PROCLAMATION OF A LOCAL STATE OF EMERGENCY UNDER SECTION 24 OF ARTICLE 2-B OF THE EXECUTIVE LAW

A State of Emergency is hereby proclaimed in Suffolk County, New York for a period of time beginning at 5:00 p.m. on September 19, 2025 and continuing in effect for a period not to exceed thirty (30) days as required by Section 24 of the New York State Executive Law.

This State of Emergency has been declared as a result of the expiration on May 11, 2023 of 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”), which prohibited the migration into the United States by “covered noncitizens” traveling from Canada or Mexico, resulting in a surge of migration into the United States and into New York State. As a consequence of such, some states have dispersed and delivered asylum seekers to various states throughout the country and, subsequently some municipalities have dispersed and delivered asylum seekers to various counties within New York State. Accordingly, the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

As the Executive of Suffolk County, I, Edward P. Romaine exercise the authority given me under Section 24 of the New York State Executive Law, to preserve the public safety and hereby render all required and available assistance vital to the well-being and health of Suffolk County.

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;

Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

DEED COVENANTS AND RESTRICTIONS

ADMINISTRATIVE

1. Action:

a. A change of zone to designate a Planned Landmark District overlay is granted as part of this application. The property may be utilized for those uses associated with an educational campus including, but not limited to, boarding school, student and faculty housing, classrooms, administrative offices, athletic facilities, dining hall, library, research center and any other such uses as may be commonly associated with, or clearly accessory, to, an educational campus. In addition, thereto, private catering events shall be permitted. Nothing herein shall affect the validity of ZBA Special Exception 173-99. Any change of use not authorized herein nor in the Residence AAA District shall require the review and approval of the Town Board after a public hearing. Any use exclusive to the Business 3 district and/or any Industrial zoning district is expressly prohibited in addition to the following:

i. Bar, tavern or nightclub

ii. Psychiatric clinic

iii. Billiard Hall

While the proposed structures depicted on the Conceptual Campus Master Plan dated June 12, 2025, and

prepared by Perkins Eastman (the “Conceptual Campus Master Plan”) are approved, any additional proposed structure/exterior renovation not explicitly listed is this section shall require a certificate of appropriateness from the Planning Board prior to the issuance of any corresponding building permit. Notwithstanding any Town Code provision to the contrary, Applicant may undertake routine maintenance, emergency repairs, and landscape work to operate the property and maintain business operations.

d. A modification of deed covenants and restrictions associated with TC #5076 shall be granted as part of this application. All deed covenants and restrictions associated with TC #5076, dated May 7, 2012 and recorded in the Office of the Suffolk County Clerk on June 20, 2012, in Liber D00012696 Page 910, and all prior Town Board imposed deed covenants shall be deemed null and void and shall be replaced with these.

2. Field Office/Construction Trailer:

Applicant shall either designate a field office within an existing campus building or obtain a permit for an on-site construction trailer which shall remain on the property for the life of the permit. Said field office or trailer shall contain a copy of the approved site plan and approved construction plans and be accessible to all Town personnel and contractors for review of plans and meetings. Should the applicant wish to close said field office or remove said trailer before the issuance of a Certificate of Occupancy, written permission must be obtained for its removal by the Building Division.

3. Student Enrollment:

Applicant shall limit student enrollment to a maximum of 435 students and shall provide a minimum of 348 student beds in accordance with the proposed phasing plan. Any proposal to increase student enrollment beyond 435 students and/or decrease the number of student beds shall require review and approval by the Planning Board to assess whether additional offsite traffic mitigation or site-related conditions are warranted. The Planning Board shall have discretion to determine, based on the nature and scope of the proposed increase and any supporting documentation submitted by the applicant, whether a public hearing is required prior to approval.

4. Catering Events:

Catered events may be held within The Bourne Mansion and The Boathouse. Said events shall be further limited by the following:

a. The service of alcohol shall be clearly accessory to food service use. Under no circumstances shall the use of a bar, tavern or nightclub as defined in the Town of Islip Town Code be permitted.

b. Hours of operation for catered events shall be limited to the hours between 7 AM and 2 AM.

c. Use of outdoor areas adjacent to the Bourne Mansion and the Boathouse shall be permitted, however use of outdoor areas shall be limited to the hours between 7 AM and 12AM. The Planning Board reserves the right after due public hearing to modify these hours and/or require sound attenuation measures if substantiated complaints are received.

5. Loitering:

Loitering shall be prohibited on the subject parcel. If substantiated complaints regarding loitering and/ or criminal activity at the site are received by the Town of Islip, the Commissioner of the Town of Islip Planning Department shall notify the property owner by certified mail to take appropriate security measures to deter loitering and/or criminal activity at the site.

If the property owner fails to take appropriate security measures within fifteen (15) days of the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional reasonable security conditions at the site including, but not limited to: the installation of fencing, lighting, security cameras, and/or the hiring of a private security company to monitor the site. The Planning Board reserves sole responsibility of determining if the Declarant/Owner is in compliance with this requirement.

6. Property Maintenance:

All buildings shall be kept in good repair, including all exterior portions and all interior portions thereof which, if not so maintained, may cause or tend to cause the exterior portions of such improvement to deteriorate, decay or become damaged or otherwise to fall into a state of disrepair. Declarant/Owner further agrees to permanently maintain all improvements and landscaping to the reasonable satisfaction of the Planning Board. The Town or its designee reserves the right to enter onto the subject property after 30 days’ written notice sent certified mail, return

receipt requested, to the address of the current owner according to Town of Islip assessment rolls, to remove litter, debris or maintain or replace any fencing or plantings if found that the improvements are not being maintained and shall bill the owner for any expense incurred. All costs associated with same shall be assessed to the owner’s next tax bill.

7. Solid Waste:

Applicant/owner shall provide regular solid waste collection services to residents of the student and faculty housing in addition to the educational facilities. Said collection services shall include separation of solid waste into recyclable components, including but not limited to newspapers, corrugated cardboard, ferrous metal, aluminum beverage containers, plastic beverage containers and glass. As part of this requirement, declarant/owner shall provide designated containers for recyclable materials. Said containers shall be regulated in the same manner as garbage dumpsters, including regular servicing and enclosure within a decorative or split faced concrete block enclosure with opaque gates. In no event shall the proposed centralized garbage collection area be considered a transfer station.

ARCHITECTURAL ELEVATION

REVIEW & SIGNAGE

8. Architectural Elevation Review:

The elevations of the proposed student housing prepared by Perkins Eastman, dated June 12, 2025, are hereby approved. Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. Said plans shall show all sides of the structure and shall also show the following design elements:

a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.

b. Use of vinyl shall be limited to railings, columns and windows and shall not comprise more than 10% of the building’s façade. The use of EIFS and concrete block shall be expressly prohibited. The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.

9. Signs:

Applicant shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated facial signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box signs shall be expressly prohibited. Freestanding signs shall be a monument style, unlit or indirectly lit only, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Declarant/owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.

SITE PLAN REQUIREMENTS & MODIFICATIONS

10. Site Plan:

The Conceptual Campus Master Plan is hereby approved. Prior to filing a building permit application, an approved site plan for each phase of construction is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to: building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The submitted plan shall be in substantial conformance to the Civil Master Site Plan, dated June 12, 2025, prepared by Perkins Eastman (“Civil Master Site Plan”). Said plan shall also show the following design elements:

a. A minimum of 406 parking stalls shall be provided on-site. Additional parking beyond these 406 stalls shall be designated as landbanked parking on the approved site plan, and shall not be constructed

without the review and approval of the Planning Board. The construction of parking shall be phased pursuant to the Phasing Plan, dated June 12, 2025 and prepared by Perkins Eastman, submitted in connection with the approved Conceptual Master Campus Plan.

b. The setbacks for any proposed building shall be a minimum of 50’ from Montauk Highway, 1220’ from the southern property line, 80’ from the eastern property line and 150’ from the western property line.

c. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative or split faced concrete block enclosure with opaque gates. Dumpsters shall be emptied on a regular basis to prevent overflow.

A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area on a daily basis. The subject site shall be maintained in a neat, clean, and litter free condition.

d. All stormwater drainage shall be contained onsite in accordance with the current SLDR. In addition, declarant/owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques:

i. Natural retention area(s) such as vegetated swales and bioretention cells/rain gardens.

ii. Permeable/porous pavement surfaces.

iii. Manufactured treatment devices, i.e. catch basin inserts designed to filter hydrocarbons and other pollutants from stormwater runoff.

e. Bike storage shall be made provided in the vicinity of the new student and faculty housing.

f. Two (2) electric vehicle charging stations shall be provided in the parking lot south of Centennial Hall and two (2) electric vehicle charging stations shall be provided in the parking lot servicing the faculty housing.

g. Fire Apparatus Access shall be designed and installed to the satisfaction of the Division of Fire Prevention.

h. All onsite lighting shall be positioned or shielded so as to illuminate only the subject parcel. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.

Applicant/owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the declarant/owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone except those required for Phase I of the Campus Master Plan.

11. Parking:

A parking relaxation is granted as part of this application. If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems. If owner fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan Modification conditions including, but not limited to:

i. Install landbanked parking stalls, if applicable. The Declarant agrees to install additional parking as may be deemed necessary at any time in the future pursuant to the direction of the Commissioner of the Department of Planning and Development. Additional parking shall be installed at the sole cost of the Declarant within thirty (30) days’ notice.

ii. require all leases on property to stipulate that employees park in remote areas. lease unused off-site parking spaces and/or a crossaccess agreement.

Such conditions must relate to parking use and shall not be unreasonably imposed. The owner shall be given the opportunity to affect the above items or prepare and implement a spillover parking plan for peak parking periods acceptable to the Commissioner of Planning & Development prior to having a public hearing before the Planning Board. The Planning Board shall be solely responsible for determinations regarding parking adequacy. No parking space shall be exclusive for any use or purpose except those designated as handicapped spaces, drive-up service or electric vehicle charging.

12. Landscaping:

A landscaping plan shall be submitted indicating in detail the proposed landscaping treatment in accordance with the SLDR. Chain link fencing shall be prohibited within the front yards. Said plan shall be prepared by a licensed landscape architect and shall indicate the maintenance or installation of native plant species to the greatest extent possible. Said landscaping shall be designed to the reasonable satisfaction of the Planning Board, or its designee and shall include the following plantings/design elements:

a. Existing vegetation shall be maintained on all street frontages and in landscaped and buffer areas to the maximum extent practicable. Declarant/owner shall make every effort to preserve the existing mature trees on the subject property.

b. The existing vegetative buffer shall be maintained abutting the proposed faculty housing adjacent to Montauk Highway (CR 85). Within the 40’ wide buffer area,

c. plantings shall be selected based on site conditions and shall create a naturalized area that does not consist of a monoculture. Existing significant trees and tall evergreen shrubs shall remain at the direction of the Planning Department. Declarant/owner agrees not to clear, or disturb in any way, all areas of the property that are designated as landscaped or buffer areas. Supplemental planting may be done in these areas at the direction and to the reasonable satisfaction of the Planning Board.

d. All vegetation within 200’ of Montauk Highway (C.R. 88) and east of the proposed practice field parking lot as depicted on the Civil Master Site Plan and Conceptual Campus Master Plan shall remain natural and undisturbed. No clearing shall occur in this area without Planning Board approval. Nothing contained herein shall prevent the construction of the maintenance/access road, bridge and any sanitary expansion area as required by Suffolk County Department of Health Services, all as depicted on the Civil Master Site Plan. In the event that the clearing is required for maintenance or the expansion of the sanitary system, the Planning Board shall review the clearing plan to minimize clearing and aesthetic impacts.

All plantings shall be maintained to the reasonable satisfaction of the Planning Board and all plant material shall be kept in a healthy well-maintained condition. The Planning Board shall be solely responsible for the determination regarding adequate maintenance. The declarant/owner shall be solely responsible for the cost of the maintenance. In the event declarant/owner fails to maintain the landscaping as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the applicant/owner’s next tax bill. The Planning Board may modify any landscaping requirements referenced in this covenant in accordance with the Subdivision & Land Development Regulations.

The above-mentioned covenants and restrictions shall be and constitute real covenants running with the land and shall be binding upon the Declarant and any and all subsequent owners of the said real property or any part thereof, and upon their heirs, executors, and administrators (or their successors and assignees) subject, however, to the right of the Town of Islip after a public hearing to amend, alter, annul or repeal any or all of the foregoing covenants and /or restrictions at any time with the consent of the owner or owners for the time being of the premises herein described, and such right shall be effectual and may be exercised without the consent of any adjacent owners or other owners or lienors of any other property.

NOTICE OF PUBLIC HEARING KINGS PARK FIRE DISTRICT

WHEREAS, on the 22nd day of September, 2025, pursuant to Section 105 of the Town Law and Section 181 of the Town Law, the Board of Fire Commissioners of the Kings Park Fire District confirmed that the Annual Fire District Budget Hearing will be conducted with reference to the Annual Fire District Budget for the fiscal year 2026 on Tuesday, October 21, 2025 commencing at 7:00 P.M. at the Kings Park Fire District Headquarters, located at 2 East Main Street, Kings Park, NY 11754.

WHEREAS, the Board of Fire Commissioners is required to adopt a proposed budget at least 21 days before October 21, 2025 so that it is available for public inspection prior to the budget hearing.
