2. Security Service:
Declarant agrees to hire a security service (licensed by the New York State Department of State) for the deterrence and/or reporting of incidents of unauthorized intrusion or entry, noise disturbances, reckless driving or trespass on the subject property. Said service shall operate at a minimum between the hours of 8pm and 4am each day of the week. The Planning Board may modify or remove this requirement after a public hearing.
3. Loitering:

4. Property Maintenance:
Declarant/owner further agrees to permanently maintain all improvements and landscaping to the reasonable satisfaction of the Planning Board. 5. Truck Idling/Parking:

ARCHITECTURAL ELEVATION REVIEW & SIGNAGE
6. Architectural Elevation Review:
Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. Said plans shall show all sides of the structure and shall also show the following design elements:
a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.
b. A decorative focal point centralized at each public entrance which shall comply with the following:
i. Is at least 50’ in width or 50% of the width of the storefront, whichever is less
ii. Shall include a canopy, planters/landscaping, and shall utilize quality building materials such as windows, metal panels, wood panels, non-vinyl shingles, and brick or stone masonry.
iii.The use of EIFS, stucco and concrete block shall be limited to accent bands and shall not comprise more than 10% of the focal point’s area.
iv. Whenever the distance between multiple focal points exceeds 50 feet, a combination of vertical breaks in façade design, such as green walls or differentiation in material or texture shall be utilized, with the inclusion of planters/ landscaping along those areas.
v. Horizontal distinguishing elements along the base and top of the façade shall be provided (e.g., substantial coping element, cornice, decorative parapet, stacked stone or brick base, etc.).
vi. Front yard architectural elevations with a Planning Department approval prior to the date of this grant may remain until future exterior changes are proposed.
Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.
7. Signs:
Declarant/owner shall obtain a sign permit from the Building Department for any future exterior signs. Prior to the issuance of any sign permits, all future exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All future internally illuminated facial signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box facial signs shall be expressly prohibited. Freestanding signs shall
be a monument style, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review any future proposed signs for design compatibility, color, materials, height, quantity and size. Declarant/owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.
SITE PLAN REQUIREMENTS & MODIFICATIONS
8. Site Plan:
Prior to filing a building permit application for the special use permits contemplated herein, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The submitted plan shall be in substantial conformance to the plan(s) prepared by Bohler Engineering and which is dated/last revised December 9, 2022. Said plan shall also show the following elements:
a. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative or split faced concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. Tenants under 8,000 square feet in gross floor area within the building shall be required to use a common dumpster enclosure and shall not cause additional, multiple dumpster enclosures to be located on the subject property that are not enclosed in an approved location and as described above. A hose bibb shall be installed adjacent to each dumpster for food uses (e.g., supermarket, restaurants) to allow routine rinsing of the dumpster area on a daily basis. The subject site shall be maintained in a neat, clean, and litter free condition
b. All stormwater drainage shall be contained onsite in accordance with the current SLDR. The existing drainage piping shall be inspected to ensure that it is structurally sound prior to establishing drainage easements with corresponding pad sites. In addition, Declarant/ owneragrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques: i. Natural retention area(s) such as vegetated swales and bioretention cells/rain gardens.
c. Fire Apparatus Access shall be designed and installed to the satisfaction of the Division of Fire Prevention.
d. All onsite lighting shall be positioned or shielded so as to illuminate only the subject parcel. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.
e. Loading areas shall be screened from view.
Declarant/owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the Declarant/ owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application, and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of the special permits and minor subdivision.
9. Parking:
A parking relaxation is granted as part of this application. If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, return receipt requested, to rectify any parking problems. If owner
fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan Modification conditions including, but not limited to:
i. Install landbanked parking stalls, if applicable.
ii. require employees park in remote areas, lease unused off-site parking spaces and/or a crossaccess agreement.
iii. modify hours of operation of a Special Permit use to reduce peak parking demands.
iv. Require that valet parking be provided for customers during peak periods. Such conditions must relate to parking use and shall not be unreasonably imposed. The owner shall be given the opportunity to effect the above items or prepare and implement a spillover parking plan for peak parking periods acceptable to the Commissioner of Planning & Development prior to having a public hearing before the Planning Board. The Planning Board shall be solely responsible for determinations regarding parking adequacy. No parking space shall be exclusive for any use of purpose except those designated as handicapped spaces, drive-up service or electric vehicle charging.
10. Landscaping:
A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Chain link fencing shall be prohibited within the front yards. Said plan shall be prepared by a licensed landscape architect and shall indicate the maintenance or installation of native plant species to the greatest extent possible. Said landscaping shall be designed to the reasonable satisfaction of the Planning Board, or its designee and shall include the following plantings/design elements:
a. Street trees shall be installed and maintained 30’ on center along all road frontages. Spacing may be adjusted in consideration of the species selection after consultation with the Planning Department. Declarant/owner shall replace any diseased or dead trees.
b. A front yard and overall landscaping relaxation is hereby granted as part of this application.
c. Existing vegetation shall be maintained in landscaped and buffer areas to the maximum extent practicable. Declarant/owner shall make every effort to preserve the existing mature trees on the subject property. Clearing limit lines shall be staked out by a licensed land surveyor, and either snow fencing or construction fencing shall be erected to protect areas from disturbance or encroachment prior to the start of any activities on site. A tree survey indicating all trees above ten inches (10”) in diameter shall be shown for all cleared areas and areas not designated as natural or undisturbed buffer areas.
d. A vegetative buffer shall be provided between any parking area and residential use or zone. Within the 25’ wide buffer area, future plantings shall be selected based on site conditions and shall create a naturalized area that does not consist of a monoculture. Existing significant trees and tall evergreen shrubs shall remain at the direction of the Planning Department. Declarant/owner agrees not to clear, or disturb in any way, all areas of the property that are designated as landscaped or buffer areas without the permission of the Planning Department. Supplemental planting may be done in these areas at the direction and to the reasonable satisfaction of the Planning Board. Declarant/owner shall replace any diseased or dead trees as directed by the Planning Commissioner or his or her designee. The following areas shall be maintained as landscaped buffer areas:
i. Northern property line: 25’ in width for the entire length of the /for the portion of the property which abuts residential zoning exclusive of the driveway and paving required to connect the subject property to Lakeland Avenue.
e. All landscaped areas shall be maintained with permanent in-ground irrigation systems.
f. Declarant to shall install landscaped gardens/ tree pits at the direction of the Town Engineer in substantial conformance with the conceptual site plan referred to in covenant #8. All plantings shall be maintained to the reasonable satisfaction of the Planning Board and all plant material shall be kept in a healthy well-maintained condition. The Planning Board shall be solely responsible for the determination regarding adequate maintenance. The Declarant/owner shall be solely responsible for the cost of the maintenance.
In the event Declarant/owner fails to maintain the landscaping as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the Declarant/owner’s next tax bill. The Planning Board may modify any landscaping requirements referenced in this covenant in accordance with the Subdivision & Land Development Regulations.
LOT 2 (FAST FOOD)
ADMINISTRATIVE
11. Action(s):
A Town Board Special Permit for a fast-food restaurant shall be granted as part of this application for Lot 2. The following uses shall be expressly prohibited on the subject parcel:
i. Bar, tavern or nightclub
ii. Psychiatric clinic
iii. Billiard Hall
iv. Adult Use
v. Transfer Station
vi. Vape shop or lounge
12. Construction Trailer:
Prior to the issuance of any construction or demolition permits, Declarant shall obtain a permit for an on-site construction trailer which shall remain on the property for the life of the permit(s). Said trailer shall contain a copy of the approved site plan and approved construction plans, and be accessible to all Town personnel and contractors for review of plans and meetings. Should the Declarant wish to remove said trailer before the issuance of a Certificate of Occupancy, written permission must be obtained for its removal by the Building Division.
OPERATIONAL RESTRICTIONS
13. Hours of Operation:
The hours of operation for the subject property shall be limited from 5am to 2am. Outdoor storage, sales and display shall be prohibited.
14. Drive-through Queuing:
Declarant/owner agrees to provide adequate queuing for the orderly operation of the drive-through. If substantiated complaints are received regarding queuing failures such that the queue obstructs the east to west drive aisle directly north of the subject parcel and/or if a stacking shortfall exists extends off, the shopping center property, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner and the branch manager of the restaurant by certified mail, return receipt requested, to correct the queuing failures. Promptly after receipt of the notice, the branch manager of the restaurant shall implement the traffic control management plan submitted in conjunction with the corresponding site plan application.
If queuing failures and/or stacking shortfalls are still occurring thirty (30) days after the date of such mailing, the Planning Board, upon fourteen (14) days written notice by certified mail to the property owner and the branch manager of the restaurant, shall be authorized to hold a public hearing to consider imposing reasonable conditions designed to improve the drivethrough queuing conditions. The Planning Board of the Town of Islip Planning Department shall maintain sole discretion as to determining whether a queuing failure has occurred and/or a stacking shortfall exists on the property. Notwithstanding the foregoing, a Queuing Failure shall not be deemed to have occurred if the queuing issue is caused by a force majeure event, including but not limited to, a pandemic, epidemic, or other public health event. Nothing in this covenant precludes the Town from enforcing the provisions of the Town Code, in effect as of the date hereof or as may be amended.
15. Litter:
The operator shall be responsible for removing litter associated with the restaurant use on the subject property. This shall be done at least once a day. The subject property shall also be kept clean of litter and debris at all times. The Planning Board shall be solely responsible for the determination regarding adequate maintenance and litter clean up. The Declarant/owner shall be responsible for adequate refuse collection and for the cost of litter clean up to ensure compliance with this covenant. In the event Declarant/owner fails to maintain the landscaping or clean up litter and debris as so directed upon 30 days prior written notice to the property owner from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the Declarant/owner’s next tax bill.
16. Loitering:
Loitering shall be prohibited on the subject parcel. If substantiated complaints regarding loitering and/ or criminal activity at the site are received by the Town of Islip, the Commissioner of the Town of Islip Planning Department shall notify the property owner by certified mail, return receipt requested, to take appropriate security measures to deter loitering and/or criminal activity at the site. If the property owner fails to take appropriate security measures within fifteen (15) days of the date of such mailing or if subsequent substantiated complaints regarding criminal activity are received, the Planning Board reserves the right, after due public hearing, to impose additional reasonable security conditions at the site including, but not limited to: the installation of fencing, lighting, security cameras, limiting the hours of operation and/or the hiring of a private security company to monitor the site. The Planning Board reserves sole responsibility of determining if the Declarant/Owner is in compliance with this requirement.
17. Property Maintenance:
Declarant/owner further agrees to permanently maintain all improvements and landscaping to the reasonable satisfaction of the Planning Board. The Town or its designee reserves the right to enter onto the subject property after 30 days’ written notice sent certified mail, return receipt requested, to the address of the current owner according to Town of Islip assessment rolls, to remove litter, debris or maintain or replace any fencing or plantings if found that the improvements are not being maintained and shall bill the owner for any expense incurred. All costs associated with same shall be assessed to the owner’s next tax bill.
ARCHITECTURAL ELEVATION REVIEW & SIGNAGE
18. Architectural Elevation Review:
Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. Said plans shall show all sides of the structure and shall also show the following design elements:
a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.
B. Use of EIFS and concrete block shall be limited to accent bands and shall not comprise more than 10% of the building’s façade.
The approved detailed architectural elevations shall supersede the submitted special permit conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.
19. Signs:
Declarant/owner shall obtain a sign permit from the Building Department for any future exterior signs. Prior to the issuance of any sign permits, all future exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All future internally illuminated facial signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box facial signs shall be expressly prohibited. Freestanding signs shall be a monument style, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review any future proposed signs for design compatibility, color, materials, height, quantity and size. Declarant/owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.
SITE PLAN REQUIREMENTS & MODIFICATIONS
20. Site Plan:
Prior to filing a building permit application for the special use permits contemplated herein, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The submitted plan shall be in substantial
conformance to the plan(s) prepared by Bohler Engineering and which is dated/last revised December 9, 2022. Said plan shall also show the following elements:
a. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative or split faced concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. Garbage cans for customers shall be provided inside as well as outside of the proposed building(s) and shall be emptied on a regular basis. Garbage can lids shall be of sufficient design with either drive-through funnel lids or chutes so as to prohibit the dispersion of litter, garbage, or debris by wind, birds, vermin, etc. from said trash receptacles. Multiple tenants within the building shall be required to use a common dumpster and shall not cause additional, multiple dumpsters to be located on the subject property that are not enclosed in an approved location and as described above. A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area on a daily basis. The subject site shall be maintained in a neat, clean, and litter free condition.
b. All stormwater drainage shall be contained on-site or via an approved drainage easement in accordance with the current SLDR. In addition,
Declarant/owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan for non-roof drainage by incorporating one or more of the following stormwater mitigation techniques:
i. Natural retention area(s) such as vegetated swales and bioretention cells/rain gardens.
ii. Permeable/porous pavement surfaces.
iii. Manufactured treatment devices, i.e., catch basin inserts designed to filter hydrocarbons and other pollutants from stormwater runoff.
c. Fire Apparatus Access shall be designed and installed to the satisfaction of the Division of Fire Prevention.
d. All onsite lighting shall be in conformance with Article LII of Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.
e. A traffic management plan detailing measures the restaurant operator will implement in the event the drive-through queue cannot accommodate the number of cars attempting to use the drive-through and materially interfere with onsite vehicular and pedestrian circulation. Said management plan shall include, but not limited to, the provision of an additional temporary lane for the drive-through, the hiring of private security to direct traffic away from the drive-through and the provision for a designated curbside pickup area.

c. Declarant is to plant a vegetation screen along the entire perimeter of the drive through between the drive through and Sunrise Highway (NYS R27) as directed by the Planning Department. Height of vegetation shall be sufficient enough to screen view of headlights of cars in drive through.
d. Existing vegetation shall be maintained in landscaped and buffer areas to the maximum extent practicable. Declarant/owner shall make every effort to preserve the existing mature trees on the subject property. iv. Manufactured treatment devices, i.e., catch basin inserts designed to filter hydrocarbons and other pollutants from stormwater runoff.
c. A single bike rack (“Inverted U” or “Post and Loop” in design) shall be installed near the entrance to the building.
d. Fire Apparatus Access shall be designed and installed to the satisfaction of the Division of Fire Prevention.
e. All onsite lighting shall be in conformance with Article LII of Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property. 33. Landscaping:
A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Chain link fencing shall be prohibited within the front yards. Said plan shall indicate the maintenance or installation of native plant
species to the greatest extent possible. Said landscaping shall be designed to the reasonable satisfaction of the Planning Board, or its designee and shall include the following plantings/design elements:
a. Street trees shall be installed and maintained 25’ on center along all road frontages. Spacing may be increased in consideration of the species selection after consultation with the Planning Department. Declarant/owner shall replace any diseased or dead trees.
b. A front yard and overall landscaping relaxation is hereby granted as part of this application.
c. Declarant is to plant a vegetation screen along the entire perimeter of the drive through between the drive through and [adjacent roadway] with a [species] as directed by the Planning Department. Height of vegetation shall be sufficient enough to screen view of headlights of cars in drive through from those cars traveling on [adjacent roadway].
d. Existing vegetation shall be maintained in landscaped and buffer areas to the maximum extent practicable. Declarant/owner shall make every effort to preserve the existing mature trees on the subject property. Clearing limit lines shall be staked out by a licensed land surveyor, and either snow fencing or construction fencing shall be erected to protect areas from disturbance or encroachment prior to the start of any activities on site. A tree survey indicating all trees above ten inches (10”) in diameter shall be shown for all cleared areas and areas not designated as natural or undisturbed buffer areas.
e. All landscaped areas shall be maintained with permanent in-ground irrigation systems.
All plantings shall be maintained to the reasonable satisfaction of the Planning Board and all plant material shall be kept in a healthy well-maintained condition.
The Planning Board shall be solely responsible for the determination regarding adequate maintenance. The Declarant/owner shall be solely responsible for the cost of the maintenance. In the event Declarant/owner fails to maintain the landscaping as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the Declarant/owner’s next tax bill. The Planning Board may modify any landscaping requirements referenced in this covenant in accordance with the Subdivision & Land Development Regulations. The above-mentioned covenants and restrictions shall be and constitute real covenants running with the land and shall be binding upon the Declarant and any and all subsequent owners of the said real property or any part thereof, and upon their heirs, executors, and administrators (or their successors and assignees) subject, however, to the right of the Town of Islip after a public hearing to amend, alter, annul or repeal any or all of the foregoing covenants and /or restrictions at any time with the consent of the owner or owners for the time being of the premises herein described, and such right shall be effectual and may be exercised without the consent of any adjacent owners or other owners or lienors of any other property.

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 5, 2024, February 4, 2024, March 5, 2024, April 4, 2024, May 3, 2024, May 31, 2024 and June 28, 2024 do hereby find and order as follows:
Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and
Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and
Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:
A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.
B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.
C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.
D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189;

SNAP/TANF/FDPIR Households: Households that currently include children who receive the Supplemental Nutrition Assistance Program (SNAP) but who are not found during the Direct Certification Matching Process (DCMP), or households that currently receive Temporary Assistance to Needy Families (TANF), or the Food Distribution Program on Indian Reservations (FDPIR) must complete an Application for Free and Reduced Price School Meals, listing the child’s name, a valid SNAP, TANF, or FDPIR case number and the signature of an adult household member. Eligibility for free meal benefits based on participation in SNAP, TANF or FDPIR is extended to all children in the household. When known to the School Food Authority, households will be notified of their children’s eligibility for free meals based on their participation in the SNAP, TANF or the FDPIR programs. No application is necessary if the household was notified by the SFA their children have been directly certified. If the household is not sure if their children have been directly certified, the household should contact the school Other Source Categorical Eligibility: When known to the School Food Authority, households will be notified of any child’s eligibility for free meals based on the individual child’s designation as Other Source Categorically Eligible, as defined by law. Children are determined Other Source Categorically Eligible if they are Homeless, Migrant, Runaway, a foster child, or Enrolled in Head Start or an eligible pre-kindergarten program.
Foster children that are under the legal responsibility of a foster care agency or court, are eligible for free meals. Any foster child in the household is eligible for free meals regardless of income. A separate application for a foster child is no longer necessary. Foster children may also be included as a member of the foster family if the foster family chooses to also apply for benefits for other children. Including children in foster care as household members may help other children in the household qualify for benefits. If non-foster children in a foster family are not eligible for free or reduced price meal benefits, an eligible foster child will still receive free benefits If children or households receive benefits under Assistance Programs or Other Source Categorically Eligible Programs and are not listed on the notice of eligibility and are not notified by the School Food Authority of their free meal benefits, the parent or guardian should contact the school or should submit an income application.
Other Households: Households with income the same or below the amounts listed above for family size may be eligible for and are urged to apply for free and/or reduced price meals. They may do so by completing the Application for Free and Reduced Price School Meals sent home with the letter to parents.
One application for all children in the household should be submitted. Additional copies are available at the principal’s office in each school. Applications may be submitted any time during the school year to the Smithtown CSD Child Nutrition Director. Please contact the Child Nutrition Director at 631-382-5500 with any questions regarding the application process.
Households notified of their children’s eligibility must contact the School Food Authority if they choose to decline the free meal benefits. Households may apply for benefits at any time throughout the school year. Children of parents or guardians who become unemployed or experience a financial hardship mid-year may become eligible for free and reduced price meals at any point during the school year. Children in households receiving Women, Infants and Children (WIC) benefits may be eligible for free or reduced price meals through the application process.
For up to 30 operating days into the new school year (or until a new eligibility determination is made, whichever comes first) an individual child’s free or reduced price eligibility status from the previous year will continue within the same School Food Authority. When the carryover period ends, unless the household is notified that their children are directly certified or the household submits an application that is approved, the children’s meals must be claimed at the paid rate.
Though encouraged to do so, the School Food Authority is not required to send a reminder or a notice of expired eligibility. The information provided on the application will be confidential and will be used for determining eligibility. The names and eligibility status of participants may also be used for the allocation of funds to federal education programs such as Title I and National Assessment
of Educational Progress (NAEP), State health or State education programs, provided the State agency or local education agency administers the programs, and for federal, State or local meanstested nutrition programs with eligibility standards comparable to the NSLP. Eligibility information may also be released to programs authorized under the National School Lunch Act (NSLA) or the Child Nutrition Act (CNA). The release of information to any program or entity not specifically authorized by the NSLA will require a written consent statement from the parent or guardian.

PROCLAMATION OF A LOCAL STATE OF EMERGENCY UNDER SECTION 24 OF ARTICLE 2-B OF THE EXECUTIVE LAW
A State of Emergency is hereby proclaimed in Suffolk County, New York for a period of time beginning at 5:00 p.m. on July 26, 2024 and continuing in effect for a period not to exceed thirty (30) days as required by Section 24 of the New York State Executive Law.
This State of Emergency has been declared as a result of the expiration on May 11, 2023 of 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”), which prohibited the migration into the United States by “covered noncitizens” traveling from Canada or Mexico, resulting in a surge of migration into the United States and into New York State. As a consequence of such, some states have dispersed and delivered asylum seekers to various states throughout the country and, subsequently some municipalities have dispersed and delivered asylum seekers to various counties within New York State. Accordingly, the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
As the Executive of Suffolk County, I, Edward P. Romaine exercise the authority given me under Section 24 of the New York State Executive Law, to preserve the public safety and hereby render all required and available assistance vital to the well-being and health of Suffolk County.
I hereby direct all departments and agencies of Suffolk County to take whatever steps necessary to provide emergency assistance as deemed appropriate.

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers
I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency issued on January 5, 2024, February 4, 2024, March 5, 2024, April 4, 2024, May 3, 2024, May 31, 2024, June 28, 2024 and July 26, 2024 do hereby find and order as follows:
Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and
Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and
Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:
A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.
B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.
C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.
D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189;
Article IV sections A 4-13 and 14; Article V section A5-1; Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.
E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.
F. Remedies Not Exclusive.
a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.
b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.
c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.
d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.
G. Effective Date
This Executive Order shall take effect immediately.
And I further order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary; and further order that
