Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 5, 2024, February 4, 2024, March 5, 2024, April 4, 2024, May 3, 2024, May 31, 2024, June 28, 2024, July 26, 2024, August 23, 2024, September 20, 2024, October 18, 2024 and November 15, 2024 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.

G. Effective Date

This Executive Order shall take effect immediately.

And I further order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary; and further order that

This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24(5).

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 5, 2024, February 4, 2024, March 5, 2024, April 4, 2024, May 3, 2024, May 31, 2024, June 28, 2024, July 26, 2024, August 23, 2024, September 20, 2024, October 18, 2024 and November 15, 2024 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended,

specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1; Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. DEED COVENANTS AND RESTRICTIONS

Sites 1, 2 & 3 (Retail and medical offices)

ADMINISTRATIVE

1. Action:

a. A change of zone from Residence B District to General Service T District is granted as part of this application. The property may be used as a medical office building. In addition, the following uses shall be expressly prohibited on the subject parcel:

i. Psychiatric or drug treatment clinic.

ii. Billiard Hall.

iii. Adult Use.

iv. Transfer Station.

v. Vape shop or lounge.

vi. Package distribution center

vii. Convenience store

viii. Single-user bulk retail establishment

b. A change of zone from Planned Development District-Multi Family to Planned Development District – Office for Site 3 is granted as part of this application. The property may be used for offices, including medical. The following uses shall be expressly prohibited on the subject parcel:

i. Psychiatric or drug treatment clinic. Cancer treatment centers and social work clinics shall not be precluded.

c. A modification of deed covenants and restrictions associated with TC #5363 shall be granted as part of this application. All deed covenants and restrictions associated with TC #5363 and all prior Town Board imposed deed covenants shall be deemed null and void and shall be replaced with these.

d. A Planning Board special permit for a restaurant is granted as part of this application. The use shall not be considered a Convenience Market as defined by the Town of Islip Zoning Code Section 68-3.

i. The hours of operation for the restaurant shall be limited from 5am to 1am 7 days a week. The Planning Board reserves the right to further limit the hours of operation after a public hearing if substantiated complaints are received. The hours of operation shall be clearly posted on the facade of building within public view.

ii. An adequate cooking area venting system shall be installed and maintained in a manner that insures that cooking odors are properly dispersed and not deemed obnoxious and/or objectionable to nearby residential uses.

iii. Applicant agrees to provide adequate and properly trained staff to supervise the premises and patrons to prevent noise, fights, disorders, and/or other unlawful behavior both inside and outside the premises. There shall be no loitering or any other activity on the premises that creates or causes noise that is loud, disturbing, unusual, unreasonable or unnecessary. The Planning Board reserves the right to revisit this application in order to further regulate or re-

scind this Special Permit if substantiated complaints are received regarding late night operation, noise, or other prohibited outdoor activity, after due public hearing.

2. Construction Trailer:

Prior to the issuance of any construction or demolition permits, applicant shall obtain a permit for an on-site construction trailer which shall remain on the property for the life of the permit(s). Said trailer shall contain a copy of the approved site plan and approved construction plans, and be accessible to all Town personnel and contractors for review of plans and meetings. Should the applicant wish to remove said trailer before the issuance of a Certificate of Occupancy, written permission must be obtained for its removal by the Building Division.

3. Central Islip Planned Development District Fees:

Declarant/Owner agrees to pay $2.00 per square foot of newly constructed building area pursuant to 68-334. Any rehabilitation of existing structures is not subject to the CIPDD mitigation fees. In addition, Declarant/Owner agrees, at its sole cost and expense, to design, and construct a roundabout on Eastview Drive.

4. Robbins Amphitheater Mitigation Fee:

Applicant agrees to submit a fee of $150,000 to be used towards the restoration of the Robbins Amphitheater, inclusive of plans, studies, and construction prior to the issuance of site plan approval for the initial phase of the project.

5. Site Access:

Applicant shall access its real property via the existing easement over Gull Haven Drive between Carlton Avenue and Robbins Road and dedicate enough property to provide for a standard right-of-way. The access easement along Gull Haven Drive east of Robbins Road is deemed terminated. The access easement for the benefit of the Town along the entirety of Robbins Road shall remain until extinguished by mutual agreement between the Town and the Declarant.

OPERATIONAL RESTRICTIONS

6. Hours of Operation:

The hours of operation for the subject property shall be limited from 7am to 8pm. The hours may be modified by the Planning Board after a public hearing. Any dumpster access, deliveries and/or garbage pickup shall not occur before 8 am daily. Outdoor storage, sales and display shall be prohibited.

7. Retail Space:

The square footage of retail space on site shall not exceed 46,400 square feet. Space for food service, entertainment, recreation, office, and personal service establishments shall not count as retail.

8. Loitering:

Loitering shall be prohibited on the subject parcel. If substantiated complaints regarding loitering and/ or criminal activity at the site are received by the Town of Islip, the Commissioner of the Town of Islip Planning Department shall notify the property owner by certified mail to take appropriate security measures to deter loitering and/or criminal activity at the site. If the property owner fails to take appropriate security measures within fifteen (15) days of the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional reasonable security conditions at the site including, but not limited to: the installation of fencing, lighting, security cameras, and/or the hiring of a private security company to monitor the site. The Planning Board reserves sole responsibility of determining if the Declarant/Owner is in compliance with this requirement.

9. Property Maintenance:

Declarant/owner further agrees to permanently maintain all improvements and landscaping to the reasonable satisfaction of the Planning Board. The Town or its designee reserves the right to enter onto the subject property after 30 days’ written notice sent certified mail, return receipt requested, to the address of the current owner according to Town of Islip assessment rolls, to remove litter, debris or maintain or replace any fencing or plantings if found that the improvements are not being maintained and shall bill the owner for any expense incurred. All costs associated with same shall be assessed to the owner’s

ARCHITECTURAL ELEVATION REVIEW & SIGNAGE

10. Architectural Elevation Review:

Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. The submitted architectural drawings for the marketplace shall be in substantial conformance to the renderings prepared by Combined Resources Consulting and Design Inc and which is dated November 6, 2023. The submitted architectural drawings for all other buildings shall be in substantial conformance to the renderings prepared by Combined Resources Consulting and Design Inc and which is dated September 12, 2023. Said plans shall show all sides of the structure and shall also show the following design elements:

a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.

b. Use of EIFS, stucco and concrete block shall be limited to accent bands and shall not comprise more than 10% of the building’s front yard façades.

c. The front yard facade for the buildings on Site 2 shall be transparent (glass) between three feet and eight feet above the ground for at least 20% of the horizontal length of the building. The rear yard façade for the buildings on Site 2 shall be transparent (glass) between three feet and eight feet above the ground for at least 40% of the length of the building. The north and south facades for Site 2 shall be transparent (glass) for at least 30% of the length of those façades. Windows shall be of clear glass and unobstructed from both the interior and exterior. The Commissioner of Planning & Development is authorized to modify these percentages provided the spirit and intent of the intended glazing is met.

d. The use of brick shall be prominently featured as required by the Central Islip Master Plan for the Planned Development District. Architectural features from preexisting buildings shall be incorporated into new building designs and clearly delineated on the architectural elevations.

e. No exterior-mounted steel security gates or shutters permitted. Only interior-mounted meshtype security gates permitted.

f. A decorative focal point centralized at each public entrance which shall comply with the following: i. Is at least 50’ wide or half the width of the storefront, whichever is less.

ii. Shall include a canopy, planters/landscaping, and shall utilize quality building materials such as windows, metal panels, wood panels, non-vinyl shingles, and brick.

iii.The use of EIFS, stucco and concrete block shall be limited to accent bands and shall not comprise more than 10% of the focal point’s area.

iv. Whenever the distance between multiple focal points exceeds 50 feet, a combination of vertical breaks in façade design, such as green walls or differentiation in material or texture shall be utilized, with the inclusion of planters/ landscaping along those areas.

v. Horizontal distinguishing elements along the base and top of the façade shall be provided (e.g., substantial coping element, cornice, decorative parapet, stacked stone or brick base, etc.).

g. Existing slate roofs shall be preserved on all preexisting buildings, when feasible. The substitution of any other roofing material in lieu of the existing slate material for preexisting buildings shall be reviewed and approved by the Planning Board. Slate roofing shall not be a requirement of newly constructed buildings.

The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with the above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.

11.

Signs:

Applicant shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated facial signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box facial signs shall be expressly prohibited. Freestanding signs shall be a monument style, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Declarant/ Owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.

SITE PLAN REQUIREMENTS & MODIFICATIONS

12. Site Plan:

Prior to filing a building permit application, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The submitted plan shall be in substantial conformance to the plan(s) prepared by Angelo V. Laino and which is dated October 4, 2023. Said plan shall also show the following elements:

a. A minimum of 436 parking stalls shall be provided on Site 2 and a minimum of 161 stalls shall be provided on Site 3. Additional parking beyond these minimum stalls may be designated as landbanked parking on the approved site plan at the direction of the Town Engineer. The Declarant agrees to install additional parking as may be deemed necessary at any time in the future pursuant to the direction of the Commissioner of the Department of Planning and Development. Additional parking shall be installed at the sole cost of the Declarant within thirty (30) days’ notice.

b. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative or split faced concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. Multiple tenants within the building shall be required to use a common dumpster and shall not cause additional, multiple dumpsters to be located on the subject property that are not enclosed in an approved location and as described above. A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area on a daily basis. The subject site shall be maintained in a neat, clean, and litter free condition

c. Garbage cans for customers shall be provided inside as well as outside of the proposed building(s) and shall be emptied on a regular basis. Garbage can lids shall be of sufficient design with either drivethrough funnel lids or chutes so as to prohibit the dispersion of litter, garbage, or debris by wind, birds, vermin, etc. from said trash receptacles.

d. All stormwater drainage shall be contained onsite in accordance with the current SLDR. In addition, Declarant/Owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques:

i. Natural retention area(s) such as vegetated swales and bioretention cells/rain gardens.

ii. Permeable/porous pavement surfaces.

iii.Manufactured treatment devices, i.e. catch basin inserts designed to filter hydrocarbons and other pollutants from stormwater runoff.

e. A single bike rack (“Inverted U” or “Post and Loop” in design) shall be installed near the entrance to each building.

f. 2% of the total number of parking stalls shall be set aside as electric vehicle charging stations. The parking lots shall be designed for 10% of parking spaces to become future electric vehicle charging stations.

g. Fire Apparatus Access shall be designed and installed to the satisfaction of the Division of Fire Prevention.

h. All onsite lighting shall be in conformance with Article LII of Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is

properly contained on the subject property.

i. Loading areas shall be screened from view.

j. Decorative street lights installed internally within the development shall be consistent with the design of Phase I of the subject development. Applicant shall replace all existing street lights along Robbins Road.

Declarant/owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the Declarant/owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone.

13. Parking:

If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems. If owner fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan Modification conditions including, but not limited to:

i. Install landbanked parking stalls, if applicable. The Declarant agrees to install additional parking as may be deemed necessary at any time in the future pursuant to the direction of the Commissioner of the Department of Planning and Development. Additional parking shall be installed at the sole cost of the Declarant within thirty (30) days’ notice.

ii. require all leases on property to stipulate that employees park in remote areas, lease unused off-site parking spaces and/or a cross-access agreement.

iii. Require that valet parking be provided for customers during peak periods. Such conditions must relate to parking use and shall not be unreasonably imposed. The owner shall be given the opportunity to effect the above items or prepare and implement a spillover parking plan for peak parking periods acceptable to the Commissioner of Planning & Development prior to having a public hearing before the Planning Board. The Planning Board shall be solely responsible for determinations regarding parking adequacy. No parking space shall be exclusive for any use or purpose except those designated as handicapped spaces, drive-up service or electric vehicle charging. Applicant agrees to offer parking for special municipal events at the Robbins Amphitheater at no charge to either the patrons or the Town of Islip.

14. Landscaping:

A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Chain link fencing shall be prohibited within the front yards. Said plan shall be prepared by a licensed landscape architect and shall indicate the maintenance or installation of native plant species to the greatest extent possible. Said landscaping shall be designed to the reasonable satisfaction of the Planning Board, or its designee and shall include the following plantings/design elements:

a. Street trees shall be installed and maintained ~35’ (prevailing spacing) on center along the property frontage of Carleton Avenue. Street trees along all other internal road frontages shall be installed 35’ on center or clustered at the direction of the Planning Department. Spacing may be adjusted in consideration of the species selection after consultation with the Planning Department. Declarant/Owner shall replace any diseased or dead trees.

b. Shade trees shall be installed within the parking lots to the maximum extent practical on islands and island returns.

c. An overall landscaping relaxation for Site 3 is hereby granted as part of this application. A mitigation fee of $5 per square foot shall be submitted in lieu of providing the minimum required overall landscaping as determined by the Commissioner of Planning & Development. The

following may be implemented to mitigate or reduce the fee:

i. Landbanked stalls may be provided to offset on a square foot for square foot basis. Said fee shall be paid in the event the parking stalls are constructed.

ii. Shade trees within parking lots with substantial coverage of asphalt area may offset the fee by $375 per tree.

d. Existing vegetation shall be maintained in landscaped and buffer areas to the maximum extent practicable. Declarant/Owner shall make every effort to preserve the existing mature trees on the subject property. Clearing limit lines shall be staked out by a licensed land surveyor, and either snow fencing or construction fencing shall be erected to protect areas from disturbance or encroachment prior to the start of any activities on site. A tree survey indicating all trees above ten inches (10”) in diameter shall be shown for all cleared areas and areas not designated as natural or undisturbed buffer areas. The following vegetation shall be expressly preserved:

i. The two evergreen street trees along the north side of Gull Haven Drive shall be preserved.

e. Loading areas shall be screened from view from public view with appropriate buffer plantings or architectural features at the direction of the Planning Department.

f. A 5’ wide meandering concrete walking path shall be installed in the front yards of sites 1 and 2. Declarant agrees to make a good faith effort to connect said walking path with the walking path of the parcel to the north. Said path shall incorporate the following:

i. A variety of ornamental flowering trees.

ii. A low-lying flowering understory.

g. A vegetative buffer shall be provided adjacent to any residential use or zone. Within the buffer area, plantings shall be selected based on site conditions and shall create a naturalized area that does not consist of a monoculture. Existing significant trees and tall evergreen shrubs shall remain at the direction of the Planning Department.

h. Declarant/Owner agrees not to clear, or disturb in any way, all areas of the property that are designated as landscaped or buffer areas without the permission of the Planning Department. Supplemental planting may be done in these areas at the direction and to the reasonable satisfaction of the Planning Board. Declarant/Owner shall replace any diseased or dead trees as directed by the Planning Commissioner or his or her designee. The following areas shall be maintained as landscaped buffer areas:

i. Site 1: 25’ in width along northern property line Site 1, with the exception of turnaround for loading area of Building A, the southeastern portion of the property abutting the parking lot for Building E on Site 2, and the southern property line.

ii. Site 3: 50’ in width along the eastern property line. A buffer relaxation is granted along the northern property line.

2. All landscaped areas shall be maintained with permanent in-ground irrigation systems.

All plantings shall be maintained to the reasonable satisfaction of the Planning Board and all plant material shall be kept in a healthy well-maintained condition. The Planning Board shall be solely responsible for the determination regarding adequate maintenance. The Declarant/Owner shall be solely responsible for the cost of the maintenance. In the event Declarant/Owner fails to maintain the landscaping as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the Declarant/Owner’s next tax bill. The Planning Board may modify any landscaping requirements referenced in this covenant in accordance with the Subdivision & Land Development Regulations. Site 4 (Multi-Family [non-age restricted])

ADMINISTRATIVE

15. Action(s): A modification of deed covenants and restrictions associated with TC #5363 shall be granted as part of this application. All deed covenants and restrictions associated with TC #5363 and all prior Town Board imposed deed covenants shall be deemed null and void and shall be replaced with these. The use of the subject property shall be a rental apartment complex and accessory amenities with a maximum of 645 dwelling units, to be further delineated as follows:

i. A minimum of 61 studio units

ii. A minimum of 419 one-bedroom units

iii.A maximum of 158 two-bedroom units.

iv. A maximum of 7 three-bedroom units. The Planning Board may modify the breakdown and total number of units within the buildings after a public hearing.

16. Construction Trailer:

Prior to the issuance of any construction or demolition permits, applicant shall obtain a permit for an on-site construction trailer which shall remain on the property for the life of the permit(s). Said trailer shall contain a copy of the approved site plan and approved construction plans, and be accessible to all Town personnel and contractors for review of plans and meetings. Should the applicant wish to remove said trailer before the issuance of a Certificate of Occupancy, written permission must be obtained for its removal by the Building Division.

17. Central Islip Planned Development District Fees:

Declarant/Owner agrees to pay $2.00 per square foot of newly constructed building area pursuant to 68-334. Any rehabilitation of existing structures is not subject to the CIPDD mitigation fees.

ONSITE OPERATIONS

18. Affordable Housing:

At least 10% (65) dwelling units shall be set aside as affordable units subject to the following Town of Islip requirements in §68-3 in effect at the time of this grant (80% of the current median family income for the Nassau-Suffolk Fair Market Rent Area as published annually by the United States Department of Housing and Urban Development). The property owner or management company shall enter into a contract with a not-for-profit HUD Certified Housing Counseling Agency to review and certify compliance with the above provisions. Evidence of compliance with the above referenced affordability provisions must be provided prior to issuance of rental permit(s) and/or upon request to the Town of Islip Planning Department.

19. Occupancy:

The residential occupancy of each unit shall be limited to the number permitted by the New York State Building Code. Each unit shall have a clothes washer and dryer machine.

20. Property Maintenance:

Declarant/Owner agrees to enter into a contract with a property management company to oversee the daily management of the property. The management company shall be responsible for the supervision, restoration and maintenance and repair on the subject property in accordance with the approved building and site plans. These shall include, but not be limited to, on-site security, internal roadways, sidewalks, litter removal, provision of garbage collection, snow and ice removal, stormwater infrastructure, landscaping, lighting, walkways and buffer installation maintenance and replacement. The subject property shall be kept neat, clean, graffiti and litter free. The internal private roadway servicing the units shall not be offered for dedication. If the property is not being managed to the reasonable satisfaction of the Planning Board, the Planning Board reserves the right to require further maintenance, improvements and/or modifications on-site. The Planning Board will notify the property owner within 30 days certified mail notice identifying the problem(s) and request rectification. The property owner agrees to rectify any problems to the Planning Board’s satisfaction within sixty (60) days, weather permitting.

21. Eastview Drive Roundabout Improvements:

Declarant/Owner further agrees to install signage and pedestrian crossing beacons in or around roundabout at the direction of the Commissioner of Public Works prior to dedication of the roundabout to the Town. Said improvements to roundabout shall include:

a. Retroreflective chevrons around the circle for northbound and southbound traffic

b. Northbound and southbound advisory signage indicating “Roundabout Ahead” with speed limit rider.

c. Hardwired blinking pedestrian signs (beacon or standalone).

d. Replace speed limit signs if speed limit is changed as of the time of dedication.

22. Solid Waste:

Declarant/Owner shall provide regular solid waste collection services to residents of the apartments. Said collection services shall include separation of solid waste into recyclable components, including but not limited to newspapers, corrugated cardboard, ferrous metal, aluminum beverage containers, plastic beverage containers and glass. As part of this requirement, Declarant/Owner shall provide designated containers

for recyclable materials. Said containers shall be regulated in the same manner as garbage dumpsters, including regular servicing and enclosure within a decorative or split faced concrete block enclosure with opaque gates.

ARCHITECTURAL ELEVATION REVIEW & SIGNAGE

23. Architectural Elevation Review:

Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. The submitted architectural drawings shall be in substantial conformance to the plan(s) prepared by Combined Resources Consulting and Design, Inc and which is dated October 2, 2023. Said plans shall show all sides of the structure and shall also show the following design elements:

a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.

b. Use of EIFS and concrete block shall be limited to accent bands and shall not comprise more than 10% of the building’s façade.

c. The use of brick shall be prominently featured as required by the Central Islip Master Plan for the Planned Development District. Architectural features from preexisting buildings shall be incorporated into new building designs and clearly delineated on the architectural elevations.

d. There shall be three variations in the building elevations showing minor variations in materials, features and/or colors.

The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.

24. Signs:

Applicant shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box signs shall be expressly prohibited. Freestanding signs shall be a monument style, unlit or indirectly lit only, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Declarant/ Owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.

SITE PLAN REQUIREMENTS & MODIFICATIONS

25. Site Plan:

Prior to filing a building permit application, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to: building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The site plan shall be in substantial conformance with the plan prepared by Angelo V. Laino and which is dated October 4, 2023. Said plan shall also include the following elements:

a. The Declarant agrees to install landbanked parking as may be deemed necessary at any time in the future pursuant to the direction of the Commissioner of the Department of Planning and Development. Additional parking shall be installed at the sole cost of the Declarant within thirty (30) days’ notice.

b. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. A hose bibb shall be installed adjacent to each dumpster to allow routine rinsing of the dumpster area as needed. The subject site shall be

maintained in a neat, clean, and litter free condition.

c. Garbage cans shall be provided near all outdoor amenity areas. Garbage can lids shall be of sufficient design with either drive-through funnel lids or chutes so as to prohibit the dispersion of litter, garbage, or debris by wind, birds, vermin, etc. from said trash receptacles.

d. All stormwater drainage shall be contained onsite in accordance with the current SLDR. In addition, Declarant/Owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques: i. natural retention area(s) such as vegetated swales and bioretention cells/rain gardens ii. Permeable/porous pavement surfaces iii.Manufactured treatment devices, i.e. catch basin inserts designed to filter hydrocarbons and other pollutants from stormwater runoff

e. A single bike rack (“Inverted U” or “post and Loop” in design) shall be installed near the entrance to each building.

f. 2% (#) of the total number of parking stalls shall be set aside as electric vehicle charging stations. The parking lots shall be designed for 10% of parking spaces to become future electric vehicle charging stations.

g. Emergency vehicle access shall be designed and installed to the satisfaction of the Division of Fire Prevention.

h. All onsite lighting shall be in conformance with Article LII of Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.

i. A minimum of 9 onsite amenities for tenant use, which may include but is not limited to:

l. Decorative street lights shall be consistent with the style and intent as provided for within the Belmont housing development.

The approved site plan shall supersede this plan for the purposes of regulating the subject property. Declarant/ Owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the Declarant/Owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application, and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone.

26. Landscaping:

A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Chain link fencing shall be prohibited within the front yards. Said plan shall be prepared by a licensed landscape architect and shall indicate the maintenance or installation of native plant species to the greatest extent possible. Said landscaping shall be designed to the reasonable satisfaction of the Planning Board, or its designee and shall include the following plantings/design elements:

a. Street trees shall be installed and maintained

~35’ (prevailing spacing) on center along the property frontage of Carleton Avenue from the Visitor Center south to the southwest-most corner of the property. Street trees along all other internal road frontages shall be installed 35’ on center or clustered at the direction of the Planning Department. Spacing may be increased in consideration of the

species selection and setbacks from other structures and/or existing trees after consultation with the Planning Department. Declarant/Owner shall replace any diseased or dead trees.

b. Parking lot islands for trees shall be 9’ wide unless otherwise directed by the Town Engineer.

c. A staggard row of evergreens on berms shall be established along Eastview Drive for the purpose of providing a buffer for the onsite residences.

d. Existing vegetation shall be maintained in landscaped and buffer areas to the maximum extent practicable. Declarant/Owner shall make every effort to preserve the existing mature trees on the subject property. Clearing limit lines shall be staked out by a licensed land surveyor, and either snow fencing or construction fencing shall be erected to protect areas from disturbance or encroachment prior to the start of any activities on site. A tree survey indicating all trees above ten inches (10”) in diameter shall be shown for all cleared areas and areas not designated as natural or undisturbed buffer areas.

e. All landscaped areas shall be maintained with permanent in-ground irrigation systems. All plantings shall be maintained to the reasonable satisfaction of the Planning Board and all plant material shall be kept in a healthy well-maintained condition. The Planning Board shall be solely responsible for the determination regarding adequate maintenance. The Declarant/Owner shall be solely responsible for the cost of the maintenance. In the event Declarant/Owner fails to maintain the landscaping as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the Declarant/Owner’s next tax bill. The Planning Board may modify any landscaping requirements referenced in this covenant in accordance with the Subdivision & Land Development Regulations.

Site 4a Multifamily Senior Citizen (condominiums)

ADMINISTRATIVE

27. Action(s):

a. A change of zone from Planned Development District Multifamily to Planned Development District Senior Citizen is deemed granted as part of this application. The use of the subject parcel(s) shall be limited to single-family senior citizen units and accessory amenities having no more than 81 singlefamily dwelling units, to be further delineated as follows:

i. A minimum of 9 one-bedroom units

ii. A maximum of 72 two-bedroom units.

b. The Planning Board may modify the breakdown and total number of units within the buildings after a public hearing.

c. A modification of deed covenants and restrictions associated with TC #5363 shall be granted as part of this application. All deed covenants and restrictions associated with TC #5363 and all prior Town Board imposed deed covenants shall be deemed null and void and shall be replaced with these.

Prior to the sale of any lots/units or the issuance of a Certificate of Occupancy, there shall exist in accordance with the general laws of the State of New York an Association of Homeowners that shall consist of all property owners. Each dwelling unit owner(s), by virtue of his/her/their holding of a unit shall be a member of the said Association and shall hold (or share) one membership for each unit so owned, and shall be bound by the by-laws of said Association; all unit owners shall be obligated to pay the common charges assessed by the Association.

Upon issuance of a Certificate of Occupancy, the Association of Homeowners shall assume all responsibility to comply with covenants provided herein. All future unit owners shall be made aware of their responsibility to comply with all of these covenants and restrictions by inclusion of the within covenants and restrictions in the Offering Plan. The Planning Board reserves the right to modify the Association requirements within these covenants, subject to compliance with the offering plan approved by the Office of the New York State Attorney General.

All plantings shall be maintained to the reasonable satisfaction of the Planning Board and all plant material shall be kept in a healthy well-maintained condition.
