NOTICE IS HEREBY GIVEN that the Suffolk County Legislature has passed Introductory Resolution No. 13292025, “A Local Law Amending Chapter 221 of the Suffolk County Code to Require Property Owners to be in Compliance with Local Zoning Code and Local Building Code Requirements in Order to Receive Suffolk County-Funded Rental Payments,” enacting a Local Law amending Chapter 221 of the Suffolk County Code (“the Code”) to require property owners of rental housing accommodations receiving rental payments or other funding from the Suffolk County Department of Social Services (the “Department”) to comply with all local zoning and building codes to remain eligible for said payments. The proposed law also extends the time for local municipalities to respond to notifications from the Department of a public assistance recipient’s intent to move into the municipality to five (5) days, and requires the Department to maintain current records of any issues of noncompliance with local zoning or building codes in buildings in which recipients of public assistance reside.

NOTICE IS HEREBY GIVEN that the Suffolk County Legislature has passed Introductory Resolution No. 15202025, “A Local Law to Create Chapter 26 of the Suffolk County Code: Conservation of Working Waterfronts,” enacting a Local Law Creating Chapter 26 of the Suffolk County Code (“the Code”) to add Chapter 26 to the Suffolk County Code (the “Code”) to create procedures for owners of working waterfront real property which includes or directly abuts coastal waters and supports commercial fisheries, aquaculture, or recreational fishing business to obtain a conservation easement. Under the proposed law, conservation easements will be issued based on the economic significance of the business, the availability of adequate waterfront access alternatives, the utility of the easement to the business with respect to the natural characteristics and developed infrastructure of the property, the likelihood that the working waterfront area will remain compatible with the business, and whether there is partnership with local municipal or nonprofit organizations on the easement. The proposed law also establishes standards for conservation easement applications and modification of conservation easements, and establishes the Working Waterfront Committee. Finally, the proposed law sets forth standards for enforcement of conservation easements, including issuance of a cease and desist order, temporary restraining order, or injunction; issuance of an order to restore working waterfront land if such land has been disrupted; removal of any unauthorized structures; civil penalties ranging from five thousand dollars ($5,000) to ten thousand dollars ($10,000) per day plus costs, disbursements, and fees; and any and all other legal and equitable remedies necessary.

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency last issued on January 10, 2025, February 7, 2025, March 7, 2025, April 4, 2025, May 2, 2025, May 30, 2025, June 27, 2025, July 25, 2025 and August 22, 2025 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1;

Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.

NOTICE IS HEREBY GIVEN that the Suffolk County Legislature has passed Introductory Resolution No. 15422025, “A Local Law Amending Chapter 517 of the Suffolk County Code to Simplify its Application and Further Protect Consumers,” enacting a Local Law amending Chapter 517 of the Suffolk County Code (“the Code”) to require businesses engaged in board-up services to provide a written statement to the consumer explaining that the business is not, and has not been dispatched by, a government service or entity. Said statement must also state it is not mandatory for the consumer to contract with a board-up business, and the statement must be signed by the consumer indicating the consumer has read and understood it. Additionally, the proposed law prohibits any vehicles other than those on official business from following any authorized emergency vehicle in the same or an adjacent lane at a distance closer than two hundred (200) feet if the emergency vehicle is displaying one or more emergency lights. Drivers are also prohibited from driving a vehicle into or parking within a block or within one thousand (1,000) feet of a stopped emergency vehicle responding to a fire alarm. Further, the proposed law requires that board-up businesses which are also licensed as home improvement contractors must pay an additional two hundred dollar ($200) fee if operating as both a board-up business and a licensed home improvement contractor. The proposed law also increases penalties for violators of the Code, including fines ranging from one thousand dollars ($1,000) to five thousand dollars ($5,000) and imprisonment ranging from fifteen (15) days to one (1) year. Finally, the proposed law expands enforcement powers to the Suffolk County Department of Fire, Rescue and Emergency Services, the Suffolk County Attorney, the Suffolk County District Attorney, and any fire marshal or code enforcement officer.

NOTICE IS HEREBY GIVEN that the Suffolk County Legislature has passed Introductory Resolution No. 15432025, “A Local Law to Strengthen Enforcement Against Unscrupulous County Licensed Professionals,” enacting a Local Law amending Chapters 563 and 564 of the Suffolk County Code (“the Code”) to require businesses applying for licensure to include the names of all individual owners, partners, officers, members, and/or directors on any license application, and prohibits issuance of a license where any such owner, partner, officer, member, and/or director has an outstanding judgment for child support, is in arrears for child support, or is listed on the Registry of Unscrupulous CountyLicensed Professionals as set forth in Chapter 564 of the Code. The Smithtown Special Library District will receive separate, sealed bids for a construction contract for the Lower Level Reconstruction & Associated Work Project to the Smithtown Special Library District - Smithtown Building located at One North Country Road, Smithtown, New York 11787. The contract will provide that every laborer and workman employed on or about the work contemplated by the contract shall be paid not less than the rate of wages which are set forth in the prevailing wage rate schedule issued by the New York State Department of Labor.
