C.A.R. Long Beach I just returned from the C.A.R. state meetings in Long Beach and would like to give you a quick snapshot of some of the many issues we will be facing, and other recommendations. The Bureau of Real Estate (BRE), formerly the DRE, has changed its name again and is now CalBRE. Please use this new designation on future correspondence. Business cards currently printed with your BRE number are OK to use, but should be changed moving forward.

Leslie Appleton-Young gave her predictions for the California market moving forward. She is predicting a leveling off of the price spike we saw this summer to something closer to a 3-5% annual gain for the next 3-5 years. This mirrors the same prediction that was recently given by Carol Rodoni.

Another recommendation (although not required) is that you have both the seller and buyer initial ALL pages of the NHD. Cases were brought up in which the page that dealt with a specific item that was being litigated “disappeared” from the file, as one party claims to have not received it. You own the file, and it is up to you to have it well documented. Be aware that your files should also contain ALL correspondence related to that DELTACURRENTS

“Pocket listings” were again a big topic of discussion. We were asked to pass on to the membership that in most cases pocket listings benefit the agent but NOT the seller, and are very difficult to defend if a problem arises in the transaction.

Beginning November 7 there will be a variety of new and updated forms in zipForms. One of the biggest to be aware of will be the new stand alone sellers multiple counter offer form. It will take the place of the current counter offer form if more than one party is involved. You will no longer be able to just check the box. Finally, as the market returns to “normal” (or something resembling that), check with Mortgage.car.org for information pertaining to down payment assistance for first time home buyers. During the week of October 27 -31, you should receive a letter from DAR by regular postal mail requesting that you make a choice as to how you’d like to be billed for your membership dues and keys in 2014. The letter explains that you may choose between two payment plan options: annual billing or quarterly billing for 2014. Here’s what’s happening: We’ve made some exciting changes. For those choosing to pay their DAR membership dues in one lump sum, the annual amount has been lowered from $440 to $395. And for those members who prefer lower installment payments, we have changed to a quarterly payment plan* instead of the existing tri-annual payment plan. The quarterly plan consists of four payments, one each in January, April, July, and October. You can sit tight, do nothing, and wait to receive your invoice, if: 1. You are currently paying your association dues and keys on the existing installment basis

and want to continue with our new quarterly payments schedule. OR 2. You paid your 2013 dues in one lump sum and wish to do the same for your 2014 dues. Here’s the clincher: If you want to switch your payment plan you must choose it NO LATER THAN NOVEMBER 8, 2013. Finally, all members can choose to have automatic deductions from their credit cards. LISTEN TO YOUR GUT If you have a bad feeling about a hotel, the location, the staff, or anything, listen to your gut. If something doesn’t seem right once you are in the room, listen to your instinct. If the staff or other visitors cause you concern, pay attention to your 6th sense. If the room is not in a secure location, ask for another room or change hotels. That funny feeling is your built-in survival mechanism. Listen to it. Do not question it. Do not try to apply logic to the situation. Do not be concerned about hurting the front desk clerk’s feelings, this is your safety. HAVE A COMMUNICATION/ITINERARY PLAN IN PLACE Be sure you have at least one emergency contact who will know your itinerary from the time you leave your local airport, or if driving, your route, your destination hotel, arrival times, event/trip schedule through the time that you get back home, and they should have the phone number and address of your hotel. Check in on a regular basis. Update your contact with where you are and your plans for the day. Make sure friends and family can reach out to your contact for updated information on your health, safety and whereabouts. Utilize technology. GPS-based apps allow you to set up a contact list for emergencies. If you are in danger, you press the button and they receive an e-mail or text alerting that you are in danger, as well as your location. They are then able to contact law enforcement officials with your location. Consider medical bracelets that contain details about your allergies and other important medical information. SECURE YOUR VALUABLES Utilize the hotel room safe or invest in diversion safes (a safe that looks like a book, can, or any other everyday item that hides your valuables). When you leave your hotel room, give the impression that you are in the room, even when you are not. Leave a lamp and your television on. Or you can even put the “Do Not Disturb” sign on your door when you leave your room but be sure to make arrangements with housekeeping if you still want your room serviced. Take your badge off when you are out and about Carry as few credit cards or debit cards on you as possible. Remember to carry a copy of your passport and your ID. Do not travel with expensive jewelry and do not openly flaunt or use your expensive electronics. If you have your smartphone out and visible, or your note book or net book, whether looking up information or taking pictures, the minute you are distracted, criminals are waiting to snatch these items from your grasp. SECURE YOUR ROOM Use all of the locks on the door whenever you are in the room, especially the deadbolt. You can also utilize the “Do Not Disturb” sign as hotel staff takes that very seriously, however it will not always deter a criminal. HAVE AN EMERGENCY ESCAPE ROUTE - Take the time to not only look at the map located on the back of every hotel/ motel room door, but also walk out into the hallway and look at the exit door. Make sure you know exactly where it is located. Imagine waking up to fire alarms and massive, blinding smoke. If you don’t already know where the exit doors are, you will not be able to find them in a crises situation.
