OPENING STATEMENT - Prosecution Opening Statement Prosecution May it please the court, your honor my name is McKenzie Haithcock, the prosecutor representing the State of Minnesota in this action against the defendant, Casey Campbell. The state is bringing the following charges against him; terrorizing by use of destructive device or explosive or commission of arson in certain places, attempting exploding destructive device with intent to commit murder, and possession of video game in violation of School Violence in Video Games statute. Regarding count one, the state will prove the defendant attempted to explode or ignite an explosive with the intent to terrorize Sawyer Simpson at a public school. The evidence will show, that Casey Campbell had in his possession all of the materials needed to create the explosive found at Park Lane School. The defendant posted on social media his interest in pyrotechnics, which is an interest in fireworks a similar explosives, and drawings of Sawyer Simpson in a burning building. We will be calling four witnesses to the stand today. Our first witness, Detective Riley will testify to finding the explosive device on the dining patio of Park Lane High School. Regarding count two, the state will prove the defendant attempted to explode a destructive device with intent to commit murder. Sawyer Simpson will testify that he saw Casey Campbell wandering around the dining patio before school began the day the explosive was found. Campbell had in his possession all the materials needed to create the bomb and had many hand drawn pictures of Park Lane School on fire, with Sawyer Simpson trapped inside. Sawyer can testify to Casey saying to him, “You will be sorry you ever picked on me.” Regarding count three, the state will prove that the defendant is under the age of 18 and knowingly possessed a video game depicting violence in schools. We will establish with his birthdate that the defendant is 17 years old. In his statement the defendant acknowledges that he owned and played the video game High School Slasher III. At the conclusion of the trial you will see that all of the evidence which includes the testimonies, exhibits, and stipulations prove the defendant guilty beyond a reasonable doubt.

OPENING STATEMENT - Defense Opening Statement Defense Your honor my name is McKenzie Haithcock, and I am representing Casey Campbell in the case of State v. Campbell. The defendant stands here falsely accused of bringing an explosive device to school, which is a very serious crime. As the evidence will show, the state has failed proved the elements of any of the counts beyond reasonable doubt. The prosecution has indicated that Mr. Campbell was the only person see on the dining patio the morning the bomb was found at Park Lane School. Ladies and gentlemen, the defence will call forward four witnesses, the first witness, Cameron Cortez will testify to seeing not only Casey Campbell but Sawyer Simpson on the dining patio the morning the event took place. Our second witness, Jamie Jefferies will testify that Casey was a sensitive, talented, and funny person who he didn’t see as any type of threat to him or his friends. Dr. Avery Atkinson, our third witness, will testify that the bomb found at Park Lane was not a true danger to the students. He will tell you that the bomb was poorly made and would not have done anything more than cause a bad smell. Our fourth and final witness, Casey Campbell will tell you that the artwork found at his home and on his R-place page are nothing more than a creative release imitating a famous painter. Also that he had no knowledge of what game he was downloading till after he had it in his possession. At the conclusion of the case we ask that you find our client not guilty. The state has not met its burden of proof and we would ask for the verdict not guilty. Thank you.

CLOSING STATEMENT - Prosecution Closing Statement Prosecution Good afternoon ladies and gentlemen of the jury, again my name is McKenzie Haithcock and I am the prosecutor for this case. In my opening statement I told you that I would be calling forward four witnesses to the stand to testify as to the defendant's guilt. We have established the following facts beyond reasonable doubt, first as stipulated Casey Campbell owned and used the game High School Slasher III, second the defendant created numerous images depicting the death of Sawyer Simpson and of Park Lane school on fire, is under the age of 18, was in possession of all materials needed to create the explosive, and that he had an interest in pyrotechnics.

We ask you to reject the defence’s arguments, that the bomb found at Park Lane was not a threat to the students of the school and would have only caused a bad smell. Dr. Kyle Killian, who did extensive work and many tests on the bomb after it was found, told us that the combination of Doxene and paint thinner are a volatile combination. He told us that if oxygen had reached the explosive combination the gas would have exploded as it left the container also releasing a large amount of heat in the process.

That Casey had no knowledge of the game has was downloading till it was in his possession, in his testimony Casey told us that he had no knowledge of what game he was getting till he had it in his hands, but even though he knew what it was once he had in his possession he still played it more than once. He states in his statement that he owns more than one video game with violence. Studies have been done that say that people that play video games depicting violence are more likely to commit violent acts. Given the evidence presented to you in this trial ladies and gentlemen of the jury we conclude that Casey Campbell is guilty beyond a reasonable doubt. Thank you.

CLOSING STATEMENT - Defense Closing Statement Defense Good afternoon, my name is McKenzie Haithcock and again I am the defence lawyer in this case. In the case that the prosecution has presented to you today there is not enough proof to convict Mr. Campbell of the crime he is being accused of. We ask for a verdict not guilty. The state has failed to prove beyond a reasonable that Casey Campbell was responsible for the bomb found at Park Lane School.

Casey Campbell was not the only student spotted on the dining patio the day the bomb was found. Witnesses testified that Sawyer Simpson was also seen on the dining patio only hours before the bomb was found.The artwork created by Casey was not proven to be anything more than an artistic release. How interesting that Sawyer Simpson is tied to not only this event but also the graffiti incident last year with Brady Bravo. The state had failed to meet its burden to prove beyond reasonable doubt Casey’s guilt, therefore we ask that you acquit and find the defendant not guilty. Thank you.

CLOSING STATEMENT - Prosecution Men and women of the jury, denfense would like you to believe Casey Campbell's innocence when he is not. The evidence we have so carefully gone through obviously states he is guilty. Casey Campbell placed the explosive in the trashcan knowing very well that that is where sawyer and his freinds hangout. He did it.

CLOSING STATEMENT - Defense Ladies and gentlemen of the jury, prosecution wants you to believe Casey is the culprit when he is innocent. Evidence shows that he is clearly the butt of a cruel joke played by Sawyer Simpson. Sawyer has disliked Casey for a while now and what better way to get rid of him than by planting an explosive in a school garbage can. Casey's paintings are a form of self expression, a way to escape the horrible things he goes through at school. Mr. Casey Campbell, is not guilty.

We plan to prove that Casey Campbell is guilty of terrorizing by use of destructive devices with also the intent to kill and possession of an illegal video game. The evidence will show that it was Casey was in full knowledge of the crime and he was the one who went forth with the plan to do so. A reason why Casey might have the motive to do this act is simply because he was given a hard time at school by the other students, and he had enough of it so he went to the extreme and decided to plant a bomb in a trash can to set off in the school with the intent to kill.

OPENING STATEMENT - Prosecution Good morning/Good afternoon my name is Sara Parent and I am the Prosecutor of this case. I am happy to be representing the people of this state in the case of Minnesota VS. Campbell. On April 7, 2015, the defendant Casey Campbell made a homemade bomb and placed in a trash can on school grounds. Detective Riley found a videogame in Casey’s game console called High School Slasher 3 which violates the new law of obtaining a videogame that contains/promotes in school violence. Also Casey had possession of a map of the school campus and a drawing of how to make a ameture bomb, with some violent drawings of the school engulfed in flames with one person unable to escape that was labeled “Sawyer.” At the end of this case we will be asking the verdict of Casey being guilty.

OPENING STATEMENT - Defense Your Honor, my name is Brittany Neu, defense attorney for Case Campbell in this action, along with Sara Parent who is also a defense attorney for Casey Campbell. We would ask for the verdict not guilty.

On April 7th around 12:23 PM, Detective Rory Riley received a call about a suspicious object in a trash can that was later identified as a homemade bomb. Detective Riley will be brought to testify that he brought the container to a lab confirming that it was a basic bomb but there were no fingerprints on the bomb. The next day he arrested my client, Casey Campbell, for terrorizing by use of destructive device or explosive, exploding device with intent to commit murder, and possession of a video game that violates the School Violence in Video Games statue.

First Casey Campbell did not create this bomb to terrorize or try to murder anyone. Detective Rory Riley will testify that his fingerprints were not on the bomb and he was not near the area when the call was made. The defendant Casey Campbell will testify that he was being bullied at the time by some school students, known as the crew. Casey reflected his anger in his painting to help relieve stress.

Casey also became closer with Jamie Jeffries who is a the only member of the crew who did not harass Casey in anyway. Jamie will be called to testify that he helped Casey talk about things and told Casey to keep painting and posting his paintings on a site called Rplace. This way the boys could communicate outside of school without the worries of other people finding out. If Casey did make the bomb and did mean to hurt or to even kill someone, then why would he put the bomb where he would know where his friend would be?

Also witness Cameron Cortez, who is Casey’s counselor will be called to tell you about how Casey came to him and told him about Sawyer Simpson and his crew. Then Mr. Cortez also told Casey to keep drawing and painting. Mr. Cortez then spoke with Sawyer about the consequences of his actions if he were to continue the teasing and bullying. Mr. Cortez will also explain a similar case that happened last also with Sawyer but with a different victim. Could it be possible that maybe Sawyer was mad that Casey might ruin his senior privileges that he might have set up Casey? Do we really want to put an innocent victim behind bars for being bullied and reporting it like all the ads or posters say we should do?

And finally the state wants to charge Casey Campbell for the possession of a video game that goes against the School Violence In Video Games statue. Casey Campbell will be testified and say that the game was downloaded from a site. This site gives you a free download every month but you do not know what game it is until it has already been downloaded. The School Violence in Video Games statute clearly states that any person under age 18 who kowningly possesses the game is punishable. In conclusion Casey who not have possibly known what the game was when he was in possession of it.

Detective Rory Riley stated that he received that call at exactly 12:23 AM. Cameron Cortez witnessed Casey walking towards the cafeteria at 12:25. This evidence shows that Casey was not near the cafeteria when the bomb was placed. If he placed the bomb earlier then why would he be walking toward the bomb area? Also Detective Riley said that there were no fingerprints on the bomb when he found it. And both Dr. Avery Atkinson and Dr. Kyle Kilian stated that the bomb was made of paint thinner and Doxene; materials that commonly found. Although Casey expressed his anger through his paintings and drawings, they were just paintings and drawings and were simply a fantasy to help cope with the stress and anxiety of being bullied.

Sawyer Simpson came to the stand to tell us that something like this happened last lear with a different victim. Last year a student named Brady Bravo was being bullied by again Sawyer Simpson. Mr. Cortez informed us that Brady was accused of vandalism last year and denied that it ever happened. Then Mr. Cortez asked him who might accuse Brady of something like this and Brady said the only person giving him trouble was Sawyer.

What would Casey’s motive be? Yes he did paint things about Sawyer but that was just to help him cope. Jamie and Casey had become close friends when the bullying got bad and Jamie had help Casey feel better. TOgether they talked about Casey’s drawings with a site and also talked about Sawyer on the R-Place site. Overall they had become closer friends through this hard time for Casey.

Casey knows that Jamie hangs out with Sawyer frequently and it would be very likely that Jamie would have been with Sawyer if that bomb exploded and was meant to hurt Sawyer. Why would Casey want to hurt one of his friends that had decreased that amount of bullying being done to him?

OPENING STATEMENT - Prosecution This young man Casey Campbell has been charged with terrorizing by the use of a destructive device, attempt to explode or ignite an explosive with intent to murder, and possession of a violent video game. Sawyer Simpson a fellow classmate of Casey's claimed that Casey threatened him. Sawyer told Dectective Riley that Casey said to him "you will be sorry you ever picked on me " after Casey was appearently bullied by Sawyer and his friends. Casey posted on his R-Place page a picture of his own high school Park Lane on fire with a person labeled as Sawyer Simpson running out of the burning building. Not only he post such an unpleasant sight but when his house was searched an empty container of paint thinners were found along with a notebook that held a drawing that looked very similar to what was posted on his R-Place page.

OPENING STATEMENT - Defense My client Casey Campbell has been wrongfully accused of terrorizing by the use of a destructive device, exploding a destuctive device with intent to commit murder, and being in possession of a video game in violation of the School Violence in Video Games statue. This young man was simply living his life and expressing himself through his art. He ovbiously felt as if he was being bullied by Sawyer Simpson and his friends who felt they were superior to Casey and even had their own nickname as a group and were called The Crew.

There is no way to connect Mr. Campbell to the actual bomb besides the paint thinner in his garage. The paint thinner simply could have been used for it's actual purpose of thinning paint or cleaning up paint. Mr. Campbell is simply the easiest person to accuse in this situationand in turn makes him the victim.

At worst what would the bomb have done without a steady flow of oxygen? Would this have caused any harm to any of the students or faculty at Park Lane High School?

Dr. Kyle Killian: Were any fingerprints found of the device? If there were no figure prints on the device how can it be linked to Casey?

How could the watch time be accurate if it had missing hands? Wouldn't the device need a steady flow of oxygen to detinate? How would it get a the oxygen it needed if it was in a garbage can? Was the igniter strip low quality? (if yes wouldn't it have only punctured a small hole ?)

Sawyer Simpson: Did you bully Mr. Campbell? Did Casey take what seemed to be jokes to you seriously? If he did why didn't you stop?

He threatened Sawyer which was a very important turning point which signified that Casey had planned something to harm Sawyer while harming others. Casey Cambpell is guilty of terrorizing by use of a destuctive device, attempt to explode or ignite an explosive with the intent to murder and possession of a violent video game.

OPENING STATEMENT - Defense Casey Campbell has had a rough year. By random he has been chosen to be the victim of an infamous brew of bullies. Bullying was not satisfying enough for the delinquents and so, one of the antagonizers, Sawyer took it further and schemed to frame Casey of a truly deadly charge.

But alas, this was merely a ruse with the intent to blame Casey. the witnesses that we call today will without a doubt show that it was Sawyer, not casey who had committed the act of terrorizing the students of Park Lane High. Today we are representing the State of Minnesota in the case of The State of Minnesota v Campbell. On Friday, April 7, 2012, at 12:23 p.m., Detective Rory Riley received an anonymous phone call on the stations anonymous tip line. The caller informed Detective Riley that a mysterious container had been found in the trash can. The mysterious container was identified as a bomb. Preliminary results showed that the liquid inside the bomb was Doxene, a common industrial cleaner and paint thinner. Sawyer Simpson told Detective Riley that he saw Casey Campbell wondering around the morning before the incident. After hearing both Sawyer Simpson and Jackie Jeffries, Detective Riley obtained a search warrant for Casey Campbell’s house. We are the prosecutors representing the state of Minnesota in this action. Over the course of this trial, it is your job as the jury to find defendant Casey Campbell guilty of placing a bomb on school grounds, attempting to explode a device with intent to commit murder, putting an offensive substance in a place of public assemblage, and possessing a video game in violation of the School Violence in Video Games statute. The prosecution alleges that Casey was a loner and believed Sawyer, the leader of a popular group on campus called the “Crew”, was bullying him. The prosecution further alleges that Casey hated Sawyer and that Casey posted drawings on the Internet depicting Sawyer in peril and sought to harm Sawyer by placing a bomb where the Crew often gathered. Today, both the defense and prosecution will each present witnesses, expert testimony, and physical evidence to support their arguments. The pretrial issue involves the First Amendment’s provisions governing freedom of speech and expression. It focuses on the constitutionality of the School Violence in Video Games statute, which prohibits the possession of certain types of video games. The prosecution asserts that the statute is constitutional. First, it argues that video games are not protected under the First Amendment because video games either do not convey any type of information, or these games in particular fall within one of the stated exceptions to the First Amendment. OPENING STATEMENT - Prosecution On the morning of April 7th, 2015, a bomb was placed on Park Lane Highschool property, and if ignited, it could severely injure and perhaps kill those within the vicinity. Casey Campbell has been charged with terrorizing by use of a destructive device of arson in certain places and for exploding or attempting to a destructive device with the intent to commit murder. The defendant here is guilty of these charges as his fingerprints had been found on one of the ingredients to create the explosive. The psychological effects of being constantly bullied and harassed has led to a "kill or be killed" mentality which has taken the literal. Casey Campbell has taken these actions to bring upon violence to a school and should not get away without any repercussions.

OPENING STATEMENT - Defense Bullying and harassment can affect many psychologically, and Casey Campbell is not one new to this harassment, yet it has not led to a "kill or be killed" mentality within him. Casey Campbell has been wrongfully charged with terrorizing by use of a destructive device, explosive, or commission of arson in certain places, along with exploding a destructive device with intent to commit murder. Kyle Killian- Do you agree with the claims Dr. Avery Atkinson, that the explosive found could actually not cause a dangerous explosion, just produce a smell? Due to Dr. Atkinson's study, do you think that your claims made on the subject could have potentially been a mere over exaggeration of the matter? Could the bomb being located underneath the piles of trash have an effect on the detonation of it in any way?

Rory Riley- When searching Casey Campbell's household, you only found the paint thinner, correct? So did you not find the Doxene, the other vital ingredient to create the explosion within Campbell's possession? In your witness statement, you claim that the primary reason you arrest Campbell would be for his possession of the video game, which violated MN law. Regardless of the video game, if that was not there, would you have arrested Campbell for other actions of which he has been accused of? In the video game High School Slasher III, you claimed that they listed instructions for how to do commit violent crimes at school, were any of the violent crimes that they explained how to do ones that Casey has been accused of doing?

CLOSING STATEMENT - Prosecution School's should be a place of safety, as it is where we send our children day in and day out. Any violence that occurs at a place such as

Casey's fingerprints were found on the paint thinner, a primary necessity to create the destructive device that was found at the highschool, his art reflected the crimes and violence he would commit, and the "kill or be killed" mentality that was a result of the harassment he suffered overall led him to commit these actions. School's should be a safe place, but the safety of Park Lane Highschool was endangered, and that shouldn't happen again.

CLOSING STATEMENT - Defense Casey Campbell is an innocent teenage boy who has been wrongfully accused of taking actions regarding trying to ignite an explosive with the pure intent to kill others. Campbell is simply a teenage boy who has suffered harassment by his peers, and his art has been mistakenly interpreted by those unaware of its true meaning. We plan to prove that Casey Campbell is guilty of terrorizing by use of destructive devices with also the intent to kill and possession of an illegal video game. The evidence will show that it was Casey was in full knowledge of the crime and he was the one who went forth with the plan to do so. A reason why Casey might have the motive to do this act is simply because he was given a hard time at school by the other students, and he had enough of it so he went to the extreme and decided to plant a bomb in a trash can to set off in the school with the intent to kill.

Where do you vacation? Why is your "imagination" a valid description of Casey's actions? Why is his interest in pyrotechnics suspicious from a bomb made of paint thinner and doxene? What makes your judgements of the defendant and his family at all valid?

CLOSING STATEMENT - Prosecution Your honor, the defendant is clearly guilty because there are several signs pointing to him. He has an interest in pyrotechnics, is picked on often, a trait of many school shooters, and is clearly the artist of pictures depicting the murder of Sawyer Simpson.

OPENING STATEMENT - Prosecution On the morning of April 5, 2015 the Park Lane Police Department received notice of a suspicous container at Park Lane High School.

Detective Riley went to the high school to investigate and found clear container holding a liquid. Taped around the container was a wristwatch, wires and a metal igniter strip. This was not the workings of a high school project or a prank. Members of the jury, this was a bomb. A bomb planted in Park Lane High School. It was not planted in the dead of summer, it was planted during school when students were present. There is only one conclusion that can be drawn. But who did it. The Defendant, Casey Campbell, is a troubled young man. He watched violent video games and was tormented by certain people at school. He had enough, he wanted to get even.

And, in his mind, getting even meant hurting people. He planned this, he drew it out and his fingerprints were on a container containing the same liquid found in the bomb. Casey Campbell did so with the intent to harm. We will also prove that he had a video game in his possession showing school violence. We will ask you to convict Casey Campbell.

OPENING STATEMENT - Defense Sometimes public fear causes net of justice to be cast too far. We see an issue, such as school violence, and all agree that is wrong.

But, sometimes in our desire to condemn an act as unacceptable, we become eager to point the finger at. We so desperately want to stop such acts that we lose sight at the first issue to address and that issue is: who is responsible? Here, the State is asking you to convict Casey Campbell based on its desire to see someone, anyone, pay for a crime. But, he didn't do it. Casey Campbell is a young man who was bullied. Instead of resorting to violence, Casey took out his anger in art. Art that expressed his frustrations, his creative feelings and for that, he is being charged. This case is built entirely on circumstantial evidence; there is not one person who saw Casey build a bomb, plant a bomb or otherwise be involved with a bomb. To the extent physical evidence exists, it is easily explained away.

In its effort to make a statement, the State has also charged Casey with posessing a video game that depicts violence. But again, this is easily explained. Casey simply received a free download of a game, opened it and forgot about it. There is no evidence that he used this game or, more to the point, knowingly possessed this game. The State has the burden of proof in this case and that is important.

Casey doesn't have to show he is innocent; although he is. The State has to show that Casey acted and acted with intent. They cannot meet this burden. Casey should be found not guilty.

It looked like a bomb? You didn't see who put the bomb at the school, did you? And you don't know their intentions do you?

Cameron Cortez - As the Park Lane guidance counselor, you were aware that Casey believed Sawyer Simpson was bullying him? You followed this up but found no evidence of bullying, did you? Casey grades were dropping, weren't they? And he seemed troubled, didn't he? On April 7, 2015 you saw Casey didn't you? And, he was in an area that students are not supposed to be, correct?

Prosecution Witnesses: Detective Riley - You didn't find Casey Campbell's fingerprints on the device found at Park Lane School on April 7, 2015, did you? You never sawy Casey Campbell make the device, did you? You never saw Casey Campbell plant the device, did you? You didn't find evidence that Casey Campbell bought the Slasher video game, did you? It's not unusual for people to have paint thinner at their home, is it?

Dr. Killian - In your examination of the device that was found at Park Lane High School on April 7, 2015 did you find Casey Campbell's fingerprints? You didn't see Casey Campbell make the device, did you? You didn't see Casey Campbell plant the device anywhere did you? You can't beyond a doubt link Casey Campbell to any of the material found on or with the device, can you? It is not unusal for people to have paint thinner at their home, is it?

Sawyer Simpson - You had at least one negative encounter with Casey Campbell, didn't you? You were called into the counselor's office, right? You knew Casey was an artist, didn't you? The day of the evacuation you claim you saw Casey by the place where the device was found? You thought it was strange that Casey was there, so you watched him, right? You saw him go over to the trash can, correct? But you didn't see him put anything in the trash can, did you?

Jackie Jeffries - You looked on Jamie's computer? You saw some content that you found disturbing, right? But, that content was only Casey's interest in pyrotechnics and some artwork, right? You never saw Casey make a bomb? You never saw him plant a bomb?

CLOSING STATEMENT - Prosecution Casey Campbell is a young man who, in his mind, had enough. The pictures he had drawn to express his feelings were no longer enough. He needed to do more. He turned those pictures and those feelings of being wronged into a plan. A plan to harm people. We may never know what drove him to this action, but we do know that he did it. People don't make bombs as presents. There is only one reason why somebody makes a bomb and that is to harm somebody. Casey's fingerprints are on the paint thinner container, Casey's

drawings depict a fire at the school; the same kind of fire the bomb, according to our expert could create. Casey had a video game, on his own computer, showing violence at a school. He had it, nobody put it there to frame him. The dots connect and Casey Campbell is guilty.

CLOSING STATEMENT - Defense Casey Campbell is guilty of nothing more than being a young artist and having his fingerprints on a container of paint thinner. If that is enough to convict somebody of the charges the State has brought in this case, many more people than Casey are also guilty of making and planting this same bomb. No fingerprints, no eyewitness, nothing other than pure speculation. He was bullied and is now being bullied again, this time by an opponent that has the ability to do much more than simply taunt him. Ladies and gentlemen this opponent, the State, has the ability to take away his freedom. And for what? Because he chose to express his anger through art? Because he is a little bit different? Again, if that is the case, more people than Casey Campbell are guilty in this case. He is also guilty of opening up a free download and that he did do. But after finding out what it was, he set it aside and forgot about it. He didn't knowingly possess anything, he simply received something and neglected to take extraordinary measures to make sure it disappeared. Again, if that is a crime, more people than Casey Campbell are guilty. The State has not met its burden. Casey Campbell is not guilty.

CLOSING STATEMENT - Prosecution I think that it's pretty clear to see that Darien had plenty of time and the intelligence to mess with the Vanessa's car causing her to crash into the light pole so he could win the race he obviously did not care about Vanessa very much. She was rude to him, and he responded in a horrible way.

OPENING STATEMENT - Prosecution Good morning. I am Isabella Brunetti and I represent the state in the prosecution of Darian Kendall. On May 21st, Darian Kendall engaged in a street race with Vanessa Foley, which subsequently resulted in her death. Ladies and gentlemen of the jury, this case is about a man whose reckless attitude and blatant disregard for the safety of others cost a young woman her life and endangered the lives of others. At the conclusion of this case, we ask you to find Darian Kendall guilty of gross vehicular manslaughter and an illegal exhibition of speed. The prosecution will call four witnesses to the stand today. We will call Officer Quinn Avila who will testify that Darian Kendall was a spectator at a street race prior to the events of the night of May 21st and that his car had a 'Road Hogz' decal on it the night of the accident. We will call Mo Lancaster, a friend of both Kendall and the victim, will testify that Darian Kendall had every intention of racing Vanessa that night. We will Parker Gallow who will testify that he as well heard the multiple arguments between the defendant and Vanessa Foley prior to Vanessa's death and that Parker witnessed Darian accelerating quickly past that stoplight and Darian's car's brakes screeching when he stopped. Finally, we will call an expert witness, Lindsay White, who will testify that the evidence presented to her led to the conclusion that the defendant's car accelerated quickly in a short amount of time. The defense may argue that Darian Kendall had no intention of racing Vanessa Foley, and that the acceleration was due to Darian's car troubles, but the witnesses will state that the relationship between Darian and Vanessa was strained, and that Darian responded when provoked minutes before Vanessa Foley's accident. It is my job as the prosecution to prove Darian Kendall guilty of these charges beyond a reasonable doubt, and it is your job as the jury reach a verdict of guilty once I do just that. CLOSING STATEMENT - Prosecution Good afternoon ladies and gentlemen. Once again, I am Isabella Brunetti, the prosecutor for this case. In my opening statement, I said I would call four witnesses to the stand. Each witness explained the facts and established beyond a reasonable doubt that Darian Kendall 1) operated a vehicle, 2) committed an illegal exhibition of speed while driving, 3) his irresponsible conduct cost Vanessa Foley her life, which would not have happened had he not been there and racing against her, and 4) the defendant acted with no regard for how his actions could affect other people and himself. We ask you to reject the theory that Darian's car was the reason he acceleorated so quickly. Mo Lancaster testified that he heard Darian reving his engine in response to Vanessa, a common symbol for accepting the challenge of a street race. Mo Lancaster was the closest person to Darian and therefor had the greatest ability to hear his engine over Vanessa's. The defendant does not wish to be held accountable for his actions, and to do so he has bent the truth to attempt to prove his own innocence. In conclusion, we ask you, the jury, to find Darian Kendall guilty of both charges. Thank you.

CLOSING STATEMENT - Defense Good afternoon, I am Isabella Brunetti, the defense lawer in this case.The prosecution has failed to prove beyond a resonable that my client is guilty of the charges against him. We ask that the jury arrive at a vedict of not guilty. Darian Kendall was not the cause of Vanessa Foley's death and the supposed illegal exhibition of speed was nothing but a faulty gas pedal. The prosecution's case is a case based on purely circumstantial evidence. It is not a case based on facts but on 'he said, she said.' The evidence their witnesses provided was nothing but maybe's and possiblies. It is the burden of the prosecution to prove the defendant's guilt, which they have failed to do. Darian Kendall does not have to prove the fact that he is innocent. We ask you to render the only fair verdict, not guilty.

OPENING STATEMENT - Prosecution Hello ladies and gentlemen. My name is Dominic Gill. Today the prosecution and I are here to prove that the defendant, Darian Kendall is in fact guilty of vehicular manslaughter and illegal exhibition of speed. We are here to prove that Darian Kendall was not only interested in spectating these uprising drag races in the city of New Prague, but also participating in them. This is why he accepted the challenge to race against Vanessa Foley on the night of Friday, May 21st. These two were both in an auto-shop class together at a fouryear university. It is said that the two had been going back and forth about threatening to race each other. Eventually they did.

According to the prosecution witnesses, the race took place at the Main and Gardener intersection. Mr. Kendall was driving his Dimension 100 with no passengers. Vanessa and Mo Lancaster were in Vanessa’s Stallion X2 at the time of this race. While being halted at the intersection of Main Street and Gardner Avenue, the two exchanged words. The race started when the stop light turned green. Mr. Kendall accelerated his car very quickly as did Vanessa. They both were headed toward Brett Williams’ auto-service station at the end of Main Street. During the race Vanessa’s car hit a light post on the corner of the gas station. Her car was a wreck and was in flames. Mr. Kendall then hit the brakes and pulled over on the side of the road. Mo Lancaster was unable to get Vanessa out of the car.

Later on, she was pronounced dead. Because of Mr. Kendall’s eagerness to race, Vanessa Foley is no longer with us. We the prosecution hope that you will find this man guilty of his charges. Thank you.

OPENING STATEMENT - Defense Hello everyone and thank you for coming. My name is Dominic Gill. Today I’m representing this wonderful young man, Darian Kendall.

We are to prove that he is not in fact guilty of the charges against him. He attends an auto-shop class at a four-year university with Mo Lancaster and formerly Vanessa Foley. It is said by many that Darian is interested in not just spectating races, but participating in them as well. This is not true. Darian has stated to me personally, and in his testimony that he was only trying to rattle Vanessa. He really had no intention of actually racing. He had attended races before though, but only spectated. He was interested in seeing what all of the big talk was about. He knew that it was a bad idea for himself to attend the race in the first place. He had no interest in racing at all. After viewing the races, he wanted to annoy Vanessa even more. He put a “Road Hogz” sticker on his car in order to make her mad. For the next few weeks she had been badgering him to stop talking big and actually race. She challenged him to a drag race. Sooner than later the word had spread around the class, and everyone knew about it. Once again he had absolutely no interest. On the night of Friday, May 21st, he met with a friend of his, Robin Avery. They planned on going out for a bite to eat at the nearby “Heavy Burger”. He met her in the college parking lot. He was then surprised when he saw Vanessa and Mo pull up there too. He wasn't at all happy to see them.

He told Robin to drive in between him and Vanessa. They all started driving to the restaurant. At the intersection of Main Street and Gardner Avenue Vanessa and Mo pulled up beside Darian. Vanessa was in the wrong lane. She rolled down her window and started to talk trash at him. Darian claims he couldn't hear what she said. When the stoplight turned green, Darian’s car quickly accelerated in a forward motion. His accelerator was stuck. This had happened before. A few weeks earlier he had repairman, Brett Williams take a look at it. He was looking down at the gas pedal. He immediately sensed that something else was wrong. He tried to look back at where Vanessa was. He saw that her car had hit a light post. He immediately stopped his car, and pulled over on the side of the road. He noticed Mo outside of the car in shock, but did not see Vanessa. Later on after the authorities arrived, he learned that Vanessa was dead. We the defense hope that the jury finds this young man not guilty of vehicular manslaughter nor illegal exhibition of speed. It was nothing but a misunderstanding that took a fatal turn. OPENING STATEMENT - Prosecution Good afternoon, Your Honor and jurymen. My name is Emma Hamilton and I am the prosecutor of this case, State of Minnesota vs. Kendall. It is my pleasure to represent people of this state. On the night of Friday, May 21, around 7:40 pm, in New Prague, MN, Darían Kendall, age 20, participated in an illegal contest of speed, which resulted in the death of his high school and college acquantance, Vanessa Foley, age 19. However, it all started when Darian led a three car caravan, concocting of Robin Avery, Vanessa Foley, and Mo Lancaster. At the red light of the intersection of Gardner and Main, Vanessa abandoned her 3rd spot, drove on the wrong side of the road, and stopped next to Darian's sedan. When the light turned green, both cars began to accelerate, and Vanessa immediately lost control. She struck the light pole, and was pinned inside her car while flames arose from her engine. After the paramedics rescued Vanessa, they took her to the emergency room at St Ignatus Hospital and pronounced her dead from traumatic head injuries. Darian came to a stop 55 feet west of the intersection. At the conclusion of the case, we ask for verdict of guilty, and that there is no doubt, for Darian Kendall is guilty of vehicular manslaughter, the unlawful killing of a human being, and an illegal exhibition of speed. As the representstive of the people of this state, I have the burden of proving beyond a reasonable doubt that Kendall committed all of the elements of Gross Vehicular Manslaughter, and that he is guilty ordinary negligence, the failure to use reasonable care to prevent reasonably foreseeable harm to oneself or to someone else. We show you at all of the elements of this crime have been proven beyond a reasonable doubt, and that Kendall is guilty on Count 2.

Ladies and gentlemen of the jury, this case is about a careless man whom allowed his recilesa actions to cause the death of a dear acquaintence of his. The prosecution will call four witnesses to the stand. First, Officier Quinn Avila, who, prior to the crime, had warned Darian the dangers of drag racing at an illegal race. As per usual to the response of a drag racing kid who believe the know everything, Darian showed indifference to the guidance of Avila. On the night of Vanessa’s accident, he could tell from Darian’s body language that Darian really didn’t seem concerned with Vanessa. Avila thinks Darian was more concerned with what happened to Vanessa’s car than with Vanessa herself. Second, Mo Lancaster, who was in the passenger seat of Vanessa's car on the night of the accident, and claimed that Darian egged Vanessa on to race. Third, Parker Gallo, a college classmate of Darian, Vanessa, and Mo, who stayed out of these races to avoid risking his future. Instead, he saw the incident happen right in front of him, and claimed that Darian sped right as the light at the intersection turned green. Months prior to the race, he claimed to be surrounded by the arguments between Darian and Vanessa and the talk of the race. Finally, Lindsay White, who has a B.S. in mechanical engineering and is a licensed professional engineer in Minnesota. She claims, in her expert opinion, that Darian Kendall was traveling at a high velocity in relation to the distance the car traveled at the time Vanessa Foley’s vehicle collided with the light pole.

The defense may claim that it is Vanessa's own fault for her own death, and that she is responsible for her thoughtless actions, however, we will prove that Darian is indeed responsible for HIS own thoughtless actions; vehicular manslaughter and illegal exhibition of speed.

CLOSING STATEMENT - Prosecution Good afternoon ladies and gentlemen of the jury, again my name is Emma Hamilton, and I am the prosecutor in this case. In my opening statement, I mentioned that I would call 4 witnesses to testify as to the defendant’s guilt. Each witness testified as I explained and we have established the following facts beyond a reasonable doubt: 1) that on the evening of May 21, the defendant did take art in an illegal exhibition of speed, willingly 2) that the defendant committed gross vehicular manslaughter, as well as vehicular manslaughter- ordianry negligence.

We would ask you to reject the defense theories of the case. The defense claims that Kendall was not speeding, but, our witness, Parker Gallo, was at the scene of the accident as a spectator, and described it as Kendall was speeding the moment the light at the intersection of Gardner and Main turned green. What better proof is there than from someone who was actually there and saw the accident happen? The answer is none. The defense also claims that Vanessa, not Darian, was the one who instigated the idea of racing. That may be true, and it may not, but if it is, then why didn't Darian just tell Vanessa that he didn't want to race?Its that simple.

Was he too embarrassed? Too afraid to be careful? Too afraid to use his brain? In all, these issues do not amount to reasonable

All of our witness are credible because they were either physically present at the scene of the race, or experts, or enforcers of the law, and their facts and opinions were consistent, which wouldn't be true if they are all lying. Of course, Darian would have a motive to lie because he doesn't want to be held accountable for his careless actions, and Brett Williams and Robin Avery would lie for Darian because they are dear friends of his. It is an important principle that people in our society be held accountable for their actions. The defense arguments, such as Vanessa instigated the races, is just a baby excuse. That is something you hear in prep school: "So and so started it". And this is exactly how the defense is putting the blame on Vanessa and not Darians careless actions.

In conclusion, we would ask that you find the defendant guilty as charged. Thank you.

CLOSING STATEMENT - Defense Good afternoon, my name is Emma Hamilton, and again I am the defense lawyer in this case. In the case that the prosecutor has presented to you today there is insufficient proof to convict. We would ask for a verdict of not guilty, for this case is about a man who acted out of self defense, and did not commit the specific crime that the prosecution alleges.

To start off, the State's witnesses are not credible, for Officer Ovila wasn't even at the scene of the incident. He just based his decision of arresting Darian of what Mo said, he didn't even listen to Darian. In a world based of democratic ideals, why didn't Ovila give Darian the freedom of speech to explain himself. Mo Lancaster would have a motive to lie because he was a very close friend of Vanessa's, and was not a fan of Darian ever since he put a Road Hogz sticker on his car irritate Vanessa.

The defendant does not have to prove he is innocent, rather it is the burden of the prosecuting attorney to prove that the defendant is guilty. They have not met that burden. The defendant here has been falsely accused of manslaughter, a very serious crime. At the end of this trial we ask and expect a verdict of not guilty. OPENING STATEMENT - Prosecution Darian Kendall is guilty of Vehicular Manslaughter and Illegal Exhibition of Speed. He provoked Miss Foley by keeping a decal of the “Road Hogz” on his car. Miss Foley was very distracted by Mr. Kendall, as he was intimidating her and bothering her about the speed of her car, saying that his car was better than hers. Mr. Kendall very clearly sped, as many of the eyewitnesses saw and can prove. Mr. Kendall should not be allowed to walk free when so many people are suffering because of his irresponsible actions. The family and friends of Miss Foley will be forever affected by Mr. Kendall’s recklessness. To prevent Mr. Kendall from causing anymore accidents and causing more tragedies like this, we need to put him in jail and stop any further drag racing.

OPENING STATEMENT - Defense My client, Darian Kendall, is innocent. It is your job as the jury to keep an innocent man out of prison. The counts on the charge for Vehicular Manslaughter are the defendant drove or operated a vehicle, and while driving the vehicle the defendant either committed a misdemeanor or other infraction; the defendant's conduct caused death in another person, and the defendant acted with gross negligence.To find Mr. Kendall guilty for Illegal Exhibition of Speed, you must find that Mr. Kendall was driving a motor vehicle on a highway. It also must be proven that Mr. Kendall purposely engaged in excessive speeding. He would not have purposely engaged in that, for a few days before the incident, his accelerator broke. He called a family friend to get it fixed, but Mr. Kendall could not get around to it because he was just too busy. Miss Foley, the woman killed in the crash, was prone to being over-competitive and wanting to win at all costs. Miss. Foley had been previously provoking Mr. Kendall to race him. That behavior started when Miss Foley had taken Mr. Kendall for a ride in her car a week or so prior to the incident. Mr. Kendall was quite anxious about the high speed Miss Foley was travelling at, along with her reckless driving. Mr. Kendall had good reason to be shaken up by this, as Miss Foley’s behavior was absolutely terrifying. After this incident, however, Miss Foley continually terrorized Mr. Kendall, telling him he was too scared to go fast, and soonafter challenged him to a race. Mr. Kendall declined the offer, but got a decal of Miss Foley’s drag racing team, the “Road Hogz”, on his car. Mr. Kendall’s intentions were never to accept Miss Foley’s challenge and race her, but simply to pester her and get on her nerves. The arguments between Miss Foley and Mr. Kendall got more intense, as they started to insult each other’s vehicles.

Miss Foley called Mr. Kendall’s a “Bougie Bucket.” The bickering between the two slightly intensified as time went on, but after a while they stopped. On the night of the accident, Mr. Kendall went to a restaurant with some friends, and as he was leaving, ran into Miss Foley. Mr. Kendall, not wanting to associate with Miss Foley any further, started to drive away. It was at the stop light at the intersection of Main Street and Gardner that Miss Foley drove up next to Mr. Kendall, challenging him to the race. Miss Foley was behind Mr. Kendall, but drove up next to him, putting herself into the wrong lane. In the car with Miss Foley was Mo Lancaster, a friend of Miss Foley. When the light turned green, Miss Foley sped away. Eyewitnesses say that Mr. Kendall sped as well, but there is solid evidence against that. Mr. Kendall’s accelerator was broken, and the shock of Miss Foley caused him to evert his attention to her, not how careful he needed to be with his accelerator. When Miss Foley crashed, Mr. Kendall took a second longer to react, as his attention was focused on Miss Foley and Mo Lancaster. This was another factor as to why Mr. Kendall appeared to be speeding. At the scene of the accident, Mr. Kendall was shocked at what had happened, causing him to act differently. Please listen to our evidence, and prevent this innocent man from going to jail.

OPENING STATEMENT - Prosecution Your honor, my name is Beckey Jiang, the prosecutor representing the State of Minnesota in this action; The evidence will show that Darian Kendall is guilty of Illegal Exhibition of Speed, misdemeanor violation of the Minnesota Criminal Code, Section 23109. Vanessa Foley, age 19, and Mo Lancaster, age 18, appeared at a City Council meeting in January to Oppose the Racing Ordinance: a misdemeanor for drivers to knowingly congregate with members of an illegal racing club on New Prague’s streets. In October 2015, both were arrested in New Prague in violation of Minnesota Criminal Code, Section 23109, which prohibits illegal contests or exhibitions of speed. Darian Kendall, age 20, is a second-year student at the college and an acquaintance of Vanessa’s from high school. On the night of Friday, May 21, at 7:40 p.m., Darian, Vanessa, and Mo assembled in a parking lot at the college for the usual caravan across town. Darian was racing Vanessa and Mo, when Vanessa crossed an intersection and struck a light pole. Mo escaped, but Vanessa was trapped inside, while flames arose. The facts will show that Kendall is justified to be convicted of Illegal Exhibition of Speed and misdemeanor violation of the Minnesota Criminal Code, Section 23109.

OPENING STATEMENT - Defense Your honor, my name is Deepta Jasthi, counsel for Darian Kendall in this action; The evidence will show that Darian Kendall is not guilty of Illegal Exhibition of Speed, misdemeanor violation of the Minnesota Criminal Code, Section 23109. In September of 2015, Vanessa Foley enrolled at community college and became friends with Mo Lancaster. Mo was known to be a drag racer, and Vanessa became interested, too. In October 2015, Vanessa and Mo were arrested in New Prague and convicted for violation of Minnesota Criminal Code Section 23109, which prohibits illegal contests or exhibitions of speed. Darian Kendall, age 20, is a second-year student at the college and an acquaintance of Vanessa’s from high school. CLOSING STATEMENT - Prosecution Based on the evidence, Darian Kendall is justified for being convicted of Illegal Exhibition of Speed and misdemeanor violation of the Minnesota Criminal Code, Section 23109. The witness statements have concluded that Darian Kendall took part in illegally abetting and aiding in an illegal contest of speed. Based on this testimony, there can be no doubt that Kendall should be rightfully charged with Vehicular Manslaughter Minnesota Criminal Code, Section 192(c) and Illegal exhibition of Speed, misdemeanor violation Minnesota Criminal Code, Section 23109.

CLOSING STATEMENT - Defense The evidence has clearly shown that Darien Kendall is not guilty of Illegal Exhibition of Speed, misdemeanor violation of the Minnesota Criminal Code, Section 23109. Darien Kendall never intended to race against Vanessa and did not accelerate when the light turned green. False assumptions were made, by Mo Lancaster and Parker Gallo in assuming he was into drag racing based on his actions.

Darien Kendall called Brett Williams to ask about his broken gas pedal, which was the only reason his car lurched forward. This action made it seem like his car was accelerating, when in fact, no illegal exhibition of speed occurred. Parker was more focused on Vanessa than Darien and assumed he was speeding, partly influenced by his friendship with Mo. Darien’s reaction time was slow because he was focused on the issues with his gas pedal. Darien has never been arrested for illegal activity, while Vanessa was very competitive and created a competition out of nothing. Darien clearly never had intentions to be part of a drag race and did not speed. Darien Kendall is innocent of all charges and should be released.

OPENING STATEMENT - Prosecution Today I'm going to prove that Darian Kendall was responsible for the death of Vanessa Foley. He was operating a vehicle in an unlawful mannor, conducted himself in a way that a reasonable person would know better han to do, and completely disregarded dangers that he was aware of. Today you will see that Darian's actions are more than enough for him to be found guilty of vehicular manslaughter and illegal exhibition of speed.

OPENING STATEMENT - Defense Today I will show you that Darian Kendall was not responsible for the death of Vanessa Foley. While Vanessa's death is tragic, Darian Kendall is innocent. He was not responsible for her actions that ultimately caused the accident. Vanessa had participated in races of this nature before and had never caused accident or injury; how was Darien Kendall expected to think that it would be different of the night of May 21st? In addition, I will show that Vanessa was anxious to show Darian how fast her car could go and may have acted the same without Darian's participation in the race.

2. The record shows that on April 23rd, you talked to Darian and others about the dangers of drag racing. Would you say that Darian understood, yet ignored the dagers of drag racing? Did you mention death as a possible danger?

3. Did you (Darian) know that Vanessa wanted to race? Did you (Dairan) ever do anything to discourage racing?

4. Would you say that Darian's excelleration was dangerous or unsafe?

3. The record shows that Darian's vehicle was found 55 feet west of the intersection. If Darian was accelerating at a "dangerous speed", would he have been able to stop within 135 feet?

4. Did Vanessa make fun of Darian's car, saying that she couldn't wait to show how fast her car can go? Was this her opportunity to show him or have they raced other times?

5. It is agreed upon that Vanessa's car was fully examined and that the accident was caused by driver error. Can we really blame Darian when we've agreed that the driver made an error? Vanessa was the driver.

CLOSING STATEMENT - Prosecution Today you've listened to witnesses and seen evidence that Darian Kendal is responsible for the death of Vanessa Foley Darian and Vanessa were both driving on Main Street on the evening of the accident. Darian willfully engaged in an exhibition of speed when he accelerated at the stop light. He knew that this was dangerous and illegal as any reasonable person would, afterall he himself had been lectured about the dangers of drag racing by law officials. Without his participation in the events of the evening, Vanessa would still be alive today.

CLOSING STATEMENT - Defense In conclusion, Darian Kendall is not the cause of Vanessa's tragic death. As you have seen and heard, Darian had no reason to believe that the race on May 21st would end any different than the many races in which Vanessa had participated in the past. In addition, Darian's car had no physical contact with Vanessa's car and therefore could not have been the cause of the accident. Furthermore, Kendall was not accelerating at the same rate as Vanessa, his rate of acceleration may not even be considered dangerous. For these reasons, it is obvious that Darian Kendall is not guilty.
