MICHIGAN STATE BAR FOUNDATION

Dear Fellows, Friends, and Supporters,

We are pleased to present you with the 2023 Michigan State Bar Foundation Annual Report. Thanks to your support, the Foundation was able to continue funding the work of nonprofit legal aid organizations and provide leadership in the ongoing effort to increase access to and advance the administration of justice.

Notably, this fiscal year, the Foundation experienced a significant increase in net revenue from the Interest on Lawyer Trust Accounts (IOLTA) program. The increase was attributable to rising interest rates and the increased cooperation between financial institutions and the legal community resulting from the efforts of the IOLTA Community Investments Committee and a vigorous compliance review program. The Foundation has continued to expand our Banking on Justice Program with eight financial institutions now participating. The Foundation is grateful for the continuing support provided by the distinguished lawyers in its Fellows Program. The 2023 Fellows Class included 21 attorneys from around the state. This year marks the 40th Anniversary of the Fellows Program. The Foundation Board looks forward to celebrating this milestone with the Fellows at a reception at the Hall of Justice in Lansing on September 18, 2024.

We are Michigan’s largest funder of civil legal aid because we believe that the client representation provided by legal aid organizations is an essential pillar of democracy. The increase in resources that the Foundation experienced in 2023 will strengthen our ability to ensure the smooth operations of civil legal aid’s vital services. Please review our “2022 Grantee Services Report” to see a summary of the help provided by the Foundation’s annual grantees. As you explore this report and the significant impact of legal aid, we encourage you to celebrate the work of our grantees and to advocate for civil legal aid in your spheres of influence.

On behalf of our Board of Directors and staff, we extend our heartfelt gratitude for your support of the Foundation’s mission. Together, we can strengthen the Michigan civil justice system and empower Michigan’s low-income population.

The Michigan State Bar Foundation provides leadership and grants to improve access for all to the justice system, including support for civil legal aid to the poor, law-related education, and conflict resolution.

Legal Aid in Michigan

Legal Aid organizations throughout Michigan provide impactful and essential legal services for thousands of low-income Michigan households each year.

In 2023, the Foundation distributed annual operating grants to the following non-profit organizations:

Preventing Elder Financial Abuse

An older woman, who was being financially abused by her daughter, contacted Legal Aid for help. Her daughter had been appointed a durable power of attorney and had been withdrawing funds at a casino through the client’s debit card. With the help of Legal Aid, the power of attorney was revoked. In addition, Legal Aid connected her to a money management program for additional support.

Restoring Benefits for a Child with Disabilities

A young boy with autism was denied disability benefits. His mother reached out to Legal Aid for help. Legal Aid’s special education advocates were able to help guide the young mother through the education process and obtain evidence to support the successful appeal of the disability decision. With the help of Legal Aid, the mother was able to obtain the disability benefits necessary to give her son the educational support he needed.

Administration of Justice Project Grants

In 2023, the Foundation awarded grants for innovative projects to the following organizations:

• Michigan Coalition to End Domestic and Sexual Violence

• Wayne State University Law School Clinic Program

The Detroit Justice Center received funding to pilot a community based social justice hub, to provide legal services and improve economic justice by collaborating with local community organizations.

Michigan Indian Legal Services received funding to update their outreach materials to help educate the Native American communities throughout the state of the legal services available to them.

Financial Information

The information provided in this financial report is a condensed version of the audited financials for fiscal year ending on September 30, 2023. The Foundation manages certain bids and contracts to support civil legal aid in Michigan. In addition, pursuant to state legislation, the Foundation administers the portion of court filing fee funds which is distributed to legal aid programs. These grants are paid directly to grantees and not included in our financial statements.

Community Support for Access to Justice

Interest on Lawyer Trust Accounts (IOLTA)

The IOLTA program serves as a critical source of funding for civil legal aid organizations across the state. As administrator of Michigan’s IOLTA program, the Foundation oversees IOLTA interest remittances from more than 100 financial institutions.

The Foundation increases the impact of Michigan’s IOLTA program by ensuring that eligible financial institutions pay comparable IOLTA interest rates and by maintaining the Banking on Justice Campaign. We encourage Michigan Attorneys to bank with one of the following Banking on Justice participating financial institutions that voluntarily pay higher interest rates and waive all fees on IOLTA accounts:

Administered by the Foundation, in partnership with the State Bar of Michigan, the Access to Justice Campaign depends on the generosity of attorneys, law firms, and corporate counsels each year, to increase the resources available to 14 regional and statewide participating programs in Michigan.

Fellows Reception

The Foundation’s annual Fellows Reception was attended by many Fellows from around the state.

2023 Foundation Awards

FOUNDERS AWARD

Recognizes lawyers who exemplify professional excellence and outstanding community contributions

Edward H. Pappas has provided significant leadership throughout the state on a variety of important issues to the legal profession, including professionalism, civility, and access to justice. He has held many leadership positions including former President of the Michigan State Bar Foundation, former President of the State Bar of Michigan and is the current MSBF Fellows Secretary.

ACCESS TO JUSTICE AWARD

Honoring persons who have significantly advanced access to justice for the poor in Michigan

Karen M. Tjapkes has been a practicing attorney with Legal Aid of Western Michigan for 23 years. As Director of Litigation, she oversees the program’s advocacy and service delivery, establishes goals and strategies for litigation, manages staff training and development, and assists with grant management. She has devoted her career to ensuring access to justice for all.

Fellows Program

In 1984, a small group of Michigan lawyers had the vision to establish the Fellows of the Michigan State Bar Foundation. Currently, there are over 1,500 lawyers and judges in the Fellows program.

FELLOWS ARE LEADERS

Fellows are a distinguished group of attorneys. The Fellows Program honors lawyers for professional excellence and community contributions. Fellows represent the highest traditions of the legal profession. Their contributions are beyond measure, and this Fellows “spirit” infuses the Foundation’s important work.

More than $2.1 million in contributions from Fellows has helped build a base from which the Foundation has steadily grown.
