Q: My widowed mother and I live in the same house. This is the house I grew up in and when I became an adult I moved out for almost 20 years. My father passed away two years ago and I moved back in to help take care of my mom. We both agreed it would be best if we put the house in both of our names so it would make it easier to manage it. We are both on title as joint tenants.

Throughout this year my mom’s health and mental sta bility has been getting worse and worse to the point where she is impossible to live with. She throws and breaks stuff, she tries to lock me out of the house, and last night she threat ened me with a butcher knife. I want to put her in a nursing facility that can take better care of her and I told her that was what I intended to do. But she still thinks this is her house and she says she’s going to throw me out. She won’t listen when I explain things to her but it’s at the point where she has to go.

Obviously I have a big problem but I don’t know what to do. I hate to evict mom but that’s what it’s come down to.

A: Well, there’s a lot going on here which has nothing to do with real estate, but some of it does and because your problem isn’t as unique as you might think, I chose your email to answer this week.

First of all, Mom is right. It is her house. It may be yours, too, but she owns as much of it as you do. So from an ownership perspective, she has every right to live there.

The bad news for you is you can’t evict Mom. The good news is she can’t evict you, either.

Your email didn’t say anything about your mom having an

estate plan, other than putting you on title to the house. As a joint tenant, when Mom dies, you will own the entire house.

But if Mom had an estate plan, it might include a medical power of attorney which would give you the right, probably after going to court, to become your mom’s conservator. As her con servator, you could place her in a nursing home.

But that presumes your mom is no longer able to take care of herself. Throwing things and trying to lock you out doesn’t necessarily mean she can’t take

care of herself. And now that I think about it, neither does threatening you with a butcher knife. For all I know you may not be all that likable since you’re considering evicting your own mother from her own house.

Anyway, assuming there is no power of attorney, if you really believe your mother’s best interest is served by a conser vatorship, you can go to court to ask to be appointed as her conservator.

This process is technical, and you will need the help of an attorney who specializes in conservatorships.

If your mother fights the conservatorship, or your appointment, she will have her own attorney who will attempt to convince the court she is able to

5 things to know if you have to sell your home right now

There’s no getting around it: High interest rates and fears of a recession make now a pretty daunt ing time to sell your home. But not everyone has the option of staying put.

“The decision to sell is often motivated by life, such as when you’re relocating for a job or a house is too small for your growing family,” says Leo Chu binishvili, a financial planner with Access Wealth in East Hanover, N.J. “In those cases, the financial scenario takes the back seat.”

And even though the current conditions aren’t ideal, it’s not as though sellers are powerless. If you’re dread ing having to list, consider these strategies for taking some of the stress out of the process.

1. Determine if renting out your home is preferable

If you’re not counting on the proceeds from the sale of your home to fund your next purchase, you may want to consider finding renters instead of buyers.

First, you’ll want to investigate your options under local ordi nances, and, if you belong to one, under the rules of your home owners’ association. For instance, some jurisdictions will allow you to turn your home into a poten tially lucrative short-term rental (such as an Airbnb), while others will not. Ask your real estate agent to help you do your home work on the local rental market, too, so you’ll generally know how much you’ll be able to charge, either nightly or monthly.

Keep in mind that if you won’t

be able to oversee the property yourself, you’ll likely have to pay a management company between 7 and 10% of the rent, says Clint Coons, author of “Next Level Real Estate Asset Protection.” On top of that, you’ll need to have funds on hand to maintain the property. But even with those expenses, renting can be a smart financial move, particularly with rents rising because of the ongoing housing shortage.

explains John Murdock, an agent with Keller Williams Realty in Reston, Va., because the rent will likely cover your mortgage payment and possibly provide some extra income.

2. Before you list, make sure your home is in top condition

Sellers often want to do the least amount of work and spend the least amount of money before they sell, Murdock says, but buyers nowadays have the luxury

of being picky – and they’ll expect a house in good condition.

“The majority of homes just need a deep cleaning, paint, decluttering, minor landscap ing, new fixtures and sometimes new flooring in a room or two,” Murdock says.

Prepping a condo can cost about $3,000, a townhouse can range from $5,000 to $7,000, and a single-family home can range from $10,000 to $15,000 for minor repairs, he says. Murdock and numerous other real estate

brokerages and third-party com panies such as Curbio and Revive will cover the costs of presale renovations, plus coordinate con tractors, and then get reimbursed at the settlement.

For example, Coldwell Banker Realty provides as much as $50,000 upfront to sellers to get a home up to market standards, says Dawn McKenna, a real estate agent with the company in Chicago and Naples, Fla.

“We can estimate what ren ovations are needed and what the return will be on the investment,” McKenna says. “Then the sellers can move out and we can stage the home.”

3. Be realistic about the sales price

Bidding wars are no longer the norm, so it’s important to list your house according to current market conditions, not what your neighbor got last year. Many studies show that pricing your house too high, then reducing it when you don’t get an offer actu ally results in a lower sales price than if you had priced it correctly from the beginning. Buyers typ ically offer less for a property that’s been sitting on the market for a while, which can happen with an overpriced house.

Multiple variables deter mine your sales price, including how many other homes are on the market in your price range, says McKenna: “If your house is the only one in a particular price range and you can make it look good, you’re more likely to get a better price.”

In a shifting housing market, it can be complicated to determine a list price. When evaluating

Avoid pitfalls of credit card debt

Now, with stimulus checks gone and inflation raising prices on nearly everything, Americans’ credit card spend ing has jumped more than 20% this year. By January 2023, the amount of consumer credit card debt will jump to $1 trillion.

The average APR on all credit cards, according to the Federal Reserve, is 16.27% and the average APR for new credit card offers is 22.40%. I saw one last week at 27%.

Credit card delinquency has risen steadily over the past 12 months, and I would expect this to get much worse over the next 12 months because of the inability for consumers to afford the higher rates. Credit cards, unsecured personal loans and all these buy-now-pay-later pro grams can really screw up a person’s financial life and their credit score.

I worked back in the 1980s as a branch manager for Ben eficial Finance Company for five years and learned some valuable lessons about how highrate credit card and personal loan companies make money. They encourage people to pay the minimum payment every month to maximize their interest income and they love consumers who pay three or four days after the grace period because late fees create profits.

My favorite way to teach people about how to avoid the pitfalls of credit card debt is to explain the cost of financing stuff that depreciates in value.

A mother of three little boys goes to Walmart and buys $200 worth of underwear, uses her 24% Visa card and then pays the minimum payment of

$6 per month. It will take four and a half years to pay off the underpants that were probably shredded in a year, and even if the boys are clean freaks, nobody passes down jockey shorts to their little brother.

Debt consolidation loans can be incredibly useful, but they can also be a recipe for disaster.

It makes tremendous sense for a homeowner to take out a $100,000 second mortgage loan or HELOC and payoff $100,000 worth of credit cards, auto loans and personal loans at a much lower APR to save $1,000 per month, but too often people don’t use the $1,000 savings for investments and building cash reserves. They often go right back to running up the debt and spending more than they make.

What people should do is use the $1,000 per month to pay down the second mortgage fast and then use a Visa card for travel points and pay off the credit card in full every month to avoid all the interest cost.

Poinsettia partnerships make holidays beautiful

National Poinsettia Day is fast approach ing – Dec. 12 to be exact. While I am sure the powers that be wanted a celebratory day, from what I have been seeing this year is that this may be a deadline day. Have your poinsettias by Monday or you may not get any. This most likely applies to poinsettia partners, too! If you are asking what a poinset tia partner is, then put on your thinking cap and gather ’round.

Christmas, families visit and long-lost cousins get together. Of course, the main reason we like this idea is that the red, pink or variegated poinsettia looks incredible. It’s as though it is sitting on a bed of snow or frost. I have found these to be more available at fine florists.

But if you are going to create your own and go plant shopping, then keep in mind some other options you might want to try.

For instance, a couple of years ago, Jenny Simpson of Creek side Nursery in Dallas, North Carolina, introduced us to not only using caladiums at Christ mas, but even in combinations with poinsettias. She used the Heart to Heart White Snowdrift caladiums, which turned out to be a perfect partner with red poinsettias.

4. Be realistic about how long it will take to sell

At the height of the pandemicfueled buying frenzy, homes often sold within one weekend. Now, buyers are slower to make an offer since they’re not facing competition.

Nationally, homes sold in an average of 21 days in October 2022, according to the National Association of Realtors, com pared to 18 days in October 2021.

Homes that have been staged spend 33 to 50% less time on the market than homes that haven’t been staged, according to HomeAdvisor, so you may want to consider asking your agent about providing that service or recommending someone who can.

5. Know how much you’ll make after closing costs

One way to alleviate some anxiety in the lead-up to selling: Do all the math upfront so you have a clear sense of the pro ceeds you’re likely to net once your place sells. You’ll avoid

unexpected stress at the closing table and be in a stronger position to plan for buying (or renting) your next home.

Your real estate agent will provide you with “net sheets” that can show your estimated proceeds under different sce narios. Your net will depend on the payoff amount of your mort gage, your closing costs and, of course, the price that your home ultimately sells for.

The split of closing costs between buyers and sellers varies by state. Generally, sellers pay the commissions for the real estate agents at the closing, which typically average 5 to 6%.

If you’ve owned your home for a long time or values have risen sharply in your market in the last few years, a sale could trigger a capital-gains tax, says Coons. You’re exempt from capital gains taxes on profits up to $250,000 (or $500,000 for a married couple), Coons says, but some homeown ers may have built up profits above that limit.

“If you’re not buying another place right away, you may want to put your money in a high yield savings account, a certificate of deposit or Treasury bonds for six months to a year,” Chubinishvili says. “Put it somewhere where it’s accessible when you’re ready to buy.” The goal is to have your money in a safe investment that’s also flexible so you can get the funds easily when you need them.

A similar application gave me the opportunity of pho tographing pink poinsettias mass-planted in an atriumlike setting and surrounded by gray-leaved Icicles Helichry sum. But if you are getting a late start, the most obvious and perhaps easiest is to combine your poinsettias with another Christmas plant like cyclamen. White cyclamen around a red poinsettia can be simply breathtaking.

This year I have also been watching what I call the pro fessional garden club ladies walking out of both florists and floral departments with holly berries. We all think of hollies on swags above the fireplace or front door, but two or three preserved branches loaded with red berries stuck in a pot of white poinsettias is quick, easy and unbeatable.

Red berries for Christ mas, landscape beauty, and of course feeding the birds is

a prime reason to grow winterberry hollies like the compact Berry Poppins. Consider also growing Berry Heavy Gold win terberry holly. The court also has a number of investigators who will interview Mom, do a little research and make recommen dations to the judge.

In the end, you will either

be appointed conservator of your mom and her estate or you won’t.

If you win, your problem is all but solved. If not, you’re left with three possible choices.

You can live in the home and make the best of it. You can move out. Or you can sue Mom to partition the property.

Partition actions are real estate lawsuits between co-own ers of property in which one owner wants to cash out. It’s a real estate divorce.

Ultimately the court will order the sale of the prop

erty and decide how the proceeds are split.

While this is a legal remedy available to any co-owners of real estate, it seems pretty heart less in your case, considering Mom bought and paid for the house and you only got on title in order to “take care of my mom.”
