PLEASE TAKE NOTICE that SEALED BIDS will be received by the DEPARTMENT OF PURCHASING, TOWN HALL WEST, 401 MAIN STREET, ISLIP, NEW YORK, 11751 ROOM 227, or may be dropped off in the container located in the front vestibule of the main entrance of 401 Main Street, Islip, New York, 11751 until 11:00 a.m., prevailing time on Wednesday, June 18, 2025, following which time they will be publicly opened and read in room 227 located on the second floor of 401 Main Street, Islip, New York, 11751 and the contract awarded as soon thereafter as practicable for 2025-2027 TOWN WIDE STREET TREES, CONTRACT No. DPD 1-25.

DESCRIPTION: This contract requires that the contractor furnish and install various species of deciduous, evergreen and ornament trees throughout the Town of Islip. The focus of the contract will be on the placement of deciduous street trees for the improvement to the aesthetics of the Town’s roadway. The contract may also be used to make improvements to Town Facilities as needed.

The pre-bid meeting is scheduled for Tuesday, June 3, 2025 AT 10:00 A.M. All prospective bidders and/or subcontractors should assemble at the TOWN BOARD MEETING ROOM LOCATED AT THE ISLIP TOWN HALL, 655 MAIN ST., ISLIP, NY 11751.

The Information for Bidders, Form of Bid Bond, Form of Contract, Specifications and Plans may be obtained from Engineering, 655 Main Street, Islip, New York, 11751 between the hours of 9:00 a.m. to 4:30 p.m. Monday - Friday upon payment of Seventy-Five Dollars ($75) for each set. Payment shall be by certified check or money order payable to the Town of Islip. The $75 fee is nonrefundable.

Each bid must be accompanied by a certified check or acceptable bid bond in the amount of not less than ten percent (10%) of the bid and made payable to the Town of Islip.

No bid will be accepted by email or facsimile. No responsibility shall attach to any person or persons for premature opening of bids not properly labeled or sealed.

The Town Board reserves the right to reject any and all bids in whole or in part, to waive any formality and/or informality in any or all bids and to accept the bid or part thereof which it deems most favorable to the Town after all bids have been examined and checked.

No bid shall be withdrawn for a period of forty-five (45) days after being publicly opened and read. In the event bids are rejected or at least two are not received the Department of Purchase is authorized to re-advertise for bids.

Attention of bidders is particularly called to the requirement as to conditions of employment to be observed and the minimum wage rates to be paid for under the contract.

BUDGET HEARING/INSPECTION: A public hearing on the proposed budget of the school district will be held on Tuesday, May 13, 2025, at the Kings Park High School, 200 Route 25A, Kings Park, in said District at 7:30 p.m.

REAL PROPERTY TAX EXEMPTION REPORT

PLEASE TAKE FURTHER NOTICE that a Real Property Tax Exemption Report prepared in accordance with Section 495 of the Real Property Tax Law will be annexed to any tentative/preliminary budget as well as the final adopted budget of which it will form a part, and shall be posted on District bulletin board(s) maintained for public notices, as well as on the district’s website.

NOMINATING PETITIONS: Candidates for the position of member of the Board of Education will be nominated by petition. Each petition must be filed with the Clerk of the District, on or before Monday, April 21, 2025 between the hours of 8:00 a.m. and

4:00 p.m., or on Monday, April 21, 2025 between the hours of 9:00 a.m. and 5:00 p.m. Each petition must be signed by at least Thirtyone (31) qualified voters of the district and must state the name and residence of the candidate.

VOTER REGISTRATION: Registration of voters for school district meetings and elections is conducted on a continuing basis, to wit: on any Monday through Friday during regular business hours at the Office of the District Clerk, and between the hours of 7:00 p.m. and 7:30 p.m. prior to each regular or special meeting of the Board of Education scheduled to take place at 7:30 p.m., at least five (5) days preceding any school district meeting or election, by the District Clerk, or the Assistant District Clerk, or Board of Registry. The register prepared for the Annual Election and Budget Vote of May 21, 2024 shall be used as a basis for the register to be prepared for this Annual Meeting and Election. In addition, all persons who shall have been previously registered for any Annual or Special Meeting or Election held or conducted at any time within four (4) years prior to the preparation of the register shall be included in such register. Upon completion of such registration, registration books will be filed in the Office of the District Clerk located in the San Remo Administration Building and will be available for inspection by any qualified voter of the school district during regular business hours on the five (5) days prior to the day of voting, except on Saturday when they will be available by appointment only. Any person, otherwise qualified to vote, who is registered under the provisions of Article V of the Election Law for general election purposes, will be entitled to vote without further registration.

ABSENTEE BALLOTS: Applications for absentee ballots may be made at the District Clerk’s office. The District Clerk must receive such application at least seven (7) days before the vote, if the ballot is to be mailed to the voter, or by the day before the vote, if the ballot is to be delivered personally to the voter. Applications may not be submitted more than 30 days before the election (not before April 21, 2025). A list of all persons to whom absentee ballots shall have been issued will be available during regular business hours in the District Clerk’s office and will be available at the polling place on the day of the election. In order to be canvassed, an Absentee Ballot must be received in the District Clerk’s office no later than 5:00 p.m. on the day of the vote.

MILITARY VOTERS: Military voters who are not currently registered may apply to register as a qualified voter of the school district. Military voters who are qualified voters of the school district may submit an application for a military ballot. Military voters may designate a preference to receive a military voter registration, military ballot application or military ballot by mail,

facsimile transmission or electronic mail in their request for such registration, ballot application or ballot. Military voter registration forms must be received in the office of the district clerk of the school district no later than 5:00 PM on April 24, 2025. No military ballot will be canvassed unless it is (1) received in the office of the district clerk before the close of the polls on election day and showing a cancellation mark of the United States postal service or a foreign country’s postal service, or showing a dated endorsement of receipt by another agency of the United States government; or (2) received by the office of the district clerk by no later than 5:00 p.m. on election day and signed and dated by the military voter and one witness thereto, with a date which is associated to be not later than the day before the election.

POLL WATCHING: The following regulations will be in effect regarding poll watching:

Poll watchers shall be required to identify themselves to the District Clerk no less than seventy-two (72) hours prior to the election at which time they will be provided with an identification tag indicating “Poll Watcher”. Such previously identified poll watchers shall sign in with the District Clerk or her designee upon arrival at the polling place. One (1) poll watcher will be permitted per candidate at any given time.

Poll watchers will not be permitted near the voting machines at any time during voting hours.

An area, with a full view of the polls, will be designated for poll watchers.

Following the recording of the vote by the District Clerk, poll watchers will be permitted time to view the voting machines prior to the machines being closed and locked. Poll watchers are not permitted near the machines while the District Clerk, Election Inspectors, Business Official and/or District’s Attorney are taking the tally.

Any questions regarding poll watchers are to be directed to the District Clerk. All actions of poll watchers shall be unobtrusive and may in no manner interfere with the orderly conduct of the voting.

WHEREAS, pursuant to Section 256-b of the New York State County Law, enacted by Chapter 58 of the 2023 New York Laws, as amended by Chapter 118 of the 2024 New York Laws, the Suffolk County Sewer Agency has prepared and submitted to the Legislature of the County of Suffolk, a map, plan, report dated May 2024, including recommendations, and cost estimates thereof, pertaining to the establishment of a Suffolk County Wastewater Management District (the “District”) and the merger and consolidation of all existing Suffolk County sewer districts therewith; and

WHEREAS, such map, plan, report, recommendations, and cost estimates addressed the establishment of a single Suffolk County Wastewater Management District and to merge all of the existing County sewer districts therein; and

WHEREAS, the map, plan, report, recommendations, and cost estimates that were accompanied to Suffolk County Resolution No. 501-2024 are attached to this Resolution and Order as Exhibit “A”; and

WHEREAS, Suffolk County is not financing the cost of the establishment of the proposed “Suffolk County Wastewater Management District” by the issuance of bonds, notes, certificates or other evidences of indebtedness of the County. The County will not incur any capital costs in connection with the establishment of the proposed District and therefore, will assume no new debt as a result of the establishment of the District; and

WHEREAS, pursuant to Suffolk County Resolution No. 501-2024 and New York County Law Section 256-b, enacted by Chapter of the 2023 New York Laws, as amended, the Clerk of the Legislature did duly cause a Notice of Public Hearing regarding the establishment of “Suffolk County Wastewater Management District” and the merger and consolidation of all existing Suffolk County sewer districts therewith, to be published at least once in each of the official newspapers of the County and proof thereof has been presented to the County Legislature; and

WHEREAS, pursuant to such Notice of Public Hearing, a public hearing was held by the Legislature of the County of Suffolk in Riverhead, New York in said County on June 25, 2024 at 6:30 p.m., Time; and

WHEREAS, based on its consideration of the map, plans and report including recommendations and estimate of costs and the evidence given at the public hearing held on June 25, 2024, this Legislature, via Resolution No. 636-2024, adopted findings and determinations and issuing an order in relation to the establishment of the District as proposed, however, there was an inadvertent procedural error made subsequent to the adoption of said resolution; and

WHEREAS, this Legislature intends to adopt the findings and determinations and issue an order in relation to the establishment of the District based on the consideration of the same map, plans and report including recommendations and estimate of costs originally attached to Resolution No. 636-2024, and the evidence given at the public hearing held on June 25, 2024, in the interest of ensuring that all affected residents are on proper notice of these proceedings, and

repeal Resolution No. 636-2024; and WHEREAS, said County Legislature has duly considered the map, plan, report, recommendations and estimate of costs for the proposed “Suffolk County Wastewater Management District,” as well as the evidence given at the public hearing held on June 25, 2024, a copy of which is attached as “Exhibit A”; now therefore be it 1st RESOLVED, that Resolution No. 636-2024 is hereby repealed in its entirety; and be it further 2nd RESOLVED, that the County Legislature of the County of Suffolk, New York, as follows:

Section 1. Upon evidence presented at the aforesaid public hearing and after due consideration of the map, plan, report, recommendations and estimate of costs (the “Map, Plan and Report”) filed with the Legislature of the County of Suffolk and attached to this Resolution and Order as Exhibit “A,” it is found and determined that there is no cost related to the establishment of “Suffolk County Wastewater Management District” and the merger and consolidation of all existing Suffolk County districts therewith.

Section 2. Upon evidence presented at the aforesaid public hearing and after due consideration of the aforesaid Map, Plan and Report, it is hereby found and determined that the establishment of “Suffolk County Wastewater Management District” and the merger and consolidation of all existing Suffolk County sewer districts therewith is necessary and desirable as part of the ongoing effort by Suffolk County to combat nitrogen contamination and protect Suffolk County’s vital aquifers, surface waters, and estuaries; to address the County’s long-term wastewater infrastructure needs comprehensively by implementing recommendations set forth in the Suffolk County Subwatersheds Wastewater Plan resulting in a more efficient, integrated approach to the development of new wastewater infrastructure; and to consolidate the properties connected to existing County treatment facilities into a unified single zone of assessment streamlining the existing duplicative and varied administrative structure and thereby optimizing the use of the District’s resources. The recommended District structure and management approach will also standardize the cost of sewer services for property owners throughout the sewered portions of the District.

Section 3. Upon evidence presented at the aforesaid public hearing and after due consideration of the aforesaid Map, Plan and Report, recommendations and estimate of costs, it is hereby further found and determined that establishment of “Suffolk County Wastewater Management District” and the merger and consolidation of all existing Suffolk County sewer districts therewith will not constitute an undue burden on all properties therein said District, and that no properties within said District will be excluded from the from the benefit of the establishment of the District, all property and property owners within the District are benefitted thereby, and all property and property owners are included within the boundaries of the District.

Section 4. Upon evidence presented at the aforesaid public hearing and after due consideration of the aforesaid Map, Plan and Report, recommendations and estimate of costs, it is hereby further found and determined that it is in the public interest to establish the “Suffolk County Wastewater Management District” as set forth in the Map, Plan and Report, recommendations and estimate of costs, attached hereto as Exhibit “A.”

3rd RESOLVED, IT IS HEREBY ORDERED, by the Legislature of the County of Suffolk as follows:

Section 1. The establishment and formation of the Suffolk County Wastewater Management District, that possesses all of the powers as set forth within section 256-b of the New York County Law and as set forth within this Resolution and Order, is hereby approved and upon the effective date of this Resolution and Order shall be comprised of all lots, pieces or parcels of land as follows:

All properties and parcels within the boundaries of all existing County Sewer Districts, as determined by each Sewer District’s Map and Plan, including any amendments thereto and any extensions, thereto, and shall include, in addition, all other properties and parcels that are within the territorial boundaries of the County of Suffolk but are not presently within the boundaries of a County sewer district, and simultaneously, not within the boundaries of any other municipal sewer or wastewater treatment district or system. The boundaries of the County Wastewater Management District shall not include, and specifically excludes, all properties that are located within, or permitted by contract, agreement, or otherwise in accordance with law to connect to, any town sewer district or village sewer district, sewerage system or service area, or any amendments or extensions thereto, as those properties and parcels are more

specifically detailed in the Map, Plan and Report on file with the Suffolk County Legislature and attached to this Resolution and Order as Exhibit “A”.

All other properties not included within the listing of properties within town sewer districts or village sewer districts, sewerage systems or service areas, as listed herein, shall be included within the boundaries of the County Wastewater Management District.

Section 2. Upon the effective date of this Resolution and Order, all 27 County sewer districts, and extensions thereof, heretofore established and formed in accordance with law, are hereby consolidated, merged, incorporated into and assumed by the Suffolk County Wastewater Management District. All maps and plans of the 27 existing County sewer districts are hereby superseded by the Map, Plan and Report hereby adopted by this Legislature and attached hereto as Exhibit “A” commencing January 1, 2026. All property, real and personal, and all other assets of each County sewer district, and extensions thereof, as well as all outstanding obligations, indebtedness and liabilities thereof, are likewise deemed or actually, as the case may be, consolidated, merged, incorporated into and assumed by the Suffolk County Wastewater Management District. All staff of each County sewer district, and extensions thereof, are transferred to and shall be the staff of the Suffolk County Wastewater Management District.

Section 3. The County Wastewater Management District shall be separated into two zones of assessment, however the ability to refer to the former County sewer districts shall remain for purposes of identifying sewer service areas, identifying capital projects, and phasing in the uniform sewer charge rates as set forth within the Map, Plan and Report attached hereto. As authorized by section 256-b of the New York County Law, enacted pursuant to Chapter 58 of the 2023 Laws of New York, as amended, one zone of assessment shall include all properties within the County Wastewater Management District that are currently connected to County sewage treatment facilities (the “Sewered Zone of Assessment” or “Assessment Zone 1”), and one that includes all other properties or parcels within the County Wastewater Management District that are not currently connected to County sewage treatment, which shall also include properties or parcels that are connected to private sewerage facilities (the “Un-sewered Zone of Assessment” or “Assessment Zone 2”).

Section 4. The cost to ratepayers will be dependent on the zone of assessment within which each parcel or property is located, and will be determined on a benefit basis collected as a sewer charge consistent with section 256-b and 266 of the New York County Law, as set forth in detail in the Map, Plan and Report adopted by this Legislature and attached hereto as Exhibit “A”.

Properties within the sewered zone of assessment will be responsible for the operation and maintenance costs of the District’s sewer facilities, the ongoing debt service of the assumed and consolidated debt of the District. Within the first year after the establishment of the District, which is expected to be 2026, the estimated annual cost to the typical one family home within the sewered zone of assessment is $661 in total. The $661 annual fee for the typical one family home will include a $171 contribution toward debt service and a contribution of $490 toward operation and maintenance costs. The cost of future District improvement projects within the sewered zone of assessment not funded by grants or other funding sources will be borne by the entire zone of assessment and the cost to ratepayers will be similarly calculated on a benefit basis and collected as sewer rents. Properties within the unsewered zone of assessment will not be responsible for any operation and maintenance costs or debt service for sewers or other wastewater improvement projects within the District.

Section 5. Parcels and properties that are connected to County sewage treatment facilities but located outside of the boundaries of the County Wastewater Management District will continue to be billed for the continuation of such service in accordance with the terms and condition of the agreements authorizing such connections (“Connectees”), including an additional surcharge for the administration of such agreements.

Parcels and properties that are located within the boundaries of the County Wastewater Management District that had previously received sewage treatment service pursuant to a connection agreement approved by this Legislature, shall, commencing January 1, 2026, be included within Assessment Zone 1 and treated similarly to all other properties included within Assessment Zone 1 for that particular service area, and except for any terms and conditions of each connection, by agreement or otherwise, that are necessary and proper to survive, as determined by the Administrative Head of the District, shall be deemed

Local Emergency Order:

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency last issued on January 10, 2025, February 7, 2025, March 7, 2025, April 4, 2025 and May 2, 2025 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. The hours of operation for the subject property shall be limited from 7am to 8pm. Any dumpster access, deliveries and/or garbage pick-up shall not occur before 8 am daily. Outdoor storage, sales and display shall be prohibited.

4. Loitering:

Loitering shall be prohibited on the subject parcel.

If substantiated complaints regarding loitering and/ or criminal activity at the site are received by the Town of Islip, the Commissioner of the Town of Islip Planning Department shall notify the property owner by certified mail to take appropriate security measures to deter loitering and/or criminal activity at the site. If the property owner fails to take appropriate security measures within fifteen (15) days of the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional reasonable security conditions at the site including, but not limited to: the installation of fencing, lighting, security cameras, and/or the hiring of a private security company to monitor the site. The Planning Board reserves sole responsibility of determining if the Declarant/Owner is in compliance with this requirement.

5. Property Maintenance:

The building shall be kept in good repair, including all exterior portions and all interior portions thereof which, if not so maintained, may cause or tend to cause the exterior portions of such improvement to deteriorate, decay or become damaged or otherwise to fall into a state of disrepair. Declarant/Owner further agrees to permanently maintain all improvements and landscaping to the reasonable satisfaction of the Planning Board. The Town or its designee reserves the right to enter onto the subject property after 30 days written notice sent certified mail, return receipt requested, to the address of the current owner according to Town of Islip assessment rolls, to remove litter, debris or maintain or replace any fencing or plantings if found that the improvements are not being maintained and shall bill the owner for any expense incurred. All costs associated with same shall be assessed to the owner’s next tax bill.

ARCHITECTURAL ELEVATION

REVIEW & SIGNAGE

6. Architectural Elevation Review:

Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. The submitted architectural drawings shall be in substantial conformance to the plan(s) prepared by BHC Architects and which is dated September 18, 2024. Said plans shall show all sides of the structure and shall also show the following design elements:

a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.

b. Use of vinyl shall be limited to railings, columns and windows and shall not comprise more than 10% of the building’s façade. The use of EIFS and concrete block shall be expressly prohibited.

c. Materials used shall be consistent with the existing structure and historic character of the area.

d. The proportion and details on the existing structure shall be maintained with respects to windows, shutters and trim.

The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.

7. Signs:

Declarant/Owner shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated facial signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box signs shall be expressly prohibited. Freestanding signs shall be a monument style, unlit or indirectly lit only, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Applicant/owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.

SITE PLAN REQUIREMENTS & MODIFICATIONS

8. Site Plan:

Prior to filing a building permit application, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division

for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to: building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The submitted plan shall be in substantial conformance to the plan(s) prepared by BHC Architects and which is dated December 9, 2024. Said plan shall also show the following design elements:

i. The size of the building shall be limited to a maximum of approximately 7,500 square feet. ii. A minimum of 43 parking stalls shall be physically constructed on-site. Additional parking beyond these 43 stalls shall be designated as landbanked parking on the approved site plan at the direction of the Town Engineer and shall not be constructed without the review and approval of the Planning Board. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative or split faced concrete block enclosure with opaque gates. Dumpsters shall be emptied on a regular basis to prevent overflow. Multiple tenants within the building shall be required to use a common dumpster and shall not cause additional, multiple dumpsters to be located on the subject property that are not enclosed in an approved location and as described above. A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area on a daily basis. A cleaning service shall be provided in lieu of a garbage dumpster. The subject site shall be maintained in a neat, clean, and litter free condition.

iii. All stormwater drainage shall be contained onsite in accordance with the current SLDR. In addition, Declarant/Owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques:

iv. A single bike rack (“Inverted U” or “Post and Loop” in design) shall be installed near the entrance to the building.

v. A minimum of 1% (1) of the total number of parking stalls shall be set aside as electric vehicle charging stations.

vi. Fire Apparatus Access shall be designed and installed to the satisfaction of the Division of Fire Prevention.

vii. All onsite lighting shall be positioned or shielded so as to illuminate only the subject parcel. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.

Declarant/Owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals.

The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the Declarant/Owner after due public hearing.

The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone.

9. Parking:

If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems. If owner fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan Modification conditions including, but not limited to:

i. Install landbanked parking stalls, if applicable. The Declarant agrees to install additional parking as may be deemed necessary at any time in the future pursuant to the direction of the Planning Board. Additional parking shall be installed at the sole cost of the Declarant within thirty (30) days’ notice.

RESOLUTION NO. 409-2025, CALLING A PUBLIC HEARING FOR THE PURPOSE OF CONSIDERING THE PROPOSED EXTENSION OF SUFFOLK COUNTY SEWER DISTRICT NO. 3 – SOUTHWEST (ZONE E – OAKDALE WEST) (CP 8504)

WHEREAS, by proceedings heretofore duly had and taken pursuant to Article 5-A of the New York County Law, the County Legislature of the County of Suffolk, New York, has established a County Sewer District designated and known as Suffolk County Sewer District No. 3 –Southwest (the “District”); the District was created by the Suffolk County Legislature with the approval of the New York State Comptroller in 1970, extended in 2021, 2022, 2024 and 2025, and includes approximately 80,000 properties serviced by the Sewer District; additional properties, including medical facilities, residential apartments and condominiums are serviced by the Sewer District through connection agreements; and

WHEREAS, the County and Town of Islip have an interest in the environmental improvement and protection of the Connetquot River and Great South Bay through the creation of sewer infrastructure in an area in Oakdale bounded by the Connetquot River on the west and south, Shore Drive/Grassmere Avenue on the north, Grand Canal on the east and south of Shore Drive between Grand Canal and Vanderbilt Blvd. (the “Project”); and

WHEREAS, engineering studies have recommended connection of the Project area to Suffolk County Sewer District No. 3 - Southwest; and

WHEREAS, the County has received grant funds to offset construction costs of the Project so that proceeding with the Project is feasible for property owners within the proposed extension area; and

WHEREAS, in anticipation of and as a necessary step in order to move forward with the Project, the Suffolk County Sewer Agency, with the assistance of the Department of Public Works, has submitted a map, plan, report and recommendation to the Legislature, pursuant to Section 274 of the County Law, dated April 2025 (the “Map, Plan and Report”), for the proposed extension of Suffolk County Sewer District No. 3 – Southwest, together with an estimate of cost thereof; and

WHEREAS, backup has been filed with the Clerk of the Legislature entitled “CN – 368-2025 Backup.pdf”; and

WHEREAS, pursuant to Section 254 of the New York County Law, upon receipt of the Map, Plan and Report, the Legislature shall call a public hearing upon the proposal to extend said County sewer district, to comprise the area described and defined within the said Map, Plan and Report; now, therefore be it

Project Description

The proposed project is to extend the boundaries of Suffolk County Sewer District No. 3 – Southwest (the “District”), to include the area defined as Oakdale West as an extension area to be known as Suffolk County Sewer District No. 3 – Southwest, Zone E –Oakdale West. With the extension of the District, it is the intention of the proposed project (the “Project”) to protect and improve the environment in the community, which has been limited in part by restrictions regarding wastewater disposal and minimize possible impacts to the environment. The connection of properties to sewer and the Project will reduce the environmental impact caused by underperforming cesspools and sanitary systems, by replacing such on-site systems with more reliable and efficient sewage treatment for the proposed Project area. The Project is being coordinated with the Town of Islip. The proposed extension area to the District is approximately 186 acres and the Project will construct sewer collection facilities within the proposed extension area that will enable connection to the existing facilities of the District for sewage treatment and disposal. The Project more specifically includes the construction of a low-pressure sewer system consisting of a network of low-pressure force mains and individual on-site grinder pump units, where the force mains ultimately discharge to a gravity sewer main. Wastewater will be conveyed to the District via the gravity sewers for treatment and disposal.

Notice of Cost

The proposed extension is proposed to be a separate zone of assessment of the District, to be known as Suffolk County Sewer District No. 3 – Southwest, Zone E – Oakdale West. Consistent with the law governing the District that is in currently effect, once the extension of the District is approved, capital improvement costs associated with being a part of the District will be charged to all rate payers within the proposed extension area on an ad valorem basis and as a per parcel charge. Once the extension Project is complete and properties are connected to the District’s facilities, a user charge (for operation and maintenance costs) will also be charged, consistent with the manner by which current rate payers of the District are charged user charges.

The total maximum cost of the proposed extension project is estimated to be $43.91 million, with $42.78 million estimated to be funded with federal and New York State grant funds. The remaining total cost of the Project not funded by the grants, which is approximately $1.13 million of County serial bonds will be paid for solely by the rate payers within the proposed extension on an ad valorem basis, and the obligation will commence upon the establishment of the extension to the District, which is expected to occur in 2025.

As described in more detail in the Map, Plan and Report, the cost for the typical one or two family home within the extension area the first year after project completion (which is in 2029), under the current method for the collection of the costs for the District (calculated by using the mode assessed value of the residential properties within the extension area) is $1,022 per year, including the ad valorem charge associated with the costs of being in the District ($134), a per parcel benefit charge ($35.76) and the debt service for the costs for the extension of the District ($628). Once the construction of the Project is complete, which is estimated to be in 2029, under the current collection method, property owners within the extension area that connect to the District’s facilities would also be billed a user charge (for operation and maintenance costs of the District), consistent with the manner that other residential rate payers in the District are charged. The user charge for the typical one- or two-

family home at that time is projected to be $224 per year. Additionally, the annual cost to operate and maintain the individual grinder pump stations is estimated to be $25, which is to be paid by the property owners.

As described in more detail in the Map, Plan and Report, under the current method collection, the cost for the typical commercial property within the extension area would have the per parcel benefit charge and debt service charges based on the assessed value. The user charge, once connected, will be based on a single-family equivalent of 225 gallons per day for the wastewater discharged in a manner similar to other commercial rate payers within the District, which is prorated based on actual water use.

It is anticipated that the current method of collection of the costs for the District, and in turn the Oakdale West extension, will be replaced by the method of the collection of costs for the Suffolk County Wastewater Management District (“CWMD”) approved by the Suffolk County Legislature pursuant to Resolution No. 636-2024 that is to become effective January 1, 2026, , and as set forth in the Map, Plan and Report upon which Resolution 6362024 was adopted. Under the approved Map, Plan and Report for the CWMD, the cost to the typical property, which is a one- or two-family home that is connected to sewers is $702 for 2029.

As stated above, the proposed Project will be largely funded with grant funding, and the remaining cost of the Project will be funded by sewer district serial bonds.

Copies of the report, map and plan for the proposed district extension are available in the Office of the Clerk of the County Legislature, where they can be reviewed during normal business hours Monday through Friday.

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1; Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575,

Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.

G. Effective Date

Only qualified voters shall be permitted to vote at said Special District Meeting Vote.

PLEASE TAKE FURTHER NOTICE THAT every qualified voter of the Town of Smithtown who resides within the Smithtown Special Library District and is otherwise qualified to vote at a General Town Election shall be qualified to vote at said Special District Meeting Vote.

PLEASE TAKE FURTHER NOTICE that applications for absentee ballots and early mail ballots will be available at each library building within the Smithtown Special Library District during regular business hours and may be printed from the Library’s website (www.smithlib.org). Such application must be received by the District Clerk at least seven (7) days prior to the July 1, 2025 Special District Meeting Vote if the ballot is to be mailed to the voter; or the last business day before the election if the ballot is to be personally delivered to the voter. Qualified voters may obtain an absentee/early mail ballot at the Community Relations Department in the Nesconset Building, located at 148 Smithtown Boulevard, Nesconset, NY, on days the Library is open to the public between the hours of 9:30 A.M. and 5:00 P.M. (except Saturday, Sunday and holidays) commencing June 6, 2025. A list of all persons to whom absentee/early mail ballots have been issued will be posted in the Administration Office in the Nesconset Building on each of the five (5) days prior to the July 1, 2025 Special District Meeting Vote between the hours of 9:30 A.M. and 5:00 P.M., except Saturday, Sunday and holidays. No absentee/early mail ballot shall be canvassed unless received by the District Clerk no later than 5:00 P.M. on the day of the Special District Meeting Vote.

AND FURTHER NOTICE IS HEREBY GIVEN, that military voters who are qualified voters of the Smithtown Special Library District must apply for a military ballot by submitting an application which is obtainable from the District Clerk. Completed applications for a military ballot must be returned by mail or in person, and received by the District Clerk not later than twenty-five (25) days before the date of the Special District Meeting Vote. Military voters may designate a preference to receive a ballot application and/or the military ballot by mail, facsimile transmission or electronic mail. Ballots for military voters shall be mailed or otherwise distributed in accordance with the preferred method of transmission, as soon as practicable, but not later than twenty-five (25) days before the date of the Special District Meeting Vote (June 6, 2025). Irrespective of the preferred method of transmission, military ballots must be received by mail or returned in person to the Office of the District Clerk no later than 5:00 PM (Prevailing Time) on the day of the Special District Meeting Vote in order to be counted.

RESUELTO:

Por la presente, se autoriza a la Junta Directiva del Distrito Especial de Bibliotecas de Smithtown (el “Distrito de Bibliotecas”), en la ciudad de Smithtown, condado de Suffolk, Nueva York, a (a) construir mejoras en el edificio de la Biblioteca Principal ubicado en 1 North Country Road, Smithtown, Nueva York, cuyas mejoras son necesarias debido a las inundaciones catastróficas resultantes de una tormenta significativa en agosto de 2024, a un costo estimado que no exceda los 16.500.000 dólares; y a gastar para ello, incluyendo los costos preliminares y los costos incidentales a los mismos y el financiamiento de los mismos, y reembolsar los gastos anteriores realizados por la Biblioteca para los mismos, sin exceder en conjunto el costo total estimado de $16,500,000, más cualquier monto adicional recibido por la Biblioteca en relación con el financiamiento de los mismos, incluyendo pero no limitado a las primas de venta de bonos, ingresos de inversión sobre ingresos de bonos, subvenciones, donaciones o contribuciones caritativas; (b) financiar el costo del Proyecto a través de la emisión de bonos y/o pagarés por parte de la Ciudad de Smithtown en nombre del Distrito de Bibliotecas por un monto que no exceda los $16,500,000; (c) hacer que el Municipio evalúe, imponga y recaude un impuesto pagadero en cuotas anuales por un monto total que no exceda los $ 1,800,000 por año, cuya cuota anual del impuesto será adicional a la cantidad actualmente recaudada anualmente por impuestos para las asignaciones anuales del Distrito de Bibliotecas, durante un período máximo de quince (15) años para el pago de todo el capital, intereses, primas de reembolso, si las hubiere, y gastos relacionados con la financiación de dicho coste; (d) ceder y prenda la totalidad de dicho impuesto a la Ciudad; y (e) celebrar contratos de préstamo y cualquier otro acuerdo y/o tomar todas y cada una de las demás acciones incidentales o necesarias para la finalización del Proyecto y la financiación del mismo.

Dicha Proposición aparecerá en la boleta utilizada para votar en dicha Votación de la Reunión Especial del Distrito en sustancialmente la forma anterior.

La votación se llevará a cabo con boletas de papel y las urnas permanecerán abiertas desde las 9:30 a.m. (hora prevaleciente) hasta las 9:00 p.m. (hora prevaleciente) y tanto tiempo como sea necesario para permitir que los votantes, entonces presentes, emitan su voto. Solo los votantes calificados podrán votar en dicha Votación de la Reunión Especial del Distrito.

TENGA EN CUENTA QUE todo votante calificado de la ciudad de Smithtown que resida dentro del Distrito de Bibliotecas Especiales de Smithtown y esté calificado para votar en una Elección General de la Ciudad estará calificado para votar en dicha Votación de la Reunión Especial del Distrito.

TENGA EN CUENTA QUE las solicitudes para boletas de voto en ausencia y boletas anticipadas por correo estarán disponibles en cada edificio de la biblioteca dentro del Distrito Especial de Bibliotecas de Smithtown durante el horario comercial regular y se pueden imprimir desde el sitio web de la Biblioteca (www.smithlib.org). Las solicitudes completadas para una boleta militar deben devolverse por correo o en persona, y ser recibidas por el Secretario del Distrito a más tardar veinticinco (25) días antes de la fecha de la Votación de la Reunión Especial del Distrito. Los votantes militares pueden designar una preferencia para recibir una solicitud de boleta y/o la boleta militar por correo, transmisión de fax o correo electrónico. Las boletas para votantes militares se enviarán por correo o se distribuirán de otra manera de acuerdo con el método preferido de transmisión, tan pronto como sea posible, pero a más tardar veinticinco (25) días antes de la fecha de la Votación de la Reunión de Distrito Especial (6 de junio de 2025).
