ORDINANCE NO. 1544 AN ORDINANCE OF THE BOARD OF SUPERVISORS OF THE COUNTY OF YOLO, STATE OF CALIFORNIA, ALLOWING THE ADOPTION OF FUTURE SUPERVISORIAL DISTRICT BOUNDARIES THROUGH PASSAGE OF A RESOLUTION WHEREAS, the Board of Supervisors must adjust supervisorial district boundaries every ten (10) years using decennial federal census data so that the supervisorial districts remain substantially equal in population as required by the United States Constitution; and WHEREAS, the County of Yolo has traditionally amended supervisorial district boundaries through the passage of an ordinance; and WHEREAS, the Yolo County Code Title 2, Chapter 1, Article 4 identifies the 2011 supervisorial district boundaries for each of the five (5) districts within the County of Yolo; and WHEREAS, Elections Code section 21500, subdivision (e), effective September 27, 2021, allows a county to adopt supervisorial district boundaries by resolution or ordinance; and WHEREAS, generally the adoption of an ordinance requires a two-hearing process as set forth in Government Code section 25131, and ordinances are not effective until thirty (30) days after their final passage pursuant to Government Code section 25123, which ultimately results in ordinance adoption taking approximately sixty (60) days; and WHEREAS, the redistricting process has traditionally occurred over multiple months, but because of delays in the release of the 2020 federal census data the timeline for redistricting in 2021 is greatly compressed; and WHEREAS, given the greatly compressed timeline for redistricting, there is a corresponding need to streamline the district boundary adoption procedure to provide maximum time for creation, review and approval of new district boundaries; and WHEREAS, the purpose of this Ordinance is to update relevant provisions of the Yolo County Code to comport with state law regarding the adoption of supervisorial district boundaries by resolution; NOW, THEREFORE, the Board of Supervisors, of the County of Yolo, State of California, ordains as follows: SECTION 1. Sections 2-1.401 through 2-1.407 of Article 4 (entitled “Supervisorial Districts”) of Chapter 1 (entitled “Board of Supervisors”) of Title 2 (entitled “Administration”) of the Yolo County Code are hereby repealed from the Yolo County Code, effective upon the passage of a resolution of the Board of Supervisors establishing new or revised supervisorial boundaries. SECTION 2. A new Section 2-1.401 (entitled “Supervisorial District Boundaries by Resolution”) shall be added to Chapter 1 (entitled “Board of Supervisors”) of Title 2 (entitled “Administration”) of the Yolo County Code, to read in full as follows: 2-1.401 Supervisorial District Boundaries Supervisorial Districts may be established by resolution. The resolution establishing supervisorial districts shall be published and available on the County of Yolo website for as long as said districts are in effect. SECTION 3. This Ordinance shall take effect thirty (30) days after its passage. SECTION 4. A summary of this Ordinance shall be published at least once five days before adoption and a least once before the expiration of fifteen (15) days after its passage in the Davis Enterprise, a newspaper of general circulation published in the County of Yolo, together with the names of members voting for and against the same.
