All assignments and projects will be discussed in class and the students will be graded according to their attendance, participation, and generation of new ideas.

The grades will be assigned according to the following criteria.

Grade F: student failed to complete the work for the course and/or failed to meet the minimum required competency in all the required course outcomes Grade D: student completed the work for the course at a passing level of competency in all required course outcomes Grade C: student completed the work for the course and illustrated basic acceptable competencies in all required course outcomes Grade B: student completed the work for the course at a high quality and mastered new skills. Maintain an environment of constructive criticism when commenting on the work of other students.

Issues of Insurance & Ethics Issues of insurance requirements are a huge part of any architects’ job or even anyone’s job. This comes down under the jobs code of ethics which sets the obligations for the firm or the employee.

For an architect or and architecture firm Professional Liability is the number one most important insurance coverage which they must have. Following their ethics which contain; General Obligations, Obligations to the Public, Obligations to the Profession, Obligations to Colleagues, Obligations to the Environment & Obligation to the Client.

Those may all be put under agreements with the client and architect – which are provided by the AIA in the Contract Documents; which shows you the different types of agreements and samples which you can purchase which are revised. Generally speaking there are different types of Architectural Contracts, which range from Verbal Agreements – which aren’t a good idea as there aren’t any guarantees; Letter Agreements – which are written down and portray a clear understanding between the client and architect; Owner Generated Agreements; Purchase Orders; AIA Standard Agreements.

However, beforehand, the architect has a job of making sure the client has knowledge about the following: a realistic understanding of the projects budget, a realistic understanding of the schedule for the project, and have a full understanding of the role of the architect.

As the AIA states “Doing the right thing… in the right way… with the right people… and the right results will come.”

Ray and Maria Stata Center – Cambridge, Massachusetts, USA Designed by architect Frank Gehry, was the Ray and Maria Center or commonly called the Stata Center. Built on the MIT site Building 20 was the center which was meant to carry the space innovations spirit this is why Gehry called it “the geek palace” – as his concept was explained to be “a party of drunken robots who got together to celebrate.” Which was opened in Spring 2004.

The center had sections which seemed to be falling on top of each other, which had labs, offices, meeting rooms and also classrooms.

As Frank was very happy with the design, MIT wasn’t – and proceeded to file a lawsuit against Frank Gehry who is the leading architect and designer & the

construction firm. MIT said “Gehry was negligent in designing the building, and both him and the construction firm have breached their contractual obligations and were involved in negligence.”

The lawsuit which was set due to their breach of contractual obligations shows how an architect can go against insurance and ethics measures. As MIT continued to say: “design and construction failures on the Stata Center project which resulted in masonry cracking, poor drainage, persistent leaks, sliding ice and snow from the building, mold growth.”

Many of those issues were reflecting on emergency exits which blocked them, which is also a breach of safety – while also damaging other building elements.

Through the lawsuit – it was shown that there was a dispute in whether the failure was coming from the construction firm: Skanska or the architect: Frank Gehry – the at fault party had to repair the costs MIT had to pay to fix the failures.

Gehry alleged that the fault was coming from Skanska the construction firm – and that they should be held accountable. However, Skanska had a different image. They considered that it was never a construction issue and said; “This

is not a construction issue, never has been. We worked hard to work with MIT to bring this to resolution… but it was a design issue.”

As word went around, Skanska later reported that the design of the amphitheater was defective and needed revision from Gehry’s part to the weak drainage it had – and when they informed Gehry he ignored the comment.

Gehry later said along the lines of, that a design as big and complicated as this one and described the design to be “seven billion pieces of connective tissues being put together” that there is a huge chance of a small part going wrong – also adding that construction issues are always apparent in complex designs However, I believe that his past statement is false as we try as much as possible to abide by the contractual agreement – and try to fix any faults that may occur and own up to them.

Gehry also commented that the main reason behind any of the faults was due to value engineering and the need to cut down costs, for example some things were left out of the design to cut down on cost, such as certain roof devices weren’t added – and that MIT is after their insurance; as the flaws are very small.

Later in 2006 and 2007, MIT hired a new designer and construction firm to fix all the issues that were at fault – that cost them $1.5 million. Adding the initial cost which was payed to Gehry for the project $15 million & the whole project costing $300 million.

In 2010 MIT settles the lawsuit against Frank Gehry and Skanska the Construction firm – as most of the problems have been repaired.

Skanska later says that the problems with the design and construction have been resolved – and that the problems were mainly coming from the design rather than the construction.

Gehry continues to deny that, and continued to say that the defects all came from construction.

The Ray and Maria Stata center issues were resolved and came to a settlement and now the center operates normally.

The Architectural Engineer & General Contractor & Owner, must have a strong relationship, as one of them completes the other.

The Architectural Engineer and General Contractor need to coordinate together the project to ensure the outcome comes as planned.

The Architectural Engineer needs to make sure the owner who may aswell be the contractor, knows the realistic budget for the project, project schedule.

Question 6 (2 marks) Mention the key information needed for profit planning of an architectural firm – do you believe other items need to be included and why?

A profit plan is key for the success of any Architectural firm, that helps it to know what is financially possible for them to do, and what isn’t, as it’s a form of budgeting, and needs to be done before each year.

Main features needed in a profit planning is for example calculating the salary for each employee using the utilization rate and total labor, how much is spent on equipment, how much is spent on projects, the taxes payed, payed bills, direct and indirect expenses – all should be discussed in detail.

I believe everything mentioned is of great value for the profit plan and makes it easier for the firm to discuss its finances and to be able to know where to cut costs if needed. I believe that it includes everything needed, such as extras like bonuses and indirect expenses which one may forget sometimes.
