Bid documents and specifications may be examined and obtained, beginning Thursday, July 3, 2025, from the Airport Administration Office located at the Terminal Building, 100 Arrival Avenue, Suite 100, Long Island MacArthur Airport, Ronkonkoma, New York 11779, from Monday to Friday 8:30 a.m. to 4:30 p.m., A NONREFUNDABLE fee of one-hundred fifty ($150) dollars for each complete set obtained is required. No bid will be accepted by email or facsimile.
Each bid must be accompanied by a Cashier’s Check, Certified Check, or Bid Bond payable to the Town of Islip, in an amount equal to ten percent (10%) of the Total Bid Price. The successful bidder is

DEED COVENANTS AND RESTRICTIONS
ADMINISTRATIVE
1. Action:
a. A change of zone from Business 1 District to Business 3 District is deemed granted as part of this application. Any change of use to other uses other shall be limited to uses permitted in the Business 2 district. In addition, the following uses shall be expressly prohibited on the subject parcel:
i. Bar, tavern or nightclub
ii. Psychiatric clinic
iii. Billiard Hall
iv. Adult Use
v. Transfer Station
vi. Vape shop or lounge
vii. Motor vehicle dealership
b. Two (2) Planning Board Special Permits for a fast-food restaurant have been granted as part of this application. Adequate cooking area venting systems shall be installed and maintained in a manner that ensures that cooking odors are properly dispersed and not deemed obnoxious and/ or objectionable to nearby residential uses. One of the fast-food restaurants shall operate as a coffee restaurant principally engaged in the sale of freshly prepared coffee and tea beverages. Said
establishment may also sell accessory retail products related to coffee and tea beverages in addition to other refreshment items, including donuts, pastries, prepackaged snacks, premade sandwiches/ wraps/salads, and frozen desserts. The sale and service of freshly prepared, cooked-to-order items including, but not limited to, hamburgers, chicken sandwiches, and tacos shall not be permitted within the respective coffee restaurant.
c. A Planning Board Special Permit for a convenience market was also granted as part of this application. If substantiated criminal activity associated with late night activity is received, and upon 30 days written notice and applicant’s/owner’s failure to cure, the Planning Board reserves the right to have a public hearing. In this event the Planning Board may impose additional conditions in order for applicant/ owner to mitigate criminal activity, including, but not limited to, limiting the hours of operation and the hiring of security guard service.
d. A Modification of Deed Covenants and Restrictions associated with T.C. #5304 shall be granted as part of this application. All deed covenants and restrictions associated with T.C. #5304 dated December 17, 2018 and recorded in the Office of the Suffolk County Clerk on January 25, 2019 in Liber D00012998 at page 274 and all prior Town Board imposed deed covenants shall be deemed null and void and shall be replaced with these.
2. Construction Trailer:
Prior to the issuance of any construction or demolition permits, Declarant shall obtain a permit for an on-site construction trailer which shall remain on the property for the life of the permit(s). Said trailer shall contain a copy of the approved site plan and approved construction plans and be accessible to all Town personnel and contractors for review of plans and meetings. Should the Declarant wish to remove said trailer before the issuance of a Certificate of Occupancy, written permission must be obtained for its removal by the Building Division.
3. Lot Consolidation:
Prior to the issuance of a building permit, the Declarant/Owner agrees to consolidate all parcels of the subject property into a single Suffolk County Tax Map parcel if those lots are owned by the same property owner.
4. Expiration:
All required permits, plan submissions, and physical property improvements described herein shall be completed within 36 months of the date of the Town Board resolution approving this application.
OPERATIONAL RESTRICTIONS
5. Hours of Operation:
The hours of operation for all uses on the subject property shall be limited from 5am to 2am. Outdoor storage, sales and display shall be prohibited. The Planning Board reserves the right to further limit the hours of operation, dumpster access or deliveries after a public hearing if substantiated complaints are received.
6. Drive-through Queuing:
The operator of any fast-food restaurant shall be obligated to provide adequate queuing for the orderly operation of the drive-through. If substantiated complaints are received regarding a stacking shortfall which extends off of the subject property into a public right-of-way and/or prevents vehicles from entering or exiting the subject property, the Commissioner of the Town of Islip Planning Department shall notify the then current property owner and the branch manager of the restaurant by certified mail, to prepare and implement a traffic management plan pursuant to 68-423.3 A (2) to correct the queuing failures. If queuing failures and/ or stacking shortfalls are still occurring thirty (30) days after the date of such mailing, the Planning Board, upon fourteen (14) days written notice by certified mail to the property owner and the branch manager of the restaurant, shall be authorized to hold a public hearing to consider imposing reasonable conditions designed to improve the drive-through queuing conditions. The Planning Board of the Town of Islip Planning Department shall maintain sole discretion as to determining whether a queuing failure has occurred and/or a stacking shortfall exists on the property. Notwithstanding the foregoing, a Queuing Failure shall not be deemed to have occurred if the queuing issue is caused by a force majeure event, including but not limited to, a pandemic, epidemic, or other public health event. Nothing in this covenant precludes the Town from enforcing the provisions of the Town Code, in effect as of the date hereof or as may be amended.
7. Litter:
Each restaurant operator shall be responsible for
removing litter associated with their respective restaurant use on the subject property and within any portion of the right-of-way within 50’ from the subject property in any direction of the right-of-way of Suffolk Avenue (CR 100). This shall be done at least once a day.
The subject property shall also be kept clean of litter and debris at all times. The Planning Board shall be solely responsible for the determination regarding adequate maintenance and litter clean up. The Declarant/Owner shall be responsible for adequate refuse collection and for the cost of litter clean up to ensure compliance with this covenant. In the event Declarant/Owner fails to maintain the landscaping or clean up litter and debris as so directed upon 30 days prior written notice from the Planning Department, the Town of Islip also reserves the right to enter onto the subject parcel and complete the required maintenance and assess all costs associated with same to the Declarant/Owner’s next tax bill.
8. Loitering:
Loitering shall be prohibited on the subject parcel. Declarant/Owner agrees to install security camera system that effectively monitors outdoor area of property around each special permitted use. Declarant/Owner agrees to post a sign on outside of building stating “Property Under 24 Hour Camera Surveillance.” If substantiated complaints regarding loitering and/or criminal activity at the site are received by the Town of Islip, the Commissioner of the Town of Islip Planning Department shall notify the property owner by certified mail to take appropriate security measures to deter loitering and/or criminal activity at the site. If the property owner fails to take appropriate security measures within fifteen (15) days of the date of such mailing, the Planning Board reserves the right, after due public hearing, to impose additional reasonable security conditions at the site including, but not limited to: the installation of fencing, lighting, security cameras, and/or the hiring of a private security company to monitor the site. The Planning Board reserves sole responsibility of determining if the Declarant/Owner is in compliance with this requirement.
9. Property Maintenance:
Declarant/Owner further agrees to permanently maintain all improvements and landscaping to the reasonable satisfaction of the Planning Board. The Town or its designee reserves the right to enter onto the subject property after 30 days’ written notice sent certified mail, return receipt requested, to the address of the current owner according to Town of Islip assessment rolls, to remove litter, debris or maintain or replace any fencing or plantings if found that the improvements are not being maintained and shall bill the owner for any expense incurred. All costs associated with same shall be assessed to the owner’s next tax bill.
ARCHITECTURAL ELEVATION
REVIEW & SIGNAGE
10. Architectural Elevation Review:
Prior to filing a building permit application, exterior architectural drawings of all proposed buildings shall be submitted to the Town of Islip Planning Department for review and approval. The submitted architectural elevations shall be in substantial conformance to the plan(s) prepared by Mojo Stumer Associates, P.C. and which is dated May 15, 2024. Said plans shall show all sides of the structure and shall also show the following design elements:
a. All exterior mechanical equipment (rooftop and surface mounted) shall be screened from public view for aesthetic and sound attenuation purposes.
b. Use of EIFS and concrete block shall be limited to accent bands and shall not comprise more than 10% of the building’s façade.
The approved detailed architectural elevations shall supersede the submitted change of zone conceptual elevations for the purposes of regulating the subject property. Any future changes to the approved architectural elevations that are not in substantial conformance with above shall require review and approval of the Planning Board. The Planning Board shall consider the nature and character of the surrounding area, the public hearing record, and architectural specific components of the Comprehensive Plan.
11. Signs:
Declarant/Owner shall obtain a sign permit from the Building Department for any exterior signs. Prior to the issuance of any sign permits, all exterior signs shall be subject to review and approval by the Town of Islip Planning Department. All internally
illuminated facial signage shall be decorative in nature and may include channel-lit, stencil-cut, or halo-lit designs. Light box facial signs shall be expressly prohibited. Freestanding signs shall be a monument style with landscaping at its base to the reasonable satisfaction of the Planning Department. The Planning Department shall review the sign for design compatibility, color, materials, height, quantity and size. Declarant/Owner agrees to waive the right to apply for signage variances from the Zoning Board of Appeals without the prior approval of the Planning Department, which shall not be unreasonably withheld or delayed.

The proposed local law also amends section C25 of the Suffolk County Charter to require that where, due to the recent State law requiring even year elections, a Legislator’s term is extended, any additional year or years served beyond the twelfth year of service shall not be used when determining that Legislator’s term of office for purposes of calculating the number of years served.
The effective date of the proposed local law is subject to the approval of the electorate by a referendum at the next general election to be held on November 4, 2025.

PROCLAMATION OF A LOCAL STATE OF EMERGENCY UNDER SECTION 24 OF ARTICLE 2-B OF THE EXECUTIVE LAW
A State of Emergency is hereby proclaimed in Suffolk County, New York for a period of time beginning at 5:00 p.m. on June 27, 2025 and continuing in effect for a period not to exceed thirty (30) days as required by Section 24 of the New York State Executive Law.
This State of Emergency has been declared as a result of the expiration on May 11, 2023 of 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”), which prohibited the migration into the United States by “covered noncitizens” traveling from Canada or Mexico, resulting in a surge of migration into the United States and into New York State. As a consequence of such, some states have dispersed and delivered asylum seekers to various states throughout the country and, subsequently some municipalities have dispersed and delivered asylum seekers to various counties within New York State. Accordingly, the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
As the Executive of Suffolk County, I, Edward P. Romaine exercise the authority given me under Section 24 of the New York State Executive Law, to preserve the public safety and hereby render all required and available assistance vital to the well-being and health of Suffolk County.
I hereby direct all departments and agencies of Suffolk County to take whatever steps necessary to provide emergency assistance as deemed appropriate.

No. 0200-369.00-05.00-038.000),” enacting a Local Law authorizing the Suffolk County Division of Real Property Acquisition and Management to convey the property located at 15 Woodridge Lane, Coram, New York, Suffolk County Tax Map No. 0200-369.00-05.00-038.000 (the “Property”), ownership of which was previously taken by the County due to nonpayment of taxes, to convey the Property to prior owner Faith M. Raynis. The purpose of this conveyance is to give Faith M. Raynis the opportunity to pay all monies owed to the County of Suffolk, to reclaim the Property, and to avoid further hardship. Local Emergency Order:
Suspending local procurement and contracting laws, rules and regulations
I, Edward P. Romaine, the Chief Executive of Suffolk County, in accordance with (3) Proclamation of a State of Emergency last issued on January 10, 2025, February 7, 2025, March 7, 2025, April 4, 2025, and May 2, 2025, May 30, 2025, and June 27, 2025 for a storm occurring on or about August 19, 2024, pursuant to Section 24 of the New York State Executive Law and my power thereunder to suspend any local laws, ordinances, or regulations, do hereby:
Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

• Chapters 1065 and 189
• Article IV sections A 4-13 and 14
Article V sections A5-1
• Charter section C5-2 (C) and (L)
Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance
• all related procurement laws, rules, and regulations required to comply with this Order; and further
Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further
Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).
