Local Emergency Order:
Suspending local procurement and contracting laws, rules and regulations
I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with (3) Proclamation of a State of Emergency last issued on June 28, 2024, July 26, 2024, August 23, 2024, September 20, 2024, October 18, 2024 November 15, 2024 and December 13, 2024 pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:
Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:
Suffolk County Code:
• Chapters 1065 and 189
Article IV sections A 4-13 and 14
• Article V sections A5-1 Charter section C5-2 (C) and (L)
• Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance all related procurement laws, rules, and regulations required to comply with this Order; and further
Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the conditions caused by this storm; and further
Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

Local Emergency Order:
Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers
I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 5, 2024, February 4, 2024, March 5, 2024, April 4, 2024, May 3, 2024, May 31, 2024, June 28, 2024, July 26, 2024, August 23, 2024, September 20, 2024, October 18, 2024, November 15, 2024 and December 13, 2024 do hereby find and order as follows:
Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and
Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and
Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:
A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.
B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.
C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.
D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;
Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.
E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.
F. Remedies Not Exclusive.
a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.
b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.
c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.
d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.
G. Effective Date
This Executive Order shall take effect immediately.

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 5, 2024, February 4, 2024, March 5, 2024, April 4, 2024, May 3, 2024, May 31, 2024, June 28, 2024, July 26, 2024, August 23, 2024, September 20, 2024, October 18, 2024, November 15, 2024 and December 13, 2024 do hereby find and order as follows:
Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and
Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and
Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.
E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.
F. Remedies Not Exclusive.
a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

Romaine, the Chief Executive of Suffolk County, in accordance with (3) Proclamation of a State of Emergency last issued on June 28, 2024, July 26, 2024, August 23, 2024, September 20, 2024, October 18, 2024 November 15, 2024 and December 13, 2024 pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:
Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

Romaine, the Chief Executive of Suffolk County, in accordance with Proclamations of a State of Emergency issued on August 19, 2024 (Proclamation 2024-33), September 20, 2024, October 18, 2024, November 15, 2024 and December 13, 2024 for a storm occurring on or about August 19, 2024, and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:
Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors as a result of a storm that caused severe damage and dangerous conditions, including torrential rain, strong winds, flash flooding, sinkholes, road buckling and closures, erosion, dam failure, downed trees and power lines, severe property, vehicle and equipment damage, collapse of residences and evacuation of impacted residents, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

Charter section C5-2 (C)
• Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance all related procurement laws, rules, and regulations required to comply with this Order; and further
Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the conditions caused by this storm; and further
Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

Specifically, the proposed law exempts such grant recipients from the requirements of: Section A5-8 of the Suffolk County Administrative Code regarding the filing of disclosure statements; Article II of Chapter 353 of the Suffolk County Code regarding the filing of affidavits of compliance with Section 1324a of Title 8 of the United States Code; Chapter 575 of the Suffolk County Code regarding certification of compliance with Suffolk County’s living wage, and; Article I of Chapter 803 regarding the filing of a certification that the organization will not use County funds to assist, promote, or deter union organizing. The proposed law states that the exemption will be in effect until December 31, 2025.

Covenants and Restrictions - Density & Density Increase Provisions: 1. No more than 280 residential units shall be permitted. 2. No more than 49,400 square feet of commercial gross floor area shall be permitted. Rooftop patios and outdoor seating areas shall not be included in this restriction. 3. The maximum permitted nonresidential, single-tenant building size shall be less than 40,000 square feet gross floor area. 4. Connection to an existing sewage treatment plant is required in order to achieve the density increase provided for in Town Code Section 85-752.B.(2). 5. The project shall utilize high-quality, fire-resistant structural materials, including but not limited to steel, concrete and masonry, in order to achieve the density increase provided for in Town Code Section 85-752.B.(4). 6. The project shall utilize substantial amounts of green energy technologies, to the satisfaction of the Planning Board at the time of site plan review and approval, in order to achieve the density increase provided for in Town Code Section 85-752.B .(5). Any green energy technologies or infrastructure designed to satisfy the drainage requirements shall not be used to satisfy the density incentive. 7. The project shall stay within the existing development envelope and shall not substantially remove existing natural vegetation or remove landmark trees, to the satisfaction of the Planning Board at the time of site plan review and approval, in order to achieve the density increase provided for in Town Code Section 85-752.B.(6). 8. A minimum of 20% of the total housing units shall be designed and constructed for those who have special needs, in order to achieve the density increase provided for in Town Code Section 85-752.B.(7). Minimum special needs design requirements are: a. Housing/units specifically designed to meet universal design guidelines or housing/units specifically designed for the visual, auditory, or other special need; and b. The applicant/owner shall enter a partnership or contract with a special need advocacy housing group to design and administer the housing units. Affordable Housing: 9.a. For Affordable and
Workforce Homeownership Units: A minimum of ten (10) percent of the total number of dwelling units shall be maintained in perpetuity as Affordable and/or Workforce units. Each of the “affordable” units shall sell for an amount at or below 80% of the median income for the Nassau-Suffolk primary metropolitan statistical areas as defined by the Federal Department of Housing and Urban Development (HUD) at the time of execution of the contract of sale. Each of the “workforce” units shall sell for an amount at or below 120% of the median income for the Nassau-Suffolk primary metropolitan statistical areas as defined by the Federal Department of Housing and Urban Development at the time of execution of the contract of sale. A minimum of half of all such units shall be designated “affordable” in perpetuity. Applicant/Owners shall enter into a contract with a local not-forprofit housing advocacy group to administer the affordability of the housing units; however, the foregoing provision shall be subject and subordinate to any and all mortgages on such workforce/affordable unit held by a commercial bank, savings and loan association, credit union, savings bank, national bank, licensed funding company, or its successors and assigns, and shall be extinguished by a sale of foreclosure by any of said lenders, or a deed given to such lender in lieu of foreclosure. 9.b. For Affordable and Workforce Rental Housing Units: A minimum of ten (10) percent of the total number of dwelling units shall be maintained in perpetuity as Affordable and/or Workforce units. Each “affordable” unit shall have a monthly rental price no greater than 30% of 50% of the median income for the NassauSuffolk primary metropolitan statistical areas as defined by the Federal Department of Housing and Urban Development (HUD) in effect at the time of execution of the lease agreement, based on the expected occupancy of the unit, provided all utilities are included in the rental price. If all utilities are not included, the monthly rental price shall be no greater than 30% of 65% of the Federal Department of Housing and Urban Development (HUD) area median income for Nassau-Suffolk Counties based on expected occupancy of the unit reduced by the monthly utility allowance in effect at the time the lease agreement is executed. Units for persons with special needs may also qualify as “affordable” or “workforce” units so long as they also meet the “affordable” or “workforce” criteria. Nothing herein shall supersede any state or federally sponsored rental subsidy guidelines. Site Design and Development: 10. The three tax lots that make up the subject property (identified as Suffolk County Tax Map Numbers 0200-160.00-06.00-005.001, 005.002 and 019.000) shall be considered joined in common development. 11. Provide a minimum 25-foot westerly side yard setback and substantially vegetated buffer to be maintained in perpetuity, adjacent to the residentially zoned properties, excluding the Town owned parcel known as Suffolk County Tax Map Number 0200-160.00-07.00-010.001, to the satisfaction of the Planning Board at the time of site plan review and approval. Maximum building height shall be limited to thirty-nine (39) feet for all buildings constructed along the westerly side yard setback lines. No construction or other activities shall occur upon said Town owned parcel. 12. Provide a minimum two (2) foot easterly front yard setback for all building frontages adjacent to New York State Route 112, to the satisfaction of the Planning Board at the time of site plan review and approval. Maximum building height shall be limited to three stories, including ground floor, at grade parking within a building for all building frontages constructed along the easterly front yard setback line. 13. Provide street trees along all internal roadways and public road frontages, to the satisfaction of the Planning Board and Fire Marshal at the time of site plan review and approval. 14. Provide substantial evergreen landscape screening, to be maintained in perpetuity, bordering the residentially zoned properties to the west, excluding the Town owned parcel known as Suffolk County Tax Map Number 0200-160.00-07.00-010.001, to the satisfaction of the Planning Board at the time of site plan review and approval. 15. Minimum civic area of two (2) square feet per residential unit and minimum outdoor recreation area equal to the number of residential units multiplied by 200 square feet shall be provided, to the satisfaction of the Planning Board at the time of site plan review and approval. Outdoor recreation areas shall not count as civic space. 16. Provisions for secure interior bicycle storage space for the residential units shall be provided. Provisions for nonresidential bicycle lockers for employees and bicycle racks for visitors shall be provided. Provide pedestrian and/or bicycle paths connecting the site with abutting areas to promote pedestrian and bicycle circulation and safety; bike paths shall be provided along the main roadways that connect the development to other streets/to the community, to the satisfaction of the Planning Board at the time of site plan review and approval. 17. Residential trash collection shall be housed within the apartment
buildings. No dumpsters or trash collection servicing the residential component of the development shall be provided adjacent to the residentially developed properties to the west. 18. Drainage and grading shall be provided to the satisfaction of the Planning Board at the time of site plan review and approval. Time Limitations: 19. Pursuant to Town Code Section 85-753, the following Time Limitations shall apply: A. All change of zone applications that are not effective within one year of the date of the change of zone grant and for every additional six months thereafter, shall forfeit one unit per acre of residential development and 500 square feet per acre of nonresidential development. B. The applicant/owner shall obtain site plan approval from the Planning Board within two years of the effective date of the change of zone.
(1) The applicant/owner shall forfeit one unit per acre of residential development and 500 square feet per acre of nonresidential development if conditional site plan approval from the Planning Board is not obtained within two years of the effective date of the change of zone. (2) For every additional six (6) months after two (2) years of the effective date of the change of zone, if conditional site plan approval from the Planning Board has not been obtained, the applicant/owner shall forfeit an additional one unit per acre of residential development and 500 square feet per acre of nonresidential development. C. The applicant/owner shall obtain a building permit and start substantial construction within three years of the effective date of the change of zone. (1) The applicant/owner shall forfeit one unit per acre of residential development and 500 square feet per acre of nonresidential development if a building permit and start of substantial construction has not commenced within three years of the effective date of the change of zone.
(2) For every additional six (6) months after three (3) years of the effective date of the change of zone, if a building permit has not been obtained and start of substantial construction has not commenced, the applicant/owner shall forfeit an additional one unit per acre of residential development and 500 square feet per acre of nonresidential development. D. The Town Board may grant a six-month extension of time for making the zoning effective, obtaining site plan approval, or obtaining a building permit and starting substantial construction, upon written request from the applicant/owner, subject to the following requirements: (1) The written request must state the reasons for the extension and delay and must document that the applicant is diligently trying to obtain all required governmental permits and approvals.
(2) The extension request shall be accompanied by a fee equal to 1/2 of the change of zone, site plan or building permit application fee that is the subject of the extension request. (3) The extension request is made 30 days prior to the expiration of the time limits herein, and the maximum extension request is limited to six months. Failure to submit all required documentation and fees prior to expiration of the time limits shall result in automatic density forfeiture as regulated herein. (4) The Town Board has the discretion to deny, approve, conditionally approve, or limit the length of any extension requested by the applicant. Additional public amenities or recreation facilities/fees may be included in any conditional approval. 20. The applicant/owner shall engage in community outreach regarding architecture and exterior building materials for the building facades. Nothing herein shall be construed to abrogate or delegate the authority of the Planning Board regarding same. 21. At the time of site plan, the site plan shall provide an area for a future shuttle bus stop, including area(s) for electric shuttle bus charging. Nothing herein shall be construed to require the applicant/owner to operate a shuttle service for its residents. 22. In accordance with Town Code Section 85-751(F)(6), the applicant/owner shall submit payment, prior to final site plan sign-off, in the amount of $125,000.00 for off-site recreational facilities within the community located upon parcels proposed to be acquired by Suffolk County and the Town of Brookhaven, more formerly known as Suffolk County Tax Map numbers 0200-161.00-01.00-022.000, 043.003, 045.000 and 057.000. In the event the aforementioned parcels are not acquired, said payment shall be used for the community in which the project is located. Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 5, 2024, February 4, 2024, March 5, 2024, April 4, 2024, May 3, 2024, May 31, 2024, June 28, 2024, July 26, 2024, August 23, 2024, September 20, 2024, October 18, 2024, November 15, 2024 and December 13, 2024 do hereby find and order as follows:
Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and
Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and
Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:
A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.
B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.
C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.
D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;
Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.
E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.
F. Remedies Not Exclusive.
a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.
b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.
c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.
d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.
G. Effective Date
This Executive Order shall take effect immediately.
And I further order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary; and further order that
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24(5).
