Section 1 Policy Statement of Intent The senior person with responsibility for Malpractice and Maladministration at Mode Training Limited (MTL) is Debbie Tagoe, Company Director, who will review this policy with Amanda Clarke, Quality Assurance Manager. 1. Aims To ensure that:
the prevention of malpractice and maladministration is promoted at MTL a robust quality and internal verification system identifies any cases of maladministration or malpractices any cases of maladministration or malpractice are investigated fully and the necessary agencies/organisations are informed
2. Definitions Definition of Malpractice Malpractice can be defined as any action which undermines the integrity of the qualification offered by the centre or a deliberate contravention of procedures and regulations. Examples of Malpractice
Deliberate misuse of the awarding body logo by the centre/provider Contravention of examination regulations by the centre/provider Offering excessive amounts of help in producing assessed work Using falsified witness testimonies Allowing candidates to use work that is not their own Claiming certification for non-active candidates Claiming certification for incorrect units or awards Claiming for fictitious candidates Changing or falsifying records or certificates Claiming a certificate for candidates who have not undergone assessment or completed the assessment process

Plagiarism including copying large amounts of work from other sources without acknowledgement for the author Pretending to be someone else Falsifying or altering witness testimonies Changing results or certificates
Definition of Maladministration Maladministration is an activity or practice which results in non-compliance with regulations, but it’s normally the result of a genuine mistake rather than any deliberate plan to gain an unfair advantage. Examples of Maladministration
Late registration of learners with ILM Claiming certification for incorrect units Failure to advise the awarding body of any changes with regard to the delivery of the qualification Failure to comply with the awarding body procedures for candidate registration and certification

Overall responsibility for malpractice and maladministration
2. Plagirism and Cheating Co-ordinator Amanda Clarke The responsibility for malpractice and maladministration has been designated to a senior member of the management team at MTL. They will be responsible for:
setting the policy and procedures investigating malpractice and maladministration giving advice to MTL on compliance issues liasion with external agencies/organisations ensuring compliance with relevant guidance

Section 3 Arrangements All identified or reported cases of malpractice and maladministration are to be dealt with as follows:
All staff are to co-operate fully with any investigation Amanda Clarke is to investigate the incident(s), and provide a timeline for outcomes Awarding bodies are to be informed immediately, by Amanda Clarke, that an investigation is taking place If it is a incidence of malpractice the staff member involved is to be suspended for one week, with full pay, pending the outcome of the investigation Senior management meeting is to be held to agree actions to be taken including if a disciplinary hearing is to be held An improvement/action plan is to be produced and communicated to all employees involved with the delivery and administration of these qualifications
