Local Emergency Order:

Suspending local procurement and contracting laws, rules and regulations

I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with Proclamations of a State of Emergency issued on August 19, 2024 (Proclamation 2024-33), and September 20, 2024 for a storm occurring on or about August 19, 2024, and pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:

Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors as a result of a storm that caused severe damage and dangerous conditions, including torrential rain, strong winds, flash flooding, sinkholes, road buckling and closures, erosion, dam failure, downed trees and power lines, severe property, vehicle and equipment damage, collapse of residences and evacuation of impacted residents, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.

This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

Suspending local procurement and contracting laws, rules and regulations

I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with (3) Proclamation of a State of Emergency last issued on June 28, 2024, July 26, 2024, August 23, 2024 and September 20, 2024 pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:

Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

• Chapters 1065 and 189

Article IV sections A 4-13 and 14

Article V sections A5-1

• Charter section C5-2 (C) and (L)

Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance

• all related procurement laws, rules, and regulations required to comply with this Order; and further

Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further

Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.

This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 5, 2024, February 4, 2024, March 5, 2024, April 4, 2024, May 3, 2024, May 31, 2024, June 28, 2024, July 26, 2024, August 23, 2024 and September 20, 2024 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189;

Article IV sections A 4-13 and 14; Article V section A5-1; Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.

G. Effective Date

This Executive Order shall take effect immediately.

And I further order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary; and further order that

DEED COVENANTS AND RESTRICTIONS

ADMINISTRATIVE

1. Action(s):

a. A change of zone from Industrial 1 District to Industrial Transition District is granted as part of this application. The property may be used as a carting company with accessory fleet storage as shown on an approved site plan. Any change of use shall be limited to uses permitted in the Industrial Transition District. In addition, the following uses shall be expressly prohibited on the subject parcel:

i. Bar, tavern or nightclub

ii. Psychiatric clinic

iii. Billiard Hall

iv. Adult Use

v. Transfer Station

vi. Vape shop or lounge

vii. Motor vehicle dealership

viii. Gasoline service station

b. A Town Board Special Permit for a fast food restaurant shall also be granted as part of this application for Parcel 2. An adequate cooking area venting system shall be installed and maintained in a manner that insures that cooking odors are properly dispersed and not deemed obnoxious and/or objectionable to nearby residential uses. Declarant/property owner agrees to modify building and remove or relocate the drive-through to coordinate with the implementation of a Brentwood Master Plan, upon the Town Board’s adoption of new zoning laws implementing said plan, and further provided that a public sewer connection line has been brought to the site and there is sufficient public sewage capacity to accommodate the redevelopment of the site in accordance with said Master Plan. Upon availability of sewer connection, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner and the branch manager of the restaurant by certified mail to, within 180 days of said mailing:

i. connect to the sewers

ii. cease operation of the drive-through.

iii. file a site plan application for development compliant with the master plan or otherwise restore

the site in substantial conformance with the plan prepared by Tahir Qureshi on July 30, 2017 and approved by the Town Engineer on November 21, 2017.

The declarant shall be given an opportunity to propose an alternate drive-through layout that does not conflict with pedestrian activity along Ross Park or future adjoining store-fronts as per the then-current Comprehensive Plan for Brentwood after review and approval of the Town Board after a public hearing.

c. A Planning Board Special Permit for outside seating as an accessory use to a restaurant shall be granted as part of this application.

2. Cross-Access Agreement:

A cross-access and shared parking agreement shall be in place in perpetuity between the Business 3 parcel and the greater shopping center.

OPERATIONAL RESTRICTIONS

3. Hours of Operation:

The hours of operation for the subject property shall be limited from 10 am to 11 pm. Any dumpster access, deliveries and/or garbage pick-up shall not occur before 8 am daily. Outdoor storage, sales and display shall be prohibited. The Town Board reserves the right to further limit the hours of operation after a public hearing if substantiated complaints are received.

4. Drive-through Queuing:

Declarant/owner agrees to provide adequate queuing for the orderly operation of the drive-through. If substantiated complaints are received regarding queuing failures such that the queue obstructs site circulation and/or if a stacking shortfall exists on, or extends off, the subject property, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner and the branch manager of the restaurant by certified mail, to correct the queuing failures. If evidence of Queuing Failures are still observed by the Commissioner of the Town of Islip Planning Department after thirty (30) days from the date of such mailing, then the Town Board reserves the right to hold a public hearing to reconsider the use of the accessory drive-thru and/or impose reasonable conditions designed to improve the drive-through queuing conditions. The Town Board shall maintain sole responsibility of determining if a stacking shortfall exists on the property.

5. Litter:

The operator shall be responsible for removing litter associated with the restaurant use on the subject property and within 50’ from the subject property in any direction of the right-of-way of Brentwood Road and Second Avenue. This shall be done at least once a day.

The subject property shall also be kept clean of litter and debris at all times. The Planning Board shall be solely responsible for the determination regarding adequate maintenance and litter clean up. The Declarant/owner shall be responsible for adequate refuse collection and for the cost of litter clean up to ensure compliance with this covenant. In the event Declarant/owner fails to maintain the landscaping or clean up litter and debris as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the Declarant/owner’s next tax bill.

6. Loitering:

Loitering shall be prohibited on the subject parcel. If substantiated complaints regarding loitering and/ or criminal activity at the site are received by the Town of Islip, the Commissioner of the Town of Islip Planning Department shall notify the property owner by certified mail to take appropriate security measures to deter loitering and/or criminal activity at the site. If the property owner fails to take appropriate security measures within fifteen (15) days of the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional reasonable security conditions at the site including, but not limited to: the installation of fencing, lighting, security cameras, and/or the hiring of a private security company to monitor the site. The Planning Board reserves sole responsibility of determining if the Declarant/Owner is in compliance with this requirement.

7. Property Maintenance:

Declarant/owner further agrees to permanently maintain all improvements and landscaping to the reasonable satisfaction of the Planning Board. The Town or its designee reserves the right to enter onto the subject property after 30 days’ written notice sent certified mail, return receipt requested, to the address of the current owner according to Town of Islip

assessment rolls, to remove litter, debris or maintain or replace any fencing or plantings if found that the improvements are not being maintained and shall bill the owner for any expense incurred. All costs associated with same shall be assessed to the owner’s next tax bill.

ARCHITECTURAL ELEVATION REVIEW & SIGNAGE

8. Architectural Elevation Review:

Prior to filing a building permit application, exterior architectural drawings of all proposed exterior building changes shall be submitted to the Town of Islip Planning Department for review and approval. Said plans shall show all sides of the structure and shall also show the following design elements:

a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.

b. Use of EIFS and concrete block shall be limited to accent bands and shall not comprise more than 10% of the building’s façade.

The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board.

The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.

9. Signs:

Declarant shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box signs shall be expressly prohibited. Freestanding signs shall be a monument style, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Declarant/owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.

SITE PLAN REQUIREMENTS & MODIFICATIONS

10. Site Plan:

Prior to filing a building permit application, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The submitted plan shall be in substantial conformance to the plan(s) prepared by Tahir Queresh, PE and received by the Planning Department on April 11, 2023. Said plan shall also show the following elements:

a. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative or split faced concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. Garbage cans for customers shall be provided inside as well as outside of the proposed building(s) and shall be emptied on a regular basis. Garbage can lids shall be of sufficient design with either drive-through funnel lids or chutes so as to prohibit the dispersion of litter, garbage, or debris by wind, birds, vermin, etc. from said trash receptacles. Multiple tenants within the building shall be required to use a common dumpster and shall not cause additional, multiple dumpsters to be located on the subject property that are not enclosed in an approved location and as described above. A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area on a daily basis. The subject site shall be maintained in a neat, clean, and litter free condition

b. All stormwater drainage shall be contained onsite in accordance with the current SLDR.

c. A single bike rack (“Inverted U” or “Post and Loop” in design) shall be installed near the entrance to the building.

d. Fire Apparatus Access shall be designed and

installed to the satisfaction of the Division of Fire Prevention.

e. All onsite lighting shall be in conformance with Article LII of Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property. Declarant/owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SDLR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the Declarant/owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application, and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone.

11. Parking:

A parking relaxation is granted as part of this application. If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems. If owner fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan

Modification conditions including, but not limited to:

a. Install landbanked parking stalls, if applicable.

b. require all leases on property to stipulate that employees park in remote areas. lease unused offsite parking spaces and/or a cross-access agreement.

c. modify hours of operation of the Special Permit use to reduce peak parking demands.

Such conditions must relate to parking use and shall not be unreasonably imposed. The owner shall be given

the opportunity to effect the above items or prepare and implement a spillover parking plan for peak parking periods acceptable to the Commissioner of Planning & Development prior to having a public hearing before the Planning Board. The Planning Board shall be solely responsible for determinations regarding parking adequacy. No parking space shall be exclusive for any use or purpose except those designated as handicapped spaces.

12. Landscaping:

A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Chain link fencing shall be prohibited within the front yards. Said plan shall indicate the maintenance or installation of native plant species to the greatest extent possible. Said landscaping shall be designed to the reasonable satisfaction of the Planning Board, or its designee and shall include the following plantings/design elements:

a. Street trees shall be installed and maintained 25’ on center along all road frontages. Spacing may be increased in consideration of the species selection after consultation with the Planning Department. Declarant/owner shall replace any diseased or dead trees.

b. A front yard and overall landscaping relaxation is hereby granted as part of this application.

c. Declarant is to plant a vegetation screen along the entire perimeter of the drive through between the drive through and the parking lot to the west as directed by the Planning Department. Height of vegetation shall be sufficient enough to screen view of headlights of cars in drive through.

d. Existing vegetation shall be maintained in landscaped and buffer areas to the maximum extent practicable. Declarant/owner shall make every effort to preserve the existing mature trees on the subject property. Clearing limit lines shall be staked out by a licensed land surveyor, and either snow fencing or construction fencing shall be erected to protect areas from disturbance or encroachment prior to the start of any activities on site. A tree survey indicating all trees above ten inches (10”) in diameter shall be shown for all

cleared areas and areas not designated as natural or undisturbed buffer areas.

e. All landscaped areas shall be maintained with permanent in-ground irrigation systems. All plantings shall be maintained to the reasonable satisfaction of the Planning Board and all plant material shall be kept in a healthy well-maintained condition. The subject property shall also be kept clean of litter and debris at all times.The Planning Board shall be solely responsible for the determination regarding adequate maintenance and litter clean up. The Declarant/owner shall be solely responsible for the cost of the maintenance and litter clean up. In the event Declarant/owner fails to maintain the landscaping or clean up litter and debris as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the Declarant/owner’s next tax bill. The Planning Board may modify any landscaping requirements referenced in this covenant in accordance with the Subdivision & Land Development Regulations.

The above-mentioned covenants and restrictions shall be and constitute real covenants running with the land and shall be binding upon the Declarant and any and all subsequent owners of the said real property or any part thereof, and upon their heirs, executors, and administrators (or their successors and assignees) subject, however, to the right of the Town of Islip after a public hearing to amend, alter, annul or repeal any or all of the foregoing covenants and /or restrictions at any time with the consent of the owner or owners for the time being of the premises herein described, and such right shall be effectual and may be exercised without the consent of any adjacent owners or other owners or lienors of any other property.

This Change of Zone is to become effective on and after October 13, 2024

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 5, 2024, February 4, 2024, March 5, 2024, April 4, 2024, May 3, 2024, May 31, 2024, June 28, 2024, July 26, 2024, August 23, 2024 and September 20, 2024 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189;

FARMINGVILLE FIRE DISTRICT REQUEST FOR PROPOSALS FOR PROFESSIONAL AUDITING SERVICES

d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.

G. Effective Date
