I lotti soggetti a questo tipo di dilazione verranno custoditi gratuitamente presso la sede della MEETING ART e verranno consegnati all’acquirente ad avvenuto pagamento dell’importo totale.

Inoltre Meeting Art raccomanda vivamente agli acquirenti di visonare personalmente i lotti offerti i quali sono soggetti alle condizioni di vendita.

STIME / BASI D’ASTA

Accanto a ciascuna descrizione dei lotti in catalogo, è indicata una base d’asta che non include le commissioni di vendita. L’asta e battuta in Euro €. Inoltre, in alcuni casi, è possibile che vengano indicate delle stime che corrispondono al probabile valore di mercato del lotto. Sia le stime che le basi d’asta riportate in catalogo sono indicative e possono essere soggette a revisione.

Accanto a ciascuna descrizione dei lotti in catalogo, è indicata una base d’asta che non include le commissioni di vendita. L’Asta è battuta in Euro (€). Inoltre, in alcuni casi, è possibile che vengano indicate delle stime che corrispondono al probabile valore di mercato del lotto. COMMISSIONE ACQUIRENTI

Il prezzo di riserva corrisponde al prezzo minimo conﬁdenziale al di sotto del quale il lotto non sarà venduto. Può essere superiore alla base d’asta indicata sul catalogo. La Meeting Art si riserva il diritto di formulare un’offerta nell’interesse del venditore ﬁno al raggiungimento della riserva. I lotti senza riserva sono segnalati sul catalogo con la dicitura “offerta libera”.

COMMISSIONE ACQUIRENTI

Oltre al prezzo di aggiudicazione finale l’acquirente dovrà corrispondere un premio del 25% (diritti d’Asta) IVA compresa.

Oltre al prezzo di aggiudicazione ﬁnale l’Acquirente dovrà corrispondere un premio del 23% (diritti d’asta).

Le vendite effettuate da Meeting Art in virtù di rapporti di commissione stipulati con privati consumatori o con soggetti IVA, che operano nel regime del Margine, sono assoggettate al regime del Margine, sancito dall’arT 40 bis D.L. 41/95. Per tali vendite Meeting Art non applicherà né l’IVA sui servizi resi al compratore, né l’IVA sul prezzo di aggiudicazione. Tale regime IVA non si applica alle vendite di beni provenienti da soggetti IVA che abbiano già detratto l’imposta all’atto dell’acquisto e alle vendite di beni in temporanea importazione, fattispecie disciplinate dalla normativa generale vigente. L’I.V.A. sul prezzo di aggiudicazione è rimborsabile solo a fronte di provata esportazione Extra-Ue avvenuta entro tre mesi dalla data della vendita la cui documentazione di prova sia pervenuta in Meeting Art entro quattro mesi della suddetta data. L’I.V.A. sulla commissione e sul prezzo di aggiudicazione non è applicabile a soggetti I.V.A. non italiani residenti in paesi Ue.

ESPOSIZIONE PRIMA DELL’ASTA

Le vendite effettuate da Meeting Art in virtù di rapporti di commissione stipulati con privati consumatori o con soggetti IVA, che operano nel regime del margine, sancito dall’art. 40bis DL 41/95. Per tali vendite Meeting Art non applicherà né IVA sui servizi resi al compratore, né Iva sul prezzo di aggiudicazione. Tale regime IVA non si applica alle vendite dei beni provenienti da soggetti IVA che abbiano già detratto l’imposta all’atto dell’acquisto e alle vendite di beni in temporanea importazione, fattispecie disciplinate dalla normativa generale vigente. Le esposizioni prima della vendita sono aperte al pubblico e si terranno dal sabato antecedente all’inizio della vendita all’asta e durante la stessa. Per i preziosi e gli orologi l’esposizione si terrà il venerdì, il sabato e la domenica antecedente l’inizio della vendita all’asta e durante la stessa.

REGISTRAZIONE ALL’ASTA

Le esposizioni prima della vendita sono aperte al pubblico gratuitamente e si terranno dal sabato antecedente l’inizio della vendita all’asta e durante la stessa. Per i preziosi e gli orologi l’esposizione si terrà il venerdì, il sabato e la domenica antecedenti l’inizio della vendita all’asta e durante la stessa, I lotti invenduti saranno esposti per una settimana dopo la ﬁne della stessa.

E’ possibile fare offerte prima dell’inizio e durante l’asta contattando il numero 0161 2291.Previo accordo con l’Ufficio Offerte, Meeting Art potrà organizzare collegamenti telefonici durante l’asta. All’Acquirente sarà richiesto di comunicare il limite massimo dell’offerta qualora ci fossero problemi di collegamento telefonico. Per i lotti “senza riserva” il cliente potrà essere contattato ma solo nel caso faccia un’offerta e su precisa richiesta, qualora tale offerta fosse superata durante l’asta, l’offerente sarà richiamato telefonicamente per poter partecipare alla gara con una successiva battuta d’asta.

E’ possibile fare offerte prima dell’inizio dell’asta e durante l’asta stessa contattando il numero 0161.2291. Previo accordo con l’Ufﬁcio Offerte, per lotti con base d’asta uguale o superiore a 500,00 € Meeting Art potrà organizzare collegamenti telefonici durante l’asta. All’acquirente è richiesto di comunicare il limite massimo dell’offerta, qualora ci fossero problemi di collegamento telefonico. Per i lotti ad “offerta libera” il cliente potrà essere contattato, ma solo nel caso faccia un’offerta e su precisa richiesta. Qualora tale offerta fosse superata durante l’asta, l’offerente sarà richiamato telefonicamente per poter partecipare alla gara con una successiva battuta d’asta.

Per poter fare offerte tramite internet bisogna essere registrati (Vedi “Registrazione all’Asta”) successivamente il cliente potrà registrarsi al servizio web tramite il collegamento al sito www.meetingarTit, dove potrà scegliere un “nome utente” ed una “password” con i quali, dopo nostra conferma, potrà partecipare all’asta attraverso l’apposito link “accedi” che si trova in home page. Per i nuovi clienti che non hanno mai acquistato è fissato un tetto massimo di € 5.000, 00 (Cinquemila/00) per le offerte inviate tramite web, è comunque possibile effettuare offerte per importi superiori telefonicamente.

Il colpo di martello indica l’aggiudicazione del lotto e in quel momento l’acquirente si assume la piena responsabilità del lotto. I risultati della vendita saranno pubblicati dopo l’asta. Gli acquirenti dovranno corrispondere il prezzo di aggiudicazione più i diritti d’asta e l’I.V.A. dove applicabile entro 7 giorni dal termine della stessa e dovranno essere ritirati entro 15 giorni, trascorsi i quali verranno trasferiti presso una Società di magazzinaggio esterna, il costo di tale servizio è di € 1,00 giornalieri per ogni singolo oggetto. Dopo la visione e la conferma di un lotto, non si accettano, a posteriori, contestazioni sull’integrità dell’opera, siamo lieti di fornirVi una relazione contenente le condizioni generali del suddetto bene. Poiché non siamo né restauratori né conservatori professionisti, Vi preghiamo di rivolgerVi a un Vostro restauratore o conservatore di fiducia, il quale potrà rilasciare una relazione dettagliata e professionale. All the auctions are subject to the conditions of sale printed in the catalogue. Meeting Art strongly recommends the Bidders to read carefully this section, as it contains the purchase conditions of all properties in auction.

ESTIMATES / STARTING BIDDINGS

The estimate price is printed under the description of every lot in the catalogue as a starting bid only and is not inclusive of Buyer’s Premium. The estimates may, at times, approximately represent the lot’s market value. Estimates and starting bids are set well in advance and may be subject to change before the auction.

RESERVE

The reserve price is the confidential minimum auction price, below which a lot will not be sold. At times, the reserve price may be higher than the estimate printed in the catalogue. Meeting Art riserve the rights to place bid(s) in the Seller’s interest, in order to match the reserve price. Is the lots are offered without reserve, these lots are indicated in the catalogue as “Senza riserva” (free bid).

The reserve price is the conﬁdential minimum auction price, below which a lot will not be sold. At times, the reserve price may be higher than the estimate printed in the catalogue. Meeting Art reserves the rights to place bid(s) in the Seller’s interest, in order to match the reserve price. Is the lots are offered without reserve, these lots are indicated in the catalogue as “Offerta libera” (free bid).

BUYER’S PREMIUM

The Buyer’s Premium will be calculated at 25% of the Hammer price (VAT included) and is required to be paid additionally to the Hammer price.

STIME / BASI D’ASTA

Il mandato a vendere ha una durata di anni 1 ed è rinnovato tacitamente, la risoluzione del contratto dovrà avvenire tramite lettera raccomandata con ricevuta di ritorno entro trenta giorni dalla scadenza. Il termine di un anno potrà, tuttavia, essere ulteriormente prorogato in caso di ritardo nella messa in vendita del bene per cause non imputabili a Meeting ArT Nell’esecuzione del mandato a vendere, Meeting Art si riserva la facoltà di decidere:

(a) le modalità con cui un lotto viene offerto in vendita;

(b) la descrizione e l’illustrazione dell’opera nel catalogo o le eventuali relazioni sulle sue condizioni; (c) la data e il luogo dell’asta/e;

(d) di consultare esperti o restauratori di propria scelta e di fare effettuare esami o analisi in relazione all’opera, prima o dopo la vendita.

COMMISSIONE ACQUIRENTI

Oltre al prezzo di aggiudicazione ﬁnale l’Acquirente dovrà corrispondere un premio del 23% (diritti d’asta).

REGIME IVA (REGIME DEL MARGINE)

Si precisa che ogni stima fornita dalla casa d’aste, scritta o orale, rappresenta un’opinione meramente indicativa. Il mandante non potrà dunque fare affidamento su una stima come previsione del prezzo di vendita. Meeting Art si riserva in ogni caso la facoltà di modificare, in ogni momento ed a propria discrezione, ogni stima che abbia fornito. Inoltre, ogni rappresentazione, scritta o orale (incluse quelle pubblicate su ogni catalogo), relazione, guida o stima, relative ad ogni caratteristica o qualità dell’opera, incluso il prezzo o il valore, costituiscono mere opinioni e possono essere modificate prima che l’opera sia offerta in vendita, incluso il periodo in cui il lotto è esposto al pubblico. Pertanto, né Meeting Art, né i suoi dipendenti o consulenti saranno responsabili di errori od omissioni contenuti nelle sopra citate rappresentazioni.

2. SPESE A CARICO DI MEETING ART

Meeting Art assorbirà tutte le spese relative alla organizzazione, alla pubblicità, alla stampa ed alla diffusione del catalogo d’asta.

3. SPESE A CARICO DEL MANDANTE

a) Costi di trasporto e consegna dei lotti presso la sede di Meeting ArT

b) Assicurazione incendio e furto 1% da calcolarsi sul prezzo di riserva con un minimo di 10 €. c) Commissione del 30% calcolata sul Prezzo di Aggiudicazione fino ad € 999,00 e del 15% oltre tale importo.

d) Spese sostenute da Meeting Art in nome e per conto del Mandante e spese per operazioni bancarie ai tassi correnti.

Per partecipare all’Asta, è necessario essere registrati fornendo un documento di identità valido, il codice ﬁscale, un recapito telefonico e la liberatoria

e) DDS: Diritto di Seguito (Droit de Suite) Dlgs n.118 del 13/02/2006, in vigore dal 9 aprile 2006 in Italia, ossia il diritto dell’autore (vivente o deceduto da meno di 70 anni) di opere di arti figurative e di manoscritti a percepire una percentuale sul prezzo di vendita degli originali delle proprie opere in occasione delle vendite successive alla prima. Avvertenza: la legge n. 34 del 25 febbraio 2008 (G.U., supplemento ordinario, n. 56 del 6 marzo 2008), all’arT 11 modifica l’art 150 della legge sul diritto d’autore (n. 633/41), prevedendo una diversa modalità di computo del diritto. La nuova normativa è applicabile dalle vendite effettuate dal 21 marzo 2008 in poi. Tale diritto sarà a carico del Venditore e sarà calcolato sul prezzo di aggiudicazione o di vendita uguale o superiore ai 3.000€ e non potrà in ogni caso essere superiore ai 12.500€ per ciascun Lotto.

Il Mandante garantisce implicitamente a Meeting Art ed al compratore di essere il vero proprietario o di essere autorizzato a vendere il bene in questione dal proprietario e di poter legalmente trasferire il bene ed il relativo diritto di proprietà libero da rivendicazioni da parte di terzi, da ipoteche e da diritti di ritenzione; garantisce inoltre che il bene non è oggetto di rivendicazione da parte del Governo o di Autorità Statali o Locali e di aver fornito alla Meeting Art tutte le informazioni in suo possesso relativamente alla provenienza del bene, il Mandante si impegna ad indennizzare la Meeting Art, i suoi funzionari, agenti e il compratore per qualsiasi perdita o danno sofferti da ciascuno in conseguenza di inadempienza a quanto indicato sopra. Garantisce altresì di aver rispettato le norme vigenti per l’importazione o l’esportazione dei Lotti. Si assume tutte le responsabilità relative all’autenticità e ad eventuali plagi. Dà consenso alla cessione, sollevando Meeting Art, per qualsiasi pretesa che l’autore dovesse avanzare sull’opera. Il mandante si impegna a manlevare e tenere indenne la casa d’aste da qualsiasi richiesta, pretesa, reclamo e/o azione, di qualsivoglia natura, avanzata da terzi, compreso l’acquirente dell’opera, in dipendenza, tra l’altro, della erroneità, non veridicità e/o parzialità (anche solo presunte) delle informazioni dichiarazioni e garanzie rilasciate alla casa d’aste; indipendentemente dall’ipotesi in cui l’acquirente promuova eventualmente un giudizio nei confronti della casa d’aste, quest’ultima è autorizzata a svelare l’identità del mandante anche prima e non appena sia a conoscenza delle pretese dell’acquirente ed indipendentemente dalla loro fondatezza. Il mandante dichiara altresì che non esistono limitazioni al diritto di riprodurre l’opera ovvero di aver già acquisito ogni più opportuna autorizzazione a tale riguardo, manlevando in ogni caso la casa d’aste da qualsiasi pretesa e/o azione di terzi con riferimento alla eventuale realizzazione e/o utilizzo delle immagini dell’opera.

5. RISERVE

Agli oggetti affidati è attribuito un prezzo di riserva in euro (€), prezzo di battuta minimo a cui il lotto può essere considerato venduto. Meeting Art potrà a suo giudizio vendere ad un prezzo di battuta inferiore alla riserva, in questo caso, sarà garantito al venditore il prezzo di riserva. Il venditore non potrà fare offerte o incaricare terzi di offrire per suo conto. Qualora accadesse Meeting Art non si assumerà nessuna responsabilità.

INCREMENTI DELLE OFFERTE

6. AUTORIZZAZIONE A DEDURRE COMMISSIONI DEL MANDANTE E SPESE

Per tutti i lotti in catalogo è riportata la Base d’Asta che corrisponde alla cifra di partenza della vendita.

Per i lotti ad “offerta libera”, l’offerta minima è di 50,00 € e subisce l’incremento di 50,00 €

Il Mandante autorizza Meeting Art a dedurre le commissioni al “tasso stabilito” e le “spese” (vedi punto 3) dal prezzo di aggiudicazione.

Salvo il caso di dolo o colpa grave, Meeting Art non è responsabile per la perdita o il danneggiamento causati alle cornici o al vetro che contengono e/o coprono stampe, dipinti o altre opere (a meno che la cornice o il vetro non costituiscano l’opera venduta all’asta). In nessun caso, la casa d’aste è responsabile per la perdita o il danneggiamento verificatisi a seguito di un qualsiasi intervento (compresi interventi di restauro, interventi sulle cornici e interventi di pulitura) da parte di esperti indipendenti incaricati dalla casa d’aste con il consenso del mandante o per la perdita o il danneggiamento causati o derivanti, direttamente o indirettamente, da:

a) cambiamenti di umidità o temperatura;

Gli incrementi sopra riportati sono sempre a discrezione del banditore.

b) normale usura o graduale deterioramento derivanti da interventi sul bene e/o da vizi o difetti occulti (inclusi i tarli);

c) errori di trattamento.

AGGIUDICAZIONI E PAGAMENTI

Qualora non fossero stati presi accordi differenti, Meeting Art si assumerà il rischio di perdite o danni al bene ad essa consegnato o comunque sotto il suo controllo per la vendita, fino al passaggio di proprietà, o al ritiro dello stesso da parte del mandante. In tal caso la responsabilità di Meeting Art per perdite o danni al bene non sarà superiore al prezzo di riserva detratte le commissioni, l’assicurazione e le spese sostenute in nome e per conto del Mandante. In nessun caso Meeting Art non sarà responsabile per rotture di vetri o cornici delle opere.

8. RISOLUZIONE DELLA VENDITA

Ritiro dei lotti aggiudicati

Qualora il contratto di vendita dell’opera, per una qualsiasi causa, divenga inefficace, sia risolto, sia annullato, o sia dichiarato nullo e la casa d’aste debba conseguentemente rimborsare all’acquirente, in tutto o in parte, il prezzo di aggiudicazione e la commissione d’acquisto pagati da quest’ultimo, il mandante si impegna a restituire a Meeting Art la somma che quest’ultima gli ha corrisposto per la vendita dell’opera, salvo, in ogni caso, il diritto della casa d’aste al risarcimento dei danni eventualmente subiti. Qualora, pertanto, il compratore richiedesse di risolvere la vendita e gli esperti incaricati all’esame del pezzo contestato confermano che la contestazione del compratore è giustificata Meeting Art è autorizzata a considerare risolta la vendita e a rifondere al compratore la cifra pagata a Meeting Art per il pezzo in questione, il Mandante si impegna in tal caso a restituire a Meeting Art i proventi della vendita pagati loro da Meeting Art per l’oggetto contestato, all’atto della restituzione della somma comprensiva delle spese sostenute da Meeting Art per la risoluzione della vendita, Meeting Art restituirà l’oggetto al Mandante.

9. PAGAMENTO

Gli oggetti saranno ritirati dall’acquirente a sua cura e rischio previo pagamento da effettuarsi secondo le suddette modalità. Meeting Art non è responsabile per danneggiamenti a seguito di modiﬁche, riparazioni o restauri richiesti dall’acquirente. Ritiro di lotti con delega

Meeting Art corrisponderà al Mandante un importo pari al prezzo di Aggiudicazione deducendo commissione e spese dopo 30 giorni lavorativi dalla data del termine dell’asta a mezzo bonifico bancario o assegno da ritirare presso gli uffici della Meeting ArT Qualora il Compratore effettui il pagamento dovuto in ritardo, Meeting Art corrisponderà il pagamento al cliente entro 5 giorni successivi alla data di ricevimento del pagamento dell’acquirente. Qualora invece non pervenisse il pagamento da parte del Compratore entro 30 giorni lavorativi dalla data del termine dell’asta e Meeting Art volesse corrispondere ugualmente i proventi di vendita

al Mandante, il diritto di proprietà dei lotti passerà a Meeting Art. Qualora invece, venisse, accordato al Compratore un pagamento rateale, Meeting Art si riserva la facoltà di corrispondere al mandante l’importo equivalente allo scadere di ogni rata. In ogni caso, Meeting Art corrisponderà il prezzo al mandante, dedotte commissioni e spese, soltanto una volta ricevuto il pagamento da parte del Compratore.

13. AUTENTICITA’ DEL BENE

Il Mandante autorizza Meeting Art ad eseguire qualsiasi ricerca, testo controllo che possa essere ritenuto necessario alla verifica dell’autenticità delle opere, addebitando al Mandante le relative spese sostenute.

10. REVOCA DEL MANDATO E ADDEBITI PER LOTTI RITIRATI

Meeting Art si riserva la facoltà di rinunciare liberamente al mandato, senza incorrere in alcuna responsabilità nei confronti del mandante qualora si verifichino particolari circostanze che possano giustificare lo scioglimento del contratto, quali ad esempio:

a) ragionevoli dubbi sulla autenticità, provenienza e/o attribuzione dell’opera ovvero sulla veridicità di qualsiasi dichiarazione, informazione e/o garanzia rilasciata dal cliente;

b) modificazioni o danni all’opera tali da alterarne in modo sostanziale le condizioni ovvero da impedirne la messa in vendita e causati da fatti non imputabili al mandatario;

c) danni subiti dall’opera che ne modifichino in modo sostanziale le condizioni.

COMMISSIONE ACQUIRENTI

Oltre al prezzo di aggiudicazione ﬁnale l’Acquirente dovrà corrispondere un premio del 23% (diritti d’asta).

REGIME IVA (REGIME DEL MARGINE)

Qualora, invece, fosse il mandante a revocare il mandato a vendere o qualora un lotto fosse ritirato per ragioni che non siano errata attribuzione o autenticità, Meeting Art si riserva il diritto di addebitare una somma pari alle commissioni di vendita ed acquisto calcolate sull’ultima offerta pervenuta ove non ne siano giunte sul prezzo di riserva, per le opere ad offerta libera su un minimo di 500 € e delle spese in relazione al bene medesimo. La revoca da parte del mandante avrà efficacia solo dopo il pagamento dell’importo dovuto dal medesimo, riservandosi Meeting Art il diritto di trattenere presso di sé il bene, a spese e a rischio del cliente, fino a quando quest’ultimo non avrà pagato quanto dovuto.

11. DIRITTI DI RIPRODUZIONE

Il Mandante dovrà rispettare le norme vigenti sul “diritto d’autore” (Copyright). Meeting Art avrà il diritto di effettuare fotografie e riprese video e, comunque di riprodurre l’immagine di qualsiasi lotto affidatole per tentata vendita. Tutti i relativi diritti spetteranno a Meeting Art, che potrà utilizzarli in ogni forma ritenuta opportuna.

12. LOTTI INVENDUTI E/O RESI

ESPOSIZIONE

REGISTRAZIONE ALL’ASTA

Meeting Art metterà a disposizione del mandante le opere invendute dopo 15 giorni dal termine dell’asta. Il Mandante provvederà al ritiro degli oggetti a propria cura e spese, per ogni lotto invenduto e/o reso, il Mandante é tenuto a pagare l’assicurazione, le spese sostenute da Meeting Art in nome e per conto del Mandante (vedi punto 3) più un contributo sulle spese di segreteria pari a € 10. Trascorsi 60 giorni dal termine dell’asta per ogni lotto è previsto un costo di magazzinaggio pari a 3 € al giorno, salvo che concordi una riduzione dei prezzi di riserva e conceda il tempo necessario all’effettuazione di ulteriori tentativi di vendita da espletarsi anche per trattativa privata.

The VAT is refundable only upon producing proof of Extra UE Export within 3 months of the sale date, this needs to be received by Meeting Art within 4 months of the same date. VAT will not be applied on the purchase or on the Buyer’s Premium for non-Italian customers living in a EU Country and for Italian customers who reside in EU countries.

5. RESERVES

Bids can be submitted via phone before the start of the live auction or during the auction itself by phoning +39.0161.2291. Meeting Art will be pleased to call the Bidder on the phone during the live auction for lots with starting bid equal or greater than € 500,00. Arrangements have to be made prior to the auction with our Bid Ofﬁces. The Bidder will be required a maximum bid, in case of problems with the phone line arising . For lots starting with free bid (offerta libera) the customer may also be contacted during the live auction, however an offer has be placed and a phone call needs to be speciﬁcally requested by the Bidder for this to take place. In case a greater bid is placed by another Bidder during the auction, Bidders will be called back in order to be able to make a new relevant higher bid.

Internet bids

The above items are assigned a reserve price in euro (€), the minimum bid price at which the lot can be considered sold. Meeting Art may in its sole discretion sell at a lower price than the reserve, in this case, the seller will be guaranteed the reserve price. The seller can not bid or assign third parties to offer on his behalf.

If the contract for the sale of a work becomes ineffective for any reason, is resolved, is annulled or is declared null and the auctioneer has to reimburse the purchaser in whole or in part the price of the award and the purchase commission paid by the latter, the principal undertakes to return to the Meeting Art sum paid by him for the sale of the work, except in any case ,the right of the auctioneer to compensate for any damages suffered .

6. AUTHORIZATION TO SUBMIT COMMITMENTS OF THE MANDATORY AND EXPENDITURE

After registering, customers will be able to access our web services via our website www.meetingart.it, choosing a user name and password. Upon conﬁrmation from Meeting Art, customers will then be able to submit bids through the relevant link on our Home Page. For new customers, who never bought, there is a limit of 5.000 for web offers. Therefore, it is always possible to make superior offers by phone.

The Mandate authorizes Meeting Art to deduct commissions at the “established rate” and “charges” (see point 3) from the award price.

10. REVOCATION OF THE MANDATE AND DEBITS FOR RETIRED LOTS

Meeting Art will make the unsold works available to the sender after 15 days from the end of the auction. The Mandator will pay for the insured, the expenses incurred by Meeting Art in the name and on behalf of the Mandator (see point 3) for each unsold and / or rendered item, plus a contribution on secretarial expenses of € 10.

After 60 days from the end of the auction each batch is subject to a storage charge of 3 € per day, unless it agrees to a reduction in reserve prices and allows the time to carry out additional sales attempts to be completed also for private deal.

Meeting Art is entitled to require from the Buyer immediate payment in full and in Euro of the Hammer Price plus the Buyer’s Premium. The payment must be made within seven days from the purchase.

Neither Meeting Art nor its staff has the authority to make or give any representation or warranty , except for cases provided by law.

Instructions for payment and collection of purchased lots can be found in the catalogue or in the website. If the Buyer fails to pay the amount due Meeting Art, reserving the right to further damages, shall be entitled to:

a) enforce the contractual purchase obligation.

b) arrange a resale of the Lot, through private treaty or during the following auction, keeping as a penalty any amount already paid by the Buyer. Meeting Art shall retain items sold at risk and Buyer’s own expense until the selling of the lot or until the restitution to the Seller, if required. In any case, until the sale date, The Buyer will have to pay a penalty equal to the interest, calculated on the Hammer price plus the Buyer’s premium, according to the interbank rate in force increased of two points: the interest so calculated shall be applied on the amount from the eighth day following the Sale.

9. The estimates and the starting biddings regarding the possible Sale price of each lot are printed under the description of every lot in the catalogue and are not Buyer’s premium inclusive. Estimates and starting bids are prepared well in advance so they can be subject to revision. The description of the lots in the catalogue could be subject to revision, as well. In that case an appropriate communications to the public will be made during the auction.

COLLECTION OF THE LOTS

3. Meeting Art reserves the right to withdraw any lot from the auction. During the auction, the Auctioneer is entitled to join or separate any two or more lots and to change the order of the sale. The Auctioneer, at his/her sole discretion, can also withdraw lots if the bids do not reach the reserve price, as agreed between Meeting Art and the Seller.

Pursuant to art. 59, paragraph 1, letter m) of the consumer code, if the auction sale contract is concluded with a bidder who has formulated an online offer via the site and/or platform and can be qualified as a consumer according to the ‘art. 3, paragraph 1, letter. a) of the consumer code, the Buyer will not have the withdrawal right, for the fact that the sales method used is a public auction, as defined by the art. 45, paragraph 1, letter. o) of the consumer code.

3. AUCTION FEES

The Buyer, after the payment of the Hammer price and the Buyer’s premium, has to collect the lots at his own risk and cost within the days specified in the paragraph “Buying at Meeting Art”. After this time, Meeting Art shall not be held liable by the Buyer for the custody or for any possible deterioration of the items. Moreover, Meeting Art will have the right to transfer lots which have not been collected at the risk and buyer’s own expense to its offices or warehouse.

EXEMPTIONS

In addition to the hammer price the buyer shall pay, for each lot, a premium of 25% on the hammer price. Meeting Art will apply the Margin Scheme for more information regarding the margin scheme and these charges, please see Commission, Premium, VAT and charges in this catalogue). In some special cases, VAT is applied to items delivered by sellers subject to VAT which will be subject, in addition to VAT calculated on the auction commission, also for VAT calculated on the hammer price.

4. In addition to the hammer price the buyer shall pay, for each lot, a premium of 23% on the hammer price. Meeting Art will apply the Margin Scheme (for more information regarding the margin scheme and these charges, please see Commission, Premium, VAT and charges in this catalogue).

4. HOW TO PARTICIPATE

5. Before the auction each prospective Buyer must complete and sign a registration form including personal data and bank references, in order to bid through an assigned number. If the registration form is not completed and signed, any eventual sale will not be valid.

5 DESCRIPTION OF THE LOTS

Despite any contrary provisions in these “Conditions of Sale”, Meeting Art reserves the right to agree with the Sellers special conditions of payment, to arrange for warehousing, to decide for the insurance of the object sold, to sell privately the lots sold uncollected, to settle any disputes made by or against the Buyers and, in general to take any action deemed appropriate for the collection of the amounts due by the Buyer and, if necessary, to cancel the Sale and return the price to the Buyer in accordance with articles 13 and 14 below.

EXPORT

For all lots dating before age 70, their export is subject to the regulations of the Italian Ministry for Cultural Heritage and Activities, Export Office. Meeting Art cannot provide any guarantees regarding the issue of a Free Circulation nor on the time needed for the same. Buyers are required to comply with all laws and regulations in force in relation to the objects subject to notification, with particular reference to AcT 1089 of 1 June 1939 The export of objects is governed by the above regulations and customs laws and tax regulations. Meeting Art disclaims any liability to any purchaser with regard to any restrictions on the export of the sold lots. The contractor shall not, in the event of exercise of the right of first refusal on the part of the state, claiming Meeting Art or the seller any refund or compensation. The Legislative Decree of 22 January 2004 n. 42 regulating the export of cultural goods outside the territory of the Italian Republic, while the export outside the European Community is also subject to the regulations laid down by EEC Regulation no. 3911/92 of 9 December 1992, as amended by Regulation EEC n. 2469/96 of 16 December 1996 and the EEC Regulation no. 974/01 Meeting of May 14, 2001. Meeting Art is not liable for issuing the relevant permits expected nor can it guarantee their release.

The failure to grant such permits cannot justify the cancellation of the purchase nor the non-payment, that will have to be made within seven days from the end of the auction.

11. The Buyer, after the payment of the Hammer price and the Buyer’s premium, has to collect the lots at his own risk and cost within the days speciﬁed in the paragraph “Buying at Meeting Art”. After this time, Meeting Art shall not be held liable by the Buyer for the custody or for any possible deterioration of the items. Moreover, Meeting Art will have the right to transfer lots which have not been collected at the risk and buyer’s own expense to its ofﬁces or warehouse. The common cost of packaging is Euro 25,00, but it could change depending on the volume and the sizeof the lot.

For export of material derived from endangered species, such as coral, ivory, tortoise, crocodile, whale bones, rhino horns, etc., you need a CITES export permit issued by the Ministry for the Environment and Territory .

Buyers wishing to export these objects must provide their care costs and the issue of the certificate and to obtain information from the country of destination on the laws that govern such imports.

11. AUTHENTICS

12. Despite any contrary provisions in these “Conditions of Sale”, Meeting Art reserves the right to agree with the Sellers special conditions of payment, to arrange for warehousing, to decide for the insurance of the object sold, to sell privately the lots sold uncollected, to settle any disputes made by or against the Buyers and, in general to take any action deemed appropriate for the collection of the amounts due by the Buyer and, if necessary, to cancel the Sale and return the price to the Buyer in accordance with articles 13 and 14 below.

Lots are sold together with the authentication issued by the credit expert at the moment of sale. Meeting Art declines any responsibility in case of a change of the credited expert appointed to issue the authentications of the various lots. If within 21 days from the sale date, the Buyer has notified Meeting Art writing that he/she has a good reason to believe that the lot concerned is a forgery and Meeting Art accepts this objection, Meeting Art shall be entitled, at its sole discretion, to cancel the Sale and disclose to the Buyer the name of the Seller, giving prior notice to him/her.

12. INFORMATIONS ON THE LOTS

13. The Buyer must comply with all the applicable legislative and regulatory provisions concerning the objects which are declared to have a signiﬁcant and particular interest or for which the process of declaration started

Lots are sold in their actual state. We therefore recommend prospective buyers to check the state of conservation and nature of the lots viewing them before the sale. The department in charge of the auction will be happy to provide upon request a condition report that is solely the opinion of our experts and may be subject to possible revisions. All the information concerning the marking of metals, the carats and weight of gold, diamonds and colored precious stones, are approximate and mere statements of opinion and cannot be

relied as a statements of warranty. Meeting Art shall not be held liable for any errors included in this information or for cases of forgery. The weight of the stones, considered individually once removed from the setting, is the approximate weight and not the “exact” weighT Meeting Art does not guarantee the certificates attached to precious objects made by gemological laboratories, if any. However, reference to them can be made for information purposes.

13. ANY CLAIMS BY THIRD PARTIES ABOUT LOTS

In addition to all our rights and obligations under this agreement, if Meeting Art becomes acquainted with a claim from a third party that has a right of to property, possession or control of the Lots, shall be entitled to retain possession of the Lots until the dispute is resolved.

pursuant to Articles 6 and ff. of Legislative Decree No.490 October 29, 1999, and more speciﬁcally pursuant to Articles 54 and ff. of the same Decree. All exports of lots from Buyer resident or not resident in Italy are governed by the above mentioned laws, and are also subject to customs, currency and tax- regulations in force. The Export licence costs approximately Euro 220+insurance+VAT. The request of this licence has to be presented to the Italian Ministry of Cultural Activities and Heritage only on payment of the lot and prior a written request from the Buyer.

14. ANTI - MONEY LAUDERING REGULATIONS

It can take up to 45 days to process from the date of presentation.

Meeting Art shall not be held liable for any restrictions on export of the sold lots or for any licences or permits that the Buyer must obtain under Italian law. In the event that the Italian State exercises the right of preemption, the Buyer shall not be entitled to receive any refund of the interest on the sale price and on the premium already paid to Meeting Art or to the Seller.

According to the arT 22 D. Lgsn n. 231/2007 (Anti-money laundering Decree) customer takes note and accepts to provide all the necessary and updated information to allow Meeting Art to fulfill adequate examination obligations of its customers. It is understood that the improvement of the operation is subjected to the realise by the Customer of the information requested by Meeting Art for the fulfillment of the above mentioned obligations. Pursuant to arT 42 D Lgs n. 231/07 Meeting Art reserves the right to abstain and to not conclude the operation in case of objective impossibility to make the adequate examination of the clientele.

15. APPLICABLE LAW

This contract is governed by Italian law.

16. DISPUTES

These Conditions of Sale are automatically accepted by those who participate in the Auction and are available to any interested party who requests them.

16.2 In case of a Consumer Buyer, the jurisdiction of the Court of Vercelli is established for any dispute relating to the application and interpretation of these General Conditions of Sale. It is specified that the derogating clause from the consumer’s Court was the subject of specific individual negotiation and the consumer declares to accept its content.

16.3 Pursuant to art. 141 sexies c. 3 of the Consumer Code, where applicable, Meeting Art informs the Consumer purchaser that, in the event that he has submitted a complaint directly to Meeting Art, following which it has not been however possible to resolve the dispute thus arised, Meeting Art will provide the information regarding the Alternative Dispute Resolutuion (ADR) Organisation or Organisations for the extrajudicial dispute resolution relating to obligations derived from a contract concluded on the basis of these General Conditions of Sale, specifying whether or not it intends to make use of such entities to resolve the controversy itself.

In any case, the right of the Consumer Buyer to appeal to the competent ordinary judge of the dispute arised from the interpretation of these General Conditions of Sale is reserved, regardless of the outcome of the extrajudicial procedure of disputes relating to consumer relations through recourse to the procedures referred to in part V, Title II bis Consumer Code.

17. NO VAT - TAXATION FOR NON-EU CUSTOMERS

Meeting Art does not guarantee the certiﬁcates attached to precious objects made by gemmological laboratories, if any. However, reference to them can be made for information purposes.

To take advantage of the VAT exemption on purchases it’s ESSENTIAL that the goods purchased are exported to NON EU countries, it’s also ESSENTIAL to adhere to one of the following options: (PLEASE NOTE: in cases 1 and 2 the VAT exemption is immediate on the invoice, in case 3 it’s posponed at a later time by refund).

16. In addition to all our rights and obligations under this agreement, if Meeting Art becames acquainted with a claim from a third party that has a right of to property, possession or control of the Lots, shall be entitled to retain possession of the Lots until the dispute is resolved.

Option 1. Entrust the shipment to Meeting Art - through accredited couriers - whose costs are to be agreed in advance with the Shipping Office and must be paid before shipmenT

Option 2. Entrust the shipment to your trusted courier WHO MUST BE INTERNATIONALLY RECOGNIZED. The certification of the shipment (as customs bill or a copy of the invoice bearing the export notification - MRN Movement Reference Number) must be returned to Meeting Art STRICTLY no later than 90 days from the date of delivery of the goods to the shipper. If these documents do not arrive within the estabilished terms, Meeting Art will charge the customer the amount of VAT

17. These “Conditions of Sale” are automatically accepted by the sale participants and are available to any person requesting them. Any dispute shall be submitted to the exclusive jurisdiction of the Vercelli Court.

Option 3. Collect the goods personally or entrust the collection to a courier NOT internationally recognized: in this case it’s possible to request a VAT refund only after having the appropriate documents proving the export to an NON EU country, these documents (MRN Movement Reference Number) must be returned to Meeting Art STRICTLY no later than 90 days from the date of collection of the goods or from the date of delivery of the goods to the shipper.
