Find A Home We will get lender pre-approval and establish a checklist for your specific home search.

Prepare An Offer We will review market value and comparable sales, determine contingencies, establish earnest money, and choose a title company.

Submit An Offer We will submit our thoroughly reviewed offer and move forward based on the three possible outcomes: accepted, rejected, or countered.

Ratification/Under Contract We will move to satisfy any contingencies such as home inspection, appraisal, financing, and review of property and condo/association documents. As well as satisfy any lender requirements such as insurance.

Final Details We will obttain final loan approval and closing disclosures, and make sure everything is checked and prepared.

Settlement We will provide funds due, conduct the final walk through, give final signatures, and get the keys!

New Construction. New Homes are not always listed in BrightMLS. McEnearney Associates have worked with large and small builders throughout the region for the past forty years, and consistently network with builders to stay informed of the latest inventory.

Private Exclusives. Working with an agent who networks within the industry to learn about listings that are currently not being publicly marketed could really give you an edge and, especially in a competitive market, potential access to more homes.

Contract of Sale This is the agreement between you and the sellers to purchase the property for a specific price. Other details defined in the contract of sale are the settlement company, date of settlement, and earnest money deposit amount. Additionally, the buyer may request to purchase a home warranty or have the sellers purchase one on their behalf.


More On Contracts of Sale In order to determine a starting price for the contract, we will research recently sold comparable properties. When multiple offers have been submitted on the same property, the property will likely sell for over the listed sale price. In an escalation clause, two numbers are provided: an escalation factor and an escalation cap. The escalation cap is the absolute max you are willing to pay. The escalation factor is the amount over the next best offer you are willing to pay. The agent compares all of the escalation caps of the offers that were received. The highest cap is usually looked at first and compared to the next highest. The highest offer will pay the cap of the next best offer plus the escalation factor defined in the escalation clause. The listing agent always provides proof of the offer that made your offer escalate. For example, your contract may offer the list price of $350,000 with an escalation clause defining the cap as $375,000 and factor as $2,500. If the next best offer was $360,000, your offer price would go to $362,500.

After the contract is negotiated, you should apply for any financing necessary to complete the purchase. Notification of loan application is passed to the listing agent, who keeps the seller informed as the process progresses. During this process, buyers must furnish the lender pertinent information regarding their assets, income, debts and credit history.

Your EMD funds must be sent to the title company and deposited into the escrow account after contract ratification. The funds can be sent as a either a wire transfer or a check dropped off at the settlement company. These funds will be applied to your down payment and closing costs at settlement.

Common Industry Terms Explained Agent

Contract

One who acts on behalf of another, representing that person’s interests and serving as intermediary.

Binding legal agreement between two or more parties that delineates the conditions for the exchange of value (for example: money exchanged for title to property).

Amortization A method of equalizing the monthly mortgage payments over the life of the loan, even though the proportion of principal to interest changes over time. In the early part of the loan, principal payment is very small and interest repayment very high; at the end of the loan that relationship is reversed.

Appraisal An expert judgment of the value or worth of a property.

Assessed Value The value placed on a property by a municipality for purposes of levying taxes. It may differ widely from appraised or market value.

Broker A real estate professional that has a higher level of training than an agent. Generally, this is one who is the legal representative or proprietor of the office.

Commission Fee (usually percentage of total transaction) paid to a broker or agent for services performed.

Deed Legal document that formal conveys ownership of property from Seller to Buyer.

Down Payment Percentage of the purchase price that the Buyer must pay in cash.

Earnest Money A large deposit paid when the sales contract is signed before closing.

Escrow A fund or account held by a third party custodian until conditions of the contract are met.

Hazard Insurance Compensates for property damage from specified hazards such as fire and wind. More complete coverage is given by all-risk homeowner’s insurance.

Home Inspection Report Prepared by a qualified inspector, it evaluates a property’s structure and mechanical systems.

Condominium (Condo)

The cost of borrowing money, usually expressed as a percentage over time.

Type of real estate ownership where the owner has title to a specific unit and shared interest in common areas.

Lien

Contingency A condition in the contract that must be met for the contract to be binding.

A security claim on a property until a debt is satisfied.


Market Value

Title Insurance

The price as established by current economic conditions, locations, and general trends.

Protects against loss from defects in the title.

Mortgage

A detail examination of the entire document history of a property title to make sure there are no encumbrances.

Security claim by a lender against property until debt is paid.

Multiple Listing Service (MLS) A system that provides to its members, detailed information about properties for sale.

PITI Principal, Interest, Taxes, and Insurance; the basis for your monthly mortgage payments.

Prequalification An informal estimate of how much financing a potential borrower might expect to obtain, done before paying substantial loan and application fees.

Prorate To divide or assess proportionately.

Realtor® A member of the National Association of Realtors®

Settlement All financial transactions needed to complete contract performance/obligations.

Title A document that indicates ownership of a specific property.

Title Search

Types of Ownership There are 4 types of ownership: Sole Ownership Only one person owns the property. Tenants in Common Two or more persons have an undivided ownership in the property. The percentage of ownership need not be equal; each party has a right to sell his interest, and upon the death of any of the owners that owner’s interest in the property goes to the deceased’s heirs. Joint Tenants Ownership is taken by two or more persons at the same time in equal percentages with an undivided right to possession. If one owner dies, his or her interest automatically goes to the remaining owner(s). Tenants by the Entireties Owners are husband and wife and together they hold title to the property with a right of survivorship. Upon the death of either, the survivor take sole ownership to the exclusion of the deceased spouse’s heirs.
