for promoting the right policy.

City Lobbyist Greg Curtis reported on the proceedings of H.B. 244 First Class County Highway Road Funds Amendments sponsored by Rep. James Dunnigan and Sen. Wayne Harper which intends to bring improvements for transportation all over the state.

structure bond, but “there have been weeks of leadership meetings and they’re still not sure what they’re doing.”

Some legislatures wanted to move funding for outdoor recreation to the Department of Natural Resources, which would change who would be in charge of the related expenditures, but conversations around that budgetary item were still ongoing as of Feb. 11.

Allen and City Lobbyist Chantel Nate reported on H.B. 17 Utility Permitting Amendments which would prohibit permitting natural gas. “They put an amendment in that bill so cities would not be prohibited from using natural gas for their own resources or educating the public,” Allen said. He anticipated that the bill would likely pass.

Allen, Nate and Curtis have all been watching topics regarding accessory dwelling units (ADUs) within the state closely.

In February, two bills which would impose state-wide regulations were heard. “Something is going to pass,” Allen reported.

The key for cities is to make sure whatever does pass is the least damaging. The bill by Peterson “would strip all power from cities and it would be devastating if that passed,” said Allen.

City lobbyists and the Utah League of Cities and Towns were working on amending H.B. 82 Single-family Housing Modifications to make regulations more livable for cities. “We want to give the city ability for basic safety,” said Allen, giving the example

of a “way to egress in the event of a fire.”

Cottonwood Heights Councilmembers Scott Bracken and Mikell voiced concerns around ADU parking in relation to the bill.

Allen agreed and mentioned that some of the city concerns about parking were going to be accommodated. “It’s not going to be the perfect bill, but a bill we can see we made progress on. It’s a little better as they added an additional one parking space has to be on premise.”

Similarly, there were a few bills that addressed billboard regulations statewide. “We will work with the League and negotiate with sign companies to try to get a place of goodness. I have talked to the sign company lobbyist and he is amenable to language similar to (Cottonwood Heights) ordinance.

I don’t think we will get to a place where we support the bill (S.B. 61 Outdoor Advertising Amendments) but we might get it to a place where it’s not too harmful.”

Mikell mentioned that a potential curfew for the lighting should include daylight savings. Allen thought that was an excellent idea as that had not been brought up in the session yet.

On Jan. 28, City Lobbyist Brian Allen reported on H.B. 98 Local Government Building Regulation Amendments concerning housing inspections. “It’s a nuclear war against cities and their permitting process.

Volunteers connect Cottonwood Heights to its past and to the arts

he city of Cottonwood Heights has long relied on dedicated volunteers to help deliver services to its residents.

Despite slowdowns and postponements due to the pandemic, work has continued to keep the city’s cultural activities moving forward. Two committees that have kept up their work through virtual meetings and planning for post-COVID activities are the city’s Arts Council and Historic Committee.

“When safety protocols allow, we will begin an oral history initiative with a goal of conducting professional level interviews with individuals having valuable perspectives on the history of the area,” said Historic Committee chair Jim Kichas. “These interviews will go into the committee archives and we are excited to find ways to bring them to the citizens of Cottonwood Heights.”

Meanwhile, despite the many challenges faced by the Arts Council to bring people together during the pandemic, it has started to move forward with activities. They have begun work on a sculpture for the City Hall plaza. “It has been a very unique process to be a part of, and we are still at the beginning stages, but we can't wait to see what happens,” said Arts Council chair Whitney Dodge.

The Arts Council has started to make tentative plans for events later this year, including rehearsals for its annual musical performance later this year, a production of “Matilda”

by Roald Dahl. Virtual auditions will be held in late March.

Each winter, the city hosts a dinner to thank its many volunteers for their service to the community. This year’s dinner was canceled due to the pandemic, and city officials felt the event’s absence. “I do miss seeing all the volunteers in person,” said Cottonwood Heights Culture Manager, Ann Eatchel.

“They are still working hard, and we have monthly meetings.”

As they look to the future, both committees could use more help. With plans for activities to resume in the coming months, the Arts Council and Historic Committee are looking for volunteers. Kichas invites anyone interested in joining the Historic Committee to contact Eatchel. The committee has planned several projects, including potentially partnering

with Brighton High School to celebrate its history and mark the opening of the new school buildings in 2021-22. Kichas and his fellow volunteers will also continue to build an online presence to help connect residents with the history of Cottonwood Heights. They will add to a growing archive of historic documents and photographs and make them available online.

“We will work towards the creation of historic monuments and markers in the city, including a marker to honor the veterans from our community who have served,” Kichas said. “We will continue to take the lead on the historic preservation of buildings and structures in the city. This effort will include applying for grant funding that will allow us to place two homes in the city on the National Historic Register.”

The Arts Council will also look to add volunteers interested in helping with several culture ventures, particularly the summer musical.

“A lot of work goes into the summer musical, creating sets, sewing costumes, practices, rehearsals, etc.,” Dodge said.

“We are planning to go ahead on all these things following all the [COVID] safety guidelines. Since the summer musical is our major event of the year, we are looking for people to join the Arts Council that have an interest in plays and musicals, and that have knowledge of theatre and putting on a production like this.”

Dodge also said the Arts Council could use assistance from people knowledgeable in stage management and equipment, marketing and social media. “Someone who loves community events and being involved,” she said. “Someone who loves Cottonwood Heights. Someone who has creative ideas and loves art.”l

Residents may pay Storm Water Fee

ottonwood Heights City Council continues to deliberate the potential of implementing a Storm Water Fee for residents. On Jan. 19, Public Works Director Matt Shipp invited Justin Dietrich from Bowen Collins & Associates, an engineering firm, to present on the federal requirements of storm water sanitation and the challenges of the infrastructure within the city.

Dietrich explained how most of the infrastructure for storm water drainage within Cottonwood Heights and surrounding cities, was first constructed within the ’70s and ’80s. When the cities started to incorporate, they inherited the storm water system that was under Salt Lake County.

“Most of that system is built out of corrugated metal pipe,” explained Dietrich, which only have an estimated life span of about 25 years. “Here we are, over double the design life.”

Almost all of the cities who adopted the storm water drainage system from Salt Lake County have been experiencing problems as the infrastructure continues to degrade. For example, a section of pipe in Millcreek almost completely degraded. The only part that was left now sits in Millcreek’s City Hall and has been named

In addition, part of the infrastructure adopted from Salt Lake County included buried manholes that were not recorded adequately.

“It causes problems within the system because it can’t vent properly and increases deterioration,” said Shipp.

With the amount of buried manholes, the current city crews can’t get to the infrastructure so it’s difficult to maintain or even know what’s happening.

Originally, the only concern of storm drain infrastructure was to keep public streets from flooding. It was widely unregulated. However, the Clean Water Act implemented regulations of storm drains.

“It took a few decades to ramp up, but now there’s heavy regulation of storm water systems to keep water clean—biologically and chemically,” Dietrich said.

Dietrich explained how storm water runoff notoriously pollutes natural resources with hydrocarbons as storm water floods from parking lots and other public spaces into natural water sources, like lakes and streams.

forcing violations, water quality testing and reporting, audits, educating the public and doing outreach, street sweeping to keep contaminants out of the storm water system, and working with some residents to inspect the systems of private systems.

Within the state of Utah, all municipalities are under one state regulation in MS4.

“We need capital improvements in the system,” said Dietrich. He explained how regular and proper maintenance is necessary as well as issues are identified before they become problems. Maintenance protects city property from flooding and road collapses.

Historically, Cottonwood Heights funded storm water maintenance through regular taxes. “Cities collect taxes and a portion of those taxes go to all of the different activities of the city, including storm water,” explained Dietrich. “Back when there were just a few things to clean out and when the system wasn’t so old, that was easier to do.”

With increased costs associated with federal regulations, maintenance from a deteriorating system, and capital improvements, expenditures related to storm drain infrastructure are beginning to outweigh the tax funding.

All cities in the area except Cottonwood Heights, South Salt Lake, and Alta have implemented a storm water fee. Even the unincorporated areas have a fee schedule pending.

One of the main benefits other cities have identified is “everyone pays, including the tax exempt,” said Dietrich. It’s a more fair way to distribute the water fee because it’s based on impervious area. The cost is heaviest on those who impact the system the most.

“We can take the storm water master plan and rate study to create a fee that meets the needs of the city, is defensible and easy to administer, and ready to implement,” reported Dietrich.

In the next few months, Bowen Collins & Associates working along with city staff members and the city attorney, will prepare a final deliverable in the form of a policy manual. “We will identify how the policy will need to be put together for the city specifically so it’s not a copy and paste from somewhere else. It will be workable for you,” Dietrich said.

In addition, there will be a public process where the city will be asking for public input. l

State control versus local control—the mantra of this year’s legislative session

A

virtual legislative town hall was held on Feb. 10 with Rep. Carol Spackman Moss from District 37, Rep. Doug Owens from District 36, Rep. Gay Lynn Bennion from District 46, Sen. Kathleen Riebe from District 8, and Sen. Jani Iwamoto from District 4.

The five legislators answered questions and responded to concerns from attendees regarding canyon transportation, concealed-carry permitting, drought and water shortages, billboard regulations, social disparities, education funding, COVID-19, and various others.

Canyon Transportation “Is the legislature going to be weighing in with UDOT (the Utah Department of Transportation) regarding the Little Cottonwood Canyon transportation plan?” asked attendee Steve Glaser. “I'm concerned that there may be a gondola. We need to be addressing this problem in a way to benefits the range of people who use the canyon.” “(Gov. Spencer) Cox would really like to see a gondola,” Sen. Kathleen Riebe said as she summarized some of the current positions. “That’s not something the people in Cottonwood Heights or Sandy would like to see. (Cottonwood Heights Mayor) Mike Peterson and I have talked about how changing transportation to the slopes is difficult. Snowbird has changed the traffic patterns tremendously with reserve skiing this year. We have an option to change the patterns of business instead of widening the road.”

Moderator and KSL’s Radio Host/Journalist Doug Wright chimed in, “The Governor told me and the KSL Board that the appeal to him was the gondola.”

Riebe clarified “I’m not saying I am against the gondola completely but that’s not what the people in my neighborhood want.

This has been going on since the 1970s and nothing’s been done yet.”

Sen. Jani Iwamoto discussed funding regarding the canyons. “50 million is just a down payment. 500 million to one billion dollars will be benefitting Snowbird and Alta. We need to think really clearly about what we are doing with taxpayer money.”

Drought Iwamoto also mentioned that part of her concern regarding the canyons is the watersheds, especially because this year the State of Utah will be experiencing a drought. The legislatures mentioned that Utah received 62% of normal precipitation.

“Even if we get snow now, we don’t’ have enough water,” Iwamoto said. “We are in a drought. There is a lot of money being put into the fire efforts. We have to think of ways to save our water. We are the top driest in the whole nation.”

“Our soils are dry,” said Rep. Gay Lynn Bennion. “They are not even in a condition to absorb water well. It’s a great concern.”

assemble a committee to make sure Utah gets the share of the Colorado river water” (H.B. 297 Colorado River Amendments).

Conceal Carry Wright asked the legislatures if they would like to respond to H.B. 60 Conceal Carry Firearms Amendment which passed earlier that week as attendee Jan Chamberlain said “do whatever you can to stop the insanity of gun violence!”

The bill allows individuals to conceal carry a firearm without a permit and related training. Wright mentioned how a similar bill passed through the legislature last year, but Gov. Gary Herbert vetoed it. This year, Cox has publicly stated that he will sign the bill when it comes across his desk.

“Now, someone can buy a weapon, put it in their purse, and carry it around,” said Rep. Carol Spackman Moss. “The climate is so divisive and violent right now. This doesn’t seem to be the time to make it easier and encourage people to carry weapons if they are not trained.”

“I was opposed,” Owens said. “The data shown was that violent crime had not increased. I did not find that wholly convincing.”

“I was concerned about this bill from the very beginning,” Bennion said. She recalled some of the instructors for concealed carry courses writing her, detailing how two thousand people were turned away from the course because they did not meet the requirements to conceal carry a weapon.

“I support having guns,” she continued.

“This is not a gun issue, it’s a gun safety issue.

We have lost a safe guard, and the training that helped with suicide prevention and gun safety.”

“We are going in the wrong direction here,” Iwamoto said. “Suicide rates are so high. We should be teaching about suicide prevention and gun storage.”

Billboards “Please comment on S.B. 61 (Outdoor Advertising Amendments), which would prohibit municipalities from limiting conversions to electronic billboards,” said attendee Andrew Gruber.

“Holladay is very concerned about the billboard bill. Billboard companies have way too much influence in the legislature,” echoed attendee and Holladay City Councilmember Paul Fotheringham.

S.B. 61 would prohibit municipalities from limiting conversions to billboards.

“The reason for opposition is that it takes away local control,” Moss said. “Holladay and Murray don’t’ want it. Holladay doesn’t allow any billboards. They even squelched the school marquees.”

“Millcreek wanted them on the west side where there was more expanse land.

Community councils want local control; they don’t’ want the control at the state level. Cities are against it that I represent. It’s a local control issue,” Iwamoto said.

Community Disparities Attendee Kelly Lake responded to Iwamoto’s comment. “I'm always deeply disappointed and concerned when I hear anyone, especially political advocates, continuing to push less desirable business to the west.”

A few similar comments were made about the different areas of the Greater Salt Lake Valley. Moderator Wright then asked, “Is there equality in East side and West side?”

Reibe quickly spoke up, “We have to stop the east side and west side mentality.

We have the capacity to meet the needs across the entire state. We are going to work across all demographics. If we are pretending it’s not there then we cant’ solve the problems. This is something we need to still work on.

“The disparities are great,” Iwamoto said. She mentioned health, social, and economic disparities in her own experiences working with the Native American community while also being a representative of color.

Education Wright asked if the legislatures wanted to respond to anything regarding the current pandemic.

Moss mentioned that she hopes funding for education will get passed, as it might allow for teachers to get raises. “It’s double

the work for them as they have had to do two different kinds of teaching. I originally said that schools shouldn’t open until we have a nine percent positivity rate. We have been at twenty percent most of the year. Its way worse than we thought. This will be a record year in terms of appropriation for education. I am saying yes this will be a good year but there are many challenges.”

Riebe mentioned that she hopes S.B. 175 Special Education Least Restrictive Requirement Amendments will pass as it would “change some of the ways we are funding education.” It would ideally result in increased funding to education and create a less restrictive environment.

“It’s really scary when the pandemic started. Lots of teachers retired and quit, they were nervous,” Reibe said. “We are relieved it wasn’t as bad as it could have been.

Elementary school kids have washed their hands and worn their masks, but they are on top of each other on the playground. We have a lot of federal funding coming. With state and federal funding, I think we are in a good place.”

Various Other topics mentioned briefly during the Town Hall were the 32+ bills on police reform including governmental immunity and citizen advisory boards, domestic violence, committee involvement, duration of legislature sessions, prioritizing time in relation to reading bills, mask mandates, senior care (especially in relation to COVID-19), redistricting, mental health, food insecurity, student disparity, ADUs, and budget.

Conclusion As the two-hour town hall came to a close, Wright asked for final comments.

“This session has shown me that technology is important,” said Reibe. “Congrats to all the parents who have made it though school, really neat to see so many people adapt.”

“I appreciate my smart and hardworking colleagues,” said Owens. He mentioned that constituents should continue to stay informed and connected. “We are looking at what you are sending.”

“All your voices matter,” said Bennion.

“Thanks to my constituents who are wonderful,” said Moss. “I’ve received 600 emails in the last few days on just a couple of bills. I get all my best ideas for bills from constituents. I want to make a shoutout to the intern Ashlynn Polmen who set this up as well.”

“The constituents have been my number one thing. I love the involvement,” said Iwamoto. “We try to do the best policy for our community. Keep in touch with us at le.utah.gov. I’m really appreciative of the legislature communities.” l

A Dropped Call Like a mother in a Disney movie, my cell phone died inexplicably. Well, not inexplicably. I dropped it in the toilet.

I was wearing jeans for the first time in seven months and had the phone in my back pocket when it promptly fell into the commode. My phone, not my back pocket.

There’s a universal response when you drop your phone in liquid; you reach in and grab the damn thing. It could be submerged in molten lava or boiling oil; you will instinctively reach for the phone at the expense of ever using your hand again.

Snatching it up, I screamed several unprintable words and resorted to 15 minutes of “No, no, no, no, no!” I shook my phone, blew in it, prayed over it and dashed home to dump it in a bowl of rice. (A robot on Mars can send information to NASA but I have to submerge my phone in rice because it got wet.)

I thought, this would make a great Instagram post and frantically looked for my phone so I could take a picture of my phone sitting in a bowl of rice.

But I was phoneless. I reached for my phone nonstop. I absently grabbed the TV remote, trying to scroll through Tik Tok. I picked up my computer mouse to check the time. I kept patting my leggings where my cell phone used to be, frisking myself like some weird felon.

I realized I’m obsessed with how many steps I walk. I’m preoccupied with social media. I’m dependent on my phone to give me instant info. If I wanted to order from Amazon, I had to go into ANOTHER ROOM and use my computer.

After 24 hours, I turned on my phone.

Nothing.

Minutes later, I was kicking in the door at my cell phone company, begging them to fix my phone. They know me well because, having been bitten by a radioactive clutz, I break my phone often. But this time, they just shook their head and called the time of death.

Then I got my phone back. I listened to all the podcasts, played all the games, bought everything on Amazon and beat my family at Words with Friends. I ignored my husband, tuned out the world in general and scrolled endlessly through social media platforms.

The lesson here should be turn off your phone and interact with the real world. But what I learned was I need to buy cargo pants with dozens of secure pockets so my phone will never fall into the toilet again.

PROTESTING CURBED100 FEET FROM HOMES

P

icketing within 100 feet of a residential home is now illegal in Cottonwood Heights.

Through a recently passed ordinance, picketing or targeting residents at their home within 100 feet of their yard line, for political or other purposes, will result in legal action.

“This affects not only elected officials but every resident in our community,” said Cottonwood Heights Police Chief Robby Russo.

Similar ordinances have been considered or passed all over Utah. The momentum for these ordinances stems from an event in October of last year when protesters gathered in front of state epidemiologist Dr. Angela Dunn’s home.

“This does protect any resident, not just elected officials, which might include an activist or member of a nonprofit. There’s equal protection of those homes as well. I think this is a good thing,” said Councilmember Scott Bracken.

“The form of this ordinance is based heavily on ordinances

that have been enacted in sister cities in Utah,” said City Attorney Shane Topham. “The use of this type of ordinance has been affirmed by the U.S. Supreme Court.”

“This ordinance implements what every other city does and we will use what’s in the ordinance,” said City Manager Tim Tingey.

From the Cottonwood Heights City Council, there was only one concern voiced when passing the ordinance. “I don’t want it to be an excuse for a heavy-handed response like we saw in August,” Councilmember Tali Bruce said. “We all want to be safe in our homes.”

Ordinance 353, Enacting Chapter 10.42 of the Cottonwood Heights City Code of Ordinances concerning Targeted Residential Parking was passed unanimously on Jan. 19. The code was updated for prohibiting targeted residential picketing (i.e., picketing or other demonstrations specifically directed or focused toward a residence or one or more occupants of that residence). l
