MSV policy can make a difference in developing legislative and policy priorities. To shape our position on key issues, the HOD considers resolutions during the Annual Meeting. The resolution process gives you the opportunity to be heard. Participation in this process is critical to ensuring that MSV continues to play an important role in advocating for the profession—and helps MSV stay relevant and effective for members.

Resolutions are due to MSV by Aug. 30. WHO CAN SUBMIT A RESOLUTION? The following individuals and organizations may propose a resolution: • any member of MSV • any MSV district, MSV committee, MSV board • any component society, specialty society, or hospital medical staff section How do I submit a resolution? Resolutions should be submitted using the online submission form at www.msv.org/annualmeetingresolutions by Aug. 30. Receipt of resolutions will be confirmed by return e-mail message. If you do not receive a confirmation, your resolution has not been received. During the Medical Society of Virginia’s (MSV) Annual Meeting we are pleased to offer two exciting educational opportunities on Sat., Oct. 15. The first offering is an exciting partnership with MSV and the Virginia Academy of Family Physicians (VAFP) - The Critical Thinking for Quality Improvement in Clinical Care is intended to help physicians improve their clinical critical thinking and quality improvement skills. This class will also allow members an avenue to receive Part IV credit that is both meaningful and relevant. MSV Speaker Kurt Elward, M.D., M.P.H. will lead this educational session. The second offering is in partnership with the Virginia Department of Health (VDH) and the Department of Medical Assistance Services (DMAS) on addiction treatment. The options for independent physicians BY DAVE ROTHENBERG, PRIVIA HEALTH

The current health care climate is undoubtedly changing. With the Affordable Care Act, the shift to value-based reimbursements and increasing health care costs, physicians are finding themselves in a very different environment than even a decade ago. In this changing landscape, independent practices are finding they have four options, and they need to decide which option is best for their practice.

STAY COMPLETELY INDEPENDENT

SINGLE SPECIALTY & FEE-FOR-SERVICE ORIENTED GROUPS

The benefits of staying completely independent are obvious: doctors remain in control of many decisions in their practice – whether and which EMR to use, billing approaches, hiring, productivity, etc. Over the last 100 years, most physician practices in the U.S. have been completely independent. But times are changing. Accenture found that while 57 percent of physicians in the United States were independent in 2000, by 2012 the number drastically dipped to 39 percent . The economic model for small and medium size practices is becoming increasingly difficult. Costs are increasing while reimbursements are not. Moreover, the shift to value-based pay requires investments in technology, care teams, analytics and workflow that are taxing on practices (not to mention administrative burdens).

Another option for physicians is joining a group that can help improve their fee-for-service reimbursement rates. These are often single specialty groups, where doctors come together to use their size to negotiate higher rates and lower costs. Most super-groups in Maryland are of this variety. The challenge for these groups is the massive shift in the industry to value-based pay. Many of these groups are new to population health and do not have the technology, teams, resources and expertise needed to thrive in these arrangements. Many also lack a big primary care base that is important to managing care across the continuum. These groups can provide benefit in the short term; what’s not known is how they’ll adapt to changing reimbursement models.

HEALTH FOCUSED 3 POPULATION MEDICAL GROUPS

Population health focused medical groups are designed specifically to help independent practices get into and succeed in performance and risk based arrangements. Across the country, physicians in these groups have the biggest opportunity to increase their income- so long as the group is successful in taking unnecessary costs out of the system. These groups tend to be mostly primary care physicians, with medical specialists that manage chronic patients, and fewer proceduralists. The key to success of these groups revolves around sophisticated strategic partnerships with payers and infrastructure, expertise, and support to help bend the cost curve. Many of the most successful of these groups are on the West coast, but they exist throughout the country. (Privia Medical Group falls within this category). The challenge for these groups is attracting the right type of physicians who share the big goals, and execution around driving costs out of the system (facility steerage, quality benchmarking, engaging high utilizers, PCP access, medication management, acute event management and avoidance, etc.)

Selling your practice to a hospital or health system is often an option for physicians. This is attractive for many reasons: improved reimbursement rates, reducing the burden of running your own practice and aligning with an entity that has the resources to invest in population health. Health systems in Maryland have been particularly acquisitive. The challenges are well known too: independent-minded doctors sometimes chafe at productivity targets, cuts in salary can happen after the initial term ends, and pressure to steer to certain facilities or specialists can conflict with population health goals.

HEALTH SYSTEM EMPLOYMENT

Whichever option you choose, the key is to do your homework. Understand short-term economics and long-term vision. Spend time understanding the big trends within payment models that will affect physicians for the next decade. Speak to doctors in the groups to learn what they like and dislike. Some of these options are easily reversible, others are more difficult. For better or worse, we’re moving into a new paradigm for reimbursement, and there will be a lot of opportunity for physicians to capture more of the value they create. It is up to you to choose your own adventure. August 2016 11

They are always ready and willing when they are called on to testify at a committee hearing, contact their legislators directly or be the party-starters at MSVPAC’s annual karaoke event. The students have become an integral part of every facet of MSV. Their involvement and dedication speaks to their passion for medicine and the profession of patient care.

Legislative Committee meets to work on 2017 legislative agenda BY SARA ROSE WELLS, ASSISTANT DIRECTOR OF GOVERNMENT AFFAIRS

The Medical Society of Virginia (MSV) Legislative Committee, co-chaired by MSV President Edward Koch, M.D. and MSV President-Elect Bhushan Pandya, M.D., met on June 22 to review the 22 proposals received at the previously held Legislative Summit. The issues discussed included certificate of public need, Medicaid reimbursement, associate physician licensure, opioid prescribing,

and many more. The committee worked diligently for three hours until they had decided on recommendations for each proposal. Their recommendations will now be delivered to the MSV Board of Directors for their consideration. Thank you to all who submitted proposals, attended the Legislative Summit, and participated in the Legislative Committee! August 2016 13


Being HIPAA compliant is part of how physicians get paid BY JONATHAN KRASNER, DIRECTOR OF BUSINESS DEVELOPMENT AT HIPPA! SECURE NOW

On April 27, the Center for Medicare and Medicaid Services (CMS) came out with a proposed rule on how physicians will get paid under MACRA (the Medicare Access and CHIP Reauthorization Act). This regulation changes the fundamental Fee-For-Service (FFS) system that CMS has used since Medicare’s enactment in 1966. The new system is premised on tying physician payments to quality and value, and is directly related to the Triple Aim of providing better care, lower costs, and improved health.

OPEN FOR COMMENTS

Like all proposed rules, there is a 60 day comment period, and we fully expect an army of criticism from lobbyists, vendors and a whole host of other interested parties. Based on the comments, a final rule will be published, most probably in the fall. The final rule will be imperfect and controversial. It will be despised by many. But don’t expect MACRA to be repealed, according to Anne Phelps of Deloitte & Touche, “MACRA is the rare health care law that was passed with overwhelming bipartisan support and continues to enjoy strong support from Republicans and Democrats in Congress,” she said. “This all but ensures its continued implementation, regardless of the outcome of the November elections.” Who can blame Congress, with health care costs spiraling out of control, something has to be done. So once it comes out, all affected parties should remember the saying “if you can’t beat’em, join’em”.

HIPAA IS NOT OPTIONAL IN MACRA

We are not here to give you the complete lowdown on MACRA. There are lots of other resources for that. However, we do want to emphasize one very important point: the role of HIPAA compliance. As indicated above, MACRA changes the way physicians will be paid. No longer will they be paid for just providing services (FFS). Rather, there is a very complicated formula called the MIPS Composite Performance Score (CPS) that will be used to determine adjustments to a physician’s Medicare payment. These adjustments can be as high as +-9% by 2022. (By the way, in order to amplify the effect of MACRA, CMS is explicitly encouraging private payers (PDF) to implement similar programs). In order to receive a substantial portion of the MIPS CPS and maximize revenue opportunity, each provider will have to have performed a HIPAA Security Risk Analysis (SRA) within

their practice. It is important to understand that since the SRA is for the practice, it can be used for all physicians within the practice. Here is a quote from the MACRA Rule:

We would require the MIPS eligible clinician to meet the requirement to protect patient health information created or maintained by certified EHR technology to earn any score within the advancing care information performance category; failure to do so would result in a base score of zero, a performance score of zero, and an advancing care information performance category score of zero.” Furthermore, the document also states:

As privacy and security is of paramount importance and applicable across all objectives, the Protect Patient Health Information objective and measure would be an overarching requirement for the base score.” MAXIMIZE PAYMENTS

Clearly there is some MACRA/MIPS specific language in those quotes. Don’t get hung up on these terms. What is important is the role of HIPAA compliance: perform a HIPAA Security Risk Analysis and you are in position to maximize your MIPS CPS and your revenue. Don’t perform the Risk Analysis, and be prepared to take a hit on your payments.

The partnership of Medical Society of Virginia Foundation (MSVF), Virginia Hospital & Healthcare Association (VHHA) and Virginia Nurses Foundation (VNF) has an innovative answer—SYNC. SYNC is leading-edge learning institute edicated to transforming healthcare leadership in Virginia through team-based learning AND action in the “real-world” setting. Continuing on the success of its inaugural class, the program will be offered again from September 2016 to March 2017 for five one-day sessions to a limited number of teams of up to five clinical leaders (to include a physician and registered nurse).

Teams will have access to research and consultation support from the SYNC Support Team to guide them in their project.

Team enrollment is limited. Tuition is $7,150 per team of five which includes an outstanding array of speakers, materials, continuing education credits, food/beverages, consulting support and an online learning portal. Virginia Medical Student Selection models leadership at AMA BY JENNY YOUNG, ENGAGEMENT MANAGER

Thirteen medical students representing four of Virginia’s medical schools attended the American Medical Association (AMA) Medical Student Section (MSS) Annual Meeting from June 9-11 in Chicago, IL. During the meeting, students participated in policy making meetings, regional meetings, advocacy training and breakout sessions. They also had the opportunity to caucus and interact with the MSV physician AMA delegation. The Virginia student delegation achieved great success in multiple aspects of the meeting. Lee Ouyang, EVMS, was elected as AMA MSS Vice Chair. Throughout the next year, he will serve as the liaison to the student representatives on AMA Councils and Committees and will assist the Chair with management of the MSS. Lee noted that, “attending the AMA Annual Meeting was a phenomenal experience thanks to the support of MSV’s physicians and staff. With their mentorship, Virginia’s student section stands as a model that other states strive to replicate. I’m honored to be a part of such a wonderful organization, and would like to help continue Virginia’s tradition of leadership within the AMA.” Nicole McCann, UVA, was elected as the AMA MSS Region 6 membership chair. Region 6 is comprised of all medical schools located in Delaware, District of Columbia, New Jersey, Maryland, Pennsylvania and Virginia. Nicole noted that the AMA Annual Meeting is one of her favorite meetings of the year,

SO WHAT’S NEW? The White Coats on Call program continues to grow in popularity and we have made some exciting changes to maximize MSV’s influence at the legislature. The days have been condensed to encourage increased participation and cross-specialty collaboration. We will have two “All Call” days for physicians, with some specialties highlighted on each day. There will also be a dedicated Physician Assistant day for all professional PAs and students. MSV will provide a robust program with guided bill updates, guest speakers, updates on MSV opportunities, and more. MSV, specialty society lobbyists, and staff will be on hand as resources throughout the day. And as always, a filling breakfast and lunch will be provided. *All Call days are open to all members, though there will be some highlighted specialties on each day
