DEED COVENANTS AND RESTRICTIONS

ADMINISTRATIVE

1. Action(s):

A change of zone from Residence AAA District to Residence CA District is deemed granted as part of this application. The use of the subject property shall be limited to a rental apartment complex and accessory amenities having no more than 40 dwelling units, to be further delineated as follows:

a. Twelve (12) units shall set aside for individuals with intellectual/development disabilities as defined by the New York State Office of People with Developmental Disabilities and/or special needs populations as certified by NYS Office of Mental Health and the NYS Department of Health.

2. Construction Trailer:

Prior to the issuance of any construction or demolition permits, Declarant/Owner shall obtain a permit for an on-site construction trailer which shall remain on the property for the life of the permit(s). Said trailer shall contain a copy of the approved site plan and approved construction plans and be accessible to all Town personnel and contractors for review of plans and meetings. Should the Declarant/Owner wish to remove said trailer before the issuance of a Certificate of Occupancy, written permission must be obtained for its

removal by the Building Division.

3. Park Fees:

Declarant/Owner agrees to pay a one-time recreation fee of $1,320 per apartment unit prior to the issuance of site plan approval.

ONSITE OPERATIONS

4. Affordable Housing:

At least 20% (8) dwelling units shall be set aside as affordable units subject to the following Town of Islip requirements in §68-3 in effect at the time of this grant (80% of the current median family income for the Nassau-Suffolk Fair Market Rent Area as published annually by the United States Department of Housing and Urban Development). The property owner or management company shall enter into a contract with a not-for-profit HUD Certified Housing Counseling Agency to review and certify compliance with the above provisions. Evidence of compliance with the above referenced affordability provisions must be provided prior to issuance of rental permit(s) and/or upon request to the Town of Islip Planning Department.

5. Van/Shuttle Service:

On-site van service will be made available to residents of the 12 apartments occupied by persons with disabilities for transportation for shopping, employment, and recreational and other required necessary trips.

6. Renewable Energy:

Declarant/Owner shall provide a maximum of 12 units with solar, wind, geothermal, or other alternative renewable energy sources deemed acceptable by the Town Board to meet a target of 30% of the total energy needs of the development.

7. Occupancy:

The residential occupancy of the one-bedroom apartments shall be limited to two persons. The residential occupancy of all other apartments shall be limited to the number permitted by the New York State Building Code. Each unit shall have a clothes washer and dryer machine or a laundry room with washer and dryer access shall be provided within each building.

8. Property Maintenance:

Declarant/Owner agrees to enter into a contract with a property management company to oversee the daily management of the property. The management company shall be responsible for the supervision, restoration and maintenance and repair on the subject property in accordance with the approved building and site plans. These shall include, but not be limited to, on-site security, internal roadways, sidewalks, litter removal, provision of garbage collection, snow and ice removal, stormwater infrastructure, landscaping, lighting, walkways and buffer installation maintenance and replacement. The subject property shall be kept neat, clean, graffiti and litter free. The internal private roadway servicing the units shall not be offered for dedication. If the property is not managed to the reasonable satisfaction of the Planning Board, the Planning Board reserves the right to require further maintenance, improvements and/or modifications on-site. The Planning Board will notify the property owner within 30 days certified mail notice identifying the problem(s) and request rectification. The property owner agrees to rectify any problems to the Planning Board’s satisfaction within sixty (60) days, weather permitting.

9. Solid Waste:

Declarant/Owner shall provide regular solid waste collection services to residents of the apartments. Said collection services shall include separation of solid waste into recyclable components, including but not limited to newspapers, corrugated cardboard, ferrous metal, aluminum beverage containers, plastic beverage containers and glass. As part of this requirement, Declarant/Owner shall provide designated containers for recyclable materials. Said containers shall be regulated in the same manner as garbage dumpsters, including regular servicing and enclosure within a decorative or split faced concrete block enclosure with opaque gates.

ARCHITECTURAL ELEVATION

REVIEW & SIGNAGE

10. Architectural Elevation Review:

Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. The submitted architectural drawings shall be in substantial conformance to the plan(s) prepared by GRCH Architecture PC and which is dated April 26, 2024. Said plans shall show all sides of the structure and shall also show the following design elements.

a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public

view for aesthetic and sound attenuation purposes.

b. b. Use of EIFS and concrete block shall be limited to accent bands and shall not comprise more than 10% of the building’s façade.

c.

d. The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purpose of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with the above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.

11. Signs:

Declarant/Owner shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally illuminated signage shall be decorative in nature and may include channel-lit, stencilcut, or halo-lit designs. Light box signs shall be expressly prohibited. Freestanding signs shall be a monument style, unlit or indirectly lit only, with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the signs for design compatibility, color, materials, height, quantity and size. Declarant/Owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.

SITE PLAN REQUIREMENTS & MODIFICATIONS

12. Site Plan:

Prior to filing a building permit application, an approved site plan is required. Application shall be submitted to the Town of Islip Engineering Division for review and subject to approval of the following items. The site plan shall show improvements specified in the Subdivision and Land Development Regulations (SLDR) including but not limited to: building locations, parking, curbs, sidewalks, curb cuts, landscaping, and drainage. The site plan shall be in substantial conformance with the plan prepared by Bohler Engineering and dated April 19, 2024. Said plan shall also include the following elements:

a. The minimum setback for all buildings from the property lines shall be 50’.

b. Any proposed stalls in excess of 50 shall be designated as landbanked parking on the approved site plan pursuant to the direction of the Town Engineer.

a. Any proposed garbage dumpster shall be located at the direction of the Town Engineer and shall be enclosed within a decorative concrete block enclosure with opaque gates and screened with evergreen plantings. Dumpsters shall be emptied on a regular basis to prevent overflow. A hose bibb shall be installed adjacent to the dumpster to allow routine rinsing of the dumpster area as needed. The subject site shall be maintained in a neat, clean, and litter free condition.

b. c. Garbage cans shall be provided near all outdoor amenity areas. Garbage can lids shall be of sufficient design with either drive-through funnel lids or chutes so as to prohibit the dispersion of litter, garbage, or debris by wind, birds, vermin, etc. from said trash receptacles.

a. d. All stormwater drainage shall be contained onsite in accordance with the current SLDR. In addition, Declarant/Owner agrees to incorporate non-point source pollution mitigation into the overall drainage plan by incorporating one or more of the following stormwater mitigation techniques:

a. i. natural retention area(s) such as vegetated swales and bioretention cells/rain gardens

a. a. ii. Permeable/porous pavement surfaces

a. a. iii.Manufactured treatment devices, i.e. catch basin inserts designed to filter hydrocarbons and other pollutants from stormwater runoff

a. e. Bike lockers and/or racks (“Inverted U” or “Post and Loop” in design) shall be installed near each entrance.

a. f. 2% (2) of the total number of parking stalls shall be set aside as electric vehicle charging stations. The parking lots shall be designed for 10% of parking spaces to become future electric vehicle charging stations.

a. g. Emergency vehicle access shall be designed and installed to the satisfaction of the Division of Fire Prevention.

a. h. All onsite lighting shall be in conformance with Article LII of the Town of Islip Zoning Code. The Planning Board reserves the right to further limit or shield lighting fixtures if it is determined that light is not being contained on the subject property. The Planning Board reserves the sole responsibility of determining if lighting is properly contained on the subject property.

a. i. A minimum of four onsite amenities for tenant use, which may include but is not limited to:

a. i. Van concierge parking

a. ii. picnic area

a. iii. Walking trail

a. iv. A court for lawn games (e.g. bocce)

a. j. Pedestrian connections, including sidewalks and ADA compliant curb ramps, shall be installed internally among the proposed site features and connecting the proposed site features to the external sidewalk system. Upgrades to the existing external pedestrian facilities/network to ADA compliance and incorporating elements typical to a downtown streetscape design.

a.

a. The approved site plan shall supersede this plan for the purposes of regulating the subject property. Declarant/ Owner acknowledges that the plans prepared in association with this change of zone are conceptual in nature and that the site plan submitted to the Division of Engineering for review must meet the requirements in the SLDR and Town Code unless specific waivers are identified in these covenants or subsequently obtained from the Planning Board or Zoning Board of Appeals. The Planning Board reserves the right to modify any site plan requirements referenced in this covenant with the consent of the Declarant/Owner after due public hearing. The Commissioner of Planning is hereby authorized to waive the requirement for such public hearing if any future site plan modification is reasonable, is evident within the documentation submitted as part of this application and is within the spirit and intent of this grant. No permits or approvals shall be granted prior to the effective date of this change of zone.

13. Parking:

If substantiated complaints regarding spillover parking or parking in areas not designated for parking are received, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner by certified mail, to rectify any parking problems. If owner fails to correct parking problems after thirty (30) days from the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional Site Plan Modification conditions including, but not limited to:

As a consequence of such, some states have dispersed and delivered asylum seekers to various states throughout the country and, subsequently some municipalities have dispersed and delivered asylum seekers to various counties within New York State. Accordingly, the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency last issued on January 10, 2025 and February 7, 2025 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico;

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1; Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575,

Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.

WHEREAS, a new Real Property Tax Law §466-a now permits enrolled volunteer firefighters throughout New York State to be eligible to qualify for a partial real property tax exemption on their residential real property subject to approvals by local counties, towns, cities, villages, fire districts, etc.; and

WHEREAS, Real Property Tax Law §466-a requires that local government entities wishing to confer the benefits of said statute on enrolled volunteer firefighters serving within their boundaries hold a public hearing; and

Local Emergency Order:

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers

I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency last issued on January 10, 2025 and February 7, 2025 do hereby find and order as follows:

Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico; and

Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and

Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.

Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:

A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.

B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.

C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.

D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1; Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575,

Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws, rules, and regulations required to comply with this Emergency Order.

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.

F. Remedies Not Exclusive.

a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.

b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.

c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.

d. G. Effective Date

And I further order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary; and further order that

This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24(5).

Local Emergency Order:

Suspending local procurement and contracting laws, rules and regulations

I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with (3) Proclamation of a State of Emergency last issued on January 10, 2025 and February 7, 2025 for a storm occurring on or about August 19, 2024, pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:

Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

Suffolk County Code:

• Chapters 1065 and 189

Article IV sections A 4-13 and 14

• Article V sections A5-1

• Charter section C5-2 (C) and (L)

Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance

• all related procurement laws, rules, and regulations required to comply with this Order; and further

Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further

Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.
