Foreword

History has always been an important part of my life. From attending family reunions to visiting Civil War battlefields and museums with my father. Maybe, it is the idea that if we learn about the past, then it may give us a better idea how to proceed in the future. Or, maybe it’s not that complicated. I may just really like the process of finding out about old stuff, looking at old pictures and talking to people that tell their stories. Even today, when I get several friends or colleagues together, the conversation will most always move to someone saying, “ I remember one time when …”. It is often said that “ a picture speaks a thousand words”. I have collected these pictures over the years. Also, there is some information that I have found out about sheriffs and deputies that I hope you will find interesting.

History of the Rockingham County Jail The first Rockingham County Jail was built in 1778. Its location was at the Daniel Smith plantation at the site of the first county court. Smithland plantation is located two miles north of Harrisonburg on US 11. Ordered by the court on April 28 th 1778, Daniel Smith and Josiah Davison were “empowered to contract with some person for the building of a square log jail or prison 12 feet square, laid with square logs above and below, 8 inches thick at the least, with one window and a door made of iron bars so as to suit the public jail when built, with a good lock and a cabin roof over the upper floor, to be fixed on the most convenient spot of the said Daniel Smith plantation, and in the meantime that Sheriff Silas Hart be empowered to hire a guard to watch such prisoners as are taken into custody (signed Daniel Smith)”. Later on September 28th 1778, the court ordered that George Boswell and John Thomas be appointed to examine and receive the jail at Smithland agreeable to a former order of the court. The two men reported that they had viewed the jail and found it agreeable to the order, except for the iron door and window, which could not be procured (signed Silas Hart). The first jail was abandoned when the second jail was erected. The logs from the first jail were used in the building of a toll house on the Valley Pike at Smithland. The toll house was later destroyed in a fire in about 1890. Records from the time period show that Daniel Smith accounted for the building of the jail at £.S.P. 48.18.0. Accounting for jailors, as guards, for a criminal was 4 (s) per day each at £.S.P. 10.0.0. The second Rockingham County Jail was to be commissioned by the same men appointed to “let” the building of the first courthouse. They were also required to “let” the building of a prison and it called for a contract for a stock and dunking stool. The jail was to be built with hewn logs 12 inches square, 18 feet square” in the clear and walled up with stone”. The stone walls were to be 2 feet thick at the lower part and 18 inches thick at the upper part. The jail was to be located on the square, near the first courthouse. Records from November 28, 1780 show that Silas Hart, John Davis, Henry Ewin, and William Herring were the commissioners appointed to “let” the building of the county jail. The commissioners chose Cornelius Cain to build the jail for 11,973 pds and retention. Cain was required to post a security bond for the amount for due performance. Records from November 27, 1781 show that Sheriff George Boswell was to pay Cornelius Cain the money levied for the building of the jail. The commissioners reported that the jail was finished according to the plan. Later, records from October 28, 1783 showed that Henry Ewin, William Herring, Benjamin Harrison reported to the court that they had viewed the work done by James Henton on the “jail, pillory and stocks” and had found it according to contract. The Sheriff paid Henton £ 33 15s for his work. Henton was also allowed 20s for a stock lock and the lock was to be placed on the inside iron door of the jail. Samuel Gay was mentioned in the record as a jailor in 1791.

History of the Rockingham County Jail - Cont. The third Rockingham County Jail was made of stone and was located on the north side of West Market Street, just beyond the railroad tracks going from the courthouse. The site was purchased by the citizens of Harrisonburg and deeded to the county. The use of the building as a prison or jail was abandoned some years before the Civil War, but it was used as a military prison or guard house during the war. After the war, it was sold to Mr. William Reherd, who for several years rented it out as a tenement house. The site is now a parking for employees of the current county jail. Records from March 22, 1850 states from an act of Assembly authorizing the Rockingham Court to buy a lot and build a new jail and sell the old one. On June 24, 1859, the court orders that the cost of the new jail should not exceed $800 and that part of the money should come from the sale of the old jail. The fourth Rockingham County Jail was built of brick and located on the corner of German (Liberty) Street and Graham Street. The fourth jail was built a few years before the war. Little else is known about this jail. The fifth Rockingham County Jail was built during 1894 and 1895. The jail was designed as a jail and a residence for the current sheriff. The house fronted on Graham Street and the jail was attached to the rear of the house. The house and jail was made of red brick with reinforced iron. The house was a three story residence that provided living quarters for the sheriff and his family. The jail was originally built as a three story structure with an entrance to the jail on the east side of the building between the house and jail. The jail was remodeled between 1933 and 1934 to add a fourth floor to the jail. A fifty cell addition was built in 1967. The sixth and current Rockingham County Jail was built between 1993 and 1994. The jail is located one block west of the courthouse, between West Market Street and Water Street on Liberty Street. The jail sets east of the railroad tracks.

In the Line of Duty John Edward Rafter 1955 - 1983 John Edward Rafter will be remembered as the All-American boy by his superiors, fellow workers, countless friends, and acquaintances. In his six years with the Rockingham County Sheriff’s Office, he was an exemplary deputy who would do anything that needed to be done, even if it took extra time to do it. The Turner Ashby High School graduate was an outstanding athlete, who particularly loved basketball and who always volunteered to be the officer on duty at local high school basketball and football games. Deputy Rafter was well known and held in high esteem throughout the area. Although the taking of his life was untimely and a senseless act, all who knew him have the assurance that he lived each day to the fullest extent. His absence is felt in many ways throughout the community and especially at the Rockingham County Sheriff’s Office, but his loving spirit and compassion for his fellow man will always remain with each of us. He was an exuberant young man who always exhibited professionalism and courteousness when carrying out his police duties. He had a friendly greeting and radiant smile for everyone he came into contact with. Deputy Rafter lost his life while extending a compassionate gesture to two women in need of help. This action was typical of his nature. Deputy Rafter, 28, was returning a prisoner to the Augusta County Jail in Staunton, Virginia, Monday, February 7, 1983, from a court appearance in Rockingham County, when he was shot and killed with his .357 Magnum revolver shortly after 3:00 p.m. Deputy Rafter had stopped on the ramp from I-81 south of U.S. 250 east of Staunton to ask two women who were walking if they needed help. While Deputy Rafter spoke to the women, his prisoner, armed robbery suspect David Allen Richardson, 26, who was riding handcuffed in the marked cruiser’s front seat, kicked the deputy and pinned him against the door with both feet. In the struggle, Richardson was able to get the gun from the deputy’s holster and fatally shoot him in the chest. Richardson was apprehended minutes later by the state police, and is currently serving a life sentence on capital murder charges. Deputy John Rafter chose a profession of public service. He died extending this service to someone in need. Sgt. Lois Driver (Ret.), Rockingham County Sheriff’s Office Deputy Rafter was posthumously awarded the Medal of Honor from the American Police Hall of Fame, a Certificate of Appreciation from the Veterans of Foreign Wars, and Senate Joint Resolution No. 79 from the Virginia General Assembly.

Law Enforcement Accreditation The Rockingham County Sheriff's Office became an accredited agency on May 26, 2005. The announcement was made by the Virginia Law Enforcement Professional Standards Commission (VLEPSC). Once every four years, accredited agencies must go through a re-assessment to make sure that agencies are following the standards set forth by the commission. Investigator Kim Garber worked for approximately two years as Accreditation Manager to get the sheriff's office ready for an accreditation assessment. The Rockingham County Sheriff’s Office is one of approximately 85 agencies in the state that have achieved this status. There are over 400 law enforcement agencies in Virginia. On June 18th, 2009, the VLEPSC Executive Board granted re-accreditation status to the Rockingham County Sheriff's Office. On August 26, 2013, the VLEPSC Executive Board granted re-accreditation status to the Rockingham County Sheriff's Office.
