Resolution of Adoption Granting the Application of Five Star Car Wash of Selden for a Change of Zone from J Business 2 to J Business 5, Town Board Special Permit for Motor Vehicle Wash and Waivers of Special Permit Criteria on Property Located on Middle Country Road (New York State Route 25) in Selden, New York
WHEREAS, on October 17, 2024, a duly advertised public hearing was held to consider the application of Five Star Car Wash of Selden for a change of zone from J Business 2 to J Business 5, Town Board special permit for motor vehicle wash and waivers of special permit criteria on property located on the north side of Middle Country Road (New York State Route 25), west of Boyle Road, in Selden, New York, further identified by Suffolk County Tax Map Number 0200-489.00-02.00-036.001; and WHEREAS, after due consideration and deliberation; NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Brookhaven that the above application for a change of zone from J Business 2 to J Business 5 is hereby approved; and be it further RESOLVED, that the Town Board special permit for motor vehicle wash is hereby approved; and be it further RESOLVED that the following waivers from Town Board special permit criteria are hereby approved: 1. Brookhaven Town Code Section 85-467. Special permit criteria. (K) Motor vehicle wash (1) Decorative walls or fencing shall be provided along all setback lines; decorative opaque walls and/or fencing shall be provided along all site property lines which are contiguous with residentially developed and/or zoned properties; other types of fencing may be permitted elsewhere on site subject to Planning Board approval: 50 foot setback required in front yard; 40 foot setback required in rear yard; minimum 15 foot setback and 13 foot setback approved in the front and rear yards, respectively. (5) Minimum setbacks for all structures and outdoor facilities and/or areas of operations, including but not limited to paved driveways, dumpster enclosure(s), etc., shall be 50 feet from all contiguous residentially developed and/or residentially zoned properties: 50 foot setback required; variable minimum of 6.7 foot to 25 foot setback approved. (7) Vacuums shall be subject to 100 foot setback from residential uses or residentially zoned parcels; vacuums shall be adequately screened by vegetative planting(s) and/or fencing from all residentially zoned and/or developed properties: 100 foot setback required; 55.59 foot setback approved. Conditions 1. The applicant must submit proof to the satisfaction of the Town Attorney’s Office that the covenants and restrictions, approved as to form and substance, referenced below have been filed with the Suffolk County Clerk’s Office. 2. Pursuant to Town Code Section 85-82, the required land use intensification mitigation fee in the amount of $14,467.50 shall be submitted prior to the zoning being made effective. The check shall be made payable to the Joseph Macchia Environmental Preservation Capital Reserve Fund. 3. The applicant/owner shall comply with all noise control and lighting requirements as set forth in Chapters 50 and 85 of the Brookhaven Town Code.

PLEASE TAKE NOTICE that the Town of Islip on behalf of the Long Island MacArthur Airport (“Town”), will receive sealed bids for the project titled, “Construct Runway 6 Hold Bay on Taxiway G” at the Office of Purchasing, 401 Main Street, Room 227, Islip, New York (Use front entrance – second floor at the top of stairs) or may be dropped off in the container located in the front vestibule of the main entrance, no later than 11:00 a.m., local time on Thursday, July 24, 2025 at which time they will be publicly opened and read.

Bid documents and specifications may be examined and obtained, beginning Thursday, July 3, 2025, from the Airport Administration Office located at the Terminal Building, 100 Arrival Avenue, Suite 100, Long Island MacArthur Airport, Ronkonkoma, New York 11779, from Monday to Friday 8:30 a.m. to 4:30 p.m., A NONREFUNDABLE fee of one-hundred fifty ($150) dollars for each complete set obtained is required. The fee shall be in the form of a cashier’s or certified check made payable to the Town of Islip. No other forms of payment will be accepted.
No bid will be accepted by email or facsimile.
Each bid must be accompanied by a Cashier’s Check, Certified Check, or Bid Bond payable to the Town of Islip, in an amount equal to ten percent (10%) of the Total Bid Price. The successful bidder is
required to furnish satisfactory Payment and Performance Bonds for the full amount of the Contract.
The Town may make such investigations as deemed necessary to determine the ability of the bidder to perform the work.

Local Emergency Order:
Suspending local procurement and contracting laws, rules and regulations
I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with (3) Proclamation of a State of Emergency last issued on January 10, 2025, February 7, 2025, March 7, 2025, April 4, 2025, and May 2, 2025, May 30, 2025, and June 27, 2025 for a storm occurring on or about August 19, 2024, pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:
Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:
Suffolk County Code:
• Chapters 1065 and 189
• Article IV sections A 4-13 and 14
Article V sections A5-1
• Charter section C5-2 (C) and (L)
Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance
• all related procurement laws, rules, and regulations required to comply with this Order; and further
Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further
Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).
