DESCRIPTION: This contract requires that the contractor furnish and install various species of deciduous, evergreen and ornament trees throughout the Town of Islip. The focus of the contract will be on the placement of deciduous street trees for the improvement to the aesthetics of the Town’s roadway. The contract may also be used to make improvements to Town Facilities as needed.
The pre-bid meeting is scheduled for Tuesday, June 3, 2025 AT 10:00 A.M. All prospective bidders and/or subcontractors should assemble at the TOWN BOARD MEETING ROOM LOCATED AT THE ISLIP TOWN HALL, 655 MAIN ST., ISLIP, NY 11751.

WHEREAS, the Town of Islip Department of Aviation and Transportation recommends entering into a new Airline Use and Lease Agreement with Avelo Airlines Inc., for a period of one (1) year with four (4) additional one (1) year renewnal options for fees that are consistent and set by the Airport’s Signatory Rates with annual rent increases for rates and charges; and

WHEREAS, the Town of Islip Department of Aviation and Transportation recommends entering into a new Airline Use and Lease Agreement with Avelo Airlines Inc., for a period of one (1) year with four (4) additional one (1) year renewnal options for fees that are consistent and set by the Airport’s Signatory Rates with annual rent increases for rates and charges; and
WHEREAS, the Town of Islip held a public hearing on May 13, 2025 at 2:00 p.m. (EST) to hear comments of all persons to be heard relating to the Avelo Airlines Inc. Airline Use and Lease Agreement;

RESOLVED, that the Supervisor is hereby authorized to execute an Airline Use and Lease Agreement with Avelo Airlines Inc., the form and content of which shall be subject to the review of the Town Attorney for a period of one (1) year with four (4) additional one (1) year renewal options for fees that are consistent and set by the Airport’s Signatory Rates with annual rent increases for rates and charges.

DEED COVENANTS AND RESTRICTIONS
ADMINISTRATIVE
1. Action:
a. A Modification of Deed Covenants and Restrictions associated with T.C. #4772 dated July 24, 2007 and recorded in the Office of the Suffolk County Clerk on November 1, 2007 in Liber 12528 Page 729 shall be granted as part of this application. The property may be used as a motor vehicle dealership. Any change of use to other uses permitted in the Business 3 District shall require the review and approval of the Planning Board after a public hearing OR shall be limited to uses permitted in the Business 1 District. In addition, the following uses shall be expressly prohibited on the subject parcel:
i. Bar, tavern or nightclub
ii. Psychiatric clinic
iii. Billiard Hall
iv. Adult Use
v. Transfer Station
vi. Vape shop or lounge
b. A Town Board Special Permit for a motor vehicle dealership and a waiver of the minimum required 160,000 square feet of plot area is granted as part of this application. The dealership shall be limited to the sales of boats and marine vessels. The sales of automobiles, trucks, trailers or construction equipment shall be expressly prohibited. Boat
repair shall be limited to minor warranty repairs/ recalls. Body work, engine overhaul, refitting and painting shall be expressly prohibited. Running of outboard motors shall occur within a tank to mitigate onsite noise.
c. A Town Board Special Permit for the commercial storage of boats is granted as part of this application. At no time shall any boats or trailers or other vehicles of the applicant be placed in such a position as to obstruct the free ingress and egress of trailers and other vehicles. The storage, parking or staging of boats and/or trailers on any street shall be expressly prohibited.
d. Except as expressly amended herein, the change of zone of the subject parcel from Business 2 District and Residence AAA District to Business 3 District, effective February 24, 2008, by Town Board Resolution T.C. #4772, shall continue to be in full force and effect. All deed covenants and restrictions associated with T.C. #4772 and all prior Town Board imposed deed covenants shall be deemed null and void and shall be replaced with these.
OPERATIONAL RESTRICTIONS
2. Hours of Operation:
The hours of operation for the subject property shall be limited from 8am to 7pm. Any dumpster access, deliveries, garbage pick-up, and/or boat motor testing shall not occur between the hours of 8am and 8pm daily. Exterior public address systems, loudspeakers, or sound amplification devices of any kind shall be prohibited. If excessive noise and activity occurs that is incompatible with the surrounding properties, then Planning Board reserves the right to hold a public hearing to revisit this special permit in order to further limit the hours of operation of the uses of the property. The Planning Board shall be solely responsible for determinations regarding this requirement.
3. Loitering:
Loitering shall be prohibited on the subject parcel. If substantiated complaints regarding loitering and/ or criminal activity at the site are received by the Town of Islip, the Commissioner of the Town of Islip Planning Department shall notify the property owner by certified mail to take appropriate security measures to deter loitering and/or criminal activity at the site. If the property owner fails to take appropriate security measures within fifteen (15) days of the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional reasonable security conditions at the site including, but not limited to: the installation of fencing, lighting, security cameras, and/or the hiring of a private security company to monitor the site. The Planning Board reserves sole responsibility of determining if the Declarant/Owner is in compliance with this requirement.
4. Property Maintenance:
Declarant/Owner further agrees to permanently maintain all improvements and landscaping to the reasonable satisfaction of the Planning Board. The Town or its designee reserves the right to enter onto the subject property after 30 days’ written notice sent certified mail, return receipt requested, to the address of the current owner according to Town of Islip assessment rolls, to remove litter, debris or maintain or replace any fencing or plantings if found that the improvements are not being maintained and shall bill the owner for any expense incurred. All costs associated with same shall be assessed to the owner’s next tax bill.
ARCHITECTURAL ELEVATION
REVIEW & SIGNAGE
5. Architectural Elevation Review:
Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. The submitted architectural drawings shall be in substantial conformance to the plan(s) prepared by Graham Associates, and which is dated October 10, 2024. Said plans shall show all sides of the structure and shall also show the following design elements:
a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.
b. Use of EIFS and concrete block shall be limited to accent bands and shall not comprise more than 10% of the building’s façade.
c. Siding shall be consistent with residential design and materials.
d. The building(s) shall be insulated for noise mitigation.
The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.
6. Signs:
Declarant/Owner shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated facial signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box signs shall be expressly prohibited. Freestanding signs shall be a monument style, unlit or indirectly lit only, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Applicant/owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.
SITE PLAN REQUIREMENTS & MODIFICATIONS
7. Site Plan:
Prior to filing a building permit application, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The submitted plan shall be in substantial conformance to the plan(s) prepared by Graham Associates, and which is dated November 13, 2024. Said plan shall also show the following elements:
a. The height of the proposed butler building shall be limited to 24’. Any overhead facing doors shall be oriented towards the north.
b. A minimum of 11 parking stalls shall be provided on-site. Additional parking beyond these 11 stalls shall be designated as landbanked parking on the approved site plan, and shall not be constructed without the review and approval of the Planning Board
c. Each designated area of outdoor display shows type and access. At no time shall any boats be placed in such a position as to obstruct the free ingress and egress of vehicles or access to boat inventory. All boats shall be set back a minimum of 12’ from the Sunrise Highway property line and a minimum of 15’ from the southern property line. The outdoor storage area shall be paved consisting of asphalt, recycled concrete aggregate, or gravel at the direction of the Town Engineer. Areas dedicated for parking shall consist of asphalt.
d. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative or split-faced concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. Garbage cans for customers shall be provided inside as well as outside of the proposed building(s) and shall be emptied on a regular basis. Garbage can lids shall be of sufficient design with either drive-through funnel lids or chutes so as to prohibit the dispersion of litter, garbage, or debris by wind, birds, vermin, etc. from said trash receptacles. Multiple tenants within the building shall be required to use a common dumpster and shall not cause additional, multiple dumpsters to be located on the subject property that are not enclosed in an approved location and as described above. A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area on a daily basis. The subject site shall be maintained in a neat, clean, and litter free condition.
e. All stormwater drainage shall be contained onsite in accordance with the current SLDR. In addition, Declarant/Owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques:
i. Natural retention area(s) such as vegetated swales and bioretention cells/rain gardens.
ii. Permeable/porous pavement surfaces.
iii. Manufactured treatment devices, i.e. catch basin inserts designed to filter hydrocarbons
and other pollutants from stormwater runoff.
f. A single bike rack (“Inverted U” or “Post and Loop” in design) shall be installed near the entrance to the building.
g. Fire Apparatus Access shall be designed and installed to the satisfaction of the Division of Fire Prevention.
h. All onsite lighting shall be in conformance with Article LII of Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.
Declarant/Owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the Declarant/Owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone.
8. Parking:
Parking shall be maintained onsite. Parking on Island Boulevard and Walnut Avenue shall be expressly prohibited. If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems. If owner fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan Modification conditions including, but not limited to:
a. Install parking stalls in place of outdoor storage areas. The Declarant agrees to install additional parking as may be deemed necessary at any time in the future pursuant to the direction of the Planning Board. Additional parking shall be installed at the sole cost of the Declarant within thirty (30) days’
notice.
b. require all leases on property to stipulate that employees park in remote areas. lease unused offsite parking spaces and/or a cross-access agreement. c. modify hours of operation of the Special Permit use to reduce peak parking demands. Such conditions must relate to parking use and shall not be unreasonably imposed. The owner shall be given the opportunity to effect the above items or prepare and implement- a spillover parking plan for peak parking periods acceptable to the Commissioner of Planning & Development prior to having a public hearing before the Planning Board. The Planning Board shall be solely responsible for determinations regarding parking adequacy. No parking space shall be exclusive for any use or purpose except those designated as handicapped spaces.
9. Landscaping:
A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Chain link fencing shall be prohibited within the front yards. Said plan shall indicate the maintenance or installation of native plant species to the greatest extent possible. Said landscaping shall be designed to the reasonable satisfaction of the Planning Board, or its designee and shall include the following plantings/design elements:
a. A minimum 4’ high decorative fence shall be constructed along Sunrise Highway and additional, low-lying plantings shall exist south of said fence.
b. Street trees shall be installed and maintained 25’ on center along all road frontages. Spacing may be increased in consideration of the species selection after consultation with the Planning Department. Declarant/Owner shall replace any diseased or dead trees
c. A minimum of 20% of the total site area shall be maintained as landscaping.
d. Existing vegetation shall be maintained in landscaped and buffer areas to the maximum extent practicable. Declarant/Owner shall make every effort to preserve the existing mature trees on the subject property. Clearing limit lines shall be staked out by a licensed land surveyor, and either snow fencing or construction fencing shall be erected to protect areas from disturbance or encroachment prior to the start of any activities on site. A tree survey indicating all trees above ten inches (10”) in diameter shall be shown for all cleared areas and areas not designated as natural or undisturbed buffer areas.
e. A vegetative buffer shall be provided adjacent

to any residential use or zone. Existing significant trees and tall evergreen shrubs shall remain and infill planting shall occur at the direction of the Planning Department. Declarant/ Owner agrees not to clear, or disturb in any way, all areas of the property that are designated as landscaped or buffer areas without the permission of the Planning Department. Supplemental planting may be done in these areas at the direction and to the reasonable satisfaction of the Planning Board. The following areas shall be maintained as landscaped buffer areas:
i. Southern property line: 10’ in width and approximately 10’ in width within the right-ofway south of the existing fence.
f. All landscaped areas shall be maintained with permanent in-ground irrigation systems.
All plantings shall be maintained to the reasonable satisfaction of the Planning Board and all plant material shall be kept in a healthy well-maintained condition. The Planning Board shall be solely responsible for the determination regarding adequate maintenance. The Declarant/Owner shall be solely responsible for the cost of the maintenance. In the event Declarant/Owner fails to maintain the landscaping as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the Declarant/ Owner’s next tax bill. The Planning Board may modify any landscaping requirements referenced in this covenant in accordance with the Subdivision & Land Development Regulations.
The above-mentioned covenants and restrictions shall be and constitute real covenants running with the land and shall be binding upon the Declarant and any and all subsequent owners of the said real property or any part thereof, and upon their heirs, executors, and administrators (or their successors and assignees) subject, however, to the right of the Town of Islip after a public hearing to amend, alter, annul or repeal any or all of the foregoing covenants and /or restrictions at any time with the consent of the owner or owners for the time being of the premises herein described, and such right shall be effectual and may be exercised without the consent of any adjacent owners or other owners or lienors of any other property.

ADMINISTRATIVE
1. Action:
a. A Change of Zone from Industrial 1 District to Industrial 2 District is granted as part of this application. Any change to the type or location of outdoor storage shall require the review and approval of the Planning Board after a public hearing. Any change of use shall be limited to uses permitted in the Industrial Transition district.In addition, the following uses shall be expressly prohibited on the subject parcel:
i. Bar, tavern or nightclub
ii. Psychiatric clinic
iii. Billiard Hall
iv. Adult Use
v. Vape shop or lounge
vi. Package distribution center
vii. Any special exception from the Zoning Board of
Appeals listed in §68-357.
b. A Planning Board Special Permit for a transfer station is granted as part of this application. Declarant/Owner agrees to upgrade the existing odor control system pursuant to the proposal prepared by Aire actor Odor Control dated October 20, 2023 and install zip doors on the existing building pursuant to the proposal prepared by United Steel Products dated October 20, 2023 prior to the issuance of a Certificate of Occupancy. The following special permit requirements are waived pursuant to 68-35:
i. Twenty feet of landscaping along Essex Street may be reduced down to approximately 14.8 feet.
ii. The height of the existing building may be increased from 30’ feet to 34.2 feet.
iii. The fencing around the landscaping may be reduced in height from 8’ in 6’.
c. A Modification of Deed Covenants and Restrictions associated with T.C. #4468, recorded in the Office of the Suffolk County Clerk on December 17, 1998 in Liber 11934 at Page 674, shall be granted as part of this application. All deed covenants and restrictions associated with T.C. #4468 and all prior Town Board imposed deed covenants shall be deemed null and void and shall be replaced with these.
2. Construction Trailer:
Prior to the issuance of any construction permits (or demolition permits, at the discretion of the Building Division or Town Engineer), Declarant/Owner shall obtain a permit for an on-site construction trailer which shall remain on the property for the life of the permit(s). Said trailer shall contain a copy of the approved site plan and approved construction plans and be accessible to all Town personnel and contractors for review of plans and meetings. Should the Declarant/Owner wish to remove said trailer before the issuance of a Certificate of Occupancy, written permission must be obtained for its removal from the Building Division of the Town of Islip.
OPERATIONAL RESTRICTIONS
3. Hours of Operation:
The hours of operation for the subject property shall be limited from 5am to 7pm Monday through Friday and 5am to 3pm on Saturday, except in the event of emergency which requires use of equipment from that location.
4. Loitering:
Loitering shall be prohibited on the subject parcel. If substantiated complaints regarding loitering and/ or criminal activity at the site are received by the Town of Islip, the Commissioner of the Town of Islip Planning Department shall notify the property owner by certified mail to take appropriate security measures to deter loitering and/or criminal activity at the site. If the property owner fails to take appropriate security measures within fifteen (15) days of the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional reasonable security conditions at the site including, but not limited to: the installation of fencing, lighting, security cameras, and/or the hiring of a private security company to monitor the site. The Planning Board reserves sole responsibility of determining if the Declarant/Owner is in compliance with this requirement.
5. Property Maintenance:
Declarant/Owner further agrees to permanently maintain all improvements and landscaping to the reasonable satisfaction of the Planning Board. The Town or its designee reserves the right to enter onto the subject property after 30 days’ written notice sent certified mail, return receipt requested, to the address of the current owner according to Town of Islip assessment rolls, to remove litter, debris or maintain or replace any fencing or plantings if found that the improvements are not being maintained and shall bill the owner for any expense incurred. All costs associated with same shall be assessed to the owner’s next tax bill.

REVIEW & SIGNAGE
6. Architectural Elevation Review:
Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. Said plans shall show all sides of the structure and shall also show the following design elements:
a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes. The approved detailed architectural elevations
shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.
7. Signs:
Declarant/Owner shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated facial signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box signs shall be expressly prohibited. Freestanding signs shall be a monument style, unlit or indirectly lit only, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Applicant/owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.
SITE PLAN REQUIREMENTS & MODIFICATIONS
8. Site Plan:
Prior to filing a building permit application, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage.
The submitted plan shall be in substantial conformance to the plan(s) prepared by North coast Civil and which is dated October 10, 2023. Said plan shall also show the following elements:
a. Each designated area of outdoor storage showing type, square footage, height and access and shall be contained with fencing. Areas dedicated for parking shall consist of asphalt.
b. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative or split faced concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. Multiple tenants within the building shall be required to use a common dumpster and shall not cause additional, multiple dumpsters to be located on the subject property that are not enclosed in an approved location as described above. A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area on a daily basis. The subject site shall be maintained in a neat, clean, and litter free condition.
c. All stormwater drainage shall be contained on-site in accordance with the current SLDR. In addition, Declarant/Owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques:
i. Natural retention area(s) such as vegetated swales and bioretention cells/rain gardens.
ii. Permeable/porous pavement surfaces.
iii.Manufactured treatment devices, i.e. catch basin inserts designed to filter hydrocarbons and other pollutants from stormwater runoff.
d. Fire Apparatus Access shall be designed and installed to the satisfaction of the Division of Fire Prevention.
e. All onsite lighting shall be in conformance with Article LII of Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.
Declarant/Owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements
referenced in this covenant with the consent of the Declarant/Owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone.
9. Parking:
A parking relaxation is granted as part of this application. If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems. If owner fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan Modification conditions including, but not limited to:
a. require all leases on property to stipulate that employees park in remote areas, lease unused offsite parking spaces and/or a cross-access agreement. Such conditions must relate to parking use and shall not be unreasonably imposed. The owners hall be given the opportunity to effect the above items or prepare and implement a spillover parking plan for peak parking periods acceptable to the Commissioner of Planning & Development prior to having a public hearing before the Planning Board. The Planning Board shall be solely responsible for determinations regarding parking adequacy. No parking space shall be exclusive for any use or purpose except those designated as handicapped spaces, drive-up service or electric vehicle charging.

10. Landscaping:
A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Said plan shall be prepared by a licensed landscape architect and shall indicate the maintenance or installation of native plant species to the greatest extent possible. Said landscaping shall be designed to the reasonable satisfaction of the Planning Board, or its designee and shall include the following plantings/design elements:
a. Street trees shall be installed and maintained 25’ on center along all road frontages. Spacing may be adjusted in consideration of the species selection after consultation with the Planning Department. Declarant/Owner shall replace any diseased or dead trees.
b. Existing vegetation shall be maintained in landscaped and buffer areas to the maximum extent practicable. Declarant/Owner shall make every effort to preserve the existing mature trees on the subject property. may be increased in consideration of the species Clearing limit lines shall be staked out by a licensed land surveyor, and either snow fencing or construction fencing shall be erected to protect areas from disturbance or encroachment prior to the start of any activities on site. A tree survey indicating all trees above ten inches (10”) in diameter shall be shown for all cleared areas and areas not designated as natural or undisturbed buffer areas.
c. Loading areas and outdoor storage shall be screened from view with appropriate buffer plantings at the direction of the Planning Department.
d. All landscaped areas shall be maintained with permanent in-ground irrigation systems.

TO THE ABOVE-NAMED DEFENDANTS:
YOU ARE HEREBY SUMMONED to answer the Complaint in this action, and to serve a copy of your Answer, or, if the Complaint is not served with this Summons, to serve a Notice of Appearance on the Plaintiff’s Attorneys within twenty (20) days after service of this Summons, exclusive of the day of service, where service is made by delivery upon you personally within the State, or within thirty (30) days after completion of service where service is made in any other manner, and in case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the complaint.
TO THE ABOVE NAMED DEFENDANTS: The foregoing Summons is served upon you by publication pursuant to an Order of the Hon. C. Stephen Hackeling, a Justice of the Supreme Court, Suffolk County, entered April 30, 2025 and filed with the complaint and other papers in the Suffolk County Clerk’s Offiice.
THE OBJECT OF THE ACTION is to foreclose a mortgage recorded int eh Suffolk County Clerk’s Office on September 12, 2014 in Liber 22524, Page 494, covering premises k/a 8 Mark Lane, Nesconset, NY 11767 a/k/a District 0800, Section 167.00, Block 05.00, Lot 010.006.
NOTICE YOU ARE IN DANGER OF LOSING YOUR HOME
If you do not respond to this summons and complaint by serving a copy of the answer on the attorney for the mortgage company who filed this foreclosure proceeding against you and filing the answer with the court, a default judgment may be entered and you can lose your home.
Speak to an attorney or go to the court where your case is pending for further information on how to answer the summons and protect your property.
Sending a payment to your mortgage company will not stop this foreclosure action.
