Please read them carefully as they set our respective rights and obligations In these Booking Conditions references ”you” and “your” include the first named person on the booking and all persons on whose behalf a booking is made or any other person whom a booking is added or transferred By making a booking you agree that;
a. You have read and understood these terms and conditions and have the authority to agree and be bound by them;
b. You are over 18 years of age and when placing an order for services with age restrictions you declare that you and all members of the party are of the appropriate age to purchase those services;
c. You consent to our use of information in accordance with our Privacy Policy (middletonstours co uk/Privacy-Policy) and you are authorised on behalf of all participants in your party to disclose their personal details to us, including, where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements);
d. You accept financial responsibility for the payment of the booking on behalf of all persons detailed on the booking
1 Booking and paying for your day excursions
A booking is made with us when you pay us for your day excursion and we issue you with a booking confirmation We reserve the right to return your payment and decline to issue a confirmation at our absolute discretion A binding contract will come into existence between you and us as soon as we have issued you with a booking confirmation
Booking on behalf of others: By booking on behalf of other participants, you are deemed to be the designated contact person for every participant included on the booking This means that you are responsible notifying us if any changes or cancellations are required and keeping your party informed By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and we will under no circumstances be liable for any errors or omissions in the information provided to complete a booking
2 Accuracy
We endeavour to ensure that all the information and prices both on our website and in any advertising material that we publish are accurate However, occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances You must check the current price and all other details relating to the arrangements that you wish to book before your booking is confirmed On very rare occasions, unfortunately we may make a genuine mistake in the price we quote and subsequently confirm to you for your day excursion This may come to light at any time prior to your day excursion We are not obliged to honour the original price if a mistake has been made when pricing We will ask you to meet
any additional charges, if you wish to go ahead with the arrangements However, should you not wish to meet these additional charges, you may cancel your holiday with a full refund
3 Cutting your day excursion short
If you are forced to return home early, we cannot refund the cost of any travel arrangements you have not used If you cut short your day excursion and return home early in circumstance where you have no reasonable cause for complaint about the standard of services provided, we will not offer you any refund for that part of your day excursion not completed, or be liable for any associated costs you may incur
4 Changes by you before departure
If you wish to change any part of your booked arrangements after our confirmation invoice has been issued, you must inform us a soon as possible Whilst we will do our best to assist, we cannot guarantee that we will be able to meet your requested change Where we are unable to assist you and you do not wish to proceed with the original booking, we will treat this as a cancellation by you A cancellation fee may be payable If you are prevented from travelling it may be possible to transfer your booking to another suitable person An administration fee may be charged If you are unable to find a replacement, cancellations as set out herein will apply in order to cover our estimated costs
5 If you cancel before departure
If you decide to cancel your confirmed booking, you must notify us as soon as possible To notify us please send an email to info@middletonstours co uk or call us on 01827 849700 Your notice of cancellation will only take effect from the date on which we receive it If the call to notify us of cancellation is from anyone other than the lead name then the lead name must confirm the cancellation Cancellation charges will be levied as follows from when we receive confirmation:
If you need to cancel your booking within 24 hours of departure please call our Emergency Line detailed on our voicemail

6 If we change or cancel
As we plan your day excursion arrangements many months in advance, we may occasionally have to make changes or cancel your booking and we reserve the right to do so at any time
Changes: If we make an insignificant change to your holiday, we will make reasonable efforts to inform you
7 Unavoidable and extraordinary circumstances
We cannot accept liability or pay any compensation where the performance of our obligations is prevented or affected, as a result of unavoidable and extraordinary circumstances This means a situation which is beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken
Such situations are include (whether actual or threatened) war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, epidemics, pandemics, fire, closure, restriction or congestion of ports, and Commonwealth and Development office advise and all other events outside our control

Special Requests
Any special request must be advised to us at the time of booking Whilst every effort will be made by us to try and arrange your reasonable special request, we cannot guarantee that they will be fulfilled The fact that a special request has been noted on your confirmation invoice or any other documentation or that it has been passed onto the supplier is not confirmation that the request will be met
Any special requests or requirements do not form part of these Terms or the contract between us and we are not liable for any failure to accommodate or fulfil such requests
9 Seating
Arrangements
Seats will be allocated at the time of booking and confirmed on your confirmation/invoice
10 Health & Safety
In some foreign countries, standards of infrastructure, safety and hygiene may be lower than those to which we are accustomed in the UK You should therefore exercise greater care for your own protection There may be countries that we visit that have special medical requirements for tourists These regulations are subject to change and our clients are responsible for complying with entry and current health requirements If you are not sure of the health requirements for the country you are visiting, you are advised to check with your own GP before travelling

Smoking/E-Cigarettes
It is a condition of travel that you are aware of the on board No Smoking Policy On longer journeys, frequent comfort stops are made en route

On-Board Refreshments
On selected departures, there will be on board refreshments available The consumption of alcohol is not permitted aboard the coach unless served by a member of our onboard team

Seat Belts
It is a legal requirement that all passengers wear a seat belt when the coach is in motion Refusal to wear a seat belt will result in the customer not being covered by the company’s insurance

Unreasonable Behaviour
Should our Driver/Tour Manager have the opinion that your behaviour is likely to cause the discomfort or endanger to safety of other customers they have the right to refuse admission/re-admission to the hotel or coach Please note we will not be responsible for any expenses incurred that result in you obtaining alternative transport or accommodation
15 Loss of Personal Belongings
Middletons Tours Ltd are not responsible for loss or damage to luggage or personal belongings carried on the vehicle It is the responsibility of all passengers to ensure they have the necessary insurance to cover for personal loss It is your responsibly to oversee your own luggage placed into the vehicle’s luggage lockers at the beginning and end of a tour In the event luggage is not stored, we will assist with the return of the property, but the cost of carriage will be at the customers expense
16 Punctuality
Please check your final documentation in detail for pick-up point and time We advise customers to be at the pick up point 10 minutes prior to the departure time We cannot be held responsible for any loss or expense incurred by clients arriving late at any departure point
17 Complaints
We make every effort to ensure that your arrangements run smoothly but if you do have a problem during your holiday, please inform our Tour Manager or the relevant supplier immediately who will endeavour to put things right If the problem cannot be resolved and you wish to complain further, you must send formal written notice of your complaint to us at Middletons Tours, Lovell, Tamworth, B79 7TA within 28 days of the end of your stay, giving your booking reference and all other relevant information Please keep your letter concise and to the point This will assist us to quickly identify your concerns and speed up our response to you
18 Theatre Tickets
Should a customer purchase any tickets to coincide with a tour, and that tour is cancelled, we cannot be held responsible for any monies lost Theatre tickets purchased through our office will be confirmed in writing and issued on the day of travel by our Driver/Tour Manager and not sent through the post

Financial Security
In accordance with the EC Directive 90/314/EC all passengers day excursions with Middletons Tours Ltd are fully protected
20 Prompt assistance
If, whilst you are on your day out with us, you find yourself in difficulty for any reason, we will offer you such prompt assistance as is appropriate in the circumstances In particular we will provide you with appropriate information on health services, local authorities and assistance with distance communications and finding alternative travel arrangements Where you require assistance which is not owing to any failure by use, our employees or sub-contractors, we will not be liable for the costs of any alternative travel arrangements
21 Marketing and images
You acknowledge and agree that, while participating in any tour, images, photos or videos may be taken by other participants, us or our representative that may contain or feature you (the “visual content”) You consent to any such pictures being taken and grant a perpetual royalty-free worldwide, irrevocable license to us, our contractors, subcontractors and assigns, to reproduce the visual content for any purpose whatsoever (including market, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you
22 Amendments
We reserve the right to update or alter these Booking Conditions at any time, and will post up to date Booking Conditions on our website at middletonstours co uk/booking-conditions The Booking Conditions that were in place on the date your booking was confirmed will apply to your holiday We recommend that you refer to the Booking Conditions applicable to your booking prior to travel to familiarise yourself
23 Privacy Policy
We must collect your personal information to deliver your booked arrangements and any products or services booked We collect, use and disclose only that information reasonably required to enable us and our third party suppliers to provide your booked arrangements, products and/or services that you have requested as described in our Privacy Policy, which can be

accessed any time at middletonstours co uk/privacy -policy and is expressly incorporated into these Booking Terms and Conditions By submitting any personal information to us, you indicate your acceptance of our Privacy Policy
24 Food Allergies
If you have any food allergies which may cause significant health issues, you must report this at the time of booking or as soon as convenient It is your responsibility that you actively avoid any food you are allergic to and make all appropriate enquiries to establish the ingredients of any food The supplier is not under any obligation to prepare or provide special meals
