WHEREAS, pursuant to NEW YORK COUNTY LAW Section 274, the Suffolk County Sewer Agency has prepared and submitted to the Legislature of the County of Suffolk, New York, a map, plans, and report including recommendations and estimate of costs pertaining to a proposed extension (the “proposed project” or “Project”) to Suffolk County Sewer District No. 3 – Southwest (the “District”), to be known as Zone D – Holbrook (CP 8167); and
WHEREAS, the map, plans, and report dated March 2024 including recommendations and estimate of costs (the “Map, Plan and Report” or “Report”) filed with the Legislature, sets forth the details of the proposed project, including the construction of sewerage facilities necessary to connect parcels within the boundaries of the extension are to the District; and
WHEREAS, pursuant to Introductory Resolution No. 13252024 and NEW YORK COUNTY LAW Section 254, the Clerk of the Legislature did duly cause a Notice of Public Hearing regarding the proposed project and extension of Suffolk County Sewer District No. 3 – Southwest as a separate zone of assessment to be known as Zone D – Holbrook, to be published at least once in each of the official newspapers of the County and proof thereof has been presented to the County Legislature; and
WHEREAS, pursuant to such Notice of Public Hearing, a public hearing was held by the Legislature of the County of Suffolk in Hauppauge, New York in said County on June 4, 2024 at 2:00 p.m., Prevailing Time; and
WHEREAS, the total cost of the proposed project, as set forth in more detail in the Map, Plan and Report, is estimated to be $12,650,000, with $9,534,861 of the total cost to be funded with American Rescue Plan Act (ARPA”) funds, $3,000,000 through other federal funding provided by the Department of Housing and Urban Development, and $115,139 in County Serial Bonds; and
WHEREAS, the total estimated cost to rate payers within the proposed project or extension area following the approval of the extension, as set forth in more detail in the Map, Plan and Report, which includes the cost for the existing debt service for being included within the District, is estimated to be at a rate of $666 per year for a typical property, which is a commercial property, and $214 for a typical one- or two-family home, and once the proposed project is fully constructed and such properties are connected to the District’s facilities, an additional user fee (operation and maintenance costs) will be charged; and
WHEREAS, Resolution No. 42-2024 made a SEQRA determination and resolved that the proposed extension constitutes an Unlisted Action, pursuant to the provisions of Title 6 NYCRR, Part 617 and Chapter 450 of the Suffolk County Code with no significant adverse impact and therefore, SEQRA is complete; and
WHEREAS, said County Legislature has duly considered the map, plans, and report including recommendations and estimate of costs for the proposed project and extension of Suffolk County Sewer District No. 3 – Southwest as a separate zone of assessment to be known as Zone D – Holbrook as well as evidence given at the public hearing held on June 4, 2024; and
WHEREAS, based on its consideration of the map, plans and report including recommendations and estimate of costs and the evidence given at the public hearing held on June 4, 2024, this Legislature, via Resolution No. 588-2024, adopted findings and determinations and issuing an order in relation to the extension of the District as proposed, however, there was an inadvertent procedural error made subsequent to the adoption of said resolution; and
WHEREAS, this Legislature intends to adopt the findings and determinations and issue an order in relation to the extension of the District based on the consideration of the same map, plans and report including recommendations and estimate of costs originally attached to Resolution No. 588-2024, and the evidence given at the public hearing held on June 4, 2024, in the interest of ensuring that all affected residents are on proper notice of these proceedings, and repeal Resolution No. 588-2024; and
WHEREAS, the Map, Plan and Report is attached hereto to this Resolution and Order as Exhibit “A”; now, therefore be it
1st RESOLVED, that Resolution No. 588-2024 is hereby repealed in its entirety; and be it further
2nd RESOLVED, by the Legislature of the County of Suffolk, New York, as follows:
Section 1. Upon evidence presented at the public hearing and after due consideration of the map, plans, and report including recommendations and estimate of costs filed with the Legislature of the County of Suffolk and attached to this Resolution and Order as Exhibit “A”, the Legislature of the County of Suffolk, New York, hereby finds and determines as follows:
a. The proposed project and the extension of the boundaries of the District are necessary and desirable for the purpose of providing sewage treatment to previously unsewered areas and provide a favorable ecological impact to the County; and
b. The proposed project and the facilities to be constructed within the extension of the District are satisfactory, sufficient, adequate and appropriate; and
c. The proposed project and the boundaries of the extension of the District shall wholly coincide with and are hereby established as a separate zone of assessment of the District to be known as Zone D – Holbrook; and
d. The allocation of the costs for the proposed project and the facilities to be constructed as an extension of the District shall be borne by the zone of assessment established herein to be known as Zone D – Holbrook; and
e. All the property and property owners within the proposed extension of the District are benefitted by the extension of the District; and
f. All of the property and property owners that will be benefitted by the extension of the District are located within the boundaries of the extension of the District; and
g. The establishment of the extension of the District as a separate zone of assessment and the construction of the facilities therein are in the public interest and the cost thereof will not constitute an undue burden on the properties within the extension of the District.
Section 2. Upon evidence presented at the aforesaid public hearing and after due consideration of the aforesaid map, plans, and report including recommendations and estimate of costs filed with the Legislature of the County of Suffolk and attached to this Resolution and Order as Exhibit ‘A’, it is hereby found and determined that the total cost for the proposed project for the extension of the District shall be set at a maximum of $12,650,000, with the cost of the proposed project being funded by American Rescue Plan Act, Federal funds and County Serial Bonds, and such costs shall only be attributed to ratepayers within the extension area and zone of assessment.
Section 3. Upon evidence presented at the aforesaid public hearing and after due consideration of the aforesaid map, plans, and report including recommendations and estimate of costs, the rate payers within the proposed extension of the District will be charged on an ad valorem basis for existing and new debt service, the per parcel benefit charge, plus a user charge (operation and maintenance costs) once connected, consistent with the manner under which the District was established and the manner by which current rate payers of the District are charged, as described and set forth in the map, plans, and report including recommendations and estimate of costs. The combined total of such charges is expected to be $666 per year for a typical property (calculated using the mean value assessed value of commercial properties within the extension area to approximate the mode), which is a commercial property, and $214 (calculated using the mean assessed value to approximate a mode) for a typical one- or two-family residential property, following approval of the extension of the District. The total charge, once connected which is estimated to be in 2027, including the user charge for operation and maintenance, for a typical one- or two-family home in the extension area is estimated to be $425 per year, and the user charge for commercial properties will be charged in a manner similar to other commercial rate payers within the District, which is prorated based on actual water use.
Section 4. Upon evidence presented at the aforesaid public hearing and after due consideration of the aforesaid map, plans, and report including recommendations and estimate of costs, it is further found and determined that it is in the public interest to proceed with the proposed project and expend a maximum amount of $12,650,000 for the extension of Suffolk County Sewer District No. 3 – Southwest, Zone D – Holbrook as a separate zone of assessment, as set forth in such map, plans, and report including recommendations and estimate of costs. and be it further
3rd RESOLVED, IT IS HEREBY ORDERED, by the Legislature of the County of Suffolk as follows:
Section 1. The proposed project which shall include the extension of the boundaries to Suffolk County Sewer District No. 3 – Southwest comprising of a separate zone of assessment hereafter known as Zone D – Holbrook, and such improvements as more particularly described in the map, plans, and report including recommendations and estimate of costs attached as Exhibit ‘A’, are hereby approved.
Section 2. Upon the effective date of this Resolution and Order, and subject to the application to the office of the New York State Comptroller in accordance with section 258 of the NEW YORK COUNTY LAW, if applicable, the Suffolk County Department of Public Works and the Administrative Head of Suffolk County Sewer District No. 3 – Southwest, as extended, are hereby authorized and directed to carry out the improvements and proposed extension to said District as more particularly described in the map, plans, and report including recommendations and estimate of costs attached as Exhibit ‘A’.

PROCLAMATION OF A LOCAL STATE OF EMERGENCY UNDER SECTION 24 OF ARTICLE 2-B OF THE EXECUTIVE LAW
A State of Emergency is hereby proclaimed in Suffolk County, New York for a period of time beginning at 5:00 p.m. on February 7, 2025 and continuing in effect for a period not to exceed thirty (30) days.
This State of Emergency has been declared as a result of the expiration on May 11, 2023 of 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”), which prohibited the migration into the United States by “covered noncitizens” traveling from Canada or Mexico, resulting in a surge of migration into the United States and into New York State. As a consequence of such, some states have dispersed and delivered asylum seekers to various states throughout the country and, subsequently some municipalities have dispersed and delivered asylum seekers to various counties within New York State. Accordingly, the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
As the Executive of Suffolk County, I, Edward P. Romaine exercise the authority given me under Section 24 of the New York State Executive Law, to preserve the public safety and hereby render all required and available assistance vital to the well-being and health of Suffolk County.
I hereby direct all departments and agencies of Suffolk County to take whatever steps necessary to provide emergency assistance as deemed appropriate.

A State of Emergency is hereby proclaimed in Suffolk County, New York for a period of time beginning at 5:00 p.m. on February 7, 2025 and continuing in effect for a period not to exceed thirty (30) days.
The State of Emergency has been declared as a result of the effects of a severe storm on August 19, 2024 which brought torrential rain, strong winds, flash flooding, sinkholes, road buckling and closures, erosion, dam failure, downed trees and power lines, severe property, vehicle and equipment damage, collapse of residences and evacuation of impacted residents.
Such conditions threaten or imperil the public safety of citizens of Suffolk County.
As Chief Executive of Suffolk County, I, Edward P. Romaine, have exercised the authority given to me under New York State Executive Law, Article 2-B, to preserve the public safety and hereby render all required and available assistance vital to the security, well-being, and health of the citizens of the County.
I hereby authorize and direct all Suffolk County Departments, Agencies, and Divisions to take whatever steps necessary to protect life and property and public infrastructure, and to perform other such emergency assistance as deemed necessary.

Order, that due to emergency conditions and the continuing threat to the public health, safety and welfare of Suffolk County residents and visitors posed by coastal storms that caused severe damage and dangerous conditions, for which the State of New York has offered financial assistance to bring the emergency under control, and in furtherance of §103 (4) of the N.Y. General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:
Suffolk County Code: Chapters 1065 and 189
• Article IV sections A 4-13 and 14
Article V sections A5-1
• Charter section C5-2 (C) and (L)
• Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance
• all related procurement laws, rules, and regulations required to comply with this Order; and further
Order, that the County Executive or his designees shall continue to have the authority to enter into any contract deemed necessary to address the threat posed by these storms; and further
Order, that all Suffolk County Departments, Agencies, and Divisions or other duly authorized law enforcement agencies take whatever steps are necessary to assist in performing such emergency measures as deemed necessary.
This order shall cease to be in effect five (5) days after promulgation or upon declaration by the County Executive that the state of emergency no longer exists, whichever occurs sooner. The County Executive nevertheless, may extend such orders for additional periods not to exceed five (5) days each during the pendency of the local state of emergency. Failure to obey this order is a criminal offense, punishable by law under New York State Executive Law § 24 (5).

General Municipal Law, the following procurement and contracting-related laws, regulations and rules are suspended as I deem necessary to address the emergency conditions as follows:

Allowing the County to Quickly Respond to the Potential Arrival of Asylum Seekers
I, Edward P. Romaine, Suffolk County Executive, in accordance with a Proclamation of a Local State of Emergency last issued on January 10, 2025 and February 7, 2025 do hereby find and order as follows:
Whereas, on August 2, 2021 the Federal Government issued an Order pursuant to 42 U.S.C. secs. 362 and 365 (the “Title 42 Order”) prohibiting migration into the United States by “covered noncitizens” traveling from Canada or Mexico;
Whereas, the Title 42 Order expired on May 11, 2023 and upon its expiration, an anticipated surge of migration into the United States commenced resulting with the imminent arrival of individuals into New York State at an increased rate; and
Whereas, Suffolk County recognizes that the anticipated uncoordinated moving of people into the County of Suffolk will result in a severe housing crisis as a result of the limited number of temporary and permanent housing available in the County.
Now, therefore, I, Edward P. Romaine, Suffolk County Executive by the power vested in me by the Suffolk County Charter and the Laws of the State of New York and pursuant to Section 24 of Article 2-B of the New York State Executive Law, do hereby temporarily suspend or modify any statute, local law, resolution, order, rule or regulation or parts thereof, if compliance with such statute, local law, resolution, order, rule or regulation would prevent, hinder or delay action necessary to assist, aid or cope with the aforementioned State of Emergency, and I hereby order the following:
A. The formation of an intergovernmental team (the “intergovernmental team”) that includes the Chief Deputy County Executive, which shall coordinate to assist in meeting the needs of the County as a result of any potential housing crisis in the County.
B. All County Departments are required to work with the County Executive’s office to effectuate any emergency measures that need to be addressed as a result of this Order.
C. No hotel, motel, owner of a multiple dwelling, or shelter in Suffolk County is permitted to contract or otherwise engage in business with any other municipality (an “external municipality”) for the purpose of providing housing or accommodations for asylum seekers without the permission or coordination of Suffolk County. This prohibition extends to any person or entity participating in an external municipality’s government program, or a contract or service funded by an external municipality or acting on behalf of any external municipality or the State of New York.
D. In order to effectuate Suffolk County’s role in this emergency, all procurement policies for the purchase of equipment, supplies or contracts, relating to this emergency, are suspended, specifically: Suffolk County Code Chapters 1065 and 189; Article IV sections A 4-13 and 14; Article V section A5-1; Charter section C5-2 (C) and (L); and Section A5-8, Chap. 575, Chap. 803, Chap. 353 and Local Law 41-2013 to the extent that they require execution of documentation of compliance; and all related procurement laws,

E. Regardless of any other remedy or relief brought by the County for any violation, the County Executive is authorized to direct the County Attorney to commence actions or proceedings in the name of the County, in a court of competent jurisdiction, to abate any violation of, or to enforce any provision of this Emergency Order.
F. Remedies Not Exclusive.
a. No remedy or penalty specified in this Emergency Order shall be the exclusive remedy or remedy available to address any violation described in this Executive Order.
b. Each remedy or penalty specified in the Emergency Order shall be in addition to, and not in substitution for or limitation of, the other remedies or penalties specified in this Emergency Order or in any other applicable law.
c. Any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any other remedy or penalty specified in the Emergency Order or in any other applicable law.
d. In particular, but not by way of limitation, each remedy and penalty specified in this section shall be in addition to, and not in substitution for or limitation of, the penalties specified in New York Executive Law Section 24, and any remedy or penalty specified in this section may be pursued at any time, whether prior to, simultaneously with, or after the pursuit of any penalty specified in New York Executive Law Section 24.
G. Effective Date
