The proposed law revises the terms and conditions set forth in Chapter 319 limiting the sale, lease, and rental of lithium-ion batteries and electric powered mobility devices, electric bicycles, and scooters (collectively, “battery powered devices”). The proposed law removes definitions for electric personal assistive mobility devices and electric scooter from Chapter 319 and adds definitions for accredited testing laboratory, micromobility device, and limited use motorcycle. The proposed law also revises the definition of lithium-ion battery and second-use lithium-ion battery to conform with New York State law. Further, the proposed law expands restrictions on lithium-ion batteries to prohibit any person, firm, partnership, association, or corporation from manufacturing, distributing, assembling, reconditioning, selling, leasing, renting, or offering for sale any lithium-ion battery or second-use lithium-ion battery unless it has been certified by an accredited testing laboratory and bears such certification on the product or packaging.
